Sankar Kumar Ray was wrong when he wrote that
Sitangshu Guha was the President of HRCBM. I am not
sure if Mr. Guha was ever even a regular member of
HRCBM. He certainly was not in the Board of Directors,
or in the Executive Committee, let alone the
President, of HRCBM.

Mr. Ray should be advised to know the facts before
writing in public.

A 14-year old Jumma girl has been subjected to sexual assault in Dighinala under Khagrachari district.

A belated report from the area said on 19 January 2008, Saturday, at around 4 pm Ms Orchoto Chakma (father's name Birendra Chakma) of Hatchinsonpur village under Kobakhali Union (No. 3) went to the nearby grazing field to fetch their cows.

Seeing her alone, a settler cowboy named Shukkur Ali, aged 21, s/o Suruj Ali of the same Hatchinson area grabbed her and made attempts to rape her. He was probably lying in wait for her, for he must have known who the cows belonged to.

Orchoto resisted with all her might and as luck would have it, found a wood or bamboo stick to defend herself. As she got a breathing space she cried aloud for help.

Hearing her scream, the villagers rushed there, rescued her and nabbed the culprit red-handed. Later they handed him over to Bishwa Kalyan Chakma, chairman of Kobakhali Union Parishad.

Later in the day, after the incident, an arbitration meeting was held in the house of UP Chairman Biwsha Kalyan Chakma in which elders from both the communities attended. The settlers were represented by Borhan Uddin, member of Ward No. 5, Kobakhali Union Council, Boshor Member, Monnaf Leader and others.

The meeting unanimously decided to fine Shukkur Ali, the offender, Taka 500 for attempted rape.

However, one week after the said arbitration meeting the settlers approached Qamrul Hassan, second-in-command of Dighinala zone, who was the mastermind behind attempts to capture Sadhana Tila land last year, and asked for his help to make the Jummas pay for the "insults meted out to the whole settler community" by slapping a fine on Sukkur Ali for a trivial matter.

Emboldened by their meeting with the army commander, the settlers flouted the decision taken at the arbitration meeting and made a counter-demand that the Jummas must pay Taka 30,000 for "beating" Sukkur Ali.

In the meantime, Qamrul Hassan called the Jumma elders to his camp and threatened to "smash the bones of their body" if the demand of the settlers were not met.

"The basis of the government being the opinion of the people, the very first object should be to keep that right; and were it left to me to decide whether a country should have a government without newspapers, or newspapers without a government, I should not hesitate a moment to prefer the latter," said Thomas Jefferson, the third President of the United States (1801-1809), the principal author of the Declaration of Independence (17776) and one of the most influential founding fathers for his promotion of the ideals of Republicanism in the United States. 
 
On the necessity of a free press, Jefferson was satisfied to believe why a government succeeds and why it fails as because the press is much more of a channel between citizens and the acts of government. When the relationship works well, both the press and the government gain, when it doesn't, both have something to lose. Press is independent and fearless, and not indebted to anyone except public interest.
 
Freedom of Press is the guarantee by the government of free public press for its citizens and their associations, extended to members of news gathering organizations, and their published reporting. It also extends to news gathering, and processes involved in obtaining information for public distribution. Until now, not all countries are protected by a bill of rights or the constitutional provision pertaining of freedom of the press.
 
Every year, May 3rd is a date which celebrates the fundamental principles of press freedom; to evaluate press freedom around the world, to defend the media from attacks on their independence and to pay tribute to journalists who have lost their lives in the exercise of their profession. In 2008, World Press Freedom Day will focus on the freedom of the press and the "Access to information and the empowerment of people."
 
Modern democratic government subsists in representation of millions by hundreds. For the representatives to be accountable and for the process of government to be transparent, effective communication paths must exist to the constituents. No doubt, these paths consists primarily of the mass media, to the extent that if press freedom disappeared, so would most political accountability. In democratic countries, a special relationship exists between media and government. Although the freedom of press may be constitutionally enshrined and have precise legal definition and enforcement, the exercise of that freedom by individual journalists is a matter of personal choice and ethics.
 
