Give credit where it's due: Hillary Clinton has shown grit and determination in finishing out the race. She has proved herself a strong campaigner. And in the week since West Virginia, she has stopped the cheap shots that had marred her campaign this year.
But Clinton has continued with one claim that could have a pernicious effect on the Democrats' chances in November. While she knows that the nomination is determined by delegates, Hillary insists on saying at every opportunity that she is winning the popular vote. And she has now taken to touting the new HBO movie "Recount," which chronicles the Florida fiasco of eight years ago. Everyone can agree that the primary calendar needs reform. But popular-vote pandering is poison for Democrats. For a party scarred by the experience of 2000, when Al Gore received 500,000 more popular votes than George W. Bush but lost the presidency, this argument is sure to make it harder to unite and put bitter feelings aside.
Oh, and it's not true.
Let me go through the numbers without making your head spin.
After Kentucky and Oregon, Obama has an official popular vote lead of 449,486.
This does not include Iowa (where Obama first broke from the pack), Nevada (where Hillary won the popular vote narrowly), Maine (where Obama won easily) or Washington state (another strong Obama state). Why? Because these caucus states don't officially report their popular votes. But if we're going to truly count all the votes, official and nonofficial, as Hillary advocates, you can't very well not include caucus states.
Adding in the unofficial tally from caucus states, as estimated by realclearpolitics.com based on official caucus turnout and the number of local delegates selected at the precinct level, that gives Obama a lead of 559,708.
Now we come to Florida and Michigan, whose popular votes Hillary says should be counted. The argument for counting them is no better than for counting the caucus states (and maybe worse, considering that these states violated party rules by moving their primaries up on the calendar, and no one campaigned there). But for the sake of argument let's count 'em. That gives Hillary a lead of 63,373.
HILLARY WINS POPULAR VOTE!
Not so fast. If the Democratic National Committee completes its expected settlement on May 31, Florida and Michigan will each get half of their votes counted. Translated to popular votes, that would subtract about 325,000 votes from Hillary, putting Obama back into the lead.
Beyond not being official numbers, there's another problem with counting Michigan in these totals. Obama wasn't on the ballot there. You can say this was his own choice, but that doesn't change the fact that had he been on the Michigan ballot he would have received a lot of popular votes. How many?
Try 238,168. That's the number of Michiganders who voted for "uncommitted." Were they possibly genuinely abstaining? Maybe a few hundred of them at most. The rest were clearly Obama supporters who launched a grass-roots campaign. Everyone in Michigan knew on January 15 that a vote for "uncommitted" was a vote for Obama.
That means that by a generous definition of popular votes (and remember, Clinton wants to enfranchise as many people as possible in her count), Obama leads by about 166,000 votes.
With a big win in Puerto Rico, Clinton could possibly erase that margin (plus several thousand more that Obama is expected to net in Montana and South Dakota). She could then proclaim that with the help of Puerto Rican voters who cannot vote in a general election, she is the popular vote winner.
The shorthand many Clinton supporters are already taking into the summer is that she won the popular vote but had the nomination "taken away" (as Joy Behar said on "The View") by a man.
What a helpful message for uniting the Democratic Party.
If the Obama people have any sense, they will demand in their negotiations with the Clintonites that Hillary cease and desist in her specious claim to have won the most popular votes.
Given that more than 35 million voters took part in the Democratic primaries and caucuses, the math games on both sides look awfully silly. Everyone should agree to call it a tie.

I'm 61. Have lived in USA since 1973 and nobody has ever shut my mouth or my children's mouth because they are not Traitors of USA like most Moslims like to be doesn't matter how good they are being treated, what kind of great jobs they find and how much they prosper beyond their own dreams.
 
You started criticizing me without understanding, what I wrote. No country can tolerate subversive Terrorist Activity in the name of eqality, Freedom of Speech and Expression. If you don't like it, go back ...!
Nobody's is forcing you to stay in a rich advanced country that is not yours to start with. Is there something wrong with becoming civilized and not being a thankless idiot or its part of your Islam to keep hating others?

Your comment is smart but lacks sensitivity.

Bangladesh has many problems and lack of human rights is one of them. No Hindu migrates to Bangladesh in search of safety and prosperity. We have a long way to go before that becomes a reality.

But the UK and US and most western countries  boast of high standard of human rights and freedom. We have immigrated to  these countries in search of  opportunities and  freedom.  You will feel the pain when your children grow up in this country, go to the university but are forced to keep their mouth shut (like the Hindus do in Bangladesh).

