Adv. Rabindra Ghosh (62) and his accompanying assistant - Rabindra Nath Baral (30) have been physically attacked and injured by Akhtaruzzaman -Superintendent of Police and by his police officers under his control at his Office in Perojpur District on 24th of November, 12 at about 1-20 p.m. while a conversation between Akhtaruzzamn and Adv.Rabindra Ghosh regarding Minority repressions, land grabbing, desecration of Hindu Deities, rape and gang rape of minority victims at Motbaria Upazila was going on. Physical attack started by police while I tried to contact with Home Secretary and I.G. of Police over phone. Rabindra Nath Baral has been seriously injured by DB Police and Adv. Rabindra Ghosh was slightly injured who was released instantly from Perojpur Sadar Hospital. Telephone set of Adv. Rabindra Ghosh was snatched away by the S.P. Perojpur. Rabindra Nath Baral's health condition was deteriorating.

 

Facts of the case:

I, along Rabindra Nath Baral-Human Rights Activists went to meet with Mr.Akhtaruzzaman,S.P. on the application of Minority victim - Bijoy Krishna Baral and Bibek Baral whose landed property (0.66 acres) minimum cost of land Taka One crore - in Ward No.7 -Motbaria was forcefully occupied by powerful  perpetrators on 12.03.2012 namely 1) Md. Majibar Rahman son of late late Hajee Mozaharuddin Howladar, 2) Md. Harun-ar-Rashid son of Abdus Sattar, 3) Md. Fazlul Hoque Moni son of late Abdul Khaleque Meah, 4) Md. Lokman Khan son of late Abdul Majid Khan, 5) Md.Ariful Hoque, son of late Anwarul Hoque, 6) Sajjad Kabir son of Md. Soharab Hossain Howladar, 7) Abdul Kalam Baidya son of Abdul Malek Howldar, 8) Rafiqul Islam son of Rafique Zammardar, 9) Shaheen Zammardar, 10) Md. Zakir Hossain (Kalam) son of Abdus Sattar, 11. Md. Abu Saleh son of late Shamdul Hoque, 12. Md. Ripon son of Abdul Hashem, 13. Md. Nazrul Islam son of Md. Anwar Hossain.

 

We have scrutinized the documents of Bijoy Brishna Baral and Bibek Baral who got decree by the Civil court of Pirojpur on 29.02.12 in Title Suit No. 231 of 2006. But the defendant Uttam Kumar Shikari having been lost his case, without any lawful authority, given anti-dated power of Attorney to those 13 Muslim perpetrators on 12.04.12 to enjoy the properties illegally.  It is curious to note that Motbaria police took a false case No.25 dated 13.3.2012 under section 143/447/323/379/354/506 of Penal code filed by Uttam Kumar against 1) Bibek Bara, 2) Bijoy Baral, 3) Bishnu Baral, 4) Mostafa 5) Yousuf Ali, 6) Jentu Biswas and arrested innocent victim 1) Bijoy Baral giving opportunity to perpetrators easily to enter into the lands of the minority victims.

I along with Rabindra Nath Baral, Bibek Baral, Bijoy Krishna Baral went to meet with Mr. Akhtaruzzman S.P.,Perojpur at his chamber at about 1.20 p.m. who gave us appointment to discuss relating to land grabbing, false cases against Bijoy Baral, gang rape of minority Hindu girl - Ms. Sanjita Kulu (13) and forceful occupation of Hindu Temple at  Motbaria Upazila. Mr. Akhtaruzzaman became angry while I enquired about false case initiated by one Uttam and Dulal against Bibek and Bijoy Krishna Baral, S.P. continued to utter " Chup Beta" stop Nonsense. S.P. called some subordinate police constables to beat me and they (I will be able to identify those who assaulted me during attack) started to kick me in a solitary room by his leg and pushed me to waiting room and blocked the door from inside, snatched away my Mobile set.  In the meantime Rabindra Nath Baral was dragged into another room and he has been mercilessly beaten by those police constables by pistol but and lathi resulting injuries on his bodies and head" Mr. Akhtaruzzaman also tried to extract confessional statements intimidating other two victims namely a) Bibek Baral and b) Bijoy Krishna Baral. Those two victims will depose the actual scenario during attack on us. 

 

I, on 24.11.12 instantly communicated with the Home Secretary Mr.C.Q.K.Mustaq Ahmed, Mr.Khondakar, I.G.of Police, Mr.Phani Bhushan Chowdhury, I.G. of Police (Co-ordination) over their Telephone numbers and informed them the situation. They assured me that they will look into the matter. On 25th Nov,12, I have also informed this matter to Mr. Shamsul Hoque Tuku – Deputy Minister for Home over his cell number and he also assured me that necessary action would be taken.

 

I also also communicated with Mr. A.K. M. Awal, Member of Parliament, Perojpur and Ms. Shadhana Halder- Member of Parliament over phone about this matter.

