[ALOCHONA] brutality in Bangladesh

Banning corporal punishment extensively

Heather N. Goldsmith

The media has recently given us a glimpse into the lives of some of Bangladesh's children: a girl with disabilities was beaten for failing to contribute to the school fund, eight students were hospitalised after being punished for forgetting to bring colour pencils to class, a young girl had a mental breakdown after being tied to a bench as punishment, and a boy died after he followed his teacher's suggestion to ingest rat poison.

A 2008 study by Unicef indicates that these are not isolated incidents -- 91% of the students surveyed reported that they had been abused by teachers.

[ALOCHONA] arundhati

House Attack

Arundhati accuses TV of inciting mob

Social activists' group Sahmat (Safdar Hashmi Memorial Trust) has condemned the 'attack' on author Arundhati Roy's residence by the Bharatiya Janata Party's (BJP) women wing.

Roy, an award-winning author and activist, has accused Indian TV channels of whipping up protests against her.

About 100 female protesters from BJP, a Hindu nationalist party, surrounded her residence on Sunday to demonstrate against a speech last month in which she said Kashmir, the disputed Muslim-majority region, had "never been an integral part of India."

[ALOCHONA] Custodial death & illegal practice of W Bengal Govt.

Posted by: "Kirity Roy" kirityroy@gmail.com

Wed Nov 3, 2010 11:15 am (PDT)

* *

1st November 2010*

*The Chairman*

*National Human Rights Commission*

*Faridkot House*

*Copernicus Marg*

*New Delhi-110001*

* *

*Respected Sir,*

* *

*We conducted fact finding on the custodial death of a prisoner(Under Trial
Prisoner) at Kandi Correctional Home, Kandi, District-Murshidaba d namely
Mofik Sk, who had an unnatural death in prison on 26.9.2010. *

* *

*The body of the victim was kept in hospital morgue and on the next day i.e.
on 27.9.2010 there was an investigation by one executive magistrate under
section 176 of Criminal Procedure Code. There was also an inquiry done by
one judicial magistrate i.e. the Additional Chief Judicial Magistrate,
Kandi, Murshidabad. The inquiry by the judicial magistrate only came after
completion of the investigation by the executive magistrate who gave opinion
in his report that the death was probably occurred by disease. Therefore the
Executive Magistrate being part and parcel of the police and state machinery
was successful to manufacture one record to the end that there was no foul
play in the custodial death of the victim beforehand the inquiry by judicial
magistrate in this case. Our attached fact finding report gives details of
the incident. *

* *

*Under the new provision of law enumerated in Section 176(1-A) of Criminal
Procedure Code an executive magistrate is not empowered to hold any kind of
investigation/ inquiry in case of custodial death, such power is only given
to the judicial magistrate. This incident again shows that a systematic
violation of law is going on to screen the offenders in uniform and the
entire exercise on the part of the government officials and judicial
authorities in this case proves the arrogance of the entire system in
refuting to implement the legal procedure and abide by the rule of law with
which they are not comfortable. *

* *

*We with this letter attached one scanned copy of the report prepared by the
Executive Magistrate in a format supplied by the State Government to hold
investigation in case of custodial death under section 176 Cr. P. C. which
proves that a system has been maintained not sanctioned under the law. *

* *

*We demand that in all cases of custodial deaths, the inquiry must be
conducted by Judicial Magistrate at first hand upholding the mandates
enumerated in Section 176(1-A) of Criminal Procedure Code in its true
spirit. We further demand that where the Executive Magistrates and the
police have conducted inquest over custodial deaths after the introduction
of the new amended provisions of the Code of Criminal Procedure law so far,
the persons responsible for such lapse must be identified and properly dealt
with for dereliction of their duties. *

* *

*Thanking you,*
*Yours truly,*
*Kirity Roy*
*Secretary, MASUM * *&* *National Convener, PACTI*

* *

by the personnel of the said correctional home but he was declared 'brought
dead' by the on-duty medical officer of Kandi Sub-Divisional Hospital,
Kandi.