As parents, we have to ensure that our children are not  misdirected to do any thing to harm the society we live in but  also ensure that  we leave behind a society which is free  for them to pursue  freedom of thought.

Please do not jump to criticize what I wrote but give some thoughts.

We can't blame British for arresting those Moslim Students because if a Hindu Religious Terrorist Group was at war against Bangladesh and had published a Manual on how to commit acts of Terrorism in Bangladesh and some Hindu Indian student of Dhaka University had downloaded that Manual to distribute amongst Hindu Indian Students of Bangladesh, Bangladesh Police would have done the same.
 
I see, not infringement of Academic Freedom in U.K. in this case.

I'm writing to call your attention to a recent incident at the University of Nottingham, where a one of our Graduate Students at the School of Politics and International Relations and an administrative member of staff at the Department of Engineering were arrested by armed police under the Terrorism Act of 2000. Their alleged "crime" was that the graduate student had downloaded an Al-Qaeda training manual from a US government website for research purposes, as he's writing his MA dissertation on Islamic extremism and international terrorist networks. He had then sent this to his friend in the Department of Engineering for printing. The printed material had been spotted by other staff and reported to the University authorities who passed on the information to the police. The two were then arrested by armed police on May 14 and held for six days without charge, before being released without charge on May 20. During the six days they were imprisoned, the men had their homes raided and their families harassed by the police. It is worth noticing that in talking to one of my colleagues, a police officer remarked that the incident would never have occurred if the persons involved had been "blonde, Swedish PhD students" (the two men were of British-Pakistani and Algerian backgrounds respectively).

Needless to say, this raises hugely important issues both about academic freedom and civil liberties. Obviously, there is the issue that for those of us involved in research on contentious issues we will by necessity have to consult primary materials of a controversial nature, and the fact that the material is controversial should not lead to it being deemed as illegitimate research material. Moreover, we should not under any circumstances have to fear for infringements upon our civil liberties as a consequence of doing our jobs. Moreover, it goes without saying that the university should guarantee the academic freedom, freedom of speech and expression, and civil liberties of all members of staff and students, irrespective of ethnic and religious background or political beliefs!

I would be most grateful if you could circulate this e-mail as widely as possible in the interest of raising awareness and attention about this incident and the wider issues of academic freedom that it gives rise to, to as many of your friends and colleagues as possible! I would of course also be very grateful if any of you would be willing to write to the University of Nottingham to express your concern about this issue. If you are willing to do so, please contact me as soon as possible.

CARLSBAD, California (Reuters) - News Corp Chief Executive Rupert Murdoch on Wednesday predicted a Democratic landslide in the U.S. presidential election against a gloomy economic backdrop over the next 18 months.
Murdoch has yet to endorse a U.S. presidential candidate but considers Barack Obama very promising, the media magnate said in an interview by two Wall Street Journal reporters at an annual conference for high-tech industry insiders.
News Corp recently acquired ownership of the Journal and its parent company Dow Jones & Co.
"You have got the Obama phenomenon. You have got, undoubtedly, a recession ... The average American is really getting hurt financially and that all bodes well for him (Obama), Murdoch said.
"You have probably the making of a complete phenomenon in this country," Murdoch said in describing what he predicted will be a sweeping victory for Democrats in November.
The recent special election for a U.S. Congressional seat held by Republicans in Mississippi showed how powerless that party may be in the face of a rising political tide, Murdoch said. Democrat Travis Childers won the seat this month.
Murdoch said Obama and John McCain, the expected nominee of the Republican Party, both have a lot of problems, but McCain will be hurt by his party and his close ties to Washington. Race will be an issue for Obama, who would be the first black U.S. president, but "it looks like he overcomes that, overcomes that totally."
Murdoch is associated with conservative political views but has a reputation for a pragmatic streak in major national races where he has shown a willingness to switch sides when he detects major political changes afoot.
"I think it (a recession) is one we will be coming out of for quite some time," Murdoch said. "In the next 18 months, this country is going to be in for a very hard time."In the 2008 U.S. Presidential race, Murdoch said he is not yet backing anyone, but then quickly added: "I want to meet Obama. I want to know if he going to walk the walk." Murdoch said he had played a role in the endorsement by the New York Post, one of his global stable of papers, in endorsing Obama during the Democratic primary with Hillary Clinton in New York.

