Exploitation in Kuwait needs international attention

A 2,300-member of Bangladesh Army contingent served with coalition forces during the first Gulf war (August 2, 1990-February 28, 1991), a war between Iraq and a coalition force from 34 nations authorized by the United Nations in order to return Kuwait to the control of the Emir of Kuwait.
 
In acknowledgement of their effort, around 267,000 Bangladeshis have been treated savagely, maligned in the local press, and unduly blamed for criminal activities. During the demolitions of mines from many parts of Kuwait after Gulf war, Bangladesh lost 59 soldiers and many were injured, but about 1,100 Bangladeshi workers, who primarily work as menial laborers, have been kicked out of the Arab state since last July.
 
While each and everyone throughout the world, media groups, human rights organizations, or even some of Kuwaiti citizen and human rights groups, who believes everyone should be treated kindheartedly, were worried of unjustly and cruelly deporting some of Bangladeshi expatriate workers, the Kuwaiti government did little to enforce its own labor laws or put an end to rampant abuse and exploitation of hundreds of thousands of guest workers rather saying that they didn't want unnecessary international attention.
 
The trouble began in the last two weeks of July. Thousands of Bangladeshis and other South Asian migrants (from Nepal, India, probably Pakistan, etc.) employed as cleaners, rubbish collectors and stevedores/dockers, went on strike over a long list of grievances: poor wages, poor working conditions, overtime without pay, lack of sick leave and time off, etc. The workers also claim that employers force workers to pay extra for health and accommodation — costs they say should be borne by the companies.
 
Due to rising inflation, workers attempted to protest only to be met with the full force of the Kuwait government which does not enjoy anyone daring to oppose those in power. The Kuwaiti Police along with the army beat the trapped workers mercilessly while breaking up the protest and also in detention centers.
 
So far in progress, Kuwait ordered its law enforcers not to arrest or harass any Bangladeshi workers if they refrain from getting involved in any further violence. According to a handout press note issued by the Press Information Department on August 03, 2008, the labor department of Kuwait assured Bangladesh government that the wages and other outstanding payments of the deported workers would be sent through the Bangladesh embassy. And as of August 20, 2008, the Kuwaiti government closed down five companies for violating the new labor law.
 
But evidently, very little has changed since the Kuwaiti government decided, in the wake of the July 28 demonstration by migrant workers that the private sector would have to increase the minimum wage for workers to 40 Kuwaiti dinars per month and also bear the workers' insurance, housing, and health expenditures.
 
According to the Arab Times, a Kuwaiti English-language daily, around 6,000 Bangladeshi workers went on strike on August 17, 2008 over non-payment and unlawful deductions of their salaries although the Kuwaiti government recently set a minimum monthly wage to be paid without any curtail. Meanwhile, the National Labor Committee of US recently unveiled news of mistreatment from the U.S. military base Camp at Arifjan, Kuwait. Around 300 guest workers, mostly Bangladeshi, are forced to work 11-hour shift, seven days a week.
 
Although the US troops themselves are very kind and decent to the workers, but the company "Kuwait Waste Collection and Recycling Company," the workers work for, is too rude to its employee. For the 70 hours of work, workers are usually paid just $34.72 a week, or 50 cents an hour, which is 45 percent short of the 90-cent-an-hour wage workers, are guaranteed when they purchased the contract to work in Kuwait. The company usually confiscates the passports of their workers at the time of hiring.
 
Observing the mass exploitation in Kuwait, Charles Kernaghan, director of the National Labor Committee, urged the secretary of state Condoleezza Rice to call upon the Government of Kuwait to end the trafficking of hundreds of thousands of foreign guest workers to Kuwait, where they are stripped of their passports, forced to work long hours, often seven days a week, while being cheated of half their wages. According to him, Kuwaiti Government must take it seriously if the US will raise strong voice against heinous practice of exploitation as there is a defense pact between US and Kuwait to guarantee the security of the Kuwaiti people and government.
 