One unnatural death was started by the police of Kandi Police Station vide
Kandi Police Station UD Case no. 180/10 dated 26.9.2010. His (the victim)
body was kept at Kandi Sub-Divisional Hospital Morgue. Thereafter on the
next day on 27.9.2010 between 12.50 pm to 1.25 pm the inquest of the victim
was done by one Executive Magistrate at the said hospital morgue under
section 176 Cr. P. C.. The said Executive Magistrate opined in his report
that the death was probably occurred by disease.

Thereafter the post mortem examination of the victim was done at Kandi
Sub-Divisional Hospital Morgue on 27.9.2010 at about 3 pm. Reportedly our
fact finding team came to know that the post mortem examination was held in
presence of one judicial magistrate i.e. the Additional Chief Judicial
Magistrate, Kandi, Murshidabad.

Thereafter on 28.9.2010 Ms. Rejina Bibi, widow of the victim and two other

before the Additional Chief Judicial Magistrate, Kandi, Murshidabad on
29.9.2010 at about 3 pm to express their statement before the said judicial
magistrate as he was holding an enquiry on the custodial death of the
victim. The said persons duly met with the Additional Chief Judicial
Magistrate, Kandi, Murshidabad and expressed their definite apprehension
that there was foul play in the custodial death of the victim and he had no
such serious physical ailment to cause his untimely death.

On 18.10.2010 Ms. Rejina Bibi, widow of the victim sent one written
complaint through courier service to the Superintendent of Police,
Murshidabad complaining that there was foul play in the custodial death of
her husband (the victim) and she demanded that the concerned personnel of
the said correctional home must be punished for causing death of her
husband.

Our fact finding team talked with Ms. Rejina Bibi, widow of the victim and
other relatives and they told our fact finding team that on 26.9.2010 at
about 3.30 pm Ms. Rejina Bibi and her son in-law namely Mr. Kismat Sk. and
Mr. Md. Rejaul Haque were at Kandi Correctional Home, Kandi to meet with the
victim. But they were soon informed by the relatives of the other prisoners
of the correctional home that the victim in death like condition was taken
outside the correctional home by two jail wardens of the said correctional
home in a motor van. Then they were informed by one relative of another
prisoner that the victim was taken to Kandi Sub-Divisional Hospital. They
immediately rushed to Kandi Sub-Divisional Hospital, and found that the body
of the victim was lying unattended on a floor of the hospital. Then some
persons (identity not known) at the said hospital informed them that the
victim was brought in death like condition and the doctor declared him
'brought dead' before one hour ago and the jail wardens who brought him left
the place leaving him there.

[ALOCHONA] Bill Moyers at Howard Zinn Lecture Series

We honor his memory. We honor him, for Howard championed grassroots social change and famously chronicled its story as played out over the course of our nation's history. More, those stirring sagas have inspired and continue to inspire countless people to go out and make a difference. The last time we met, I told him that the stories in A People's History of the United States remind me of the fellow who turned the corner just as a big fight broke out down the block. Rushing up to an onlooker he shouted, "Is this a private fight, or can anyone get in it?" For Howard, democracy was one big public fight and everyone should plunge into it. That's the only way, he said, for everyday folks to get justice – by fighting for it.We honor his memory.                     For all those who do not have a copy at home yet  I urge them to rush to the bookstore and get a paperback of
                  A People's History of the United States

                     In the midst of the Midterm Election doldrums it will help you to see a silver lining.

                     If you are a keen learner then Zinn's book teaches you how to be a better reader of history, any history, not just the history of the USA.  In the first chapter, in tne story of Columbus' fake "discovery" of America, you will note how Zinn contrasts the postures of re;igiosity of Columbus with the humanism of a Spanish priest whose diaries exposed the cruelties inflicted by the Spanish seamen upon the natives.  I loved watching and listening to Howard Zinn on C-SPAN whenever I had a chance.

                    Some day I hope someone will write A People's History of the Indian Penninsula.

[ALOCHONA] No promises from Pakistan

Meeting of foreign secys stalls on genocide apology, stranded Pakistani repatriation, asset sharing

Pakistan once again avoided making any commitment to resolve long outstanding issues with Bangladesh, including apology for the 1971 genocide, repatriation of stranded Pakistanis, and sharing of pre-separation period state assets.

