Anuj Dhar explains how the Freedom of Information Act can be invoked to unravel secrets about India.


THE Central Intelligence Agency (CIA) is one of those organisations that are commonly and freely talked about in India but about which informed studies are scarce. The role of the mole in Indira Gandhi's Cabinet in December 1971 is very evident in Jack Anderson's Papers and those released by the United States State Department much later.

Indira Gandhi, true to form, tried to make political capital out of the affair during the election campaign in 1979, immediately after the publication of Thomas Powers' authoritative work The Man Who Kept the Secrets. Neither critics nor fawning admirers called her to account.

What steps did she take against the mole? His identity was no great secret. It is surely a matter of deep concern that at the height of the Bangladesh war a record of the Prime Minister's talks with the Soviet Ambassador should land on the table of Henry Kissinger within 48 hours or less. Three things are incontrovertible. A mole did exist; he was not officially identified; and Indira Gandhi did not punish him ever.

Anuj Dhar moved the Central Information Commission on this matter. After its direction to provide the information, the Ministry of External Affairs accepted that records of discussions of meetings between the then External Affairs Minister, Swaran Singh, and U.S. Secretary William Rogers on October 5, 1972, were available; but, PTI reported, "it refused to disclose them claiming confidentiality".

Dhar rightly complained, "While the Ministry is claiming confidentiality clause, the U.S. government has declassified the memorandum of conversation between Singh and Rogers titled 'Indian Allegations Regarding CIA Activities'."

The author's researches have sadly received little notice. This book testifies to his labours and his grasp of the material on the subject. He explains how the Freedom of Information Act can be invoked to unravel secrets about India. The memo of the October 5, 1972, talk is reproduced:

"Secretary [Rogers] initiated discussion this subject saying he was perplexed at Prime Minister Gandhi's public remarks regarding CIA activities in India. Initially [Swaran] Singh tried to side step issue in light hearted manner saying Mrs. Gandhi paid compliment to CIA for its activities." But shedding flippancies, he added: "It has not been difficult for GOI to come to know of CIA activities. … For example, GOI had information that proceedings of Congress Working Committee were known to U.S. officials within two hours of meetings. Said when this happens it offends people." Were the delinquent members of that body identified and punished?

CIA infiltration

Anuj Dhar writes, "The final twist in the tale came in 1988 in Bombay. … Now defunct newspaper Independent carried a story reportedly based on a (R&AW) communication to Prime Minister Rajiv Gandhi exonerating Morarji Desai and implicating deceased stalwart Yashwant Rao Chavan, Finance Minister during the 1971 war. This led to an ugly uproar and the paper's editor Vinod Mehta, in his words, 'had to flee Bombay'.

"Now, the story from the horse's mouth. Documents 27 to 30 in this book confirm the CIA's infiltration of Indian establishment at the top level in December 1971. Rendered unidentifiable due to redactions, a 'reliable source' (see back cover for the first page of document 29) leaked out the details of confidential Soviet-Indo deliberations and, more horrendously, 'India's war objectives' as elucidated by Prime Minister Indira Gandhi….

War objectives

"Prime Minister Gandhi told her Cabinet on December 6 that before accepting a U.N. call for a cease-fire there were three objectives that would have to be achieved: to guarantee the establishment of Bangladesh; to liberate the southern part of Azad Kashmir; and to destroy Pakistan's armour and air forces."

The mole's name was deleted when the CIA papers were published, officially. Did she omit the northern areas of Kashmir to avoid trouble with China?

The author rightly does not identify the mole, a caution not evident in some of his other inferences. But he fairly sets out the documents for the reader to judge for himself. The book deserves wide readership and its documents, careful analysis. It provides the CIA's material on domestic politics, relations with China, on Kashmir, Bangladesh, nuclear proliferation and much else.

Khamin reveals the illegal arms trafficking and trade that is going on within the country unabatedly

 
Around sunset on March 20, the company commander Major MM Shafiqur Rahman rushes out of the Tikatuli office of the Rapid Action Battalion 3 (RAB 3) with his team, in civil clothes. Their excitement was propagated by the fact that the illegal arms trading group, whose activities they have been investigating for over a month and were trying to contact to buy fire arms while posing as a group of professional killers themselves, had finally decided to sell weapons to them.