According to Timothy Balding, chief executive officer of the World Association of Newspapers, balancing the sometimes conflicting interests of security and freedom might indeed be difficult, but democracies have an absolute responsibility to use a rigorous set of standards to judge whether curbs on freedom can be justified by security concerns and should set them against the rights protected in Article 19 of the Universal Declaration of Human Rights which guarantees freedom to seek, receive and impart information and ideas through any media and regardless of frontiers.
 
Anti-terrorism and official secrets laws, criminalization of speech judged to justify terrorism, criminal prosecution of journalists for disclosing classified information, surveillance of communications without judicial authorization, restrictions on access to government data and stricter security classifications, all these measures can severely erode the capacity of journalists to investigate and report accurately and critically, and thus the ability of the press to inform.

Press freedom and safety is not only an issue in conflict and post-conflict areas; there is also a worrying tendency of increased political pressure in many other countries. In the past decade, more than 1000 media professionals have been killed in the exercise of their profession, most of them victims of targeted killing. Only very few cases are investigated. In even fewer cases the perpetrators are brought to justice. Indeed, impunity stands in the way of justice in more than ninety percent of these cases, and as long as this pervasive culture of impunity persists, journalists will remain easy targets.
 
According to the New York based Committee to Protect Journalists (CPJ), sixty-five journalists were killed in direct relation to their work in 2007 since 1994, the highest death toll in more than a decade. For the fifth straight year, Iraq was the world's deadliest country for the press. Its 32 victims accounted for nearly half of the 2007 toll. Somalia was the second-deadliest country, with seven journalist deaths.
 
Taking note of the many problems of media and media-persons in South Asia face in the pursuit of truth and in fulfilling the demands of the professional tasks, in particular as a result of legal, social and political constraints on, and a growing pattern of governments' intolerance of criticism, the freedom of press and the right to know continue their well-deserved reputation as one of most unsafe places in the world for journalists to work. Governments continue the crack down on democratic rights and press freedom in the name of tackling situation. And corrupt officials, insurgents, fundamentalists of all religions and gangsters with their own violent methods of silencing truth tellers, continue with impunity.
 
It becomes a significant symbol of the curb on the freedom of expression that the state of emergency is forcing on public views and opinions when the government asked private television channels to follow a set of guidelines in airing talk shows while the chief adviser of the present interim government of Bangladesh Dr. Fakhruddin Ahmed claimed to the BBC in an interview that the media is operating freely in Bangladesh without any government intervention. Print media has been also advised several times to be cautious about their editorials, features or columns related to politics and government.
 
Media freedom shrinks and grows in Pakistan, as it does in Sri Lanka and other South Asian nations. The changes can be rapid, depending on leaders' ambitions, the state of the economy, or a worsening security situation. But the media's persistence, resourcefulness, and cohesion have often formed a bulwark against attacks.

Journalists in countries under duress realize that a free and open society is something grander than journalism. They also know that without journalism—even when it is flawed, or biased, or self-censored—a free society cannot truly exist. Power-obsessed politicians know that, too, and that is why in Pakistan and Sri Lanka they have tried to suppress the media. That these politicians have not fully succeeded should give us hope. Failed governments have come and gone. Their executives, legislatures, and judiciaries are easily and regularly corrupted, but South Asian journalists have persevered to uphold a higher ideal.
 
Although a cherished right of the people, freedom of the press is different from other liberties of the people in that it is both individual and institutional. It applies not just to a single person's right to publish ideas, but also to the right of print and broadcast media to express political views and to cover and publish news. A free press is, therefore, one of the foundations of a democratic society, and as Walter Lippmann, the 20th-century American columnist "A free press is not a privilege, but an organic necessity in a great society."
 
Freedom of press is not an event; it's a continuous process that should be remaining as it is as because it is widely related with the general people to re-install confidence whenever they need. Government must not restrict unnecessarily the freedom of movement of journalists or compromise the right of news media to gather, produce and disseminate information in secure and safe conditions.

