Abuse of female student: Punishment of DU teacher demanded

 
Dhaka University students brought out a procession
on the campus yesterday demanding exemplary punishment to Dr
Kamal Uddin, a teacher of Psychology Department, for alleged
sexual harassment of a female student. Focus Bangla

A number of students of Dhaka University under the banner of general students staged a demonstration on the campus yesterday demanding exemplary punishment to a teacher for reportedly harassing one of his female students sexually.

But the students were chased by a group of Bangladesh Chhatra League (BCL) activists, while they were going to the Proctor's office to submit a memorandum demanding punishment of the teacher.

Being afraid of the attack by BCL activists, the students started running helter-skelter in the Arts Building, while the female students were seen crying for their safety.

Later, the group set fire to a banner 'New dormitory wanted to reduce residence problem' of another student group, Chhatra Mukti.

Sources said the guardians of the female student earlier submitted a written allegation against Dr Kamal Uddin, Associate Professor of Psychology Department, to the Vice-Chancellor office in this regard. But the university authority did not take any action in this connection, the sources added.

The VC office sources said a group of teachers were trying to hush up the incident though similar allegation was brought against him by another female student a few years ago.

"My Mother" a Victorian Poem

Below is a quaint poem called "My Mother". It was written by Ann Taylor (1783 –1866). She's the sister of Jane Taylor, the author of Twinkle, Twinkle, Little Star. Ann and Jane published books of rhymes and poems together.

The illustrations below were done by Walter Crane. Here's what Crane wrote about it in 1910:

"My Mother" is mid-Victorian—just after crinolines had gone out—but mothers are always in fashion, bless them…

Crinolines are so old-fashioned that many of us in the 21st century are no longer familiar with the word! Crinolines were hoop petticoats worn under skirts to give them a wide round shape. They were often made out of steel to support and widen the look of the skirt. Ladies, let's all be glad we're not too familiar with this word!

[mukto-mona] Why attack Tagore. Is it intellectual generosity?

I wonder how generous is it to attack Tagore ignoring his genius?  How much darkness one can bring on his character by pointing out his weaknesses only? Voltaire had many faults as a person but people who write or talk about him at the end they call him the most perfumed personality of the French culture. His faults vanish into the thin air in the face of his creative genius. Unleashing an intellectual assault any one is never unacceptable but a balance is maintained if it's even handed. We do not show any generosity by eulogising ones contribution for making history; rather it proves our ability to understand that person. The genius of Tagore is so fathomless that it becomes a matter of grace for many to understand him. He is easy but tough for any one whose mind is not wise enough. W.B.Yeats wrote in 1912,'I read Rabindranath every day, to read one line of him is to forget all the troubles of the world,'

Visiting US Assistant Secretary of State Richard A. Boucher (detailed news attached below:}  Said " Sheikh Hasina and Khaleda Zia, former prime ministers detained on corruption charges, must face the law, but the trials would have to be fair and open". His comment which conforms with Universal Declaration Human Rights of United Nations,   "Article 7. All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination"  ( ttp://www.un.org/Overview/rights.html  ) --- is not the headlines in any news paper of Bangladesh to my knowledge. Are we fit for democracy, transparency, truthfulness, justice, and human rights at all? Sir Winston Churchill during our Ist independence 1947, said India is not fit and for ready  democracy and independence yet. Fortunately, India proved to be otherwise, but we--Bangladesh, Pakistan. Srilanka, Nepal etc.  remain in painful unstable condition till now. In our value system, tradition, and culture our popular leaders are above their parties, above our countries, and above the law of the land; they are considered above our fathers and mothers, adorable like religious Popes/Ayetullas/Pir/Gurus like prophets, or they are almost near Allah, no human justice system can touch/try them.  Mr. Richard A. Voucher, our US Diplomat can ever hardly understand our feelings, respect, and worship mentality of our culture. India has passed through this test when Indira Gandhi allegedly charged and arrested for corruption. never violated and dared to challenge her country's legal system for her freedom before trial. neither her followers. She came out of Jail obeying/according to law, got elected again, became popular again, gave her life for the cause of her country, knowing full well that Terrorist Sikhs will take revenge of Golden Temple incident; her last speech was " ...... I know I will be killed, but I also know each drop of my blood will unify India.....".    Any nation can be great if her people and her leaders have the patience and respect for the rule of law which is the sacred code of justice of the people, by the people, for the people.