   'It was quite tedious as the traders were rapidly changing locations and giving us new ones from a number of different mobiles,' says Shafiqur to Xtra later. 'Still we did not give up and held onto every possible lead,' he adds.

   After half an hour on that day, Shafiqur receives a call on his phone that asks him to reach a particular Char from the Mawa ferry station by boat. 'But upon reaching the Char, we were asked to go to another Char that was a few miles away from there,' he says.

   After jumping three Chars in such a manner, the traders finally decide to trade on the fourth Char. 'I asked my men to spread out discreetly on the Char while two members of the team accompanied me to the rendezvous point,' remembers Shafiqur.

   At the char, a man walks up to the three and leads them to a temporary hut where the weapons were already on display. 'The man asked me how many weapons I will buy and I told him that I will buy all of them for our upcoming killing mission,' says Shafiqur, before shooting a blank and initiating the bargaining process.

   'He did not come down from the fixed price of TK 15,000 per weapon,' says Shafiqur. Around this time, the RAB 3 team began shooting at the traders.

   'They also opened fire on us and there was a brief fire-fight after which they fled,' says Shafiqur while adding that they recovered seven foreign revolvers and two pipe guns from the spot.

   Almost a week after the RAB 3 operation, RAB 2 recovered two foreign pistols and a revolver with 22 rounds of Chinese manufactured .22 bullets, on March 27 from Jahangir who was speeding on a white X Corolla car. RAB 2 had chased the car from Adabar till Mirpur 2.

   The RAB sources inform Xtra that one of the pistols was an Italian-made Berretta while the other was an Indian-made stainless steel copy of US standard pistols. Although the price of the Beretta is no less than three lakh takas with licence, it can be bought illegally at Tk 50,000.

   The daily recovery of such light and heavy arms by law enforcement forces signify the growing prowess of illegal arms traders within the country, further aggravating the law and order situation. According to the law enforcement officials, most of these guns are being smuggled in through the borders while the crude ones are being made in Dholaikhal, Maheshkhali and Fatikchhari.

   'Almost every day, we recover foreign pistols, revolvers and locally made pipe guns,' says Major Rezaul Hoque, a second-in-command of RAB 2 at Shere-e-Bangla Nagar. RAB sources claim that they recover around 120 to 150 illegal fire arms only in Dhaka on a monthly basis with the highest recoveries made by RAB 3 and 10.

   On the other hand, RAB 7 in Chittagong and RAB 6 in Khulna usually recover heavy illegal arms such as rifles, shotguns, pipe guns and LGs as they are in high demand in these areas.

   Last year, RAB recovered around 1,394 revolvers, 2,190 pistols, 15 SMG/LMG and 9 mm SMC/SMG, 2,183 pipe gun, two .303 rifles, 60 AK-47 machine guns, a T-56 rocket launcher, two M-79 grenade launchers, 42 .22 calibre bore rifles and 189 grenades across the country.

   While most of the foreign illegal revolvers are copies of US-made Colt Detective Special S&W Performance Centre Model 25, the pistols are copies of German-made HK P2000 and Italian-made Beretta M951 and M951R. These guns are all manufactured in India and are smuggled into our country.

   'These arms are available at very cheap prices ranging from Tk 7,000 to 10,000,' says a RAB 10 official. 'As pistols and revolvers are very small, these are easily concealed underneath the clothes they wear while crossing the border,' says Shafiqur.

   'Most of the light arms also come through Lalmonirhat and Kurigram of the bordering areas,' says a senior official from the counter-terrorism cell of an intelligence agency.

   AB sources also inform Xtra that some hand guns are coming into the country through Myanmar. 'While the bulk comes from India, the rest come in from Myanmar,' says Shafiqur.

   RAB 7 sources claim that most heavy arms coming through Myanmar have found their way from China and Laos. 'The insurgents from Myanmar buy these weapons from those countries with the money they receive from selling opium gums,' says a RAB 7 official.

   He points out that the arms are then channelled into Bangladesh through buyers in Bandarban and Teknaf.

