Let come merit in the Bangladesh Civil Service

"Government jobs belong to the country's people, not politicians and shall be filled only with regard to public service," said Theodore Roosevelt, first U.S. Civil Service Commissioner (1889-1895) and the 26th President of the United States ((1901-1909).
 
To recruit the people the country needs, the department or the respective authority must ensure to expand its outreach to all parts of the country so that a country gets a high skilled workforce who can represent country's diversity and can advance national interests. To do so, recruitment should be fair.
 
Recruitment is about getting the best person for the job. In most of the countries, it is usually dealt with by the Public (or Civil) Service Commission (PSC) whose remit is enshrined in the Constitution. Recruitment should be fair which means that the PSC should be genuinely independent. It can be harder to ensure fairness in a decentralized system, which is why many developing countries resist devolving recruitment to line agencies. Recruitment should also use skilful methods, e.g. developing selection criteria, introducing occupational testing at assessment centers, standardized interview structures and training for interviewers. It offers suggestions for governments wishing to strengthen appointments based on merit.
 
The Commission is charged with maintaining the purposes of civil service systems, merit selection, tenure and an independent Civil Service Commission. Independent civil service commission only defense against politics.
 
The Bangladesh Public Service Commission (BPSC) is a quasi judicial body established under the Constitution of the People's Republic of Bangladesh and works under the provisions of the Articles 137 to 141 of the Constitution of Bangladesh and certain other rules and regulations made by the Government.
 
Although it has gone through various amendments since 1981 including eliminating political patronage, encouraging efficiency and introducing staff training, Bangladesh Civil Service Recruitment Rules, 1981, laid down the procedure for recruitment to various services of the republic to bring success in the public sector programmes. The requirement to consult the Public Service Commission is a constitutional one as envisaged in Clause (2) of Article 140 of the Constitution.
 
The implementation of government policies and projects is the duty of the Bangladesh Civil Service (BCS) body, a corps of trained administrators who form the nation's most influential group of civilians. Although according to the constitutional obligations, the commission is only responsible to the parliament of Bangladesh for its actions and the recommendations and the decisions of the commission can only be reviewed or replaced by the Hon'ble President of the People's Republic of Bangladesh, the civil service remains divided, politicized and corrupted.
 
Political sympathy and partisan activity are now required as a condition of appointment. Fitness for office is given far less consideration and thus, the quality of public service is seriously affected in Bangladesh. Nobody feels important what factors contribute to the success or failure of public sector programmes? Why should ensuring merit in public appointments be an important element of public service sector? What can civil service specialists contribute to the debate about corruption and patronage?
 
The partisan recruitment of BSC examinees according to the interest of either political parties or other beneficiary groups, leakage of question papers frequently over the years and taking bribe by members, officials or staffs of the Commission are among the most raised allegations against the Commission, which have contributed to a massive erosion of trust and credibility of this constitutional body.
 
In addition, irregularities in BSC examination, allocation of seats in groups with bribe, ensuring success in the preliminary test with bribe, copying and solving questions outside the exam hall, replacing examination scripts or documents, failed candidates on the merit list, corruption in viva voce, giving extra-ordinary marks to the target candidates, calling candidates to Commission after viva voce, changing marks, leakage of BSC results or contract for whole BCS exam are some obstacles to get genuine administrators to serve the country.
 
The civil service was instrumental in sustaining military or semi-military rule in 1975-90—a linkage that impeded the institutional development of the service. One reason for holding general elections under neutral caretaker governments is that many civil servants back one of the political parties in the hope of being awarded lucrative postings and other benefits. Many observers believe that tackling corruption in the civil service will reduce the corruption in every where as the civil service sector is the real wheel of country's administration.
 
The present military-backed interim government is aware that the primary way by which corruption can be tackled in the long term is to target the development of a merit-based, suitably rewarded civil service. BPSC has been reconstituted by appointing a new chairman and other members, and has planned to develop a strategic perspective for improving the quality of the civil service, beginning with recruitment and promotion policies and practices.
 
It has already cancelled the viva voce of the controversial 27th BCS examinations decision after reviewing newspaper reports and various allegations about the examination in order to restore confidence in public mind and establish transparency in the recruiting process for public jobs and immediately reschedule the viva for all successful candidates of the written examinations. And after a time-lag of two and a half years since the circular for the last BCS exam was issued on June 28, 2005, that for the 28th BCS exam, has just been published on January 23, 2008.
 
