[mukto-mona] Chief Justice's remarks re:irregularities in judiciary & the US State Report/07

The Chief Justice, M Ruhul Amin, remarked that the irregularities in appointment of judges in the past would need at least 20 years to remove (Quoted from his speech at the reception given by Noakhali Bar last year). He also said that there is no scope of indiscipline in the judiciary. A judge must be prudent and he must follow the code of conduct. His observation was a revelation for many but informed people have witnessed turmoil in the Supreme Court in the past few years. The present government is seriously considering options for restoring the image of the higher judiciary which has been tarnished in the past few years through acute politicisation and appointments of judges with lack of qualification or competence.
 
The US State Department's Country Reports on Human Rights Practices  - 2007 
released by the Bureau of Democracy, Human Rights, and Labor on March 11, 2008 clearly mentioned in the paragraph of Denial of Fair Public Trial:

The law provides for an independent judiciary; however, in practice, a long-standing temporary provision of the constitution placed the executive in charge of the lower courts, judicial appointments and compensation for judicial officials. The caretaker government implemented legislation developed by the previous government separating the judiciary from the executive.

The Appellate Division of the Supreme Court frequently overturned politically charged decisions by the High Court Division of the Supreme Court if those rulings went against the government. For example, the Appellate Division overturned several decisions granting bail to high-level corruption suspects. On several occasions when the Appellate Division upheld the High Court ruling to release a high-profile detainee, the person was re-arrested immediately upon release on a new set of charges. Corruption, judicial inefficiency, lack of resources, and a large case backlog remained serious problems.

The nation and international civil societies want to know the response from the Chief Justice regarding the observation of the US Department of State. If his observation was a revelation for many but informed people have witnessed turmoil in the Supreme Court in the past few years, then why now the same situation prevails under his courtship?

Dear Mr. Chakrabarty:

I have been living in the US continuously since 1969. Staying far
away from America it may seem that there is not an ounce of
difference between the Democrats and Republicans. However, this is
the product of an erroneous thinking process. Ronald Reagan
epitomizes the "virtues" of Republicans. Republicans are for smaller
government (but they end up making the government big), less tax for
the wealthy, also, they think they are true Christians (they evoke
Christianity every which way they could). Last but not least, they
are the CONSERVATIVES. Contrast this with the Democrats. They
strongly believe in the separation of Church (read religion) and
state. They are the champion of Keynesian model of economics. They
tend to be more liberals than the Republicans.

Mr. Chakrabarty, you are grossly misstating when you say that FDR
(President Roosevelt) and President Harry Truman were Republicans.
Both of them were Democrats.

Also, Truman (1945-1953) did not start the Vietnam War. The Korean
War may have started in the waning days of Truman's presidency.
Eisenhower's presidency (1953-1960) was however greatly mired in
Korean War. President Eisenhower was a Republican but he was a
moderate person. I read somewhere that after the war, he was
thinking about joining the Democratic Party. The governor of New York
convinced Eisenhower to join the Republican Party. During Jack
Kennedy's time (1961-1963) The Indo-China War (later known as the
Vietnam War) broke out, which got intensified during Johnson's time
and Nixon's rule of America (1969-1974). Both Kennedy and Johnson
were Democrats but Richard Nixon was a moderate Republican. It was
after 1980 when the music man (Ronald Reagan) came to Washington DC
that the Republican Party overtly became the conservative. Many
people do not know that Reagan was outwardly a Christian and
conservative. He gave only lip service to conservative movement but
look at his family life. It was all show biz. However, millions of
gullible Americans thought he was the epitome of the hawkish arch-
conservative politician.

My sincere request to Mr. Chakrabarty, please consult an
authoritative history books before citing historical facts and
figure. The last thing that we want is an archive in Mukto-mona
strewn with wrong information.