   'There is an elaborate arms trading network, spread throughout Bangladesh, India and Pakistan that works for the Jamaatul Mujahideen Bangladesh (JMB),' said Commissioner AKM Shahidul Hoque at a press meet on April 2 after arresting Shafique Mahmod alias professor Selim with arms and fake money from Mohammadpur. Police found connections between the JMB and Shafique.

   Interestingly, pistols and revolvers are not smuggled much in Khulna and Chittagong as there is a high demand for rifles, 9 mm SMC and even AK-47 machine guns. These arms, mostly copies of Chinese fire arms, are smuggled into Bangladesh from the India-Bangladesh border at Khagrachhari and the Myanmar-Bangladesh border at Alikadam of Bandarban.

   'These heavy arms, like AK-47 and even the Arges grenades, are smuggled into the Chittagong Hill Tract (CHT) areas for the insurgent and terrorist groups in these regions,' says an intelligence official. 'They are not used at all in Dhaka city,' he adds.

   A RAB 6 official of Khulna informs Xtra that the Jessore and Satkhira border points are the most lucrative for arms traffickers. 'The arms peddlers maintain a good relation with Border Security Force (BSF) who help the traffickers cross the Indian border and smuggle these illegal arms into the Bangladesh side,' he says.

   LG and pipe guns, made at Fatikchhari in Chittagong and Maheshkhali in Cox's Bazar are also used in Chittagong. Pipe guns are also made at the small machine factories in Dholai Khal of old Dhaka as the manufacturing process is quite easy.

   'Guruk Ghata and Shaplapur hill areas at Maheshkhali of Cox's Bazar are the lucrative spots for LG and pipe gun; we had several successful arms recovery operations in these areas,' says company commander Major Syed Ali Ashfaq from RAB 7 in Chittagong.

   The law enforcement sources point out that illicit arms are smuggled, stolen, black marketed, locally produced, licensed or rented. The last procedure has become extremely popular of late in the city as fire arms are required for mugging, murders and other criminal acts.

   Arms traffickers use students and children as carriers while moving arms from one part of the city to the other as the law enforcement forces rarely suspect them. One such arms carrier informs Xtra that the Bhomra border point in Bangladesh and Ghoja point of India at Benapole near Jessore district are two of the most important trading points.

   'We receive arms from Manjo Banarjee at Ghoja Danga in India and send it to Ajit Khowa at Bhomra in Bangladesh,' he says. 'We usually receive support from the BSF and it is easier to smuggle these arms as these are all hand guns,' he adds.

   Only when there are orders from the city, these arms are carried into the city through points like Amin Bazar at Gabtali, Pallabi at Mirpur, Ashulia near Uttara and Ulan in Rampura.

   Earlier, these criminal trading groups used to trade in the outskirts of the city like Mawa of Munshiganj, Aftab Nagar of Badda, Meradia at Rampura and Dakshin Khan of Uttara amongst others. However, following recent RAB operations in these areas, these arms sellers have shifted their selling spots to remote places like Char, under-construction buildings and near river shores outside the city.

   A report, titled 'Small Arms Violence and Trafficking in Bangladesh: Security Implications' by Naila Husain and published in 2009, mentions that revolvers, pistols, rifles, submachine guns, assault rifles, light machine guns are some of the widely used small arms in Bangladesh. The report also suggests that in order to reduce the arms related problems, the government needs to review the prevailing Arms Act of 1878 and explosive act 1884.

   Furthermore, the report urges the introduction of new laws and the enhancement of border security. However according to Detective Branch (DB) sources, the law enforcement authorities throughout the country and the borders do not have the technology and equipment with which arms smuggling can be detected and hence curbed.

Some 61 people were killed in the hands of law enforcing agencies across the country in the last six months, says Odhikar, a rights group. In its half-yearly report, Odhikar says among the 61 people, 29 were killed by elite force RAB, 25 by police, 4 by RAB-Police, and the other 3 by RAB-Coast Guard.(UNB, Dhaka)

Besides, 35 Bangladesh nationals were also killed by Indian Border Security Force (BSF) along the Bangladesh-India border in between January 1 and June 30.

Odhikar, which compiled the figures based on reports published in different national dailies, also says 26 Bangladesh nationals were injured allegedly by Indian BSF during the period.

It says some 113 people were killed and 8,505 injured across the country in political violence.