Documents unearthed under the Right to Information Act reveal how industry added Rs. 16 lakh to the government's Rs. 44 lakh to commission a study by the National Institute of Occupational Health (NIOH) to "specifically indicate how technology has made working conditions [in asbestos factories] better."

The study is titled "Implementation of Rotterdam Convention on Prior Informed Consent Procedures — Study of Health Hazards/Environment Hazards Resulting from the Use of Chrysotile Variety of Asbestos in the Country." Chrysotile is popularly known as white asbestos.

Acknowledging the hazards from asbestos, Anbumani Ramadoss, Union Health Minister, informed Parliament: "…regarding asbestos, a lot of poor people use it. As regards the issue pertaining to banning of asbestos, as a health issue, the government certainly has not taken it up. It is an occupational hazard and people working in the asbestos factories are prone to lung cancer, but we are taking the enormity of the usage of asbestos. Mostly, poor people in the villages use it. Hence, I cannot take a decision on this issue."

Deadly fibre


The enormity of usage is no excuse to expose Indian workers and citizens to this deadly fibre. Without amendment to the existing import policy by the Union Ministry of Commerce and Industry for white asbestos, its consumption pattern is unlikely to change.

The study that has now been exposed through the Right to Information is supposed to be presented at the next meeting of the Chemical Review Committee of the Rotterdam Convention to rationalise its third veto against the U.N. action on white asbestos. It will also form the basis for India's domestic policy on the continued use of asbestos.

The next conference of the Parties to the Rotterdam Convention will be held from October 27 to 31, 2008 in Rome. Chrysotile asbestos will be on the agenda of Fourth Conference of Parties (COP-4) as was agreed at COP-3. This treaty, a result the efforts of the United Nations, came into force in February 2004. The text of the Convention was adopted in Rotterdam, the Netherlands. The Indian government, irrespective of the ruling party, has consistently colluded with asbestos interests.

The COP-3 of Rotterdam Convention held in Geneva, Switzerland, in October 2006 failed to bring the Prior Informed Consent (PIC) Treaty to apply to chrysotile (white asbestos), a known human carcinogen that represents 94 per cent of world's asbestos.


Although 95 per cent of the countries sought its inclusion, the COP-3 failed to list this and the decision to include it has been proposed in COP-4 in 2008. The Indian delegation has consistently argued that the science behind the recommendation to list chrysotile asbestos was not categorical.

The minutes of the Review Committee obtained recently through the Right to Information Act, dated December 19, 2006, read: "The report will be finalised after due discussions with the asbestos industry." Another meeting minutes, dated April 18, 2007, report that "...the results of the study which was under way could not be shared [with public] till the same was finalised." Clearly, a scientific study that is finalised after discussions with the corporate interests is grossly conflict of interest ridden and deserves to be scrapped.

As per data released by the U.N. Statistics Division, India imported about 306,000 tonnes of asbestos in 2006. Of which, 152,820 tonnes was imported from Russia and 63,980 tonnes from Canada.


Made-to-order science


The rising consumption is a result of a made-to-order science that gets exposed by the documents that show how the Union Ministry of Chemicals, acting in collusion with the asbestos industry, is manufacturing science to back its pre-determined position to fight global regulation on the killer fibre by reiterating that 'controlled and safe use' of white asbestos is acceptable both to the white asbestos industry and the Indian government.

Dr. Barry Castleman, an expert on asbestos who was in India in December 2007, commented: "Anyone who says there's a controlled use of asbestos in the Third World is either a liar or a fool."

