[ALOCHONA] DU: All four charged teachers now jailed

Another DU teacher sent to jail

Neem Chandra Bhowmick, one of the four Dhaka University teachers charged with the August 20-22 campus protests, was sent to jail on Tuesday after he surrendered in a metropolitan magistrate’s court in Dhaka.

Magistrate SM Ferdous Alam passed the order after Bhowmick, professor of applied physics, appeared in the court.

The magistrate on September 13 issued a warrant for arrest of Neem Chandra and his fellow, Sadrul Amin, also the president of Dhaka University Teachers’ Association, and 16 leaders of student wings of the Awami League and the BNP as they did not appear in court in connection with the hearing in the case.

Sadrul, professor of English and arts dean, was sent to jail on Sunday after he had surrendered in the court.

‘The charges brought against me are false and baseless,’ Bhowmick told the media after the court order.

Bhowmik’s lawyers appealed for division facilities and treatment for him as there was no provision to seek bail under the Emergency Powers Rules.

The magistrate asked the jail authorities to ensure proper medical treatment for Bhowmick, but did not allow division facilities in jail. But the chief metropolitan magistrate, Jalal Ahmed, asked the authorities to ensure division facilities for the teacher on plea from the defence counsels.

With Bhowmick, all the four teachers, accused in the case, are now behind bars on charge of breaching the Emergency Powers Rules by instigating demonstrators during the three-day campus protests.

The teachers’ association general secretary, Anwar Hossain, social sciences dean Harun-or-Rashid and student Moniruzzaman Sarder of Jasimuddin Hall were arrested by the joint forces late August.

Sixteen Chhatra Dal and Chhatra League leaders, charged with leading the demonstrators, are yet to surrender in court.

The investigation officers of the three cases in connection with campus protests, on September 9 submitted the charge sheet against 21 people.

[ALOCHONA] BNP: Naser Rahman Jailed

A Sylhet court on Tuesday jailed Naser Rahman, son of former finance minister Saifur Rahman, for nine years in an extortion case.

The additional district and sessions judge, Binoy Kumar Mazumder, also jailed former Road and Highway executive engineer in Sylhet Abdul Khalique, former Roads and Highways executive engineer in Moulvibazar Shafiqul Islam and former organising secretary of the Moulvibazar BNP Wali Siddiquee for five years each.

The court acquitted Moulvibazar municipal chairman Fayzul Karim Mayun and former Roads and Highways sub-divisional engineer in Moulvibazar Road Monwar Sadik of the charge.

The verdict in the case against Sylhet city BNP president Ariful Haque Chowdhury was postponed on a High Court order.

Nuruzzaman, executive director of a construction firm at Mirabazar in Sylhet, filed the case with the Kotwali police against M Saifur Rahman, Naser Rahman, also a former lawmaker, and six others on charge of extorting Tk 2.85 crore from him.

The police on February 17 registered the case dropping M Saifur Rahman off the list of the accused.

Nuruzzaman, in the first information report, claimed Naser Rahman with others accused misappropriated Tk 2.85 crore by drawing the money illegally from the his [Nuruzzaman] account with the Karwan Bazar branch Oriental Bank in Dhaka and Chauhatta branch Southeast Bank in Sylhet.

He deposited the amount in earnest money against the tenders of the Road and Highway Department.

The plaintiff said Naser, after taking him to the house of the Sylhet city BNP president at Kumarpara on October 11, 2003, demanded Tk 1 crore against five tenders under a development project which the construction firm won.

Re: [ALOCHONA] Who practices politics abroad?

Mr. Asif,
As you mentioned my   yahoo ID , i need to answer.

In Bangladesh , if anyone  talk in favor of islam, some ignorant and allergic person to islam will brand  you with  Jamatee Islami Bangladesh enen if you are dead against Jamatee islami.

Similarly some blind supporters of  angel's governtment , CTG run by helper army  will  brand  you with those they don't like if you criticize the CTG.