 

Local Perojpur police took no G.D or cases against those attackers from us as the attackers are all police officers. We also went to Press Club and met with some journalist who informed us that they will not be able to publish news without permission from the Superintendent of Police, Perojpur and advised us to convene a press conference at Dhaka for taking necessary action against the police officers.

I have also gone to Mr.Biplab Goswami, District and Sessions Judge of Perojpur over his telephone who became astonished hearing the news of police assault.

I have also appraised the situation to Adv. Sayed Majibur – President of Perojpur Bar Association who also became astonished having been informed about the situation.

Bangladesh Minority Watch is very concerned about this Police assault on the Human Rights defenders at Perojpur and we condemn this attack and necessary steps for arrest Mr. Akhtaruzzaman – and his associates responsible for assault on Human Rights defenders should be made and punishment of such offence should be done and compensation should be awarded for their medical treatment.

 

Previously also police in many times  tried to assault me and our human rights defenders in course of our humanitarian activities in the ground zero level in Bangladesh since 2002 to 2012.

We have to have a "Level playing field" for ALL parties. Problem starts when our politicians use one law for their party members and use other laws for opponents. That is NOT democracy. We have vibrant media and they are one of the most effective safeguards to uphold democracy.

O K.  Tell me, in your lecturing tone, how does a political party based on a religion function in a democracy? Where would the 'beauty' reside?  In India there is BJP flaunting the inability of Babasaheb Ambedker to stop the formation of religion-based political party from Indian Constitution due to the badmaishi of Hindu Mahasabha in 1947.  Where do you see the 'beauty' in BJP politics in the functioning of current Indian democracy? How would you show us the 'beauty' in the politics of the crooks, criminals and mass-murderers among Jamaat members in Bangladesh?

Jamat was banned before, and the preachers of scientific socialism, JSD, gave them shelter.  That is the reality of politics in Bangladesh.  To render a snake harmless, one should remove it's poison tooth instead of killing it.

The demand of the civil society is to put Jamat out of politics. Is that a stupid demand also, in your view? You said - it will be stupidity to ask Jamat not to use religion for politics - because it can't survive without religion. That's what is the ultimate goal of the civil society, Mr. Chakraborty.
The later part of your remaks indicate that you are worried about consequences of Jamati-politics in the society; yet, you are not ready to put them out of politics. What are you trying to say, Mr. smart guy?

No sir. I did not say that. What I meant is this: asking Jamaat to strip itself off Islsmic agenda is sheer stupidity. Jamaat as its very name implies cannot go without Islam on its plate. Worse, the kind of Islam Jamaat caters is of worst kind. Once they come to power, they will a few Muslim sects illegal. They will not stop there. Just remember what Mr. Hannan believes. You will see all of them.

What you are saying is that there is no secularism in those societies, because secular political party manifestos do not go on a head on collision with the Islamic religious edicts. That's not the criterion of secularism. You can be secular without violating tenants of Islam. A secular manifesto should comply with all religions.
If Jamat manifesto cannot do that, and becomes oxymoronic, it will cease to exist as a political party. Do not go overboard with your generalization.

Jamaati politics without religious agenda is an oxymoron. The manifestos of our so called secular parties even are not free from religious agenda. For example, no law will contradict the Koran and Sunnah. This simply reflects the social reality and the existing power politics. 
Democracy is obviously not perfect. But in the absence of any other better alternatives, we will have to rely on the people's verdict.

Your views should influence social and political conditions in the country; that's where we need them mostly, but - I still disagree with you on the point that a country should be run by a religious group.

I like most of what you have said in your attached article. I like the moderation in the approach to deal with the non-Muslim in an Islamic country, which is a progressive step in the right direction. This is in keeping with the situation in the modern world, but - my worry is - these are views and interpretations of the moderate Islamic scholars, like you, and these interpretations can change suddenly under the more fundamental (strict) interpretations of the Islamic-laws. The recent example is Taliban-rules in Afghanistan. I know you disagree with the implementation of the Islamic laws by the Taliban, and I commend you for that. I strongly agree with you that Taliban rules were dead on arrival; they were 100% incompatible with the modern world.  I can't help but admire your efforts to bring moderate Islamic views into the main-stream. Your views should influence social and political conditions in the country; that's where we need them mostly, but - I still disagree with you on the point that a country should be run by a religious group.

I explain only one point.Dhimmi is a term used to denote protected minorities in conquered territory of Muslims .
All modern Muslim states have been achieved by joint efforts of Muslims and non- Muslims against colonial masters. So there will be no Zimmi now ) Please read Rasail wa Masail by Syed Abul Ala Maududi) .There was no Zimmi in Madinan state established by Prophet as it was not conquered territory)

Depends on how you look at it. Remember that, men are NOT allowed in all women mosques.