Politics, politicians and
the government

The detention of two former prime ministers by the military-driven caretaker government is a blot on our democracy. Clearly, the court and police are unwilling to consider their record as popular party leaders and their records of service to the people.
   The caretaker government's stance on the issue compromises its responsibility to uphold the rights guaranteed by the constitution. Every citizen has a right to speech and association and the government ought to protect these rights. They also have a right to a speedy and fair trial.
   As Bangladesh sets out to expand its influence in global affairs, its record on civil rights will increasingly be under scrutiny. No government can claim special powers and suspend civil rights like freedom of speech and association.
   The trial of the two former prime ministers has now started after a year they spent in prison. Scores of similar under-trial detainees are languishing in Bangladesh's makeshift jails. It just doesn't do any good to Bangladesh's brand image as a country that protects civil rights. Democracy enhances Bangladesh's soft power potential on the world stage. However, disregard for democratic rights will take the sheen off Bangladesh's patchy but promising record as a liberal democracy. Make a practice to judge persons and things in the most favourable light at all times, in all circumstances.

'Disillusioned' McClellan Defends Memoir

Former White House press secretary Scott McClellan today strongly defended his critical new book on the Bush administration, saying he became "disillusioned" as he realized he was a pawn in a larger political game.

McClellan, who has been harshly condemned as a turncoat by some of his closest friends and former colleagues, said in an interview on NBC's "Today" show that the book was intended to illustrate how a presidential candidate who vowed to change the culture of Washington failed to do so once he was elected.

Instead, McClellan says, President Bush stayed in a "permanent campaign culture" and allowed his staff to use misleading and incomplete information to "sell" the Iraq war to the American people.

McClellan told "Today" he hoped his message would resonate during the current presidential campaign season, when the major candidates are again emphasizing their desire to change the way Washington operates.

"The White House would prefer I not speak out openly and honestly about my experiences, but I believe there is a larger purpose," McClellan said in his first interview since the book's contents were reported earlier this week. "I had all this great hope that we were going to come to Washington and change it. Then we got to Washington, and I think we got caught up in playing the Washington game the way it is being played today."

McClellan, 40, was the ultimate Bush loyalist. He first went to work for George W. Bush when he was Texas governor in 1999, helped Bush gain the White House in 2000, and then came to Washington to defend the president for the next six years on such issues as the war in Iraq and Hurricane Katrina.

But the explosive book, "What Happened: Inside the Bush White House and Washington's Culture of Deception," alleges that the Bush administration waged a "political propaganda campaign" in favor of the Iraq war and bungled the response to the storm that devastated the Gulf Coast. The accusations are prompting a counterattack from some of his oldest political colleagues, who accused him of disloyalty and questioned his credibility.

Dan Bartlett, former counselor to the president, appeared on the "Today" show as well, and said many of McClellan's allegations don't ring true. "He talks about wanting to change the tone in Washington, and yet uses inflammatory terms like 'propaganda machine' and 'shading the truth,' " Bartlett said.

He said McClellan was only a deputy press secretary during the buildup to the Iraq war and did not have access to all the high-level discussions at that time. Bartlett also said McClellan offers little proof in his book to back up some of his charges and asked why McClellan did not question the actions of Bush and his top aides while he was still employed by the White House.

McClellan, in turn, said it took him some time after leaving the White House to come to terms with his experience there. When the Iraq war started, "my beliefs were different," he told "Today." "I trusted the president's foreign policy team and I believed the president when he talked about the great and gathering danger from Iraq. I believe the president believed it too. He had convinced himself.

"I don't think this is a book that I could have written two years ago," McClellan added. "[I] struggled as I went through this book process. I struggled to come to grips with how things went so badly off course."

Dana Perino, the current White House press secretary, said the president was "surprised" by McClellan's assertions. "He is puzzled, and he doesn't recognize this as the Scott McClellan that he hired and confided in and worked with for so many years," Perino said yesterday, adding that Bush was "disappointed that if he had these concerns and these thoughts, he never came to him or anyone else on the staff."

Former Bush political adviser Karl Rove compared McClellan to a "left-wing blogger." Several former Bush administration officials have written tell-all accounts. In one book published this month, retired Army Lt. Gen. Ricardo Sanchez accuses Bush and his top advisers of "gross incompetence and dereliction of duty" for their handling of the Iraq war.

But none was as close to Bush or his inner circle as McClellan, an amiable Texas native who was widely known for his cautious demeanor. He started out in politics by managing several state election campaigns in the 1990s for his mother, who became Texas comptroller, and was recruited to the governor's mansion by Bush confidante Karen Hughes.

