Another proof of Jamat - BNP corruption


The Canadian oil and gas company, Niko Resources Ltd has been fined more than $9 million after it admitted in a Canadian court that it had bribed former Bangladesh state minister for energy 0f BNP - Jamat JOT AKM Mosharraf Hossain (Ex husband of Ershad's girlfriend, Jinat Mosharraf) with the use of a vehicle and a trip to North America.

The Canadian oil and gas company pleaded guilty yesterday to providing goods or services "to influence the acts or decisions of a foreign state," the Associated Press reports from Calgary, Canada.


The fines total 9,499,000 Canadian dollars (US$9,750,794)


The value of access to the vehicle, a Toyota Land Cruiser, was 190,984 Canadian dollars (US$196,046) and the value of travel was 5,000 Canadian dollars (US$5,132).


The company agreed to a statement of facts read in court.


The bribes were made after explosions at one of Niko's natural gas fields --Tengratila in Bangladesh -- resulted in protests in a nearby village and elevated concerns about the environment surrounding the property, reports AP.

BNP - Jamat JOT minister AKM Mosharraf (Ex husband of Ershad's girlfriend, Jinat Mosharraf) had received a luxury car from Niko Resources which was blamed for the Tengratila gas field explosion early January 2005.


The Tengratila blowout damaged at least 10 billion cubic feet (BCF) of gas worth $2.5 million, apart from severely damaging the geological zone.

[ALOCHONA] Corrupt BNP Minister

Canadian oil and gas company to plead guilty to bribery

Calgary-based Niko Resources will admit in court Friday that it bribed
a Bangladeshi minister with the use of a vehicle and a trip, the oil
and gas company announced Thursday.

The development comes after a six-year RCMP probe into allegations
that a government official was offered goods and services by the
company in an attempt to "induce that official to influence the acts
or decisions" of the state.

According to a news release issued by the company on Thursday, Niko
was indicted for offering the official the use of a car and a paid
trip to Canada and the U.S., in contravention of Canada's Corruption
and Foreign Public Officials Act.

Niko Resources and the Crown prosecutor will make a joint sentencing
recommendation in court Friday, the release said.

The company has agreed "to enter a guilty plea to a single charge,
which is expected to resolve all matters investigated by the RCMP."

Company officials and the RCMP could not be reached for comment on
Thursday night.

In 2009, the company announced the RCMP was investigating allegations
that Niko or one of its subsidiaries "may have made improper payments"
to government officials in Bangladesh.

That same year, anti-corruption watchdog Transparency International
called Canada a "laggard" in enforcing an international anti-bribery
convention devised in 1997 under the Organization for Economic
Co-operation and Development.

To that point, only one Canadian firm, Hydro Kleen, had been fined
$25,000 for bribing a U.S. customs agent.

Niko Resources has oil and gas operations in Bangladesh, India,
Pakistan, Kurdistan, Indonesia, Madagascar and Trinidad.

The company has been involved in Bangladesh for more than a decade,
and struck pay dirt in 2002 participating in a joint venture with
India-based Reliance Industries in the D6 block off the east coast of
India.

The site turned out to be the largest natural gas discovery of its
time, with an estimated 40 trillion cubic feet of in-place reserves.

Bangladeshi TV channels blocked in India

Indian government is continuing an unwritten ban on allowing
Bangladeshi television channels from entering their domestic cable
network, thus depriving millions of Bangla speaking population in that
country from watching Bangladeshi programs, especially drama and music
videos, which are considered to be top favourite to India's Bangali
[Bangla speaking] population. On the other hand, Bangladesh has
adopted a very liberal policy in allowing foreign television channels,
including most of the Indian channels [even some regional language
channels] and have not only allowed them in Bangladeshi cable network,
but also, each month Indian channels are earning significant amount of
revenue, both by selling advertisements as well as subscription to
Bangladeshi entrepreneurs and households.

According to a recent statistics availed by a team of Weekly Blitz,
Indian channels are earning millions of dollars every year from
Bangladeshi cable operators. Below is the chart of monthly revenue
earned by the Indian channels from Bangladesh:

Bangladesh also freely allows more than 180 regional and international
channels on country's domestic cable network, which includes HBO,
ESPN, NGC, Discovery, BBC, CNN, Al Jazeera, NDTV, DW, Fox, VOA,
France24, MGM, TVC, TNT, Cartoon Network, RAI etc. India though allows
most of the international channels within its domestic cable network;
it continues to stop Bangladeshi channels from entering the same
network, for reason unknown.

It may be mentioned here that, currently there are several Bangladeshi
channels, which are continuing broadcast mainly via Telstar-10
satellite, while some are also using other satellites. The Bangladeshi
channels on satellite are: BTV-World, BTV-Sangshad, Channel-I,
ATN-Bangla, ATN-News, Diganta TV, NTV, Boishakhi TV, Bangla Vision,
RTV, ETV, DESH TV, Mohona TV, Independent TV, Maasranga TV, My TV,
GTV, Channel 9, Shomoy TV, Bijoy TV etc.