[mukto-mona] Atten: Mr R N Islam

 
While agreeing with Mr Islam on his characterisation of conceited people like Dr Jiten Roy or Mr Sitangshu Guha but I am against censoring their views. Who doesn't like court-jesters who have a role too, although all court jesters are not like the legendary Birbal in the royal durbar of Akbar The Great. Some resemble Gopal Bhanr of Maharaja Krishnachandra Roy.
With malice towards none including those that lick the boots of George Bush and keep mum after the corwadly killing of Colombian revolutionary leader Raul Reyes, direcly under the patronage of neocons that call the shots at the US administration and the Pentagon.

1. I don't understand American politics from which I am far far away. To me the Democratic Party and the Republican Party are simply the two sides of the same coin. Differences are marginal. No party is lesser patriot than the other. They look after American interests with equal priority. The revolutionary and pro-people minimum wage, Social Security, overtime, 9 to 5 office hours, and deposit insurance decisions were taken by Republican President Roosevelt. On the other hand decision to make atom bomb was taken by Roosevelt and decision to drop atom bombs on Nagasaki and Hiroshima was taken by another Republican President Truman. He also started Vietnam war. As California Governor Ronald Regan passed a revolutionary abortion bill and yet got nomination from the Republican Party. Differences in opinions and rhetoric are more political than ideological.Because of all this, when I talk about conservatives and liberals, I don't have American politics in my mind.
I rather use dictionary meanings of these two terms.

2. According to Chambers:
Conservative: Averse to change.
Liberal: Not bound by traditional orthodoxy.
As an example, in Hindu society a conservative tends to preserve caste system whereas a liberal person will denounce it although both may believe in God. That is why I mentioned that the extreme version of conservatism can be fundamentalism and fanaticism. And that is why I protested when Dr. Jiten Roy tried to promote Savage's Principle of Mental Disorder.

3. I proved that as per Dr. Roy's own 10-criteria test, he himself is a liberal. Now looks like he is determined to be better known as a conservative and that is why he has shortened the list of criteria.

4. Dr. Roy has raised the issue of moral decay. Has this decay been caused by liberals or some thing else? There can be a good debate on this topic.

5. Dr. Roy has said that he believes in marriage between a man and a woman. Is he suggesting that liberals believe otherwise?

6. Is he equating liberals with atheists, radicals, nihilists, or anarchists?

I read the two articles by my friend Dr. Nripendra Sarkar. I don't want to make comments on every thing he has written. Just a few points:

1. First article: We really need broadness of mind to make a member of a minority (religious, ethnic, linguistic, etc.) community the topmost leader of our choice. Obama is an example. Many people do not support him just because he is a minority perceivably/actually at least in two senses. India is great in this respect. What about some other cases I can remember at this moment: Saddam (a Sunni who ruled a Shiite majority country), Jinnah (similar case as of Saddam, and Stalin who was from Georgia?) I am sure we will find more. How do these exceptions occur? Obviously broadness of mind alone cannot explain it totally. That's another story.

2. Second article: "Loving a country" is a pretty deluding term. I believe with utmost confidence that all immigrants love America. Conspirators are the exceptions who constitute a tiny fraction of the total immigrant population. Visitors are excluded from my discussion. Now Mr. X's and Mr. Y's love for America may not be of the same nature. Mr. X may be so overwhelmed with gratitude that he may find it immoral and unethical to find faults with any policies or actions. On the other hand Mr. Y will want to see his newly adopted country as a more beautiful country in all respects and that is why he may disagree on some policies and actions.

[ALOCHONA] John Pilger - The prisoner of Dhaka

John  Pilger who has done a lot of fine work over the years & most recently on Iraq has let his personal friendship with Moudood cloud up his assesment of him. True Moudood's arrest on charges of illegal alcohol possession is laughable and ridiculous. The a great portion of the ruling circles in Bangladesh can be put in prison for alcohol and other narcotic possesion.

