[ALOCHONA] Hanging of Zia/Moeen/Ershad/Ghatak Mushtaque




In a watershed judgment, the Bangladesh Supreme Court ruled that Bangabandhu--not Zia- proclaimed the republic's independence on March 26, 1971. It also ordered cancellation of 15-volume war documents that portray Zia as the declarer of independence. The Liberation War affairs ministry brought out the publications during the BNP-Jamaat-led alliance government in June 2004. The Apex Court said the government could take action against those liars who sought to rewrite history. Bangladesh Supreme Court has also declared that the governments between August 15, 1975, and April 9, 1979, of Mir-Jafar Mushtaque, Justice Sayem, and Gen Zia were illegal and without lawful authority. In my opinion, the Apex Courts Judgment opens the door for the prosecution of the dictators--Gen Zia, Gen Moeen, Justice Sayem, Mir-Jafar Mushtaque, Gen Ershad, and Iajuddin. They can be tried under the High Treason (Punishment) Act of 1972 for subverting the Constitution deserving death penalty. Every action taken by them is illegal, unconstitutional, and unlawful. In plain English—Zia was an illegal president. Every action, including his decision to form BNP is also illegal. The HC in its verdict said the constitution does not permit anyone to assume power by any means other than the ones mentioned in it. If anyone does so, it will amount to sedition. Act of Sedition is punishable by death. To join the ranks of civilized nations, we must establish the rule of law. From this day forward, our justices must enforce the law and hang those who usurp the power through illegal means. Once we fully execute this law, no one in the future will dare subverting the constitution. In another bold move, the Justices today established their supremacy over the Chiefs of Army, Navy and Air force.  One giant step towards the establishment of rule of law and order.