Yes, from the day one i am  against this CTG, before they started anti-corruption drive, arrested any one. day by day i have become harsh critique of CTG so that to some people  it seems that i am a worker of  any political party.

Because in my observation , this is a senseless government, who got sense  by the letter of UN , not of their own sense declared  emergency.

As they  have declared emergency being sensed by other, they are  to fulfil the agenda of their master in abroad, not at home .

We have already seen it that this CTG is a puppet of IMF , World Bank. Bussinessmen felt for the first time  to give statement against goverment puppetting of IMF , World Bank.

Economist from left , right are  against the govt move.

This a reactive government , they way  Moin and  Moinul talk, proactive people can not  talk in this  way.

Only  reactive people can say that nothing good had happened in Bangladesh in the last 36 years , politicians had done nothing good etc.

Once i was fan of Moinul  due to his  oppossion  to Baksal and  his writings in the Daily ittefaq. But no i feel to slap him whenever i heard his voice in BBC.

The game is over, the anti-corruption drive is going to be finished. But corruption has not ceased, rather high risk, high rate.

Moreover,  this anti-corruption drive will increase corruption  in future when party government  will come as they are  working  for their exit way with some corrupt politicians.

if  you give a temporary embankment  to protect from flood, when the embankmet is no more, flood increases.

So anti-corruption drive by emergency government is   not an effective way. No country  in the world has become corruption free in this way.

Ultimately the success of this CTG will be tend to zero. they have just changed some people in PSC, UGC , ACC.

Blind supporters of CTG may think this  is reform and great success.

No reform will occur  in parties due to creation of traitor  Like Mannan bhuyan , AMu by the CTG.

Bangladesh is not going to be corruption free, it is clear to those who has no blind love for this CTG.

I know people like  Asif , become blind to some body new   as they became  blind for  Dr. Yunus. But from the beginning it was clear to me that Yunus' s  chance to success in BD politics tend to zero.

Similarly , my observation , this CTG is   more detrimental for Bangladesh  than AL and BNP due to their  reactive nature, lack of experience,  lack of understnading of reform and corruption  and pupetting of IMF and  World Bank.

The sooner the CTG goes, the better it is for the country.

From the present situation in Bangladesh i apprehend ,  CTG will get no chance to go, rather people will push them (Banglai jake bole golla Dhakka dao a). if thery go before that time  or such situation does not come , then it is better for Bangladesh.

 With best wishes for Bangladesh

A  simple Bangladeshi, not sole agent of Bangladesh , not worker of any party.

( who has  to  take the name of his favorite leader Mahathir , as famliy  people don't want  me waste time writing in yahoogroups )

From the above link it will be clear a lot about the subject of this mail. I do believe and know almost in the same way as the article is written.
I have some more question to the aboard politicians.
1) Why they do BD type politics in aboard?
2) How much they (most of them)  got and are getting now also from politicians of BD?
3) How many of the aboard politicians are full time politicians in aboard too?? How many of them are doing 50 % working time politics?? and so on..................
4) How many (%) of them got political asylum from foreign govt?
Now, I want to ask Bangladesh Govt. Why Govt is not taking any initiatives to catch those stupid/culprit/criminal  politicians in aboard?????????????????  Is not it possible to catch them by building some bi-lateral LAW/diplomatic procedures between the foreign country and our country???????????? CTG should do it if possible.  According to the above link these people getting small amount from the politicians of BD. In my evaluation they (most of them) are getting much more......... They are the PARTNERS of corruption/crimes of BD politicians.  These, people are like PERSONAL BANK of BD politicians. Their only aim to release enemy of OUR SOIL (corrupt politicians of BD).  They only become friends of jailed politicians and making procession/telephone conference  in aboard. In BD there is no more friends of jailed politicians but in aboard. Those stupid people in aboard gave/giving reception and did/doing barberry to the jailed politicians. In addition, only the people donft support CTG but support corrupt politicians of our soil those were the partners in past and want to be again the partner of BD corrupt politicians. Thatfs the reason some of them have warned MASK and hide their actual name. Now we can see some of them with MASK, for example Mahathir of BD or some thing like this.  I think those MASK are of  the criminals and/or employed by the CRIMINALS of OUR SOIL to write in such a way. We should be much careful from these employed criminals. Because, criticism is very important for the betterment of CTG or whatsoever, but supporting of the criminals are not acceptable.
With the best wishes
Asif

