        Have you read the lengthy proceedings of the Indian Constituent Assembly in 1947-48?  There are certain superb gems hidden there.  Should some of those points (especially about local governance) be taken into consideration and included in the Constitution it would simply have been great!  Poor Babasaheb Ambedkar had a handful with the shenanigans of Hindu Mahasabha guys who ultimately won the day by scoring small victories like 'cow slaughter' clause.
        Indian Constitution was one of the half a dozen different Constitutions that were being closely studied by the 1972 Constituent Assembly in Dhaka, Bangladesh.  That we were able to correct some of the mistakes in the Indian Constitution deliberately left behind 25 years ago was simply the RIGHT thing to do. That is why a great statesman like T N Haskar encouraged us to do so. But our pride in doing the right thing was smashed up in 1979 with the Martial Law proclamation of Maj. Gen. Ziaur Rahman who mangled up our beloved 1972 Constitution by the curse of Fifth Amendment.

দেওয়া ছিল বাহাত্তরের সংবিধানে, ১৯৭৭ থেকে নানা মার্শাল ল' প্রক্লেমেশন দ্বারা সেসবের অধিকাংশ খর্ব করা হয়েছিল। এই নৈরাজ্য থেকে সৃষ্ট অবস্থা মানুষকে কত রকমভাবে নাজেহাল করেছে তার সব তো জানি না, জানা সম্ভবও নয়। শুধু একটি জলজ্যান্ত উদাহরণ হলো মুন সিনেমা হলের মামলাটির আসল আরজি। দেশের আইন-আদালতগুলোর হালহকিকত বা কার্যর্ক্রমের নির্ভরযোগ্যতা নিয়ে গর্ব করার মতো কিছু নেই। অথচ তারই মধ্যে একটি মামুলি মামলা, প্রচলিত আইন প্রয়োগ দ্বারাই সুচিন্তিত পরিচালনাপূর্বক কী করে পঞ্চম সংশোধনীর মতো একটি মারাত্মক ক্যান্সার থেকে দেশ ও জাতিকে পরিত্রাণ দিতে পারল, বিচারিক সৎ সাহস ও দেশপ্রেমের তা এক প্রকৃষ্ট দৃষ্টান্ত

I feel proud to know that the constitution of Bangladesh is more progressive than the Indian one at least on the point of formation of religion based political party. What has happened to Article 12? Jamaat and other Islamic parties can be outlawed by this article if it still exists.

        Religion-based political party is a logical impossibility in a democracy, as I spell it out below.  The Indian Constituent Assembly in 1947 made the attempt to prohibit religion-based political party from its Constitution. The move failed due to Hindu Mahasabha manipulation (which managed to insert a ban on "cow slaughter"). It was Mr. T. N. Haskar  who encouraged Bangladeshi Constituent Assembly members in 1972 to accomplish what Indian Constitution could not. A clause was included in Article 12 which prohibits the formation of a political party based on any particular religion, caste or creed in the Bangladesh Constitution, 1972.

Why Jamaat must be banned as a political party in Bangladesh   

  1)    A political party  based on religion is propositioned on the principle that all those outside the party are excluded from the 'religion' or, considered lesser members of that religious community.  Thus an Islamic political party is already a betrayal of both the fundamental ideal of "equality of all believers in the eye of Allah" and the democratic principle of freedom of religion (meaning free to practice religion without any political binding).
          [The point was made stark and clear in 1992 Presidential election in the USA. The Republicans tried to paint the Democrats as godless.  "I did not hear one word at their Convention", said George H. W. Bush running for re-election, "and that word is G-O-D". Next day the National Council of Churches vehemently rebuked the statement, "It is sacriligeous to claim God belongs to one party, or God prefers one political party over the other."]
 
       2) Religion is not the same as a political ideology, here today and gone tomorrow.  Neither is it a fixed, monolithic, unchangeable, unvaried institution.  A big religion like Islam has various sects, sub-sects, and local groupings. When Jamaat-i-Islami claims to be adhering to ONE and only one form of Salafi/Wahhabi Sunni Muslim school then it ceases to be representative of other groups of Muslims nurtured by centuries of beliefs and regional practices. It is precisely in this sense of ONE fixed idea at its core that makes Jamaat resemble a fascist organization. As a fascist organization it has engaged in killing Muslims of other sects by the thousands.

      3) Islam is not a clergy-oriented religion and has no central authoritative body (like the Vatican in Catholic Christianity) dictating its norms and rules.  Wahhabism is a diabolically manipulated diversion from this core principle in Islam.  Its ignominious political origin in 18th century Arabia is well-known and it its propagation as the only "pure Islam" is downright kufri and sinful. A political party based on these ideas is, therefore, un-Islamic and undemocratic.

                      Jamaat-i-Islam MUST be BANNED in Bangladesh in order to SAVE ISLAM in Bangladesh.

I think there should be ONE law for all parties. If they have criminals among them, they should be charged and punished (If found guilty). Jammat should be given the same treatment.


History tells us banning any organization does not help. In fact it makes them more popular. I was told that, our own dictator Ershad was not very popular in his native Rangpur during his term but he became very popular after he went to jail. 


Generally Jammat have few followers but it seems so much talk about them is making them even more popular and they should thank BAL for that. They were given more attention than their major rival BNP. I just don't know why is that.

Farida, get off your high horse! Most of the Bangladeshis are illiterates and you have been trying to preach Jeffersonian democracy to these hapless people? Please go to a Bangladeshi village and ask about our constitution. You will get your answer! I do not know what have you been smoking?

Banning Jamat will create problem for Bangladesh unless you go for a Bangladeshi police state. Let Jamatis sink or swim in a free society. Let voters decide their fate than you, who have all the solutions for our ills.