Ari Fleischer, who served as White House press secretary before McClellan took over in 2003, said he first met McClellan in Austin in 1999 when the two worked on the Bush presidential campaign.

"That's one of the reasons this book comes as such a shock," Fleischer said. "It comes from the last person that anyone would have thought would have said these things or written these things. . . . All you can do is scratch your head when you see how far he's turned."

Trent Duffy, who worked as McClellan's deputy for more than two years, said of the avid University of Texas sports fan: "Tomorrow maybe we're going to learn he's rooting for the Oklahoma Sooners."

"Here's a man who owes his whole career to George W. Bush, and here he's stabbing him in the back and no one knows why," Duffy said. "He appears to be dancing on his political grave for cash."

McClellan suggests in his preface that he expected a negative reaction. "My friends and former colleagues who lived and worked or are still living and working inside that bubble may not be happy with the perspective I present here," he wrote.

In the book, McClellan says he retains great admiration for Bush but portrays the president as stubborn and isolated. Calling the Iraq war "unnecessary" and a "strategic blunder," McClellan alleges that senior administration officials began a campaign in 2002 to "aggressively sell the war," even as he and other officials insisted that all options were on the table.

He also accuses Rove of misleading him about the leak of a CIA officer's name, and he suggests that Rove and former vice presidential adviser I. Lewis "Scooter" Libby may have improperly met to discuss the case. Perino and other officials sharply criticized that assertion yesterday.

When he was press secretary, McClellan made some of the same arguments against other ex-officials that he now faces. In 2004, for example, former counterterrorism adviser Richard A. Clarke published a book sharply critical of Bush's anti-terrorism policies.

"Why, all of a sudden, if he had all these grave concerns, did he not raise these sooner?" McClellan said. "This is 1 1/2 years after he left the administration. . . . He is bringing this up in the heat of a presidential campaign. He has written a book, and he certainly wants to go out there and promote that book."

Dhaka, May 29 (bdnews24.com) – The Islamic Constitution Movement in talks with the government Thursday demanded trial of alleged 1971 war criminals.

The Islamist party demanded elections to local government bodies ahead of the national polls and a parliament seat to be preserved for the national mosque's khatib, the chief cleric.

An 18-point proposal the party presented at the dialogue includes relaxing emergency rules and identifying and preparing lists of "corrupt people and criminals".

Party chief Mufti Syed Rezaul Karim led the ICM delegation to the talks at the Chief Adviser's Office.

ICM asked the government to be careful in listing war criminals to protect innocent people from prosecution. It added that those who sheltered, nurtured and formed political alliances with the "war criminals" should also be prosecuted.

After the dialogue, ICM secretary general ATM Hedayet Uddin told reporters that they had asked the government to relax the emergency rule for enabling everybody to hold free and fair elections.

"We asked the government to identify criminals and corrupt people in all the 300 electoral seats and publish their particulars, so that people may be warned against these people and the listed bad guys might not become active again before the forthcoming elections."

"We've stressed the need for foiling foreign interference in our domestic affairs."

Hedayet said the ICM delegates spoke about the need for bringing a "qualitative change" to the country's politics.

ICM proposed that a separate Shariah Bench might be constituted to foil any attempt at desecrating the diktats of Islam by taking advantage of religious misinterpretations.

ICM had been involved in April clashes over a proposed women development policy with police near Baitul Mokarram mosque, which left at least 200 people injured.

Briefing reporters, education and commerce adviser Hossain Zillur Rahman said: "Our discussion with ICM has been quite open and cordial at the same time. They stressed effecting qualitative changes in our political arena and we endorse that fully."

The adviser hope that a specific way-out would emerge in the process of dialogue and said: "ICM recommended reforming the election processes. A long-term plan may be considered."

The next round of dialogue will resume on June 2. The government will also hold talks with businessmen on June 3 instead of June 5 as earlier scheduled, at the Chief Adviser's Office.

The businessmen's session will be attended by about 300 delegates representing all districts, which is being coordinated by the FBCCI, the apex trade body.

The government dialogue with political parties began on May 22 with a first meeting with the Workers Party of Bangladesh.

60 years of human rights failure - Governments must apologize and act now

Amnesty International today challenged world leaders to apologize for six decades of human rights failure and re-commit themselves to deliver concrete improvements.

"The human rights flashpoints in Darfur, Zimbabwe, Gaza, Iraq and Myanmar demand immediate action," said Irene Khan, Secretary General of Amnesty International, launching AI Report 2008: State of the World's Human Rights.