Although the latest circular disappointed everyone and should be reviewed as it said that only graduates aged 30 years or below as of January 1, 2008 can apply for the 28th BCS examinations, it is a palpable public expectation to get real meritorious civil servants as they are core functionary of the government.
 
The present caretaker government has completed its one year of its tenure and the outgoing year will remain a remarkable transition phase for the nation, if BPSC can finish all the recruitment processes of the 28th BCS examination during the end of this non political government.

It was narrated from 'Abd-Allaah ibn Mas'ood
(may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said:
Allaah has cursed the woman who does tattoos
and the one who has them done
the woman who plucks eyebrows (al-naamisah)
and the one who has it done (al-mutanammisah)
and the one who files her teeth for the purpose of beauty
altering the creation of Allaah

Evidence that tattooing, plucking the eyebrows
 and filing the teeth is haraam
 
Question:
What is the Islamic ruling on women reducing their eyebrows? Please quote the specific ahaadeeth if possible.

Answer:
Praise be to Allaah.  
Firstly: 
Allaah has forbidden women to remove any part of the hair of their eyebrows; this action is called al-namas in Arabic, and it is haraam because of the following evidence: 
1 � Allaah says (interpretation of the meaning): 
"They (all those who worship others than Allaah) invoke nothing but female deities besides Him (Allaah), and they invoke nothing but Shaytaan (Satan), a persistent rebel!
Allaah cursed him. And he [Shaytaan (Satan)] said: 'I will take an appointed portion of your slaves.
Verily, I will mislead them, and surely, I will arouse in them false desires; and certainly, I will order them to slit the ears of cattle, and indeed I will order them to change the nature created by Allaah.' And whoever takes Shaytaan (Satan) as a Wali (protector or helper) instead of Allaah, has surely, suffered a manifest loss"
[al-Nisa' 4:117-119] 
The relevant point in this verse is that Iblees will tell people to change the creation of Allaah. Some of the mufassireen interpreted it by saying that what is meant here in this verse is tattooing, plucking the eyebrows and filing the teeth, as we shall see below. 
Al-Qurtubi said in his commentary on this verse: 
A group said what was meant by changing the creation of Allaah was tattooing and other things that are done for the purpose of beautification. This was stated by Ibn Mas'ood and al-Hasan.

2 � It was narrated that 'Abd-Allaah said: "Allaah has cursed the women who do tattoos and those who ask for tattoos to be done, those who ask for their eyebrows to be plucked, and the women ask for their teeth to be filed for the purpose of beautification, changing the creation of Allaah." A woman from the tribe of Bani Asad whose name was Umm Ya'qoob heard of that and she came and said, "I have heard that you have cursed So and so and So and so." He said, "Why should I not curse those whom the Messenger of Allaah (peace and blessings of Allaah be upon him) cursed and who are mentioned in the Book of Allaah?' She said, "I have read what is between the two covers [of the Qur'aan], and I did not find anything in it like what you have said." He said, "If you have read it, have you not read that Allaah says,  
'And whatsoever the Messenger (Muhammad) gives you, take it; and whatsoever he forbids you, abstain (from it)'
[al-Hashr 59:7]?" 
She said, "Of course." He said, "He forbade that." She said, "I think your wife does it." He said, "Go and look." So she went and looked and she did not see what she was looking for. He said, "If she had been like that, she would not be with us."

Al-Qurtubi said concerning the meaning of tattooing
Tattooing is done on the hand; it involves piercing the back of the hand with a needle and filling it with kohl or another substance so that it changes colour. [Translator's note: this refers to the type of tattooing known at that time] 
Tafseer al-Qurtubi, 5/392. 
Ibn Hajar said concerning the meaning of plucking the eyebrows: 
The mutanammisah is the one who asks another to pluck her eyebrows, and the naamisah is the one who does it. Al-nimaas means removing the hair of the face with tweezers. It was said that the word nimaas refers specifically to removing hair from the eyebrows in order to reduce them or make them straight. Abu Dawood said in al-Sunan: al-naamisah is the one who plucks the eyebrows in order to reduce them.

It was said concerning the meaning of those who ask for their teeth to be filed (al-mutafallijaat)
 This refers to one who asks for her teeth to be filed or who does that. Falj means making a gap between two teeth and tafalluj means making a gap between two attached things by means of filing or the like. This was usually done to the incisor and the eyetooth for the purpose of beautification. A woman might do this if her teeth were close together so that she would have gaps between her teeth, or an old woman might have do to make it look as if she were younger, because young women usually have gaps between their teeth that disappear as the woman gets older.