Bangladesh, a net oil importing country, has a demand for nearly 3.8 million tons of petrol per year, including 2.8 million tons diesel. Not only the Bangladeshi workers, who remit about $1 billion every year to Bangladesh, but also the Kuwait Petroleum Corporation (KPC), a state-owned company of the Kuwait government is the main oil supplier to Bangladesh. Bangladesh is importing import 1.152 million tonnes of oil from Kuwait for consumption over the July-December period by paying a higher premium. In his upcoming visit to Kuwait in between September 3 and 4, foreign affairs adviser, Iftekhar Ahmed Chowdhury, also in charge of the expatriates' welfare and overseas employment ministry, should strongly protest against mass exploitation in Kuwait and mention that a good bilateral relation depend upon mutual cooperation.
 
Bangladesh should also announce greater regulation of labor brokers' practices. Despite its complete disinterest in ever previously regulating or limiting workers' exploitation by local recruiting agents, the country is in need to resolve the labor unrest and repair the damaged reputation of their migrant workforce; over 5 million Bangladeshis work abroad, mostly in Saudi Arabia and other Middle Eastern countries, sending home around $8 billion a year and providing a vital foreign exchange injection to Bangladesh's economy. This is almost as much as the $9 billion the country's other main export - ready made garments - brings into the country.
 
In its further action, Kuwait has decided not to renew residency visas of Bangladeshis doing menial jobs, saying these workers are a threat to state security and bring unnecessary international focus on the country. Mistreatment of South Asian workers especially Bangladeshis are nothing new in the Gulf States. Kuwait and the Gulf nation's infrastructure were built by these workers from South Asia. Kuwaitis owe their liberation to the coalition forces which included Bangladeshi soldiers.
 
It's not only a matter of country's remittance inflow, but also a matter of country's dignity. Bangladesh government's move on the migrant workers' issue reflects its "bowing-down" policy as the government hardly raised a voice of protest, nor did it file any formal complaint with the Kuwaiti authorities. Let alone bring the issue to the notice of the International Labor Organization, the United Nations, European Union, the United States, and other human rights organizations in the world.

[mukto-mona] Some of the facts that I would like Mr. Ray and Dr. Das to consider

I agree with Mr. Sankar Kumar Ray, this debate between him and Dr. Kamal Das has been "pushed astray to a ludicrous extent." I can clearly see that Mr. Ray and Dr. Das both have read a lot more of history than I have. However, I can also see that none of these gentlemen are expert historians. Yet the arguments of "this authority is right, that authority is wrong" keep going, with a certain amount of personal attacks.

 

Much of the focus of this debate has been about the wealth of Bengal in the eighteenth century, and how much of that the British stole. The way I see it, the question of how bad was it for Bengal that Siraj was defeated by the British can not be addressed properly by looking at the wealth and its stealing issue.

 

Here are some of the facts that I would like Mr. Ray and Dr. Das to consider:

 

1)      The Hindu Caste System is going away, albeit too slowly.

2)      Treating of women as nobody by her own rights has been going away from India. (Even in my childhood, the vast majority of women were best known as being someone's daughter, sister, wife, mother, etc., with hardly any identity of their own).

3)      Hindu female children did not inherit any property from her parents, unless if all her siblings were female. Muslim female children get a fraction of the male children from the parents. I believe there have been some improvements there for the Hindu women; I am not sure to what extent.

4)      The life of the average Hindu widow in India is still too much of a misery.

5)      Democracy and human rights are alien concepts in virtually everywhere in the world where the Muslims are in power.

 

Now, I would like Mr. Ray and Dr. Das to debate on which of the above points Siraj's survival in 1757 would have improved human life in the land that is the Indian sub-continent today.

Thanks a lot for your comment on my article. Yes, the idiocy and
fanaticism do not reside to any domain of particular religion, it
has been spread irrespective to race and culture. To be frank, I
have seen a lot of dark side in the `advanced world' of the west.
Some of these you have already mentioned. Bonna and I once wrote an

"Famous Shah Abdul Hannan", a former member of Pakistan Customs and Excise
Service ( or is it Taxation) service, the former Deputy Gover of Bangladesh
Bank. If you are I have nothing to say to you. If your not that famous
person I will only say " Andho Holey Ki Proloy Bondho Thakey!"

Mr. Hannan,

You said "For me what is important is that no body can be blamed for

In other words, to a razakar sympathizer like you, all the crimes
committed by these lowest form human beings against other human beings
have to be forgotten or not talked about just because there was no

Unless a person was totally blind or an idiot, it was clear what was
happening during the liberation war. Anyone who supported or gave
assistance to Pakistani army along with the one who actively
participated in these crimes are of to be treated with the same
contempt. I have seen you defend these criminals on tv not too long
ago. In my book, you are no better than these criminals and you will
not get any respect from me.

