The Romans were the first to codify a constitution as far reference goes. Medina thing came far later in the middle ages. Please do not make things up, bro. Give the credit to the people where it is due. Thank you.

If that is the case (অনেকে এটাকে পৃথিবীর প্রথম লিখিত সংবিধান বলেও মনে করেন), then why can't we implement this Madinah Sanad in Bangladesh? Is there any better constitution, laws than the ones Prophet Muhammad (pbuh) used to Govern?Shaheen

সুপ্রিম কোর্ট প্রতিবেদক বিডিনিউজ টোয়েন্টিফোর ডটকমPublished: 2013-04-11 19:18:39.0 GMT Updated: 2013-04-11 19:18:39.0 GMTজামায়াতের গঠনতন্ত্র মদিনা সনদের সঙ্গে সাংঘর্ষিক বলে দাবি করেছেন ব্যারিস্টার তানিয়া আমীর।জামায়াতের নিবন্ধন নিয়ে বিচারপতি এম মোয়াজ্জাম হোসেন, বিচারপতি এম ইনায়েতুর রহিম ও বিচারপতি কাজী রেজা-উল-হকের বেঞ্চে বৃহস্পতিবার শুনানিতে তিনি এ কথা বলেন।আদালত আগামী ১৬ এপ্রিল পরবর্তী শুনানির দিন রেখেছে।তানিয়া আমীর বলেন, "জামায়াত নিজেদেরকে ইসলামের সোল এজেন্ট বলে বলে বেড়ায়। তারা কাদিয়ানিদেরকে মুসলমান মনে করে না। বিভিন্ন সুফী সাধকদেরকে মুসলিম বলে মনে করে না। কিন্তু তাদের সংবিধান ইসলামের প্রথম সংবিধান মদিনা সনদের সঙ্গে সাংঘর্ষিক।""মদিনা সনদ ইসলামের প্রথম সংবিধান। অনেকে এটাকে পৃথিবীর প্রথম লিখিত সংবিধান বলেও মনে করেন। ইসলামী আইন বিশেষজ্ঞদের মতে, মদিনা সনদের সঙ্গে সাংঘর্ষিক কোনো কিছু ইসলামিক হতে পারে না।"তিনি আরো বলেন, "জামায়াত বলছে তারা এ দেশে ইসলাম কায়েম করবে। কিন্তু প্রশ্ন হলো, তারা কখন, কোথায় ও কীভাবে ইসলাম কায়েমের এই দায়িত্ব পেয়েছেন?"শুনানির সময় নির্বাচন কমিশনের পক্ষে অতিরিক্ত অ্যাটর্নি জেনারেল এমকে রহমান এবং জামায়াতে ইসলামীর পক্ষে অ্যাডভোকেট আশিকুর রহমান আদালতে উপস্থিত ছিলেন।এদিকে রিট আবেদনের শুনানি সামনে রেখে অতিরিক্ত অ্যাটর্নি জেনারেল এম কে রহমানের কাছে রুলের জবাব পাঠিয়েছে নির্বাচন কমিশন, যা এম কে রহমান বৃহস্পতিবার আদালতে উপস্থাপন করেন।ইসির আইন শাখার যুগ্মসচিব এন আই খান জানান, নবম সংসদ নির্বাচনের আগে যে সামাজিক-রাজনৈতিক অবস্থা ছিল তা বিবেচনায় রেখে দেশে-বিদেশে সবার কাছে গ্রহণযোগ্য নির্বাচন উপস্থাপনের জন্য জামায়াতকে নিবন্ধন দেয়া হয় বলে উল্লেখ করা হয়েছে রুলের জবাবে।বাংলাদেশ তরিকত ফেডারেশনের সেক্রেটারি জেনারেল সৈয়দ রেজাউল হক চাঁদপুরী, জাকের পার্টির মহাসচিব মুন্সি আবদুল লতিফ, সম্মিলিত ইসলামী জোটের প্রেসিডেন্ট মওলানা জিয়াউল হাসানসহ ২৫ জন ওই রিট আবেদন করার পর ২০০৯ সালের ২৭ জানুয়ারি হাই কোর্ট একটি রুল জারি করে।একটি রাজনৈতিক দল হিসাবে নির্বাচন কমিশনে বাংলাদেশ জামায়াতে ইসলামীর নিবন্ধন কেন আইনগত কর্তৃত্ব বাহির্ভূত এবং গণপ্রতিনিধিত্ব আদেশের ৯০বি(১)(বি)(২) ও ৯০(সি) অনুচ্ছেদের লঙ্ঘন ঘোষণা করা হবে না- তা জানতে চাওয়া হয় ওই রুলে।জামায়াতের আমির মতিউর রহমান নিজামী, সেক্রেটারি জেনারেল আলী আহসান মো. মুজাহিদ এবং নির্বাচন কমিশন সচিবকে ৬ সপ্তাহের মধ্যে এর জবাব দিতে বলে বিচারপতি এম বি এম খায়রুল হক ও বিচারপতি মো. আবদুল হাইয়ের বেঞ্চ।পরে রুলটি বিচারপতি এ এইচ এম শামসুদ্দিন চৌধুরীর নেতৃত্বাধীন বেঞ্চে যায়। সেখানে আংশিক শুনানির মধ্যেই ওই বেঞ্চে এখতিয়ার পরিবর্তন হয়ে যায়।ওই রিটের বাদি পক্ষের আইনজীবী ব্যারিস্টার তানিয়া আমীর এর আগে বিডিনিউজ টোয়েন্টিফোর ডটকমকে বলেন, "২০০৯ সালে রুল জারি হলেও এখন পর্যন্ত বিবাদীর কারো জবাব আমরা হাতে পাইনি। তবে রুল শুনানি পর্যায়ে জামায়াতের পক্ষে খন্দকার মাহবুব হোসেন ও ব্যারিস্টার আব্দুর রাজ্জাক ওকালতনামাও দাখিল করেছিলেন।"রিট আবেদনে বলা হয়, চার কারণে জামায়াত রাজনৈতিক দল হিসাবে নিবন্ধন পেতে পারে না।প্রথমত, জামায়াত নীতিগতভাবে জনগণকে সকল ক্ষমতা উৎস বলে মনে করে না। সেইসঙ্গে আইন প্রণয়নে জনপ্রতিনিধিদের নিরঙ্কুশ ক্ষমতাকেও স্বীকার করে না।দ্বিতীয়ত, গণপ্রতিনিধিত্ব অধ্যাদেশ অনুসারে কোনো সাম্প্রদায়িক দল নিবন্ধন পেতে পারে না। অথচ কাজে কর্মে ও বিশ্বাসে জামায়াত একটি সাম্প্রদায়িক দল।তৃতীয়ত, নিবন্ধন পাওয়া রাজনৈতিক দল ধর্ম-বর্ণ-লিঙ্গের কোনো বৈষম্য করতে পারবে না। কিন্তু জামায়াতের শীর্ষপদে কখনো কোনো নারী বা অমুসলিম যেতে পারবে না।চতুর্থত, কোনো দলের বিদেশে কোনো শাখা থাকতে পারবে না। অথচ জামায়াত বিদেশের একটি সংগঠনের শাখা। তারা স্বীকারই করে তাদের জন্ম ভারতে। বিশ্বজুড়ে তাদের শাখা রয়েছে।সম্প্রতি সারা দেশে জামায়াত নিষিদ্ধের দাবি আবারো জোরালো হয়ে ওঠায় আবেদনকারীরা আবারো মামলাটি শুনানির জন্য নিয়ে আসেন। পরে প্রধান বিচারপতি বেঞ্চ নির্ধারণ করে দেন।
