[ALOCHONA] Re: [KHABOR] Outgoing CJ Karim slated at farewell : We Feel Bad

The utterances  by AG did not sound like a prudent or erudite or sophisticated Lawyer. Rather he proved to be sounding like the illiterate person who does not have iota of knowledge or practice how to speak in farewell and also respect an elderly, senior and that too was holding highest Judicial post.

Friends, must be aware that his(AG) ruthless inhuman utterances while objecting Bail Petition for Babar wherein he said that let the defendant die than come sue the government. How insane and insular statement by the person who is suppose to be vanguard of constitutional right of the people??????

Actually it is not his fault it is way he and party behaved all through since inception. They only believe in "Ami ar Amar Mamura" and also beleive that other then them none has any right whatsoever to a civil, safe and peaceful life. This is the reason people are losing respect as well as trust on the government organs and the politicians. None of the political parties are free from such accusations in succession.

Outgoing CJ Karim slated at farewell : We Feel Bad

Attorney General Mahbubey Alam yesterday blamed outgoing Chief Justice Mohammad Fazlul Karim of violating the constitution by not administering oath to two high court judges appointed by the president. In a written statement, he said Justice Fazlul Karim has satisfied a section against the Liberation War through violating the constitution. The attorney general placed the statement while according farewell to Justice Fazlul Karim at court No-1 of the Appellate Division of the Supreme Court yesterday afternoon. The chief justice goes into retirement today.Justice Fazlul Karim in his speech at the farewell ceremony said he had tried to ensure justice for all and decided cases in a manner where his constitutional duty and moral obligation towards the rule of law were upheld. On April 11 this year, Justice Fazlul Karim refused to administer oath to Ruhul Quddus Babu and M Khasruzzaman as additional High Court judges along with 15 others appointed by the president."You (Fazlul Karim) have clearly violated the constitution day after day by refraining from administering oath to the judges and you are even going into retirement amid such situation."The government could have taken appropriate constitutional steps against you, but it refrained from that considering the dignity and importance of the chief justice's office," the statement read."You did not even request the president to amend the gazette notification on appointments of the two judges," said Mahbubey Alam.He said President Zillur Rahman saved Justice Fazlul Karim an uneasy situation by appointing him as the chief justice since he (Fazlul Karim) had earlier been superseded four times. The attorney general said the chief justice also had not taken any measures regarding some BNP lawyers' unwarranted comments against two judges of a High Court bench over the hearing of the case in connection with the cantonment residence of BNP Chairperson Khaleda Zia.He also mentioned that the chief justice's sitting over the allegation of anomalies in the apex court although a two-member committee formed by the then chief justice Md Tafazzul Islam had placed a probe report to Fazlul Karim. In his defence the attorney general added that he had made the comments on Justice Fazlul Karim so that no one disregards the constitution in future. Justice Fazlul Karim said, "In my crisscross journeys from Panchagarh to Teknaf and Satkhira to Sylhet, I tried to establish accountability in the lower judiciary," he added.Fazlul Karim said during his tenure as the chief justice, several false and motivated news reports were published. "Although, I was in possession of unassailable evidence to contradict the reports, I maintained dignified silence befitting the office of the chief justice," he said, adding that fortunately the newspapers retracted their false allegation. He also said, "We must appreciate and recognize the role media is playing in establishing vigorous, open, accountable and vigilant democracy."Justice Karim concluded his speech saying that he had failings, deficiency and shortcomings, but those were unintentional.Almost all the judges of the Appellate and High Court divisions, SCBA leaders, senior lawyers of the Supreme Court and state law officers were present at Justice Fazlul Karim's farewell ceremony.

We have also come to serious reaction of the Supreme Court Bar and senior advocates. They consider such a statement as most disgraceful in the farewell ceremony. He could say all thes things in a letter to the Chief Justice when he was in office or later  but this was not the occasion. We also were not satisfied with all his judgements, particularly on the fifth amendment of the constitution case but this does not mean that we ignore his qualities of head and heart and his sincerety.