[ALOCHONA] Gen. Moeen influenced clearing Ershad of gold smuggling charges?

Sub: Gen. Moeen influenced clearing Ershad of gold smuggling charges?

There was absolutely no doubt in anyone's mind that military backed regime of Moeenuddin-Masududdin do not want to jail there one time boss autocrat Gen. Ershad. Both of them are also the beneficiary of Ershad regime.

Today, court gave verdict clearing Ershad of gold smuggling charges. First additional sessions judge Md Abul Bashar handed down the verdict, which had been deferred several times earlier.

Court sources says there are rumor all around the court that autocrat Gen. Ershad was found guilty but government was forcing judge Abul Bashar to declare him not guilty which he declined and rejected until today. The verdict readout was canceled six times earlier and government mounted pressure on judge to give-up and do what he has been asked to do. Today judge delivered the verdict as Moeenuddin's DGFI directed.

It's just another sad day for Bangladesh judiciary which went through marching military bandits boot so many times until now since 1975.

Time will come when Moeen-Masud and all other clowns of DGFI have to stand on trial for forging the national interest.

Ershad cleared of gold smuggling charges
Tue, Sep 18th, 2007 3:13 pm BdST

Dhaka, Sept 18 (bdnews24.com) – A Dhaka court Tuesday cleared former president HM Ershad of charges in the Gold Smuggling Case.
First additional sessions judge Md Abul Bashar handed down the verdict, which had been deferred several times earlier.

"I have got justice," Ershad, chief of Jatiya Party, told bdnews24.com in his instant reaction.
Ershad's lawyer Sheikh Sirajul Islam said: "The verdict has proved that the judiciary works independently."

"The then BNP government filed the case with a political motive. The eight witnesses on behalf of the state could not say anything about Ershad's involvement in the case," he added.

Immigration officials seized gold worth Tk 2.4 crore from two foreigners' luggage at Zia International Airport on July 16 1990.
Customs and VAT inspector Md Zakaria filed a case with the Airport Police Station.
Ershad was not named in the case, nor was he included in the first chargesheet submitted to court.

The police pressed charges against Ershad in a supplementary chargesheet, submitted to court on Aug 31 1991.
The judge Tuesday said the accused person was acquitted of the charges as nothing was proved against him beyond doubt under the Special Powers Act.

Ershad appeared in court shortly after 10 in the morning, accompanied by party colleagues Anisul Islam Mahmud, ABM Ruhul Amin Howlader, Syed Abu Hossain Babla and Zia Uddin Bablu.

[ALOCHONA] Fakhruddin: Army has no political role

Army has no political role: chief adviser

He says govt ponders formation of nat’l security council
Courtesy
United News of Bangladesh. Dhaka

The chief adviser, Fakhruddin Ahmed, has dismissed the notion that the country is placed under a dual rule and said he does not perceive any political role of the armed forces.

‘I don’t feel existence of dual rule… the army is assisting the civil government and playing an important role in curbing corruption, improving law and order, distributing flood relief. I don’t see the reflection of their political role through these activities,’ he said in an interview with BBC (Bangla Service) broadcast on Friday.

Replying to a question, the chief adviser said the reasons that had called for promulgation of the state of emergency have not all disappeared, but assured that the emergency would be lifted at an appropriate time.