So women can learn about authentic religion and educate their kids accordingly.

Most Masjids have section for women all over the world (Rare in Indian sub-continent but pretty common in other parts).

So it is another creative option for women.

All woman mosque is a very negative impression of Islam; it shows that Chinese Muslim men and women cannot even pray in the same mosque, and these women are emphasizing that perception once again.

Chinese Muslims praise efforts of the women-only mosques in educating females about their religion
CAIRO – Unlike their peers around the world, Muslim women in China are enjoying having female-only mosques and getting a unique opportunity to develop their religious knowledge.
"I feel so blessed to have a mosque I can visit," 80-year-old Ma Guifang told China Daily on Tuesday, November 20.
"Not many female Muslims enjoy such a privilege."
For the past 20 years, the elderly Muslim lady from the Hui ethnic group has been attending this women-only mosque, a phenomenon unique to China.
The Lulan mosque was built in 1956 by a group of Muslim women who had relocated to Lanzhou from Henan province in central China.
Prayers are led by a male imam in a mosque 100 meters away with the service is usually piped into the room through a loudspeaker to the female worshippers.
The province's Muslim women are proud of being able to take care of their mosque.
Ma Lan, the 46-year-old caretaker, rises at 4 am to shovel coal into the boiler to ensure a good supply of hot water for the washing ritual.
She even cooperates with other female worshippers in keeping the mosque clean and ready for daily prayers and Friday congregation, which gathers about 150 worshippers.
"Women do all the work here, no matter how physical it gets," Ma said.
The mosque is financed solely by donations from female worshippers and visitors as well.
"We receive about 2,000 to 3,000 yuan ($321 to $481) a month," imam Tao Jinling said, pointing at the list of donors and how much they gave.
"Around 20 to 30 people come to the mosque every day. The number rises to around 150 during the Juma prayers on Friday."
According to official data, China has 20 million Muslims, most of them are concentrated in Xinjiang, Ningxia, Gansu, and Qinghai regions and provinces.
Unofficially, Muslim groups say the number is even higher, stating that there are from 65-100 million Muslims in China — up to 7.5 percent of the population.
In general, during Muslim prayers, women may not lead men but may lead other women, which is the case of females leading prayers in female-only mosques in China.
In Islam, the majority of jurists maintain that a woman is allowed to lead her fellow sisters in congregational prayer if there is no man to lead the congregation.
Education
Chinese Muslims praise efforts of the women-only mosques in educating females about their religion.
"Only China has women's mosques, but this is not a common practice among Chinese Muslims," said Jin Rubin, secretary-general of the China Islamic Association.
"But one thing for sure is that women's mosques can provide them with a better level of education, which Islam greatly encourages."
Wang Yuming, director of Lanzhou's Xihu mosque, which also runs a school for women, agrees.
"Muslims care about education for women because we believe they are the lighthouse of the family," he said
"Their influence helps to keep our society stable."
The school costs the mosque about 500,000 yuan every year, but Wang believes it's worth the cost.
"In addition to teaching the women about the Qur'an and Islam, we also teach them basic math and urge them to tell their children to stay away from drugs," he said.
"Female Muslims deserve a decent level of education and the mosque is the best place to provide that.
"Now that winter has come, we have to make sure the classrooms are warm enough to allow elderly students with arthritis to sit through the classes without pain," said Wang.
Studying at the school for five years, Ma Lanying, 76, said that learning is a lifelong activity for Muslims.
"I feel so proud that I can understand the Qur'an and know exactly what the prayers mean," said Ma, who walks 45 minutes to school every weekday.
Determined to change her life, Ma Aizheng, who worked as a nurse before she retired, said she makes time to study at home in the afternoon after classes finish at 11:30 am.
"Studying the Qur'an has become a spiritual support for me," said Ma.
"I didn't have time when I was working and now I have a lot catching up to do."

It appears that Bangladesh Labor Ministry may not be up to any good also. Labor   Ministry's responsibility is to setup guidelines for safety and security of the workers in all industries and work places.

The question is - how could you have outside locking system for an emergency exit? If you called it an emergency-exit, it should not be locked from outside. What kind of stupidity is this?  Any locking system has to be keyless, and from inside only. It's totally an unthinkable offense, and I, first, blame Ministry of Labor for either not implementing proper safety rules or for not strictly enforcing the rules if they exist already. Before any industry gets permission to operate in the country, there needs to be strong safety guidelines and requirement for regular drill for fire and other hazards, and inspection for any violation. These are well known safety standards in the world, and the Labor Ministry should not be unaware of these rules in this day and age. 

That being said - I also know that - there is a possibility that these rules may be already in the book, but the owner may have violated them. I also know - in Bangladesh, rules can be bent with a right price. Therefore, proper investigation is warranted in this case, and there should be exemplary punishment for any violation, and adequate compensation for victims of this senseless tragedy.