Quite a hilarious piece by Mr. Sarkar. Mixing up support of
Obama or not with rationality. The issue was not whether Mr.
Sarkar's non-support of Obama made him a non-freethinker.
Rather the issue was HIS allegation that support of Obama
meant goins against ratioanlity. He cleverly turned around
the issue to suit him so he can defend himself easily (After
all, not supporting a political candidate is not against
rationality). Reminds me of strawman fallacy that many our
rational members of MM often refer to. It was he, Mr. Sarkar
who made the loaded and blanket characterization that ALL
Deshis support Obama because of his (perceived) Islamic
connection and hence they(i.e any Deshi Obama supporter)
cannot be truly rational. Is that naive and simplistic or
what?. It is. But what is bothersome is the disingenuous way
that Mr. Sarkar twisted the issue around made a strawman of
his opponents that THEY are accusing him of not being
rational because he does not support Obama. That is why he is
repeating his stand on Obama and McCain ad infinitum. Mr.
Sarkar's reference to the two criteria of rationality are
totally irrelevant here, and possibly both him and Dr.
JafforUllah and meet that criterion. So bringing in such
unnecessary baggagein the debate was tendentious at best .
Let us all be clear what the issue is. The issue is whether
suporting Obama's candidacy automatically makes a Deshi an
Islamist, and thus a non-freethinker. That was very
simplistic analysis by Mr. Sarkar to imply so. It certainly
doesn't. To analyze Obama it is irrelevant to talk about
Deshi mindset. The issue was Obama's preferability over other
candidates, not Deshi mindset. I think the reason many are
leaning towards Obama is to express a negative vote for
status quo on Iraq and economy which republicans represent
and to a large extent Hillary, specially on Iraq issue. Obama
not have to be flawless. All he has to be is against Iraq war
and more middle class friendly then others. If Edwards was
competing agaisnt Clinton then he would also have been
preferred over her by many, including many Deshis for the
same reason. It is not because there is something
extraordinary in Obama to be gaga about. What does it matter
if a handful of deluded Deshis support him for the wrong
reason (that he has some Islam connection?). Is it worse than
supporting McCain or Hillary? First of al If the Islam loving
Deshis help Obama to be elected then all the power to them. I
would look at it as exploiting them for the right cause(
overthrow the status quoist on Iraq and the war hawks they
represent). If Obama will not in the end serve their Islamic
dream then why even bring it up as an issue?. Their support
for Obama cannot hurt anyone except them if Obama does not
help their islamic cause/ dream!. But like all other groups,
not all Deshis think the same. It is simplistic and brainless
to generalize all Deshis as being Islamic minded. Many would
support Obama for the reason I mentioned, not because of his
perceived Islamic connection. Mind you Ex fed chairman
Volcker has endorsed Obama. And he is not Islamic minded.
Then why does a Deshi (I assume you meant Deshi as one born
in Bangladesh and living in USA) have to automatically
Islamic minded just because of being a Deshi? Is that the
kind of logic you believe in?. Can our freethinker members
cite any logical rule that would support this kind of
conclusion? Also not all of the Islamic minded Deshis have
the illusion that Obama would serve Islamic interest. Only
some among the Islamic minded Deshis do. Rather many Islamic
Deshis would still support neocons as the neocons seem to be
very friendly with Wahabi Saudi kings who are more dangerous
than the Talibans, because they are exploiting their good
relation with USA to infiltrate, indoctrinate Wahahabi
ideologies all around the globe including USA. If and when
their goal is achieved they will mend their fences with Bin
Laden. Their difference with Bin Laden is only in the means,
not in the goal. One of the most delusional notions that many
non-Deshi and Deshi neocons like Mr. Sarkar and Mr. Guha
represent, have is that opposing Iraq war is automatically a
pro-Islamic stand, and supporting it is anti- Islamic. Guess
what deshi neocons. Saudi arab supported Iraq war. Are the
Wahabi Sauidis anti-Islamic? On the other hand many atheists (
not including many Deshis), hollywood celebrities, US
statesmen, military men, economists etc have opposed Iraq war.
Are they Islamophiles? What a naivette!. These simple minded
folks do not even know that Islamic Arab countries hated
Saddam's Iraq because he was anti-Islamic, and secular. Thats
why they supported US invasion of Iraq. Look at Iraq today.
Not much different from Wahabi Saudis. Sharia laws are
officially in effect. Women are scared to come out and dress
normally like they did before. Madrasahs and Mullahs are
reigning all over. Saddam had them under control with his
iron rod. Women were the top scientists in Saddam's
government. Mullah were like rats hiding in their burrows
during Saddam's regime. Now they are out like hyneas baring
there jaws. The Neocons do not mind that. They would rather
not have a secular progressive scientifically/
technologically advanced Iraq, like it was under Saddam,
because then Iraq would have been hard to manipulate and
exploit.

