Abdullah Gul is a respected person. He is not one who does not know. War crime trial has become a human right issue, particularly after skype conversation disclosue.The whole world is talking about this issue.

Turkey is a member of NATO.We should not poison our relations with Turkey. President Zillur Rahman  may reply to Abdullah Gul , the Turkish President in a suitable way. That is the proper course.

Clemency is usually asked after the sentencing of a committed crime. We do not know if they will be convicted of the crimes they are accused of, yet clemency is sought assuming they are guilty as charged. This is a very interesting case, in which religious connection is overriding the right or wrong. Why don't we wait for the verdict before we ask for pardon, Mr. President? How about the victim families if they have really committed the crimes? Who will show empathy for them, Mr. President?

Diplomatic tension has been created between Dhaka and Ankara over Turkish President Abdullah Gul's letter to President Zillur Rahman calling for "clemency" to the accused under trial in the International Crimes Tribunal for the "sake of peace in the society".

Gul requested clemency for Ghulam Azam and the other accused, foreign ministry sources said.

Tension intensified as Ankara summoned yesterday Bangladesh Ambassador to Turkey Md Zulfiqur Rahman, a day after Dhaka summoned Turkish Ambassador in Bangladesh Mehmet Vakur Erkul on Wednesday.

The foreign ministry sources told The Daily Star yesterday that content of the December 23 letter from the Turkish president is not acceptable and it is a clear interference in the internal affairs of Bangladesh.

Gul said the accused leaders of Jamaat-e-Islami are too old to stand trial and apprehended that it might cause a civil war in Bangladesh, the sources mentioned.

Dhaka was surprised to get such a letter and was going to send a reply to the Turkish president, but it was delayed because of the president's illness.

Subsequently, the visit of a 14-member delegation of Turkish NGO Cansuyu Aid and Solidarity Association from December 20 to 24 hiding their identity and misusing “on arrival visa” facilities and its inappropriate activities have made Dhaka too unhappy.

The foreign ministry summoned the Turkish envoy in Dhaka and asked him to explain the NGO team's visit without informing the government.

Acting Foreign Secretary Mustafa Kamal also handed over an aide memoir (diplomatic letter) to the ambassador in which Dhaka strongly protested Gul's letter and said it was an interference in the internal affairs of the country.

The aide memoir categorically mentioned that Bangladesh government is determined to conduct the war crimes trial as there is overwhelming support from the people.

It said the trial is taking place in the most transparent way by maintaining international standard, and categorically stated that the government will not compromise on this specific issue.

The two-page letter also mentioned the visit of the Turkish NGO delegation which it said misused the “on arrival visa” facility.

“Bangladesh believes that it is not the job of a friendly country to create any problem or confusion about an issue and hopes that this type of incident will not happen again,” the letter stated.

In 2009, Dhaka unilaterally offered “on arrival visa” for tourist, investor, business, official, diplomatic and special passport holders, while Ankara approved on arrival visa only for official and diplomatic passport holders from the middle of this year.

Talking to The Daily Star yesterday, some foreign ministry officials said the government could have sent back the NGO delegation but it refrained from doing so considering the excellent bilateral ties with Turkey and the recent exchange of visits at president and prime minister level.

They said the Turkish envoy has violated certain diplomatic norms and he can be expelled as he did not give prior information to the government about arrival of the delegation and subsequently he concealed information about its programmes and schedules.

The ambassador did not inform the foreign ministry about the delegation's meeting with leaders of BNP and Jamaat and others as well as its visit to the ICT.

A senior official said during the meeting with acting foreign secretary, the envoy claimed that the delegation's visit was not sponsored by the Turkish government, but he failed to give a satisfactory reply when asked why he accompanied the team during meetings with the opposition leaders.

Asked, a senior official that despite the tension, the existing bilateral relations with Turkey will not be affected and "our cooperation in all sectors will continue".

However another foreign ministry source told The Daily Star last night that the Turkish president wrote the letter both to the president and prime minister on December 23 and the Turkish embassy sent it to foreign ministry and the ministry subsequently sent it to Bangabhaban and PMO.

Sources said the Turkish president in his one-page letter, written in Turkish language and attached with English translation, requested Zillur not to give death sentence to Ghulam Azam and other Jamaat leaders.

President Gul said they came to know former Jamaat chief Ghulam Azam is being tried at the International Crimes Tribunal. It is learnt that this 90-year-old leader might be sentenced to death. Some other elderly leaders are also facing trial, which is a matter of great concern.

According to the Turkish president, if these leaders are punished, it might affect Bangladesh's socio-economic advancement and cause social instability and bloodshed.

Dhaka considered Gul's letter as the first ever interference since the ICT was formed in 2010, the sources said.

Reuters has reported from  Islamabad that the Pakistani Taliban have outlined conditions for a ceasefire, including the adoption of Islamic law and a break with the United States, a spokesman said yesterday, an offer a senior government official described as "preposterous".The Taliban, in a letter sent to the Pakistan daily The News, also demanded that Pakistan stop its involvement in the war pitting Afghan insurgents against the Kabul government and refocus on a war of "revenge" against India.