On the formation of National Security Council, he said the government is pondering the matter as such institution exists in neighbouring countries, but no final decision has yet been arrived at.

Asked if the government or its agencies are engaged in changing leadership of major parties or splitting the parties through reform process, Fakhruddin refuted the allegation saying that it is internal affairs of the parties to decide about their leadership and running their parties.

He said lifting of the ban on indoor politics has created an atmosphere for political parties to sit with the Election Commission for discussing reforms of election rules and regulations.

Asked whether the ban on indoor politics was relaxed soon after the arrest of Khaleda Zia in a bid to expedite the reform process to remove both Hasina and Khaleda from their party leadership, the chief adviser said he didn’t think there was any element of truth in it.

He said the government had been contemplating the lifting of ban on indoor politics and    it was done at an appropriate time to allow parties to discuss their own party reforms as well as cooperate with the Election Commission in reforming election rules and regulations.

Asked about the conditions imposed after lifting the ban on indoor politics, he said these were not conditions, but some explanations or parameters to give a clear idea about the indoor politics so those who would practice it would not face any confusion.

He mentioned that Awami League already held a meeting at its party office and they had faced no problem.

Asked why the state of emergency is not being relaxed after eight months of its promulgation, the chief adviser said it was imposed against an extraordinary background. The government is moving ahead with a certain mission to hold a free, fair and democratic election acceptable to all.

Asked whether reforms are not possible by relaxing the emergency, he said the question is whether the emergency is creating any problems to general people.

He asserted that the emergency is not causing any problem for general people, for the media in transmitting news or for national economy.

He admitted that due to emergency some fundamental rights might be denied, but this is a temporary measure for long-term welfare of the nation.

This temporary arrangement, he said, would continue for some time more as the government was conducting the twin tasks of holding a national election and curbing corruption, which have been accepted by the people.

Asked whether he thinks evil forces or public grievances were behind the last month’s student unrest on Dhaka University campus, the chief adviser said the DU problem was resolved, but the one-man judicial commission that has been constituted to find out how and why this unrest had spread out.

The government is waiting for the report of the inquiry commission, he added.

[ALOCHONA] Expat Labour: Problems in Malaysia continue

Bangladeshis mired in Malaysian miseries for govt inaction

Courtesy New Age 16/9/07

Bangladeshis working in Malaysia are set to suffer more and future recruitment is likely to become uncertain as Dhaka fails to reach an amicable solution with Kuala Lumpur over exploitation that has continued for some time now.

Hundreds of Bangladeshi workers had been forced to camp in the parking lot of the international airport in Kuala Lumpur for days as they waited for their employers to taken them out of the premises, Malaysian daily newspaper, the Star, reported on Saturday.

A Bangladesh high commission official in Kuala Lumpur told New Age on Saturday that hundreds of Bangladeshi workers had been mired in such a situation for lack of communication between the recruiting agents in Dhaka and the employers in Kuala Lumpur.

‘As soon as the problem of one group is solved, a new group comes in with similar problems,’ he said.

Bangladeshi officials in Kuala Lumpur with the help of local law enforcers and recruiting agents forced out about 150 Bangladeshi workers from the high commission premises late Friday.

The exploited and deprived Bangladeshis in Malaysia had been on a hunger strike in front of the high commission for five days, seeking Dhaka’s intervention to take them back home and punishment for the recruiting agents in Bangladesh.

A protester named Jainal Abedin alleged the Bangladeshi officials, led by the labour counsellor at the high commission, Talat Mahmud Khan, drove them out of the commission area with the help of the recruiting agents.

The officials, with the agents and local law enforcers manhandled the workers and packed them into buses for a place at a distance of eight hours’ drive from the commission, Jainal said.

The officials told the workers that they would be placed on job or given compensation.

‘The Malaysian home ministry called Talat on Saturday over the demonstration as we lodged a complaint with the ministry,’ Jainal said.