Visiting official expects no delay in election

Visiting US Assistant Secretary of State Richard A Boucher yesterday said the United States would not accept any deviation from the path to parliamentary polls here by this year-end. He also observed that "good elections" are not possible with a state of emergency and ban on political activities still in force.

Speaking at a press conference at the American Club in the city, Boucher said, "The US believes the only path forward for Bangladesh is to have an election. We won't accept any deviation from that."  Replying to a query, he said he does not think there will be a military intervention in the country.  Boucher said, "We don't think you can have a good election under a state of emergency. The emergency has to be lifted."  Besides, restrictions on the political activities must go while an environment congenial to free and open discussions should be in place, he continued.

"We have been pushing for that and encouraging lifting of the emergency because that is necessary for a good and successful election."  Earlier on Thursday, the assistant secretary of state for South and Central Asian affairs reached Dhaka in a two-day visit, and met Chief Adviser Dr Fakhruddin Ahmed and Chief of Army Staff Moeen U Ahmed. Asked about the human rights situation here, he said, "There are problems that need to be fixed, and we think those are best fixed under an elected government."  Democracy is the best way to fight terrorism, safeguard human rights and ensure a sustainable development, he added.  He however declined to comment when asked if an election without either or both of BNP and Awami League would be credible.

"We will hear more from the government. I can't deal with all these ifs, there is too much speculation out there," he said, adding, "We'll be monitoring the situation. All of these proceedings need to be on track."  He said Sheikh Hasina and Khaleda Zia, former prime ministers detained on corruption charges, must face the law, but the trials would have to be fair and open.

Boucher asked the political parties to "keep their eyes on the ball and the need to hold elections" because, he said, "nobody can claim any rights or mandate unless they are elected". He welcomed the caretaker government's initiative to hold dialogue with political parties, and said he hopes the talks will produce a set of understandings and help the election take place in a free and fair manner.  Turning to the fight against terrorism, he said there is always a prospect of terrorist threat to Bangladesh and work needs to continue to prevent the territory from being used by terrorists.  Recently, the US government has announced $20 million in assistance for Bangladesh to finance counter-terrorism programmes. Boucher said Dhaka's claim to the US Millennium Challenge Account would be reviewed in the light of the anti-corruption drive of the present caretaker government.

He said the bill to grant Bangladeshi goods greater duty-free access to the US market is unlikely to be passed this year since the US congress and political machinery would be preoccupied with the presidential election there.

 the law is not good for anyone. She should prove CTG  wrong unless she has doubt

that she will fail to to do so. In that case she should do she knows best - anarchy and

Nandigram Act II - Rape and Democracy in West Bengal

We are passing through difficult times. Radharani Ari of Nandigram has been raped. Those believing in the politics of negating the truth by its repeated denial have got into the act. That rape had occurred on March 14 at Nandigram was earlier denied by the 'creamy' (sic) layer of the CPI-M. There was earlier a denial about the involvement of CPI-M apparatchiks in the rape and murder of Tapasi Malik at Singur. It is therefore not surprising that the CPI-M will deny the sexual assault and rape of Radharani Ari.

However, it is frightfully shocking when medical professionals, in total disregard of ethical norms that the profession entails on its practitioners, join the ruling party in its politics of negating the truth by its denial and use their professional knowledge and skills to reinforce the party's heinous claims. The news byte carried by all daily newspapers, including the party's mouthpiece and the electronic media, was of the Super of the State-owned P.G. Hospital, Kolkata's statement:

The Medical Board's report says that that the assaulted/attacked (aakranto in Bangla) Radharani Ari has not been raped.

The question that arises is: whether the Super is empowered, in his official capacity, to make such a statement. Only the chief of the Medical Board, looking into the case, can make a statement on the case. Was the Super's act of assuming the Medical Board's authority an attempt to conceal the unpleasant truth? Further, the moot question is: whether medical professionals are permitted, by their code of professional conduct, to conclude in their report if a person has been raped or not.