Bangla drama, soap opera and music videos, especially folk songs are
extremely popular amongst the Bangla speaking population in India.
Some Indian traders are trading in audio and video CDs of Bangla
drama, soap opera and music videos, which have high demand in India.

Commenting on the current ban on Bangladeshi channels from entering
Indian cable network, an Indian journalist on condition of anonymity
told Weekly Blitz, Indian government fears that Bangladeshi TV
channels may contain anti-Indian propaganda as well as instigative
messages to various separatist groups inside India.

"We all want to see Bangladeshi TV channels, but we fear such channels
may contain anti-Indian propaganda", the source said.

On the other hand, an owner of a Bangladeshi TV channels said, "We
never allow any negative propaganda against India or any foreign
nation. Bangladeshi channels are already available on major cable
networks in United States, Europe and the Middle East. We never heard
any such complaint of any Bangladeshi channel airing anti-Indian
campaign. This must be a lame excuse of the Indian authorities for
stopping Bangladeshi channels from reaching the Indian viewers."

Commenting on the existing ban on Bangladeshi TV channels from
entering Indian cable network, eminent researcher of Sufi music as
well as popular Sufi singer, Fakir Shabuddin said, "As far as folk and
Sufi songs are concerned, Indian listeners are definitely interested
in such songs from Bangladesh. Whenever we go abroad for shows, we
hear requests from expatriate Indians in foreign countries for singing
Bangla Sufi songs. As a singer, I would humbly request the Indian
government to allow Bangladeshi channels in reaching millions of
Bangla speaking viewers in that country."

Rahman Mustafiz, popular news reporter in Bangladesh said, "None of
the Bangladeshi TV channels have any anti-Indian agenda. Authorities
in New Delhi should not unnecessarily continue ban on Bangladeshi
channels, just on the basis of mere speculations or doubts."

Eminent Bangladeshi music director Milton Khandekar said, "As we are
already watching Indian channels in Bangladesh, we also have the equal
right of showing our channels to the viewers in India. As an
individual, I do believe that, India, being the largest democracy in
the world will withdraw such unkind decision on Bangladeshi TV
channels."

Illegal Proceeds from Foreign Bribe Payments

WASHINGTON—The Department of Justice has filed a forfeiture action
against accounts worth nearly $3 million that are alleged to be the
proceeds of a wide-ranging conspiracy to bribe public officials in
Bangladesh and their family members in connection with various public
work projects, Acting Assistant Attorney General Matthew Friedrich of
the Criminal Division announced today.

The forfeiture action was filed Jan. 8, 2009 , in U.S. District Court
in the District of Columbia against funds located in Singapore held by
multiple account holders. The forfeiture complaint relates primarily
to alleged bribes paid to Arafat "Koko" Rahman, the son of the former
prime minister of Bangladesh , in connection with public works
projects awarded by the government of Bangladesh to Siemens AG and
China Harbor Engineering Company. According to the forfeiture
complaint, the majority of funds in Koko's account are traceable to
bribes allegedly received in connection with the China Harbor project,
which was a project to build a new mooring containment terminal at the
port in Chittagong , Bangladesh .

"This action shows the lengths to which U.S. law enforcement will go
to recover the proceeds of foreign corruption, including acts of
bribery and money laundering," said Acting Assistant Attorney General
Matthew Friedrich. "Not only will the Department, for example,
prosecute companies and executives who violate the Foreign Corrupt
Practices Act, we will also use our forfeiture laws to recapture the
illicit facilitating payments often used in such schemes."

Siemens Aktiengesellschaft (Siemens AG), a German corporation, and
three of its subsidiaries pleaded guilty on Dec. 15, 2008 , to
violations of and charges related to the Foreign Corrupt Practices Act
(FCPA). Specifically, Siemens Bangladesh admitted that from May 2001
to August 2006, it caused corrupt payments of at least $5,319,839 to
be made through purported business consultants to various Bangladeshi
officials in exchange for favorable treatment during the bidding
process on a mobile telephone project. At least one payment to each of
these purported consultants was paid from a U.S. bank account.

According to the forfeiture complaint, the bribe payments from Siemens
AG and China Harbor Engineering Company were made in U.S. dollars, and
the illicit funds flowed through financial institutions in the United
States before they were deposited in accounts in Singapore , thereby
subjecting them to U.S. jurisdiction. Money laundering laws in the
United States cover financial transactions that flow through the
United States involving proceeds of foreign offenses, including
foreign bribery and extortion.

In August 2006, the President announced a National Strategy to
Internationalize Efforts Against Kleptocracy to fight high-level
corruption around the world. This strategy combines the policy and law
enforcement tools of several federal agencies, including the
Departments of Justice, Treasury, State and Homeland Security.

The case is being prosecuted by Deputy Chief Linda Samuel and Trial
Attorney Frederick Reynolds of the Criminal Division's Asset
Forfeiture and Money Laundering Section. Additional assistance was
provided by the Criminal Division's Office of International Affairs.
The case was investigated by the FBI's Washington Field Office in
cooperation with Bangladeshi law enforcement.
