Any old civic organization is not ONE and the SAME as a registered political party of a country. How many times does one have to point that out?
Religion-based political party is a logical impossibility in a democracy, as I spell it out below. The Indian Constituent Assembly in 1947 made the attempt to prohibit religion-based political party from its Constitution. The move failed due to Hindu Mahasabha manipulation (which managed to insert a ban on "cow slaughter"). It was Mr. T. N. Haskar who encouraged Bangladeshi Constituent Assembly members in 1972 to accomplish what Indian Constitution could not. A clause was included in Article 12 which prohibits the formation of a political party based on any particular religion, caste or creed in the Bangladesh Constitution, 1972.
Why Jamaat must be banned as a political party in Bangladesh
1) A political party based on religion is propositioned on the principle that all those outside the party are excluded from the 'religion' or, considered lesser members of that religious community. Thus an Islamic political party is already a betrayal of both the fundamental ideal of "equality of all believers in the eye of Allah" and the democratic principle of freedom of religion (meaning free to practice religion without any political binding).
[The point was made stark and clear in 1992 Presidential election in the USA. The Republicans tried to paint the Democrats as godless. "I did not hear one word at their Convention", said George H. W. Bush running for re-election, "and that word is G-O-D". Next day the National Council of Churches vehemently rebuked the statement, "It is sacriligeous to claim God belongs to one party, or God prefers one political party over the other."]
2) Religion is not the same as a political ideology, here today and gone tomorrow. Neither is it a fixed, monolithic, unchangeable, unvaried institution. A big religion like Islam has various sects, sub-sects, and local groupings. When Jamaat-i-Islami claims to be adhering to ONE and only one form of Salafi/Wahhabi Sunni Muslim school then it ceases to be representative of other groups of Muslims nurtured by centuries of beliefs and regional practices. It is precisely in this sense of ONE fixed idea at its core that makes Jamaat resemble a fascist organization. As a fascist organization it has engaged in killing Muslims of other sects by the thousands.
3) Islam is not a clergy-oriented religion and has no central authoritative body (like the Vatican in Catholic Christianity) dictating its norms and rules. Wahhabism is a diabolically manipulated diversion from this core principle in Islam. Its ignominious political origin in 18th century Arabia is well-known and it its propagation as the only "pure Islam" is downright kufri and sinful. A political party based on these ideas is, therefore, un-Islamic and undemocratic.
Jamaat-i-Islam MUST be BANNED in Bangladesh in order to SAVE ISLAM in Bangladesh.

I think there should be ONE law for all parties. If they have criminals among them, they should be charged and punished (If found guilty). Jammat should be given the same treatment.
History tells us banning any organization does not help. In fact it makes them more popular. I was told that, our own dictator Ershad was not very popular in his native Rangpur during his term but he became very popular after he went to jail.
Generally Jammat have few followers but it seems so much talk about them is making them even more popular and they should thank BAL for that. They were given more attention than their major rival BNP. I just don't know why is that.

Stubborn ignorance is a prerogative of the educated and the semi-literates.
There is a difference between an "organization" and a registered political party that participates in elections. If the party manifesto of a political party is vehemently opposed to, or violates, the foundational democratic principles of the Constitution of a country, then that political party is simply not eligible to participate in the democratic process.
The Constitution is the highest law of the land. If the party manifesto violates any part of the Constitution then it is an "illegal" party. What is so difficult to understand? Any illiterate in Bangladesh understands this rule.
Ask an American friend whether s/he thinks the Constitution is something you can mock and play around and ignore at no peril.

I would like to practice as I preach. I do not believe in banning any organization whether they believe in constitution or not. As long as the organization is not preaching violence against the law abiding citizens of Bangladesh or foreigners, I got no problem with them. Let them participate in a democratic election and let voters decide their fate. If the party looses election and uses religion or race to create violence, let law enforcement department to deal with them.