The Bangladesh high commissioner in Kuala Lumpur designate, M Khairuzzaman, claimed that the hunger strike by the workers amicably ended Friday night after a fruitful discussion.

‘We arranged the meeting with the parties concerned that included officials of the Malaysian ministries of home, labour and environment, and the employers and workers,’ he told New Age over telephone Saturday evening.

Referring to the plight of Bangladeshi workers at the airport, another high commission official said, ‘Sometimes recruiting agents in Bangladesh are not informed of the cancellation of the calling visa at the last moment by the Malaysian employer. Sometimes they ignore the cancellation of the visas and they often send workers more than requirement.’

He said some Malaysian agents did not even have the idea that their workers arrived which resulted in situations where workers keep waiting at the airport to be picked up.

‘As the agents fail to show up within seven days after the arrival of the workers, the workers are deported, in accordance with the law,’ the official said.

The Bangladesh expatriate welfare and overseas employment secretary, Md Abdul Matin Chowdhury, said a three-member delegation, headed by him, was scheduled to visit Kuala Lumpur by September 23 to discuss the issues with the Malaysian officials.

Despite repeated instructions to the recruiting agents, such incidents keep happening for lack of strict provision by the Bangladesh ministry concerned.

According to the statistics available with the Bureau of Manpower and Employment Training, some 1,57,000 Bangladeshis have gone to Malaysia since the recruitment process resumed 11 months ago.

Malaysia now employs 3,85,399 Bangladeshis, official statistics said.

[ALOCHONA] Khaleda: Graft Case brought under EPR

Graft case against Khaleda brought under EPR
Courtesy New Age 18/9/07

The Anti-Corruption Commission on Monday decided to bring under the Emergency Powers Rules 2007 the graft case against detained former Prime Minister Khaleda Zia and 12 others, including her detained younger son Arafat Rahman, for awarding a contract to an unsuitable and ill-equipped firm to handle the containers’ depots in Dhaka and Chittagong, allegedly in return for kickbacks.

The ACC gave the approval in response to a plea made by its deputy director, Zahurul Huda, who is the investigation officer of the corruption case.

‘We have decided to bring the case under the emergency rules, which bar any accused persons from seeking bail, in response to a plea filed by the investigation officer of the case,’ said the ACC’s secretary, Mokhlesur Rahman, at a news briefing on Monday.

When he was asked why the case against Khaleda Zia was brought under the emergency rules, Mokhles replied, ‘The investigation officer felt that the case should be brought under the emergency rules because of its public importance.’

Golam Shahriar Chowdhury, a deputy director of the ACC, filed the case with Tejgaon police on September 2 against Khaleda, her younger son Arafat Rahman, and 11 others for awarding an important contract to an incompetent firm, Global Agro-Trade Company, to handle the containers’ depots in Dhaka and Chittagong Port, allegedly for the sake of bribes.

The joint-forces arrested the 63-year-old prime minister, also the BNP chairperson, and her son from her Cantonment residence on September 3. They were sent to separate jails for corruption after being produced in the Chief Metropolitan Magistrate’s Court of Dhaka. But the 11 other persons accused in the case could not be arrested so far.

Zahurul Huda, a deputy director of the ACC, was assigned to investigate the case.

As the case against the former prime minister was filed by the ACC under the Prevention of Corruption Act 1947, the investigation and trial need to be conducted in accordance with the Anti-

Corruption Rules 2007 and the Criminal Law Amendment Act 1958 as amended on April 18, said sources.

According to the rules, the investigation of such a case needs to be concluded within 45 working days from the date of appointment of the investigation officer.

The rules empower the ACC to extend the time of investigation by 15 more working days if there are valid reasons for failure in concluding the investigation in the stipulated time.

According to the Criminal Law Amendment Act, the cases need to be tried by the Special Judge’s Courts within 45 days after taking them into cognisance.

The court will have the scope to extend the time by 15 more days after recording the reasons for failure in concluding the trial.
