Murshidabad gets a Nawab again, but fight for assets ahead
The Supreme Court, in a judgment on August 13, declared 72-year-old Syed Mohammed Abbas Ali Meerza the successor and legal heir to the last Nawab of Murshidabad, Waris Ali Meerza, ending a bitter succession dispute that has been raging since 1969.
Justice Ranjan Gogoi and Justice R K Agrawal have directed that Abbas Ali Meerza, son of Syed Md Sadeque Ali Meerza, is the direct descendant of the second son of the original Nawab. "Being the successor and legal heir, I believe I am the Nawab Bahadur now," Abbas Ali Meerza told TOI.
By dint of the verdict, Abbas Ali Meerza can now claim to be the descendent of Mansur Ali Khan, the independent ruler of Bengal, Bihar and Orissa in the year 1891. With the advent of British Rule, he entered into an agreement on March 12, 1891. According to it, the royal properties were to be enjoyed by the Nawab Bahadur and his heirs and successors in perpetuity. The only significant change was that instead of being regarded as the Nawab Nizam of Bengal, Bihar and Orissa, the title would henceforth be Nawab Nizam of Murshidabad.
The first Nawab Nizam of Murshidabad died in 1908 and was succeeded by elder son Wasif Ali Meerza, the second Nawab Nizam. After his death in 1959, his eldest son Waris Ali Meerza became the third Nawab Nizam of Murshidabad. The latter died 10 years later without any children to succeed him. Two claimants emerged for the title and the enormous estate — Abbas Ali Meerza and Wasif Ali Meerza.
While Abbas Ali Meerza claimed to be the legal representative on the basis of being the son of the daughter of the second Nawab Wasif Ali Meerza, Sajid Ali Meerza claimed he had the right on the basis of being the son by muta marriage of second Nawab Wasif Ali Meerza. Muta marriage is a private and verbal short-term marriage recognized in Islam.
The apex court felt that Abbas Ali Meerza also had a claim as the son of Syed Md Sadeque Ali Meerza, who married the only daughter of the second Nawab. It was her brother Fateyab Ali Meerza who had moved Calcutta high court, challenging the Murshidabad Estate (Management of Properties) and Miscellaneous Provisions Act, 1980, introduced by the Left Front government.
Though this law, the entire property of Murshidabad Estate was transferred to the state government by virtue of Section 3 of the Act. The high court had ruled that Fateyab Ali Meerza had no locus standi to file the case, prompting him to move Supreme Court. After his death in 1998, Abbas Ali Meerza and Sajid Ali Meerza claimed they were the legal heirs, leading to the dispute.
Abbas Ali Meerza, who is now in New Delhi to obtain the court order, said: "I am very happy with this order. This sets to rest all dispute over succession."
But the Lalbagh resident, who retired as an Urdu teacher in 2000 from Krishnanagar Collegiate High School, has another battle ahead — to reinstate the case against the state's annexation of the Murshidabad Estate. "I will continue to fight for our legal rights," he said, buoyed by the recent victory.

কলকাতা : বাংলার শেষ স্বাধীন নবাব সিরাজউদৌল্লার সঙ্গে বিশ্বাসঘাতকতা করেছিলেন মীরজাফর। সেই থেকে ভারতবাসীর কাছে ধিক্কৃত চরিত্র হয়ে রয়েছেন তিনি। আর তার বংশধরদেরও সেই গ্লানি নিয়ে দিন কাটাতে হচ্ছে। তবে মুর্শিদাবাদের নবাবী খেতাব ফিরে পাবার জন্য মীর জাফরের বংশধররা আদালতে যে দীর্ঘ আইনি লড়াই চালাচ্ছিলেন তাতে তাদের জয় হয়েছে। তারা ফিরে পাচ্ছেন নবাবী খেতাব। আসলে বিশ্বাস ঘাতকতার পুরস্কার হিসেবেই লর্ড ক্লাইভ মীরজাফরকে মুর্শিদাবাদের নবাবের আসনে বসিয়েছিলেন। সেই সময় বৃটিশ পার্লামেন্টে মীর জাফরের পরিবারকেই নবাবের স্বীকৃতি দিয়ে বছরে এক লক্ষ ৮৫ হাজার রুপি ভাতা বরাদ্দ করা হয়েছিল। আর ১৯৬৯ সালে কলকাতায় মারা গিয়েছিলেন মুর্শিদাবাদেরর শেষ নবাব ওয়ারিশ আলি শাহ। এই সময়ই ভারত সরকার মুর্শিদাবাদের নবাবের উত্তর সুরী কে তা জানতে বিজ্ঞপ্তি জারি করেছিল। এর কিছুদিনের মধ্যেই পশ্চিমবঙ্গের বামফ্রন্ট সরকার হাজার দুয়ারিসহ মুর্শিদাবাদের নবাবের সব সম্পত্তি অধিগ্রহন করে নেয়। নবাবী খেতাবও হারান মীর জাফরের উত্তরসূরীরা। তবে খেতাব ফিরে পাবার জন্য মীর জাফরের উত্তরসুরিরা আদালতে লড়াই জারি রেখেছিলেন। সেই লড়াইয়ে সুপ্রিম কোর্ট তাদের পক্ষেই রায় দিযেছে। বুধবার সুপ্রিম কোটের বিচারপতি রঞ্জন গগৈ ও কে আগরওয়ালের বেঞ্চ মীর জাফরের বংশধরকেই নবাবী খেতাব ফিরিয়ে দিয়ে রায় দিয়েছেন। এই রায় জানার পর শেষ নবাব ওয়ারিশের ছেলে ফতেয়ার আলি মির্জার ভাগ্নে আব্বাস আলি মির্জা জানান, এই স্বীকৃতিটুকু আদায়ের জন্য বহু লড়াই করেছি। এই স্বীকৃতি আমাদের পূর্বপুরুষের আত্মাকে শান্তি দেবে। অবশ্য সুপ্রিম কোর্টের এই রায়ের পর মীর জাফরের বংশধররা হাজার দুয়ারির প্রাসাদ, ইমামবাড়া , মতিঝিল, ওয়াসিম মঞ্জিলের মত ঐতিহাসিক সৌধগুলির দখল তারা পাবেন কিনা তা এখনও স্পষ্ট নয়।