বিশেষ প্রতিনিধি ॥ জামায়াতে ইসলামীর গঠনতন্ত্র দেশের সংবিধানের সঙ্গে সাংঘর্ষিক দাবি করে দলটির নিবন্ধন বাতিলের দাবি জানিয়েছেন দেশের সংবিধান প্রণয়ন কমিটির অন্যতম সদস্য ও আন্তর্জাতিক খ্যাতিসম্পন্ন আইনজ্ঞ ব্যারিস্টার এম আমীর-উল-ইসলাম। তিনি বলেন, আমাদের রাজনীতি করতে হলে সংবিধানের প্রতি অনুগত থাকতে হয়। কিন্তু জামায়াতের গঠনতন্ত্র সংবিধান পরিপন্থী। তাই ওরা দেশে যেভাবে নৈরাজ্য সৃষ্টি করছে, তাতে আজ পরীক্ষা-নিরীক্ষা করার সময় এসেছে তাদের রাজনৈতিক নিবন্ধন থাকবে কি না।
শুক্রবার সকালে ঢাকা রিপোর্টার্স ইউনিটি মিলনায়তনে শহীদ নূর হোসেন দিবস উপলক্ষে বঙ্গবন্ধু একাডেমী আয়োজিত 'জামায়াত-শিবিরের তা-ব : যুদ্ধাপরাধী বিচারে বাধা, খালেদা জিয়ার দেশে-বিদেশে ষড়যন্ত্র' শীর্ষক আলোচনাসভায় তিনি এ কথা বলেন। অনুষ্ঠানে অন্য বক্তারা যেখানে জামায়াত-শিবির সেখানেই প্রতিরোধ করার ঘোষণাও দেন। বঙ্গবন্ধু একাডেমীর উপদেষ্টা শেখ মোঃ জাহাঙ্গীর আলমের সভাপতিত্বে সভায় আরও বক্তব্য রাখেন আওয়ামী লীগের সভাপতিম-লীর সদস্য এ্যাডভোকেট ইউসুফ হোসেন হুমায়ুন, আইন প্রতিমন্ত্রী এ্যাডভোকেট কামরুল ইসলাম, আওয়ামী লীগের সাবেক যুগ্ম সাধারণ সম্পাদক মোজাফফর হোসেন পল্টু, ঢাকা মহানগর আওয়ামী লীগের যুগ্ম সাধারণ সম্পাদক ও সাবেক সংসদ সদস্য হাজী মোঃ সেলিম, মুক্তিযোদ্ধা সংসদ কেন্দ্রীয় কমান্ড কাউন্সিলের যুগ্ম সম্পাদক শফিকুল বাহার মজুমদার টিপু, সাবেক ছাত্রনেতা ডা. দীপক দাস, যুবলীগ নেতা মিনহাজ উদ্দিন।
ব্যারিস্টার এম আমীর-উল-ইসলাম বলেন, শিবির ও হিযবুত তাহ্রীর একই জঙ্গীবাদী আচরণ করছে যা আমরা গত কয়েক দিনে দেখেছি। এরা জঙ্গীবাদে প্রশিক্ষণপ্রাপ্ত। তিনি পাকিস্তানের উদাহরণ দিয়ে বলেন, যুদ্ধাপরাধীদের বিচার না হলে দেশ স্থিতিশীল হয় না, যেমন পাকিস্তান। তিনি বলেন, খালেদা জিয়া ভারত থেকে দেশে ফেরার পর পরই দেশে বিশৃঙ্খলার সৃষ্টি হলো।
ইউসুফ হোসেন হুমায়ুন বলেন, সর্বশক্তি দিয়ে জামায়াত-শিবিরকে প্রতিহত করতে হবে। কারণ যুদ্ধাপরাধীদের বিচার যত ঘনিয়ে আসছে তাদের বিশৃঙ্খলা ততই বাড়ছে। একাত্তরের ঘাতকদের বাঁচানোর জন্য দিগন্ত টেলিভিশনের চেয়ারম্যান মীর কাশেম আলী ২৫০ মিলিয়ন মার্কিন ডলার খরচ করেছেন বলে তিনি অভিযোগ করেন।
আইন প্রতিমন্ত্রী কামরুল ইসলাম বলেন, যুদ্ধাপরাধীদের বাঁচানোর জন্য অপশক্তি ট্রাইব্যুনালের ভেতরে বিশৃঙ্খলা এবং বাইরে সন্ত্রাস চালাচ্ছে। তাদের বিরুদ্ধে আমাদের গণপ্রতিরোধ গড়ে তুলতে হবে। সব পেশার মানুষকে এক হতে হবে। যেখানে জামায়াত-শিবির সেখানেই প্রতিরোধ করতে হবে। তিনি বলেন, বঙ্গবন্ধু ধর্মান্ধদের রাজনীতি থেকে নিষিদ্ধ করেছিলেন। কিন্তু জেনারেল জিয়াউর রহমান এদের পুনরায় সুযোগ করে দিয়েছেন। বর্তমানে খালেদা জিয়া তাদের সঙ্গে এক হয়ে দেশে আবারও নৈরাজ্য সৃষ্টি করছেন। তিনি বলেন, জামায়াত একা নৈরাজ্য করছে না। এদের সঙ্গে ছাত্রদল-যুবদলের ক্যাডাররাও রয়েছে। অথচ আজ টকশো' ও মানবাধিকার কর্মীরা নিশ্চুপ।