We believe that if any medical professional does so then he/she is in fact, exceeding his/her brief because rape is a criminal offence that has its own legal definition and jurisprudence. In fact, it is not an ailment which can be diagnosed and treated by a medic. The medical professional's role has been clearly elucidated in the authoritative Modi's Medical Jurisprudence and attention may be drawn to this relevant portion of the text wherein it is stated that

…. The medical officer should not give his opinion that no rape has been committed. Rape is a crime and not a medical condition. Rape is a legal term and not a diagnosis to be made by the medical officer treating the victim. The only statement that can be made by the medical officer is that there is evidence of recent sexual activity. Whether, the rape has occurred or not is a legal conclusion, not a medical one. -(11 edition, 1993, p. 369)

It is therefore clear that the specialist doctors transgressed their limits to commit this heinous and nefarious act. However, it needs to be emphasised that such an act in obeisance to political powers in gross violation of professional ethics cannot wish away the offence committed, by just saying that "Radharani Ari has not been raped". History has numerous instances of medical professionals having associated covertly or overtly with the nefarious designs of political parties that are in power. The medical professionals who were part of the medical board of P.G. Hospital, Kolkata, added their names to this despicable list.


 


IT has been rightly said by Saonli Mitra and Subhaprasanna et al. in a press conference that the most important evidence in a case of rape is the deposition of the victim and perhaps that is the only evidence that ought to be considered by the investigating agencies/courts. The Supreme Court of India has, in its many pronouncements/judgements, given legal recognition to this principle. It may be pointed out that nowhere in the law of evidence in India is it stated that the victim's deposition will not be considered as good evidence until and unless it is supported by medical reports. A1993 Supreme Court judgement (AIR,1990,SC658) states that in a case of rape, seeking corroborative evidence, tantamount to casting aspersion on the victim as an accomplice to the act, adding to her pain and woe, is also an insult to womanhood. In fact, in the 1950s, the Supreme Court had laid down that in a case of rape it is the deposition of the victim that is of prime importance, any additional evidence is also welcome ("matter of prudence"; AIR, 1952, SC54). In the 1972 Supreme Court judgement in the famous case of Gurcharan Singh (1972 2 SCC 749) it was held that

Corroboration of the statement of the prosecutrix (or the victim) is a rule of prudence and not of law. It is not absolutely essential.

It therefore follows that even if the Medical Board opines, under pressure from political bosses, that that there was no occurrence of rape, such an opinion will not be sufficient to brush the truth under the carpet. The powers that be know it all and so, says Brinda Karat (a member of the CPI-M Polit-Bureau) in one of her essays, that "do not make the victim culpable". She forgot to state: except in the State of West Bengal.

Democracy does not mean a rule of the might of a government that commands electoral majority. It ought to be rather a rule of conscience, principles and values. However, in West Bengal we have heard the swan song of these norms a long while ago. It is this state of affairs that is frightening—a State where the weak, the victim is punished, where the perverted state of mind of the party in power and its violent manifestations are established as the norms of democracy, a democratic order where Opposition has to be killed and destroyed by every possible means. This mentality or state of mind needs to be defeated; only then will democracy survive in West Bengal.

Obama Promises Germany-Plus

When I begin to feel homesick for Germany, I have discovered a cheap
and easy way out. I simply turn on the TV and listen to a Barack
Obama stump speech.

The promised land of universal health care, secure pensions, a lot of
green-collar jobs and stable bridges brings me back to my home
country. My grandma, who has worked in a post office all her life,
enjoys her pension without having ever observed the stock market.
Everyone who travels through the countryside can see thousands of
windmills, but never a collapsed bridge. And the best: My mom, my
friends and everyone around them have access to first-class medical
services.

Sometimes it appears to me that Mr. Obama wants to trump all that. He
has promised not only a $160 billion program for new green-collar
jobs, a higher minimum wage, affordable health care for everybody, a
massive investment in infrastructure and tax-free status for
pensioners who make less than $50,000. All these nice things come
with no tax increase for 95% of Americans. Wow! That's Germany-plus!

I've been in the U.S. for a while, but if I remember my home country
correctly, all the German comforts come with a price. My grandma has
paid 10% of her salary to the public pension system, and her employer
has matched the contribution. For our health insurance everyone has
to sacrifice 7% of his or her earnings, which again is matched by the
company. Fashionable windmills go along with extra taxes for fuel. A
gallon of regular gas in Munich or Berlin costs – fasten your seat
belt – more than $8.

Not all of my fellow Germans are happy with this, but the
overwhelming majority of my fellow countrymen made their decision a
long time ago. They prefer big government. They have learned to live
with growth rates far behind and an unemployment rate far above the
U.S.

Maybe I am being unfair to Mr. Obama. But it seems to me that the
agent of change was window-shopping in Germany without looking at the
price tag. You should ask him for the bill.