[vinnomot] University incidents in Bangladesh - what can we do?

Dear Sir,
What we see in various universities in Bangladesh are very painful, shameful and we MUST control and stop these.
 
WHAT A SHAMEFUL EVENTS!
  • Teachers are beaten by students.
  • VC, Provost, Pro-VC and others - remain captive, locked, harassed, etc. --- what a shame for a nation!
  • Students are fighting each other, killing, torturing, etc. - this is long history - but most of these incidents are more politicized and from students' wings of various political parties.
  • Being a University teacher, even me including many others, see wrong, odds, criminal act, ppression within university campus, university halls [e.g., watching one urinating in corner of a department, another student in a afternoon was so excited to release his sperm in a floor of a department while a teacher was passing but no control, immoral activities with pairs of boys-girls within and outside from students - staying even till 9/10pm inside various corridors and if any protest from any teacher or staff, they are sometimes harassed <once attacked by gunbut to a uni staff in Dhaka University>, and many more] -- and teachers mostly can not say anything and remain silent though their heart burns.
  • Mind it, only a few teachers are doing or involved in politics, even those who are getting nomination or elected [e.g., in Syndicate member election. Senate member election, Teacher's Union election, etc.] are not all that much political in nature.
  • Sometimes, even from the teachers, due to to factions mainly - they fight or argue in very aggressive way. So these are shameful. Just recall the last meeting at Dhaka University Teachers' Union [sikkhok samity election] where in the meeting for 3 or more hours, some of them bahaved so badly that destroy the image of teachers.
  • Also, we see, teachers are murdered within campuses - whereas, many of us feel that after Cantonment, University teachers; quarters are the safest place to live because we respect [!!!] out teachers.
WHAT CAN WE DO?
  • If you really feel that teachers are respected, then we need to take few actions, motivate students, teach them the importance of public values, moral values, public property, life of another fellow-student, respect for woman.
  • We MUST try to stop the politics within university.
  • Within univeristy - we must stop strikes, miking, processions, posters, immoral activities, etc. It is unbelievable and many teachers just can not feel comfortable to stay longer in the campus due to bad immoral conduct of some groups around the department, corridors, etc. Just answer me, how come used condoms are sometimes available is some classrooms or other places?!!! It is rare but still available sometimes.
  • Also, please ensure quality food for the students in the dining halls and canteens. This is very bad that a generation is evolving with very poor quality of food due to money. Every department's alumni, etc. can subsidies for quality food and life for student halls.
  • Also I strognly recommend for university halls to allow new students to stay in the hall and seniors to leave the hall [like few universities in Bangladesh - this is a practice] - this way, new admitted 1st yr's student can get a seat in hall, make his life smooth, and after 2/3 years time, he can manag his life, get some earning sources in some cases, or manag life outside or get tutionee and stay outside halls. This can help students not to be a card for political students' wings.
  • We must ensure that the purpose for University life is to STUDY, improve knowledge. But we do a small amount of this. We have more frustratation, gossip, misuse of time; less brain-storming, team work, share of knowledge and academic competition. We MUST engage our students to do well and motivate them.
  • TO motivate students: Teachers must take the 1st role and then work hard. Change curriculum if necessary, change exam systems, do not mark based on partisan or gender or face-value in viva-voce. In Science faculties, medical fields, it is a big problem -- lots of students complain regarding viva-voce, thesis defence as there is no steadfast rule to maintian a neutral environment, etc.
Please do bit bit and bit based on your ability ----- please refresh our country and young kids for the next generation. Many of us hate the present status-qou, very few of us react and take action.
 
We can try a bit - and step by step - a can solve many problem. Just ensure academic environment for the students.
 