Al-Qurtubi said: 
With regard to all of these matters, the ahaadeeth indicate that those who do them are cursed and that they are major sins. But there is some difference of scholarly opinion concerning the reason why they are forbidden. It was said that it is because it is a kind of deception, or because it is changing the creation of Allaah, as Ibn Mas'ood said. This is more correct, and it also includes the first meaning. And it was said that what is prohibited is what is permanent, because it is changing the creation of Allaah; with regard to what is not permanent, such as kohl and make-up, the scholars have permitted that.

Dear Mr Khairul Anam Mohiuddin

Who is this president Iajuddin? He was the teacher who reportedly led his fellow teachers to break the emergency rule during Ershad's regime! It was not the first time when teachers-students broke the law imposed by autocrats! If you do not agree with the emergency, how do u abide by it?

How will u justify the judgement when teachers were found innocent in a similar charge! It is not a normal practise of law when you influence the trial. I believe the teachers could be cleared from the high court if the lower court's verdict could be challenged! Why Iajudding pardoned the teachers after this controversial verdict? ........Because, it was an arranged drama by Army backed Govt. I strongly disagree with your comment <does the convicted teachers have any moral right now to teach at DU>!

Book review: The Tribute to the Strugglers

The Tuhfat al-Mujahidin or 'The Tribute to the Strugglers' is one of the earliest extant historical treatises about the southern Indian state of Kerala. Its author, the sixteenth century's Shaikh Zainuddin Makhdum, hailed from the renowned Makhdum family from the town of Ponnani in Malabar, in northern Kerala. This family traced its descent to migrants from Yemen, who played a leading role in the spread of Islam in southern India.
Following in the footsteps of many of his forefathers, Shaikh Zainduddin rose to become a leading Islamic scholar. He spent ten years studying in Mecca, where he also joined the Qadri order of Sufism. On his return to his native Malabar, he spent almost four decades teaching at the central mosque in Ponnani, then a major centre for Islamic studies in southern India. He also served as the envoy of the Zamorins, the Hindu rulers of Calicut, to Egypt and Turkey.