Besides, 63 people, including 38 women, were the victims of acid attack while 291 women and children victims of rape - of which 45 were killed after being raped - across the country during the period.

The report further says some 104 women were killed and 50 others tortured in 163 incidents of dowry-related violence across the country between January 1 and June 30.

I think most of us are against extremism of all kind. However this movement lforgot to mention Muslims suffering in Kashmir, Iraq,Israel, Afghanistan and other places. If they have genuine interest in "Humanism"[ Not sure what that word actually stands for. Is there a charter for "Humanism"?], I am willing to join them. However their selective concerns raises more concerns from those who got burnt before by flowery speeches coming from leeches of our country.
 
Qur'an itself asked Muslims not to be fanatics about religion. I am always confused why we cannot use our religion for such noble causes [ Bringing harmoney, religious tolerance in our country]?
 
Had Allah willed, they[ non-Muslims] would not have taken others besides Him in worship. And We have not made you a watcher over them nor are you set over them to dispose of their affairs. And insult not those whom they (disbelievers) worship besides Allah, lest they insult Allah wrongfully without knowledge. Thus We have made fair­seeming to each people its own doings; then to their Lord is their return and He shall then inform them of all that they used to do.

The MSSK Trust, Forum for Secular Bangladesh and Trial of War Criminals of 1971 and South Asian People's Union against Fundamentalism and Communalism jointly organised the conference titled "The International Conference on Peace, Justice and Secular Humanism" at Osmani Memorial Auditorium.
In the resolution titled "Dhaka Declaration", the conference also called on international community for extending support to the process that Bangladesh government has initiated to try the war criminals.
The resolution was adopted at concluding session of the conference following daylong discussions attended by delegates including human rights activists, lawyers and experts from 11 countries.
The resolution said the trial of war criminals in Bangladesh would discourage the culture of impunity and urged international community "to unite against the culture of impunity to prevent genocides and war crimes from recurring."
Countries affected by terrorism and regional extremism were also urged to support the proposed regional taskforce, a taskforce proposed by Prime Minister of Bangladesh Sheikh Hasina, to combat religious extremism and terrorism.
The resolution also emphasized strict measures to check money laundering for what they said, "fundamentalist organisations across the world are using different NGOs, Banks and various financial institutions to finance militancy and terrorism through money laundering."
Building a domestic and regional secular humanist network by civil societies and governments across the world was also urged upon.
The conference also called upon Pakistan to take effective measures to curb and eliminate religious militancy, repeal anti-Ahmadiyya laws and blasphemy laws.
Earlier, during its inauguration, speakers from home and abroad urged all countries to form an inter-continental network based on secularism.
"Religious fundamentalism in many forms and faces has become a great problem. There is no time to lose. With cooperation from all we must cut it out globally before it is too late. Otherwise humanism will be in jeopardy," said Prof Kabir Chowdhury, president of the advisory committee of Ekattorer Ghatak Dalal Nirmul Committee.
"If there are Muslim fundamentalists in Pakistan, there must be Hindu fundamentalists in India. If there is Hindu fundamentalists in India, there is no way to resist Muslim fundamentalists in Bangladesh," said former speaker of India PA Sangma.
Former speaker of Nepal Daman Dhungana said that democracy couldn't be achieved without overcoming religious extremism.
"Individually it is tough to overcome this, but globally it can be done," he added.
Prof Shafaraj Khan from Pakistan, Prof Maxim Dubayev from Russia, terrorism expert Chris Blackburn from UK, Cecilia Wikstrom, member of MEP, Sweden, Parvin Najfgholi Ardalan, human right activist from Iran and Attorney William Sloan also spoke in the inaugural session. Journalist Shahriar Kabir conducted the programme.
Speakers also discussed Jamaat-e-Islami's link with international terrorist organizations.
"Trial of war criminal is necessary for strengthening the foundation of democracy. It is a matter of great shame that collaborators were reinstated in Bangladesh politics," said Dr Peter Custers from The Netherlands in his speech during inaugural session.
He also mentioned that European countries politically support this effort of war crimes trial and suggested taking assistance from international lawyers.
"It's never too late for justice. Time is always now. It is always the right time to punish crime against humanity," said William Sloan.