মোজাফফর হোসেন পল্টু বলেন, নিবন্ধন শুধু রাজনৈতিক দলের থাকতে পারে। জামায়াতের যে আচরণ এতে তাদের নিবন্ধন থাকতে পারে না। জামায়াত-শিবিরের বিরুদ্ধে সর্বদলীয় সংগ্রাম পরিষদ গড়ে তুলতে হবে। তিনি বলেন, আজ পুলিশ বাহিনীর ওপরে জামায়াত-শিবির যে হামলা করছে, এটি মুক্তিযুদ্ধের বিরুদ্ধে হামলা।
জামায়াতকে লেলিয়ে দিয়েছেন
খালেদা ॥ কাজী জাফরউল্লাহ
আওয়ামী লীগের সভাপতিম-লীর সদস্য কাজী জাফরউল্লাহ বলেছেন, মানবতাবিরোধীদের বিচার বানচালের জন্য খালেদা জিয়া তার মদদপুষ্ট জামায়াত-শিবিরকে লেলিয়ে দিয়েছেন। তবে তাদের ষড়যন্ত্র সফল হবে না। জামায়াত-শিবিরকে প্রতিহত করতে আওয়ামী লীগের দরকার নেই, মহিলা আওয়ামী লীগই যথেষ্ট। যত যড়যন্ত্রই হোক না কেন যুদ্ধাপরাধীদের বিচার হবেই হবে।
শুক্রবার সকালে জাতীয় প্রেসক্লাবের সামনে ঢাকা মহানগর মহিলা আওয়ামী লীগ আয়োজিত বিএনপি-জামায়াত-শিবিরের সন্ত্রাস, নৈরাজ্য ও পুলিশের ওপর হামলার প্রতিবাদে মানববন্ধন কর্মসূচীতে তিনি এসব কথা বলেন। মহিলা আওয়ামী লীগের সভাপতি আশরাফুন্নেছা মোশারফ এমপির সভাপতিত্বে মানববন্ধনে আরও বক্তব্য রাখেন আওয়ামী লীগের তথ্য ও গবেষণাবিষয়ক সম্পাদক এ্যাডভোকেট আফজাল হোসেন, সংগঠনের ভারপ্রাপ্ত সাধারণ সম্পাদক পিনু খান এমপি, সহসভাপতি সাদিয়া খাতুন এমপি, ফরিদা রহমান এমপি ও খালেদা খানম এমপি।
http://www.dailyjanakantha.com/news_view.php?nc=15&dd=2012-11-10&ni=115056 শুক্রবার সকালে ঢাকা রিপোর্টার্স ইউনিটি মিলনায়তনে শহীদ নূর হোসেন দিবস উপলক্ষে বঙ্গবন্ধু একাডেমী আয়োজিত 'জামায়াত-শিবিরের তা-ব : যুদ্ধাপরাধী বিচারে বাধা, খালেদা জিয়ার দেশে-বিদেশে ষড়যন্ত্র' শীর্ষক আলোচনাসভায় তিনি এ কথা বলেন। অনুষ্ঠানে অন্য বক্তারা যেখানে জামায়াত-শিবির সেখানেই প্রতিরোধ করার ঘোষণাও দেন। বঙ্গবন্ধু একাডেমীর উপদেষ্টা শেখ মোঃ জাহাঙ্গীর আলমের সভাপতিত্বে সভায় আরও বক্তব্য রাখেন আওয়ামী লীগের সভাপতিম-লীর সদস্য এ্যাডভোকেট ইউসুফ হোসেন হুমায়ুন, আইন প্রতিমন্ত্রী এ্যাডভোকেট কামরুল ইসলাম, আওয়ামী লীগের সাবেক যুগ্ম সাধারণ সম্পাদক মোজাফফর হোসেন পল্টু, ঢাকা মহানগর আওয়ামী লীগের যুগ্ম সাধারণ সম্পাদক ও সাবেক সংসদ সদস্য হাজী মোঃ সেলিম, মুক্তিযোদ্ধা সংসদ কেন্দ্রীয় কমান্ড কাউন্সিলের যুগ্ম সম্পাদক শফিকুল বাহার মজুমদার টিপু, সাবেক ছাত্রনেতা ডা. দীপক দাস, যুবলীগ নেতা মিনহাজ উদ্দিন।