Reporters Without Borders deplores yesterday's raid by members of the counter intelligence agency on the home of Shujaat Bukhari, The Hindu daily newspaper's correspondent in Srinagar. Bukhari, who was not at home at the time, was told by his family that the agents were looking for two Kashmiri leaders.

No newspapers are on sale in Kashmir for the third day running as a result of a curfew imposed by the authorities to prevent demonstrations.

I actually agree with Shah Abdul Hannan here, when he says, "nobody can be blamed for any criminal activity if there is no case against him in the court", particularly because the person in question here, Abul Kalam Azad, has not been taken to court by anyone while 37 years have passed after the alleged crimes.
People like Jamal Hasan (who started this thread) need to stop making worthless noise about the so-called war-criminals. Calling people like Abul Kalam Azad "a despicable war criminal", is worth nothing when the so-called pro-liberation intellectuals, politicians and governments do not do anything meaningful to bring the criminals to justice. Instead of calling the criminals "despicable", Mr. Hasan and others should call the so-called pro-liberation forces spineless, irresponsible, and devoid to the true senses of honor for the nation of Bangladesh. If they had the sense of honor and conviction, many of the war-criminals would have been punished long time back.

Depositions and statements recorded in over 40 cases from across the country

 

 

Interim observations:

 

The testimonies showed that a large number of innocent young Muslims have been and are being victimized by the police on the charge of being involved in various terrorist acts across the country. This is particularly so in Maharashtra, Gujarat, Madhya Pradesh, Andhra Pradesh and Rajasthan, though not limited to these States.

 

In most of the cases, the persons picked up are not shown to be arrested by the police until many days after their arrest in gross violation of the law. Their families are also not informed about their arrest. In many cases, they have been tortured in Police custody and made to "confess" and sign blank papers. The police has been often humiliating Muslim detenues on the ground of their religion. The testimonies show widespread communalization of the police across states in the country.

 

In most of these cases, the Courts are routinely allowing police remand and not granting bail, merely on the police statements that they are required for further investigation. They do not examine whether there is any evidence against the accused. Unfortunately, the media too uncritically publicizes the charge and allegations leveled by the police. This has resulted in the destruction of the lives and reputations of a large number of persons so picked up by the police who have later been found to be innocent.

 

When the police chargesheets the victims, the trials go on almost interminably during which poor victims are virtually defenceless since they are often not even able to get lawyers. In some cases, Bar Associations have been preventing lawyers from appearing on behalf of persons accused by the police of such terror offences. However, though this is gross contempt of Court, the Courts have not taken action against such Bar Associations and lawyers who are coercing other lawyers in this manner.

 

Even when the victims are acquitted or discharged on being found innocent, they are not compensated for the destruction of their lives and reputations. Even when the case against the victims is found to be totally cooked up, no action is being taken to hold the concerned police officials accountable. This has led to an impunity among the police officials as a result of which they are casually and callously picking up and victimizing innocent persons, particularly Muslims, sometimes to extract money from them.

 

It was been reported by the victims that those citizens who are picked up by the police officers for interrogation and are subject to repeated harassment and torture, are implicated in false cases even after release or acquittal and are further subjected to mental and physical torture.

 

Unfortunately, the Courts are going along with this behaviour of the police and are virtually ignoring allegations of torture in police custody. Hardly anyone is being held accountable for the torture and third degree methods that are being routinely practiced in police and even in judicial custody.

 

Unfortunately, the Human Rights Commissions which should have taken suo moto cognizance of such victimization and violation of human rights of these people have by and large been treating even complaints about this with casual indifference. They either do not take up such cases on the ground that they are the subject matter of court proceedings or just ask for a routine police report without getting any independent investigation done on such serious charges of human right violations.

 

This victimization and demonisation of Muslims in the guise of investigation of terror offences, is having a very serious psychological impact on the minds of not only the families of the victims but also other members of the community. It is leading to a very strong sense of insecurity and alienation which may lead to frightful consequences for the nation.