Chhatra League Derailed

Now a days Chhatra Leagues activists are derailed from their political activities. Recently they are engaged with terrorism, violence, clash [1], [2],[3], rape [4], torchuring, grabbing, minority torture, tender business, vandalism [5], admission business , women harassment [6] and other illegal businesses using women [7], [8], [9], [10] in whole the country. To control these activities of chattra league Awami League leaders are handling the total issues [11], [12], [13]. They are also became a threat for the Pollice Officials [14] and students in whole country, [15], [16]. Recently DU authority suspended a BCL activists for Arms holding [17]. Clash between several faction of Chattra League is destroying the educational environment of Bangladesh [18].

[edit] Debate on Cut AL's link with BCL for 'criminal activities'

Five noted educationists of the country have urged Prime Minister Sheikh Hasina to sever all direct and indirect links between the Awami League and Bangladesh Chhatra League to maintain a congenial atmosphere at all educational institutions [19], [20]. Besides, Fifteen teachers of Rajshahi University expressed deep concern over the "criminal activities" of Bangladesh Chhatra League at the educational institutions and urged the government to take immediate steps in this regard [21]. Ex Chattra League Activist and Renowned Journalist of ATN Bangla (a leading TV Channel) Nayeem Nizam demanded to Govrernment for declaring chattra league as out law for three months in Daily Bangladesh Pratidin 5 May issue. But in the next day issue of Bangladesh Pratidin the ex Senior Gov't Official and ex-Chattra League Leader now the Editor of Weekly 'Sotta Katha' Ubaidul Muktadir Chowdhury react on the issue and advised not to stop chattra league but to control pollice officials linked with terror activists of Chattra League.now a days chattra league known as secular terrorist. it's the demand of time to bend all activities of chattra league.

[edit] AL Leaders Demanded 'Special Tribunal' for BCL

AL Presidium member Obaidul Quader suggested five measurers for bringing the BCL back to track: stern legal action against wrongdoers, corrective measurers, reconstituting all BCL committees with students, holding elections to the student unions of educational institutions, and providing jobs to those who are no more students but have been engaged in politics for long.

He said BCL activists involved in criminal activities should be brought under speedy trial act and kept in jail for a couple of months.

AL policymaker Obaidul Quader also demanded identifying and punishing the party leaders who are patronising BCL in resorting to tender manipulation and other unlawful activities across the country [22]. He also urged in a metting not to give shelter Chattra League [23].

Another Senior Presidium Member of Awami League Begum Matiya Chowdhry has bouycotted Chattra League. She declared, she will never join any programme of Chattra League or other pro-awami league organisation's programme where any of leaders of Chattra League would present there.

Mohammad Nasim, Ex home Minister and Senior Leader of Awami League also pointed chattra league's crime in a meetting.

Besides, The government of Bangladesh feel ambarassed duer to chattra League's activities for about 20 times after taking oath on 2009.

[edit] Prime Minister on Stern Action

As per organogam of BCL the Prime Minister Sheikh Hasina Was the Organizing Leader of BCL. But, last year she rejected to bear the responsibility of Chattra League and angrylly thrown the honorery post. Besides, demand raising to control chattra league the Prime Ministers office took attempt against violent BCL. On 30 April 2010 she ordered home ministry to take necessary action against tender violence, women harassment and other inhuman activities of BCL all over the country [24]. Besides this renowned Awami League leaders are commeing to handle the total issues of chattra league [25], [26], [27]. Some of Awami MP's are patronising Chatta League. AL acting general secretary Mahbubul Alam Hanif also admitted that the allegation of patronisation by AL lawmakers is "partially" true [28]. "They have also been asked not to consider recommendations of any minister, state minister, lawmaker and party leader in favour of Chhatra League wrongdoers," he said. Recently The Prime Minister Sheikh Hasina refuges to receive BCL leader's flower vases in a reception programme in Dhaka. The reception was arranged for 3rd anniversary of incoming day of Sheikh Hasina from abroad during the last military backed caretaker government. The BCL leaders then put the flower vases on the table and was harassed by the security guards of the Premier. By this way the PM warns Chattra League, but, Warnings not working. Some leaders of the ruling Awami League observed that the unruly activists of Bangladesh Chhatra League can be reined in only if Prime Minister Sheikh Hasina plays a more serious role.