ব্যারিস্টার এম আমীর-উল-ইসলাম বলেন, শিবির ও হিযবুত তাহ্রীর একই জঙ্গীবাদী আচরণ করছে যা আমরা গত কয়েক দিনে দেখেছি। এরা জঙ্গীবাদে প্রশিক্ষণপ্রাপ্ত। তিনি পাকিস্তানের উদাহরণ দিয়ে বলেন, যুদ্ধাপরাধীদের বিচার না হলে দেশ স্থিতিশীল হয় না, যেমন পাকিস্তান। তিনি বলেন, খালেদা জিয়া ভারত থেকে দেশে ফেরার পর পরই দেশে বিশৃঙ্খলার সৃষ্টি হলো।
ইউসুফ হোসেন হুমায়ুন বলেন, সর্বশক্তি দিয়ে জামায়াত-শিবিরকে প্রতিহত করতে হবে। কারণ যুদ্ধাপরাধীদের বিচার যত ঘনিয়ে আসছে তাদের বিশৃঙ্খলা ততই বাড়ছে। একাত্তরের ঘাতকদের বাঁচানোর জন্য দিগন্ত টেলিভিশনের চেয়ারম্যান মীর কাশেম আলী ২৫০ মিলিয়ন মার্কিন ডলার খরচ করেছেন বলে তিনি অভিযোগ করেন।
আইন প্রতিমন্ত্রী কামরুল ইসলাম বলেন, যুদ্ধাপরাধীদের বাঁচানোর জন্য অপশক্তি ট্রাইব্যুনালের ভেতরে বিশৃঙ্খলা এবং বাইরে সন্ত্রাস চালাচ্ছে। তাদের বিরুদ্ধে আমাদের গণপ্রতিরোধ গড়ে তুলতে হবে। সব পেশার মানুষকে এক হতে হবে। যেখানে জামায়াত-শিবির সেখানেই প্রতিরোধ করতে হবে। তিনি বলেন, বঙ্গবন্ধু ধর্মান্ধদের রাজনীতি থেকে নিষিদ্ধ করেছিলেন। কিন্তু জেনারেল জিয়াউর রহমান এদের পুনরায় সুযোগ করে দিয়েছেন। বর্তমানে খালেদা জিয়া তাদের সঙ্গে এক হয়ে দেশে আবারও নৈরাজ্য সৃষ্টি করছেন। তিনি বলেন, জামায়াত একা নৈরাজ্য করছে না। এদের সঙ্গে ছাত্রদল-যুবদলের ক্যাডাররাও রয়েছে। অথচ আজ টকশো' ও মানবাধিকার কর্মীরা নিশ্চুপ।
মোজাফফর হোসেন পল্টু বলেন, নিবন্ধন শুধু রাজনৈতিক দলের থাকতে পারে। জামায়াতের যে আচরণ এতে তাদের নিবন্ধন থাকতে পারে না। জামায়াত-শিবিরের বিরুদ্ধে সর্বদলীয় সংগ্রাম পরিষদ গড়ে তুলতে হবে। তিনি বলেন, আজ পুলিশ বাহিনীর ওপরে জামায়াত-শিবির যে হামলা করছে, এটি মুক্তিযুদ্ধের বিরুদ্ধে হামলা।
জামায়াতকে লেলিয়ে দিয়েছেন
খালেদা ॥ কাজী জাফরউল্লাহ
আওয়ামী লীগের সভাপতিম-লীর সদস্য কাজী জাফরউল্লাহ বলেছেন, মানবতাবিরোধীদের বিচার বানচালের জন্য খালেদা জিয়া তার মদদপুষ্ট জামায়াত-শিবিরকে লেলিয়ে দিয়েছেন। তবে তাদের ষড়যন্ত্র সফল হবে না। জামায়াত-শিবিরকে প্রতিহত করতে আওয়ামী লীগের দরকার নেই, মহিলা আওয়ামী লীগই যথেষ্ট। যত যড়যন্ত্রই হোক না কেন যুদ্ধাপরাধীদের বিচার হবেই হবে।
শুক্রবার সকালে জাতীয় প্রেসক্লাবের সামনে ঢাকা মহানগর মহিলা আওয়ামী লীগ আয়োজিত বিএনপি-জামায়াত-শিবিরের সন্ত্রাস, নৈরাজ্য ও পুলিশের ওপর হামলার প্রতিবাদে মানববন্ধন কর্মসূচীতে তিনি এসব কথা বলেন। মহিলা আওয়ামী লীগের সভাপতি আশরাফুন্নেছা মোশারফ এমপির সভাপতিত্বে মানববন্ধনে আরও বক্তব্য রাখেন আওয়ামী লীগের তথ্য ও গবেষণাবিষয়ক সম্পাদক এ্যাডভোকেট আফজাল হোসেন, সংগঠনের ভারপ্রাপ্ত সাধারণ সম্পাদক পিনু খান এমপি, সহসভাপতি সাদিয়া খাতুন এমপি, ফরিদা রহমান এমপি ও খালেদা খানম এমপি।