Repression of journalists continues with two more arrests

Reporters Without Borders condemns a decision by the Chinese authorities to place a journalist known by the name of Naranbilig under house arrest for a year after holding him for 20 days in Inner Mongolia. It also condemns the 3 May arrest of writer Zhou Yuanzhi, who may now be charged with "inciting subversion of state authority" as many other Chinese intellectuals and dissidents have already.

"With just three months left to the Beijing Olympic Games, the authorities continue to jail people who express independent or critical views in different parts of the country," the press freedom organisation said. "Whether it is a Mongol journalist or a writer in Hubei province, they are silenced with the same determination. Far from view, the repression continues as the games draw near."

Naranbilig, an independent journalist and human rights activist of Mongol origin, was arrested on 23 March at his home in Hohhot, the capital of the Inner Mongolia Autonomous Region. His family was not informed of his arrest until he was released on bail of 1,850 euros and placed under house arrest for one year beginning on 12 April. The police searched his home, confiscating his computer and many personal documents.

The author of dozens of books and essays about the Mongol minority, Naranbilig edited a monthly magazine called Golonte ("Family Hearth") that was banned in 2006 after only five issues. An ambassador of Mongol culture and traditions, he represented the Southern Mongolian nomad community in the World Alliance of Mobile Indigenous People (WAMIP).

According to the Southern Mongolian Human Rights Information Centre (SMHRIC), he was arrested in an attempt to suppress the issue of minorities in Inner Mongolia, as has already been done in Xinjiang, in the north, and Tibet, in the west. Inner Mongolia's leading political prisoner, the Mongol journalist Hada, has been detained since 1995 and is serving a 15-year sentence for "separatism" and "spying." His family recently complained about the appalling conditions in which he is being held and the deterioration in his health.

A writer and journalist aged 47, Zhou was arrested with his wife on 3 May in Zhongxiang, in the central province of Hubei, by the city's State Security Bureau. According to the Independent Chinese PEN Centre, a writers' association, he has not been seen since his arrest. His wife was released and placed under house arrest. It is impossible to reach their house by telephone.

Zhou was expelled from the Communist Party in 1992 after writing an article for a Voice of America publication. The authorities have often criticised him for raising social problems and government corruption in the hundreds of articles he has written. The Zhongxiang police say they have lots of evidence that would allow them to prosecute him on a charge of "inciting subversion of state authority."

Democratic presidential candidate Barack Obama has overtaken his rival Hillary Clinton for the first time in endorsements from super-delegates.
 
Four super-delegates - party and elected officials - pledged to support Mr Obama, including two who previously supported Mrs Clinton.
Mr Obama also has a strong lead in delegates won in state primary and caucus votes.
The Democratic super-delegates look set to decide who wins the nomination.
Added to the nine who came out in support of Barack Obama on Friday, he now has 275 super-delegates to Mrs Clinton's 271.
'Likely nominee'
Mr Obama won a convincing victory in Tuesday's North Carolina primary; while Mrs Clinton narrowly won in Indiana.
Six more states hold primaries before the Democratic Party officially declares at its nominating convention in August who will take on presumptive Republican candidate John McCain.
The nearly 800 super-delegates automatically attend the Denver convention and can vote for whomever they choose.
Mrs Clinton held a massive lead in super-delegate support before the party's first primary in Iowa in January.
But a string of wins for Mr Obama has convinced many of them to come out in his favour.
 
Unity stressed
On Friday, former Democratic US presidential hopeful John Edwards said that Mr Obama is now the party's "likely presidential nominee".
 
But he stopped short of actually endorsing Mr Obama.
 
With fears mounting that the long, indecisive campaign may be fatally dividing the party, both candidates have been careful to say that they will work to unify Democrats before November's election.
 
"I want to go into the general election... with the party unified and ready to take on what I think is a wrong-headed vision of where the country should go," said Mr Obama from Bend, Oregon.
 
Although Mrs Clinton has said the nominating race is not over, she also said Democrats would come together against the Republicans no matter who wins.
"What I hear and what I see is all about how we're going to finish this nominating contest which we will do," she said at a New York fund-raiser.
 
"Then we will have a nominee, and we will have a unified democratic party, and we will stand together and we will defeat John McCain in November and go on to the White House."
Mrs Clinton is favoured to win the next primary in West Virginia on Tuesday. Then Oregon and Kentucky vote on 20 May.