"Injustice, inequality and impunity are the hallmarks of our world today. Governments must act now to close the yawning gap between promise and performance."

Amnesty International's Report 2008, shows that sixty years after the Universal Declaration of Human Rights was adopted by the United Nations, people are still tortured or ill-treated in at least 81 countries, face unfair trials in at least 54 countries and are not allowed to speak freely in at least 77 countries.

"2007 was characterised by the impotence of Western governments and the ambivalence or reluctance of emerging powers to tackle some of the world's worst human rights crises, ranging from entrenched conflicts to growing inequalities which are leaving millions of people behind," said Ms Khan.

Amnesty International cautioned that the biggest threat to the future of human rights is the absence of a shared vision and collective leadership.

"2008 presents an unprecedented opportunity for new leaders coming to power and countries emerging on the world stage to set a new direction and reject the myopic policies and practices that in recent years have made the world a more dangerous and divided place," said Ms Khan.

Amnesty International challenged governments to set a new paradigm for collective leadership based on the principles of the Universal Declaration of Human Rights.

"The most powerful must lead by example," said Ms Khan.

  • China must live up to the human rights promises it made around the Olympic Games and allow free speech and freedom of the press and end "re-education through labour".
  • The USA must close GuantÙ„namo detention camp and secret detention centres, prosecute the detainees under fair trial standards or release them, and unequivocally reject the use of torture and ill-treatment.
  • Russia must show greater tolerance for political dissent, and none for impunity on human rights abuses in Chechnya.
  • The EU must investigate the complicity of its member states in "renditions" of terrorist suspects and set the same bar on human rights for its own members as it does for other countries.

Ms Khan warned: "World leaders are in a state of denial but their failure to act has a high cost. As Iraq and Afghanistan show, human rights problems are not isolated tragedies, but are like viruses that can infect and spread rapidly, endangering all of us."

"Governments today must show the same degree of vision, courage and commitment that led the United Nations to adopt the Universal Declaration of Human Rights sixty years ago."

"There is a growing demand from people for justice, freedom and equality."

Some of the most striking images of 2007 were of monks in Myanmar, lawyers in Pakistan, and women activists in Iran.

"Restless and angry, people will not be silenced, and leaders ignore them at their own peril," said Ms Khan.

The Rule of Law in Afghanistan

One tough question remains, however: can the rule of law and the separation of powers be introduced in Afghanistan? The international community has made doing so a priority.

 

SAN-Feature Service : Three distinct judicial systems are in force in Afghanistan: the official courts, the traditional jirgas and Islamic scholarship. The country's constitution stresses the importance of international standards such as the UN's Universal Declaration of Human Rights, while jirgas and religious leaders largely ignore them.

 

News out of Afghanistan is usually bad, whether it is about the tenuous security situation or the unrelenting influence of warlords and drug barons. The Afghan government is still struggling to assert its authority, and it continues to lose legitimacy.

 

Although there is positive news, it gets far less attention. Examples include the growing number of girls going to school, construction of hospitals and roads or the implementation of irrigation and drinking-water projects. Moreover, the Afghan people support such efforts by the international community, at least in the provinces in Afghanistan's northeast and north.

 

One tough question remains, however: can the rule of law and the separation of powers be introduced in Afghanistan? The international community has made doing so a priority. But achieving these goals will not only depend on a judiciary that is independent and free of corruption. It is also crucial that every citizen be allowed access to the courts, regardless of their family background, gender or income. Moreover, the courts' jurisdiction will have to be recognised as binding. None of these conditions are met in Afghanistan yet.

 

Traditional conflict resolution

 

Historically, Afghans hardly ever experienced an independent judiciary. While they are loyal to their families, village or their ethnic groups, Afghans are not loyal to the state. Therefore, Afghanistan can hardly be considered a single nation – even King Zahir Shah never controlled the entire country during his reign from 1933 to 1973.

 

Civil and criminal cases are usually adjudicated by traditional means, regardless of where the case is being heard or which ethnic group is involved. Jirgas, as traditional councils of elders are called, decide 70 to 80 % of all cases. Sometimes, these councils seek the advice of religious leaders. On the other hand, even state courts sometimes refer cases to jirgas. Doing so may serve peace in the short term, but it also proves that Afghans remain deeply suspicious of the state-run judicial system. Indeed, the official judiciary is prone to let cases pend for many years. Furthermore, many people believe that it takes bribes to get favourable rulings from the judges.