It is quite disheartening to know that someone deliberately started the fire in the factory, which has cost about 114 lives. People deserve to know the full extent of this plot. Since, Awami League has prematurely politicized the incident - the investigation should be conducted by a non-partisan panel; that could be a challenge also because - there is none to qualify as a non-partisan individual in Bangladesh. Instead, may be the panel should consist of people from all political parties.

    DHAKA, Bangladesh (AP) — Thousands of Bangladeshi workers blocked the streets of a Dhaka suburb Monday, throwing stones at factories and smashing vehicles, as they demanded justice for 112 people killed in a garment-factory fire that highlighted unsafe conditions in an industry rushing to produce for major retailers around the world.

    Some 200 factories were closed for the day after the protest erupted in Savar, the industrial zone where Saturday's deadly fire occurred. Protesters blocked a major highway.

    The government announced that Tuesday will be a day of national mourning, with the national flag flying at half-mast in honor of the dead.

    Investigators suspect that a short circuit caused the fire, said Maj. Mohammad Mahbub, fire department operations director. But he said it was not the fire itself but the lack of safety measures in the eight-story building that made it so deadly.

    "Had there been at least one emergency exit through outside the factory, the casualties would have been much lower," Mahbub said. He said firefighters recovered at least 100 bodies from the factory, and 12 more people died at hospitals after jumping from the building to escape the fire.

    Local media reported that up to 124 people were killed.

    Mohammad Ripu, a survivor, said Monday that he tried to run out of the building when the fire alarm rang but was stopped.

    "Managers told us, 'Nothing happened. The fire alarm had just gone out of order. Go back to work,'" Ripu said. "But we quickly understood that there was a fire. As we again ran for the exit point we found it locked from outside, and it was too late."

    Ripu said he jumped from a second-floor window and suffered minor injuries.

    Mahbub said the fire broke out on the ground floor, which was used as a warehouse, and spread quickly to the upper floors. He said many workers who retreated to the roof were rescued, but dozens of others were trapped; firefighters recovered 69 bodies from the second floor alone.

    Many victims were burned beyond recognition. The bodies were laid out in rows at a school nearby. Many of them were handed over to families; unclaimed victims were taken to Dhaka Medical College for identification.

    The garment-factory fire was Bangladesh's deadliest in recent memory, but such dangers have long been a fact of life as the industry has mushroomed to meet demand from major retailers around the world.

    The factory is owned by Tazreen Fashions Ltd., a subsidiary of the Tuba Group. Neither Tazreen nor Tuba Group officials could be reached for comment.

    The Tuba Group is a major Bangladeshi garment exporter whose clients include Wal-Mart, Carrefour and IKEA, according to its website. Its factories export garments to the U.S., Germany, France, Italy and the Netherlands, among other countries. The Tazreen factory, which opened in 2009 and employed about 1,700 people, made polo shirts, fleece jackets and T-shirts.

    Tazreen was given a "high risk" safety rating after a May 16, 2011, audit conducted by an "ethical sourcing" assessor for Wal-Mart, according to a document posted on the Tuba Group's website. It did not specify what led to the rating.

    Wal-Mart spokesman Kevin Gardner said online documents indicating an orange or "high risk" assessment after the May 2011 inspection and a yellow or "medium risk" report after an inspection in August 2011 appeared to pertain to the factory. The August 2011 letter said Wal-Mart would conduct another inspection within one year.

    Gardner said it was not clear if that inspection had been conducted or whether the factory was still making products for Wal-Mart. If a factory is rated "orange" three times in two years, Wal-Mart won't place any orders for one year. The May 2011 report was the first orange rating for the factory.

    "Our thoughts are with the families of the victims of this tragedy," the retailer said in a statement. "While we are trying to determine if the factory has a current relationship with Wal-Mart or one of our suppliers, fire safety is a critically important area of Wal-Mart's factory audit program and we have been working across the apparel industry to improve fire safety education and training in Bangladesh."

    In its 2012 Global Responsibility report, Wal-Mart said it ceased working with 49 factories in Bangladesh in 2011 because of fire safety issues, and was working with its supplier factories to phase out production from buildings deemed high risk.

    Bangladesh has some 4,000 garment factories, many without proper safety measures. The country annually earns about $20 billion from exports of garment products, mainly to the U.S. and Europe.

    The Bangladesh Garment Manufacturers and Exporters Association said it would stand by the victims' families and offered 100,000 takas ($1,250) to each of the families of the dead. The association's acting president, Siddiqur Rahman, said on a talk show late Sunday that Tazreen's owner was to meet with group representatives on Monday.

    "We will discuss what other things we can do for the families of the dead," Rahman said on Rtv, a private television station. "We are worried about what has happened. We hope to discuss everything in detail in that meeting."