Moudood could have been charged for far more serious offenses such as high treason in in assisting prior dictators in illegally amending the constitution to legitimize their grip on power. I suspect the present military regime may yet require his services in the future to make necessary amendments when they decide to give up the charade and legitimize their rule. And Moudood will most certainly oblige for reasons of "national interest & necessity". (wink wink)

Moudood is no Tom Paine just an above average for-rent constitutional hack.

There is a decent, brave man sitting in a dungeon in a country where the British empire began - a country of poets, singers, artists, free thinkers and petty tyrants. I have known him since a moonless night in 1971 when he led me clandestinely into what was then East Pakistan and is now Bangladesh, past villages the Pakistani army had raped and razed. His name is Moudud Ahmed and he was then a young lawyer who had defended the Bengali independence leader Sheikh Mujibur Rahman.

 

"Why have you come when even crows are afraid to fly over our house," said Begum Mujib, the sheikh's wife. This was typical of Moudud, whose tumultuous life carries more than a hint of Tom Paine.

 

As a schoolboy, Moudud wet his shirt with the blood of a young man killed demonstrating against the imposition of "Urdu and only Urdu" as the official language of Bangla-speaking East Pakistan. When the British attacked Egypt in 1956, he tried to haul down the union flag at the British consulate in Dhaka, and was bayoneted by police: a wound he still suffers.

 

When Bangladesh - free Bengal - was declared in 1971, Moudud brought a rally to its feet when he held up the front page of the Daily Mirror, which carried my report beneath the headline, BIRTH OF A NATION. "We are alive, but we are not yet free," he said, prophetically.

 

Once in power, Sheikh Mujib turned on his own democrats and held show trials at which Moudud was their indefatigable defender until he himself was arrested.

 

Assassination, coup and counter coup eventually led to a parliamentary period headed by Zia ur-Rahman, a liberation general with whom Moudud agreed to serve as deputy prime minister on condition Zia resigned from the army. Together they formed a grassroots party, but when Moudud insisted that it must be democratic, he was sacked.

 

Whenever he came to London he would phone those of us who had reported the liberation of Bangladesh and we would meet for a curry. His pinstriped suit and inns-of-court manner belied his own enduring struggle and that of his homeland: recurring floods and the conflict between feudalists and democrats and, later, fundamentalists.

 

"I am the prime minister now," he once said, as if we had not heard. Outspoken about his people's "right to social and economic justice", especially women, he was duly arrested again, then won his parliamentary seat from prison.

 

On April 12 last year, late at night, 25 soldiers smashed into Moudud's house in Dhaka. They had no warrant. They stripped his home and "rendered" him, blindfolded, to a place known only as "the black hole". There, he was interrogated and tortured and forced to sign a confession. He was finally charged with the possession of alcohol - a few bottles of wine and cans of beer had been found. The supreme court declared his prosecution and detention illegal. This was ignored by the government, which calls itself a "caretaker" administration, but is a front for a military dictatorship.

 

Moudud is suffering from a pituitary tumour and has been denied medication for six months. He is terribly ill, says his wife, the poet Hasna Jasimuddin Moudud. "Thousands of people have been detained for being activists, or just supporters," she says. "The country is a prison, and the world must know."

 

There are striking similarities between Moudud's case and that of the Malaysian opposition leader, Anwar Ibrahim, who this week all but overturned the old, autocratic regime. Both were framed in order to silence them. The difference is that Anwar Ibrahim's case became an international cause celebre, whereas there is only silence for Moudud Ahmed, locked in his cell, ill, without charge or trial.

 

In the next few days, Dr Fakhruddin Ahmed, the "chief adviser" to the caretaker government - in effect, the head of Bangladesh's government - will visit London. He is said to have a meeting arranged at 10 Downing Street. I and others have written to Dr Fakhruddin, asking him to comply with the supreme court's ruling and to release Moudud. He has not replied. If Gordon Brown's recent pronouncements on liberty have a shred of meaning, it is the question he must ask.