 

Interim Recommendations

  1. State Human Rights Commission and National Human Rights Commission and State Minority Commission should take up such matters seriously and should come to independent finding itself and awarding adequate compensation in suitable Cases.  It should not wait for somebody to approach the commission but should take action Suo-moto .  They should utilize their own agency to find out the truth. The malafide prosecution of innocent persons is also a serious violation of Human Rights which must be vigourously pursued by the Human rights Commissions.
  2. The courts must not routinely grant police or judicial custody but must examine at that stage whether there is any credible evidence against the accused. The Courts should keep in mind that no reliance should be placed on the alleged confession of the accused even for consideration of bail/remand.
  3. Whenever any person is released by the police for want of evidence against him the Courts should award adequate compensation for the destruction of his life and reputation. In such cases the courts should examine if the prosecution was malafide, and if it is so found, the police officials involved must be held accountable and the compensation payable to the victim must be recovered from the officers concerned.
  4. Cr.P.C should be amended to make it obligatory on the Courts to award adequate compensation to the innocent victim who is discharged or acquitted due to lack of evidence or was falsely implicated.
  5. There ought to be separate department/wing for investigation who should be given specialized training on modern scientific basis, in line with the recommendations of the National Police Commission, duly endorsed by the Supreme Court. Independent police complaints authorities must be immediately set up at all levels in line with the Supreme Court's judgment in the Police Reforms case.
  6. The trial courts be provided with a medical officer who can immediately examine any accused complaining of torture in Police or judicial custody. The courts must immediately, on any complaint being made, order such examination and take stringent action if the allegation is found true. The number of Trial courts must be greatly increased to ensure speedy conclusions of Trials. Investigations must also be concluded within the shortest possible time and extensions of time must not be routinely given. An adequate cadre of competent defence lawyers must be created to defend those accused who cannot afford their own lawyers. An independent statutory office of public prosecutors must be created.
  7. The Police during interrogation or investigation cannot get blank papers  signed by the accused; Police officers found indulging in such practice must be severely punished. Narco analysis is a psychologically and physically third degree method of investigation which is not even scientifically proven. It must not be allowed on persons particularly without consent.
  8. Persons including officials of Bar Associations seeking to prevent lawyers from representing accused persons must be hauled up for Contempt of Court for interfering with the adminstration of Justice.
  9. Special sensitization programmes should be organized for the Judiciary and Police regarding Human Rights.
  10. The Governments should provide adequate compensation to the relatives of the person who died due to police firing at Mecca Masjid.  No discrimination should be made based on religion or caste or place of residence.  Employment should also be provided to the dependents of the deceased.
  11.  The Media, both Print as well Electronic should be very careful not to publicize mere allegations or claims of the police which can irreparably damage reputations of innocent persons without subjecting them to basic scrutiny.
  12. In cases where all the bread earners of a family have been arrested by the police, the families of the victims, especially minor children and desolate women are rendered penniless and helpless and are driven to starvation. In such cases, until and unless the accused are convicted by courts, the State must provide regular financial help to the extent that the education of children is not disrupted and the family is not starved.
  13. India must immediately sign the International Criminal Court Treaty known as the Rome Statute which has been signed by most countries.                    anhad.delhi@gmail.com

A promoter of Indian hegemonism in Bangladesh

I refer to the article in NFB titled "The Intellectual Blueprint of the Neo-Razakars" by Sohail Tajul Islam, published on August 25, 2008 in the Reader's Opinion section. The writer introduced himself as a student of Imperial College, London: (E Mail:

sohailtaj2008@gmail.com).

To Sohail Tajul Islam, any one who stands for the independence and sovereignty of Bangladesh is a 'neo-rajakar'. He has listed many writers and newspapers as anti-India and to whom, in his opinion, his title of 'neo-rajakar' applies. It is possible that he has been prompted by his backers from dark corners to produce this list. However, anti-hegemonism is not the same as anti-India, and anti-imperialism is not the same as anti-America, and any conscious person should steadfastly struggle against imperialism, hegemonism, inequality and exploitation.

