[ALOCHONA] Re: Minister for amending religious laws



It is shocking that Law Minister Shafique Ahmed quoted to have stressed the need for amending the existing religious laws to establish the rights of women as well as real religious rules. Even the British during their 200 years of rule had allowed the Muslim to use the Qur'anic law of inheritance. Mr. Ahmed made an enormous comment that challenges the divine decree relating to law of inheritance.

There is more to this divine law that includes the members of the whole family of the deceased than the simple son-daughter's portion of inheritance mentioned by the law minister.

This divine law also permits writing living wills of a significant portion of the properties by an individual. Mr. Ahmed should consult a
Muslim scholar of jurisprudence before he made such an ignorant anti-Islamic statement regarding the Quranic injunction about the law of inheritance. Allah in his infinite mercy and with his infinite wisdom has prescribed these laws for all time and space. The simple reason for a higher portion for a son's is, in an Islamic society a son has to take care of his own family as well as his paternal family which includes his siblings and his surviving mother. A daughter does not carry any such responsibility.

If the society followed Allah's decree regarding distribution of wealth such as zakat and other laws regarding individual responsibility; women and girls would not be abused and treated unfairly rather they would be treated like our mothers, sisters and daughters. If our leaders were God fearing and conscious about answering to Allah on the Day of Judgement regarding their election promise of alleviating the suffering of the people, the society would be prosperous and very few would fight to become the elected officials. Leaders would have to answer big-time on judgement day regarding all those abused, homeless, unjustly treated and hungry people.

I would advise Mr. Ahmed to study in-depth the total package of the Muslim inheritance law before making such a blunderbuss comment. He should apologize to the Muslims for his ignorant comments

"Religious laws have been sometimes denying the religious rules in many ways. In real sense, many laws could not support the holy Quran and Islami sharia," he said.As per advises and recommendations from the religious leaders, the new laws could be announced to eliminate discrimination against women, said the minister.

"Society, religions, and laws aim the welfare of people. Half the society's population is women. I never think the people will oppose the announcement of new laws for their welfare." Shafique Ahmed said the government will consider all logical recommendations to reduce violence against women.

He said if the women can attain economic self-sufficiency through proper education, the violence against women would be reduced a great deal.The law minister was addressing a workshop titled "Implementation of 'CEDAW' for reducing violence against women (ICRVAW) project." Legislative and parliamentary affairs division of the ministry and the UN Women jointly organised it at Cirdap auditorium in the city yesterday.

Prof Dr Shawkat Ara Hossain, chairperson of political science department of Dhaka University, read out the keynote paper. Legislative and Parliamentary Affairs Secretary Mohammad Shahidul Haque chaired the workshop addressed also by State Minister for Law Qamrul Islam and UN Women's national programme manager Naheed M Ahmed.

Shafique also said, "The state-religion Islam and secularism is not contradictory in the constitution. As per the verdict of court, the constitution is being reprinted."He told reporters that the constitution will be placed in parliament as per the recommendations by the special committee formed to install the 1972 constitution.

State Minister for Law Qamrul Islam stressed the need for changing the Muslim Inheritance Law to establish equal rights of Muslim women on father's property.