 

Traditional conflict resolution, however, has several drawbacks. One of them concerns women in rural areas. For two reasons, they frequently cannot invoke their rights:

– Many women do not know what their rights are, neither under the constitution nor under Islamic Sharia law

– Women may only appear before jirgas in the company of men, so they cannot receive any direct legal assistance. The sole exception is in a few districts in Badakhshan Province, home to the Ismaelites.

 

A further problem is that traditional conflict resolution is based upon customary law and Sharia law, both of which are often at odds with the Afghan constitution and its emphasis on the legally binding nature of the UN human rights charter. Members of jirgas tend to disregard these principles.

 

For instance, child marriage is still common, though banned under the secular constitution. But as child marriage has been the norm so far in rural areas such as Kunduz Province, that area's spiritual leader, the maulawi, considers the practice legally binding. He says that the people do so too, and that the tradition is therefore legitimate.

 

Another widespread tradition is the practice of compensation, according to which a woman or a girl can be "handed over" to another family that has been the victim of a crime. If a man murders the member of another family, he may, for instance, be required to turn his sister over to that family as a kind of reparation for the crime. This practice obviously violates basic human rights and, accordingly, the constitution of the country. Nonetheless, such compensations still occur, and particularly so in regions with majority populations of Ismaelites, Pashtuns or Tajiks.

 

Examples like these illustrate that customary and Sharia law can undermine the state's authority to mete out punishment. Many people, especially those living in rural areas, still neither trust state institutions, nor do they know much about them. Warlords and drug barons, who stack the jirgas with their followers so they can assert their interests in the event of land disputes, for instance, are particularly troublesome.

 

It would be difficult to combine all three judicial systems. They are often in conflict, even though the constitution states that all rules, laws and provisions have to be consistent with Sharia law. But state judges and prosecutors have only limited knowledge, if any at all, of traditional and Islamic law, in case they studied secular law.

 

There are two ways to study law in Afghanistan. There are the Sharia universities that teach traditional and religious law, whereas secular law is taught at the "Faculties of Law and Political Sciences" at the universities (for instance in Kabul and Mazar-i-Sharif). Only recently did the government start to draft a unified law curriculum.

 

It is quite difficult to find qualified lawyers in Afghanistan. There are some, but they usually work for international non-governmental organisations. These NGOs pay much higher salaries than the government. Judges earn only between $ 60 and $ 90 a month – whereas NGOs pay lawyers between $ 900 and $ 1,200 dollars a month. Organisations based in the USA frequently pay even more.

 

There are far too few female lawyers in Afghanisaten, and far too few female judges. Only three women justices work in the four northern provinces of Balgh, Kunduz, Tahar and Badakshan. Women, whom rural traditions already put at a disadvantage, suffer the consequences. Experience shows that women are rarely able to obtain a divorce from a jirga, even though Sharia law allows that to happen. But that law is nearly impossible to enforce; after all, women are not allowed to appear before a jirga on their own.

 

Things are difficult for women even before state-run courts. It is considered indecent to speak of marital problems in front of someone of the opposite sex, and the judges are almost always men.

 

Women empowerment

 

The greatest obstacle women face, however, is their lack of knowledge of the law. That is the starting point for many Afghan NGOs. They offer workshops to boost the level of women's education. Workshops that deal with topics like health, child rearing or sewing also tackle legal issues. Women need their husband's permission to take part in such events, and some even obtain permission from the local mullah. NGOs often stage meetings with men in attempts to convince them of the workshops' importance. The mullahs play a special role: they can use Friday prayers to disseminate the message.

 

Afghanistan's Department of Women's Affairs has affiliated offices in all provincial capitals. This is where one does find women who are well versed in legal matters and who can provide advice to their fellow countrywomen. Sometimes, they assist women in the courtroom. It would probably make sense to support for these offices, especially at the district level. That way, women who lack money or have not obtained permission could still get advice, without having to travel to the provincial capital.

 

Schools – and in particular girls' schools – are probably the most effective place to boost legal awareness. Several approaches for doing so have been developed. What matters now is that teachers become more aware of rule-of-law issues. NGOs are organising relevant workshops too. However, principals at girls' schools complain that they have had to obtain permission from both the fathers and the mullahs for the girls to attend relevant lessons.

 

These are long-term suggestions on how to improve the legal situation for women in Afghanistan. Old-fashioned ways of thinking must be overcome – ways of thinking that are deeply entrenched and span several generations. But if Afghanistan is to develop a democratic legal system, then the country's people will have to develop a sense of justice.—SAN-Feature Service Courtesy : Qantara.de