Since independence, Bangladesh has been asking Pakistan to resolve the issues which also include transfer of foreign aid that was meant for cyclone victims of 1970, and payment of war reparations. But all successive Pakistani governments, including the present one, have completely ignored the request, except repatriation of a small number of stranded Pakistanis.

Bangladesh Foreign Secretary Mohamed Mijarul Quayes raised the issues again at the 5th round of Bangladesh-Pakistan Bilateral Consultations held in Islamabad on Monday. But conveying their position on the issues, Pakistan Foreign Secretary Salman Bashir said "they remain open to continue discussion on these at all levels".

Diplomatic sources said Pakistan officials' assurances since independence are merely rhetorical. They did not take any initiative to resolve the issues. Full diplomatic ties between the two countries were established in 1976.

However, on Bangladesh's request, Pakistan agreed at the meeting to provide access to information and database particularly on geological surveys and archaeological excavations conducted by Pakistani agencies before 1971 in Mainamati, Chittagong, etc.

Mijarul led a seven-member Bangladesh delegation at the foreign secretary level consultations, which covered the entire range of bilateral relations.

Bangladesh High Commission in Islamabad, which issued a media release yesterday about the outcome of the consultations, however said the two sides agreed to give fresh thrust to promoting bilateral relations, and Pakistan suggested moving towards a comprehensive partnership.

Both sides recognised that there is an abundance of goodwill and potential for further development of relations. Pakistan agreed to the proposal of the Bangladesh foreign secretary for holding regular directors general level bi-annual meetings of the two foreign ministries.

They agreed to redouble efforts to achieve US$1 billion target set for bilateral trade, and to address the issues of market access, trade facilitation, and removal of tariff barriers for export of Bangladeshi products to Pakistan.

Bangladesh specifically sought duty free market access for value added jute products, and urged Pakistan to review its sensitive list. But there was no specific word from Pakistan regarding duty free access.

Both sides agreed on the need for easing visa procedures, and for enhancing connectivity through direct shipping and increasing the number of flights between the two countries.

Pakistan foreign secretary welcomed Bangladesh's proposal for undertaking joint initiatives to celebrate the 150th birth anniversary of Bangla poet Rabindranath Tagore, and the 100th birth anniversary of Urdu poet Faiz Ahmed Faiz.

[ALOCHONA] AL men besiege Ctg mayor’s office

AL men besiege Ctg mayor's office

Some pro-Awami League activists besieged the office of Chittagong city mayor Monjurul Alam on Tuesday in protest against the drive launched by the city corporation to remove illegal hoardings, police sources and witnesses said.

   The activists of Juba League led by its city unit joint secretary Mohiuddin Bachchu laid siege to the office of the mayor for about two hours till 5:00pm asking for halting the drive, they said. Some of the activists allegedly stormed into the mayor's office room and manhandled his staff.
   When contacted, mayor Monjur Alam told New Age that the Juba League activists entered into his office to register their protest against the drive for removing illegal hoardings from the city.
   'Some of the activists misbehaved with my office staff when they protested. I calmed down the activists and they left my office after I assured them that a meeting would be called sometime next week to settle the issue,' he said.

   'Hearing the news, many people, including activists of Chhatra Dal, came to the city corporation office but no untoward incident took place…I tackled the situation to avoid any confrontation there,' he said.
   Assistant commissioner of the CMP's Kotwali zone Mohammad Shahnawaz said that some activists of Juba League were seen kicking at the collapsible gate of the mayor's office room.
   'The activists misbehaved with people after entering the city corporation office. But somehow we managed to have them leave the place,' he said.
   'We also forced the JCD activists to leave the scene to avert a confrontation,' he added.
   Juba League leader Mohiuddin Bachchu told newsmen on the spot that the CCC had started the drive to pull down hoardings without notice.
   Police and CCC sources said that some leaders of Juba League were involved in setting up illegal hoardings in different areas of the city.Juba League denied the charges.