The Tuhfat is one of Shaikh Zainuddin's several works, and is the best known among them. A chronicle of the stiff resistance put up by the Muslims of Malabar against the Portuguese colonialists from 1498, when Vasco Da Gama arrived in Calicut, to 1583, it describes in considerable detail events, many of which that the author had himself witnessed and lived through. It was intended, as Shaikh Zainduddin says, as a means to exhort the Malabar Muslims to launch a struggle or jihad against the Portuguese invaders. The book thus extols the virtues of jihad against oppressors, and, at the same time, also provides fascinating details about the history of Islam in Malabar, the relations between Muslims and Hindus in the region and the customs and practices of both.
Islam's first contact with India is said to have taken place in Malabar, and Shaikh Zainuddin offers a popularly-held account of this. He writes of how the Hindu ruler of Malabar, impressed with a group of Muslim pilgrims on their way to Ceylon, converted to Islam and accompanied them back to Arabia. There, shortly before he died, he instructed them to return to Malabar. They did as they were told, and the king's governors welcomed them, allowing them to settle along the coast and establish mosques. Gradually, he writes, the Muslim community began expanding through the missionary efforts of Sufis and traders.
Relations between Muslims and the Hindus of Malabar, Shaikh Zainudin observes, were traditionally cordial. The rulers of Malabar, all Hindus, treated the Muslims with respect, one reason being that the Muslims played a vital role in the region's economy because of their control of the trading routes linking Malabar to other lands by sea. Hindu rulers even paid salaries of the muezzins and qazis and allowed the Muslims to be governed in personal matters by their own laws. Hindus who converted to Islam were not harassed, and, even if they were of 'low' caste origin, were warmly welcomed into the Muslim community. This was probably one reason for the rapid spread of Islam in the region.
Shaikh Zainuddin's observations about the Hindus of Malabar are remarkable for their sense of balance and sympathy. Of the Hindu rulers, he says, 'There are some who are powerful and some comparatively weak. But the strong, as a matter of fact, will not attack or occupy the territory of the weak'. (This, Shaikh Zainuddin suggests, might be a result of the conversion of one of their kings, referred to earlier, to Islam 'and of his supplications to this effect to God'). He also adds, '[The] people of Malabar are never treacherous in their wars'. At the same time, he notes with disapproval the deeply-rooted caste prejudices among the Malabari Hindus. So strict is the law of caste, he writes, that any violation of it results in excommunication, forcing the violator to convert to Islam or Christianity or become a yogi or mendicant or to be enslaved by the king. Even such a minor matter as a 'high' caste Hindu woman being hit by a stone thrown by a 'low' caste man causes her to lose caste. 'How many such detestable customs!", Shaikh Zainuddin remarks after recounting some of them. 'Due to their ignorance and stupidity, they strictly follow these customs, believing that it is their moral responsibility to uphold them', he adds. 'It was while they were living in these social conditions that the religion of Islam reached them by the grace of Allah', he goes on, '[a]nd this was the main reason for their being easily attracted to Islam'.
Of all the Hindu rulers of Malabar, the most powerful, and also the most friendly towards the Muslims, were the Zamorins of Calicut, who claimed descent from the king who is said to have converted to Islam and died in Arabia. The Tuhfat describes how the Zamorins turned down bribes offered by the Portuguese to expel the Muslims, and of how they, along with Nair Hindu and Muslim forces, engaged in numerous battles with the Portuguese, who are said to have singled out the Muslims for attack and persecution. Shaikh Zainuddin is at pains to note the contrast between the response of the Hindu Zamorins to the plight of the Malabar Muslims with that of several Muslim Sultans in other parts of India, who were approached for help in expelling the Portuguese. 'The Muslim-friendly Zamorin', he writes, 'has been spending his wealth from the beginning' for the protection of the Malabari Muslims from the depredations of the Portuguese. On the other hand, he rues, 'The Muslim Sultans and Amirs—may Allah heighten the glory of the helpful among them—did not take any interest in the Muslims of Malabar'.
The Portuguese conquests, resulting in their wresting the monopoly over the Malabar spice trade from the Muslims, caused a rapid decline in Muslim fortunes, reducing the community to abject poverty. Shaikh Zainduddin describes the reign of terror unleashed on the Malabari Muslims, by the Portuguese, who were fired with a hatred of Islam and Muslims—indiscriminate killings of Muslims, rapes of Muslim women, forcible conversions of Muslims to Christianity, enslaving of hundreds of Muslims, destroying mosques and building churches in their place and setting alight Muslim shops and homes.
In appealing to the Malabari Muslims to launch jihad against the Portuguese, Shaikh Zainuddin makes clear that this struggle is purely a defensive one, directed at only the Portuguese interlopers and not the local Hindus or the Hindu Zamorins, for whom he expresses considerable respect. Nor is it, he suggests, a call to establish Muslim political supremacy and control. Jihad, then, for Shaikh Zaiuddin, was a morally just struggle to restore peace in Malabar and expel foreign occupiers, to return to a period when Muslims and Hindus in the region lived together in harmony.
This treatise is an indispensable source of Malabari history and would be invaluable to those interested in the history of Islam in South Asia. Much that Shaikh Zainuddin says with regard to the legitimacy of struggle against foreign occupation and oppression finds powerful echoes today.

According to CIA, the leader of 9/11 incident in USA had received $ 100,000 to finance his mission thru a famous ISI Agent, who had hijacked an Air India Airliner to Kabul years before and was provided a sanctuary in Pakistan by ISI. For more than 6 month I do not read (& response) any e-mail of that liar, bustard, RAZAKAR.
 
When initially this liar had started & participating in these blogs, then I protested & replied some of his lies and abusive e-mails of very filthy language, but no joy!
 
He (some of his ideological supporter, like Paki-RAZAKAR) has no enough, accurate political, social knowledge and logic (because he was a 2nd class holder in his academic life, SSC & HSC, and he never studied in any recognised university in this modern era)
 
Main thing is that, he (& his Paki-RAZAKAR ideological supporters, moderator, like Notun Bangladesh, Dahuk etc, Paki-RAZAKAR dominated blogs) writes lies with out any hesitation. This is the very common character of most (95%)  of the Paki-Jamat-RAZAKAR-ML activist-supporters. You will find many wrong, twisted and mix of lie & truth information in their posting & replies.
 
When you challenge them on any of their statement & information and when they can not face logically they start abusing, & slang & filthy language (few of those example are quoted by a blogger).
 
These Paki-Jamat-RAZAKAR minded overt & covert moderators supporters - publish, encourage & patronise them to write such offensive & ugly e-mails.
 
Yes, you are 99% right, "Some have quitted forums and some have been banned because of his pleading to Moderators"