Without going into details, it needs to be mentioned that we wanted independence for one reason, but India wanted to divide Pakistan for another reason, with their ulterior motive of reducing Bangladesh to a vassal state and finally annexing it to India as a dependent state. Sohail Tajul Islam wants us to be grateful to India for 1971 and he then, what is more, wants us to surrender our independence to India. But what has he got to say about the plunder of Bangladesh by India after 16 December 1971, the permanent massive damage to Bangladesh by Farakka barrage, the raising of Rakkhi Bahini who ruthlessly massacred 30 thousand patriots (half of them of JSD) and established a reign of terror to bring Bangladesh to its knees in front of India, the killings of hundreds of villagers at the border, the uneven trade of India with Bangladesh with which billions of dollars are being plundered by India from Bangladesh every year, etc., etc.? How is Bangladesh going to be compensated for the losses of these valuable lives, the massive permanent damages and the huge plunders? But as regards the people of India, we of course promote the people-to-people solidarity between all the countries of the world and we support the struggles for the emancipation of the people in all countries.


Sohail Tajul Islam also terms the book, "The India Doctrine" edited by Barrister MBI Munshi, as "The Intellectual Blueprint of the Neo-Razakars". He offers neither arguments nor logic, but dishes out abusive expressions and personal attacks.


There cannot be any doubt that Sohail Tajul Islam is a promoter of Indian hegemonism in Bangladesh. Actually he goes more than most in his submission, and he invites others to submit, to his hegemonic masters when he concludes: "It is without doubt India that will emerge as the regional superpower and elites in Pakistan and Bangladesh better come to recognize that reality or both countries will suffer the consequences. Both Pakistan and Bangladesh are too weak and internally divided to pose a threat to India's rise so why foster dreams based on an ill-conceived religious division which has done more harm than good. The meaning of Islam is submission so both countries should gracefully submit!" No doubt he is a promoter of "Akhand Bharat" (undivided India), which MBI Munshi and other writers of the book, The India Doctrine, have taken pains to explain precisely the concept of and the Indian operations thereof since 1947.


Thus, according to Sohail Tajul Islam, the two-nation theory, on the basis of which British India was partitioned was "an ill-conceived religious division which has done more harm than good" and that both Bangladesh and Pakistan should submit their independence to India!! And in his supreme wisdom (!), he says: "The meaning of Islam is submission so both countries should gracefully submit!"


After this, the writer could be totally ignored and brushed off. But for the sake of our respected and patient readers, and for the sake of the writer too, a few points need to be mentioned. Firstly, weak nations can certainly defeat strong nations. It is the weak nations who smashed colonialism to smithereens! Again, weak nations like Vietnam, Iraq, Afghanistan, many countries in Latin America and many other countries of the world have defeated imperialism. So, threat to other countries of South Asia about the potential super power of India is futile and counter-productive in a world, where weak nations refuse to be cowed down even by the hyper power, the USA. On the other hand, India is beset with huge problems of poverty, inequality and strife, which are no better than the situation in Bangladesh.

Secondly, it was over-riding socio-economic and political necessities with the tag of 'two-nation theory' which led to the partition of British India. Even the Communist Party of India (CPI) in 1942 supported the movement for Pakistan i.e., supported the partition of British India on the basis of 'two nation theory'. As Sohail Tajul Islam is a college student, he can study these in detail, and of course CPI is no less secular than what he professes to be as his main contention. Just a reminder to him that secularism is not the same as servitude or prostrating to Indian hegemonism.


Thirdly, when he says, "The meaning of Islam is submission so both countries should gracefully submit" (their independence to India), he distorts and abuses the 'meaning' of Islam. He has actually insulted a faith, without understanding the implication of what he is saying. He seems to be utterly confounded in his thoughts on religion. One should be very careful about making any statement about any religion. "Islamic theology says that all of God's messengers since Adam preached the message of Islam—submission to the will of God" (Wikipedia). So, it is submission to the will of God, not to the devil of Indian hegemonism!

Fourthly and finally, I assume Sohail Tajul Islam is a normal-age college student and not what is termed as a 'mature student'. So, at his formative tender age, I will not describe him as a national-traitor or accuse him of insulting religion, except that I will take him to be grossly misguided by vested interest groups. I think it would be right to give him a stark warning that unless he makes amends and cleans up his ways and comes out of the network of RAW, he will be destined to reap the bitter harvest of the wrath of the people of Bangladesh as well as the wrath of the right-minded people of India and other peoples of South Asia, however endearing his writings may be to the hegemonists of India and their lackeys in India, Bangladesh and elsewhere in South Asia or rest of the world.