Media can take a strong position - through good and postitive achievements of students [like some developed countries - they have many programs on TV], through drama, newspaper, etc. Please remove the partisan or yellow-journalism and be honest --- at least with the students' related activities. We must clean our heart, mind and soul and act positivaly. The noble - A Time To Kill by J. Grisham ---- reflects that mind - not black or white --- feel thr truth and act then. Do not forget your student life when you suffered and watched your friends to suffer. Please act based on your ability.

  • Being a University teacher, even me including many others, see wrong, odds, criminal act, ppression within university campus, university halls [e.g., watching one urinating in corner of a department, another student in a afternoon was so excited to release his sperm in a floor of a department while a teacher was passing but no control, immoral activities with pairs of boys-girls within and outside from students - staying even till 9/10pm inside various corridors and if any protest from any teacher or staff, they are sometimes harassed <once attacked by gunbut to a uni staff in Dhaka University>, and many more] -- and teachers mostly can not say anything and remain silent though their heart burns.
  • Mind it, only a few teachers are doing or involved in politics, even those who are getting nomination or elected [e.g., in Syndicate member election. Senate member election, Teacher's Union election, etc.] are not all that much political in nature.
  • Sometimes, even from the teachers, due to to factions mainly - they fight or argue in very aggressive way. So these are shameful. Just recall the last meeting at Dhaka University Teachers' Union [sikkhok samity election] where in the meeting for 3 or more hours, some of them bahaved so badly that destroy the image of teachers.
  • Also, we see, teachers are murdered within campuses - whereas, many of us feel that after Cantonment, University teachers; quarters are the safest place to live because we respect [!!!] out teachers.
WHAT CAN WE DO?
  • If you really feel that teachers are respected, then we need to take few actions, motivate students, teach them the importance of public values, moral values, public property, life of another fellow-student, respect for woman.
  • We MUST try to stop the politics within university.
  • Within univeristy - we must stop strikes, miking, processions, posters, immoral activities, etc. It is unbelievable and many teachers just can not feel comfortable to stay longer in the campus due to bad immoral conduct of some groups around the department, corridors, etc. Just answer me, how come used condoms are sometimes available is some classrooms or other places?!!! It is rare but still available sometimes.
  • Also, please ensure quality food for the students in the dining halls and canteens. This is very bad that a generation is evolving with very poor quality of food due to money. Every department's alumni, etc. can subsidies for quality food and life for student halls.
  • Also I strognly recommend for university halls to allow new students to stay in the hall and seniors to leave the hall [like few universities in Bangladesh - this is a practice] - this way, new admitted 1st yr's student can get a seat in hall, make his life smooth, and after 2/3 years time, he can manag his life, get some earning sources in some cases, or manag life outside or get tutionee and stay outside halls. This can help students not to be a card for political students' wings.
  • We must ensure that the purpose for University life is to STUDY, improve knowledge. But we do a small amount of this. We have more frustratation, gossip, misuse of time; less brain-storming, team work, share of knowledge and academic competition. We MUST engage our students to do well and motivate them.
  • TO motivate students: Teachers must take the 1st role and then work hard. Change curriculum if necessary, change exam systems, do not mark based on partisan or gender or face-value in viva-voce. In Science faculties, medical fields, it is a big problem -- lots of students complain regarding viva-voce, thesis defence as there is no steadfast rule to maintian a neutral environment, etc.
Please do bit bit and bit based on your ability ----- please refresh our country and young kids for the next generation. Many of us hate the present status-qou, very few of us react and take action.
 
We can try a bit - and step by step - a can solve many problem. Just ensure academic environment for the students.
 
Media can take a strong position - through good and postitive achievements of students [like some developed countries - they have many programs on TV], through drama, newspaper, etc. Please remove the partisan or yellow-journalism and be honest --- at least with the students' related activities. We must clean our heart, mind and soul and act positivaly. The noble - A Time To Kill by J. Grisham ---- reflects that mind - not black or white --- feel thr truth and act then. Do not forget your student life when you suffered and watched your friends to suffer. Please act based on your ability.