The letter from Taliban spokesman Amir Muawiya comes as the focus in Afghanistan shifts from a military push by Nato troops to potential peace talks, and amid speculation of a rift between top Pakistan Taliban leaders.The Pakistani Taliban are a separate entity allied to the Afghan Taliban. Known as the Tehreek-e-Taliban Pakistan (TTP), they have launched devastating attacks against the Pakistani military and civilians. "No one can take such an offer or terms seriously. The TTP is not a proper entity, certainly not one any government can negotiate with," said one senior government official. The ceasefire conditions, confirmed by spokesman Ihsanullah Ihsan in a phone call to Reuters, said Pakistan should rewrite its laws and constitution according to Islamic law.

Taliban Pakistan is an illegal violent entity. They are killing civilians and military, men and women of Pakistan. They are trying to be a state within state. Pakistan has already have most of all  the necessary Islamic laws .The only lacking is in governance and that will come only gradually if Islamic parties can get popular mandate. Without that mandate nothing can be done. Taliban can not demand their brand of extremist in a part of Pakistan only.No country can have two sets of laws in two areas.

Mathematician's Century-Old Secrets Unlocked

While on his death bed, the brilliant Indian mathematician Srinivasa Ramanujan cryptically wrote down functions he said came to him in dreams, with a hunch about how they behaved. Now 100 years later, researchers say they've proved he was right.

"We've solved the problems from his last mysterious letters. For people who work in this area of math, the problem has been open for 90 years," Emory University mathematician Ken Ono said. 

Ramanujan, a self-taught mathematician born in a rural village in South India, spent so much time thinking about math that he flunked out of college in India twice, Ono said.
But he sent mathematicians letters describing his work, and one of the most preeminent ones, English mathematician G. H. Hardy, recognized the Indian boy's genius and invited him to Cambridge University in England to study. While there, Ramanujan published more than 30 papers and was inducted into the Royal Society. 

"For a brief window of time, five years, he lit the world of math on fire," Ono told LiveScience.

But the cold weather eventually weakened Ramanujan's health, and when he was dying, he went home to India.

It was on his deathbed in 1920 that he described mysterious functions that mimicked theta functions, or modular forms, in a letter to Hardy. Like trigonometric functions such as sine and cosine, theta functions have a repeating pattern, but the pattern is much more complex and subtle than a simple sine curve. Theta functions are also "super-symmetric," meaning that if a specific type of mathematical function called a Moebius transformation is applied to the functions, they turn into themselves. Because they are so symmetric these theta functions are useful in many types of mathematics and physics, including string theory.

 
 
 

Ramanujan believed that 17 new functions he discovered were "mock modular forms" that looked like theta functions when written out as an infinte sum (their coefficients get large in the same way), but weren't super-symmetric. Ramanujan, a devout Hindu, thought these patterns were revealed to him by the goddess Namagiri.

Ramanujan died before he could prove his hunch. But more than 90 years later, Ono and his team proved that these functions indeed mimicked modular forms, but don't share their defining characteristics, such as super-symmetry.

The expansion of mock modular forms helps physicists compute the entropy, or level of disorder, of black holes.

In developing mock modular forms, Ramanujan was decades ahead of his time, Ono said; mathematicians only figured out which branch of math these equations belonged to in 2002. 
"Ramanujan's legacy, it turns out, is much more important than anything anyone would have guessed when Ramanujan died," Ono said.
The findings were presented last month at the Ramanujan 125 conference at the University of Florida, ahead of the 125th anniversary of the mathematician's birth on Dec. 22.

স্টাফ রিপোর্টার ॥ নির্দলীয় তত্ত্বাবধায়ক সরকারের দাবিতে জাতীয় নির্বাচন অনুষ্ঠানের দাবিতে জনসংযোগ কর্মসূচীর বিষয় উল্লেখ করা হলেও বিএনপি নেতৃত্বাধীন ১৮ দলীয় জোটের বুধবারের গণসংযোগে যুদ্ধাপরাধীদের বিচার বন্ধের দাবি গুরুত্ব পেয়েছে। যুদ্ধাপরাধীদের মুক্তির দাবিতে স্লোগানে চাপা পড়ে ছিল তত্ত্বাবধায়ক সরকারের দাবির বিষয়টি। খালেদা জিয়ার এ কর্মসূচীতে যুদ্ধাপরাধীদের মুক্তিই যেন প্রধান দাবি হয়ে উঠেছিল। জোট নেত্রী ও বিএনপি চেয়ারপার্সন বেগম খালেদা জিয়ার প্রতিটি পথসভায় জামায়াতের নেতাকর্মীদের ব্যাপক অংশগ্রহণ লক্ষ্য করা যায়। গণসংযোগকালে পথিমধ্যেও জামায়াত-শিবিরের নেতাকর্মীদের যুদ্ধাপরাধীদের মুক্তির দাবি সংবলিত নানা স্লোগানে সরব দেখা গেছে। একই দাবিতে শত শত ব্যানার ও প্ল্যাকার্ড নিয়ে এ কর্মসূচীতে অংশ নেয় জামায়াত নেতাকর্মীরা। 
গণসংযোগের প্রথম পথসভা অনুষ্ঠিত হয় গাবতলীতে। খালেদা জিয়া সভাস্থলে পৌঁছার আগে থেকেই সেখানে যুদ্ধাপরাধীদের দাবিতে মিছিল করতে থাকে শিবির কর্মীরা। মানবতাবিরোধী অপরাধে কারাগারে আটক নেতাদের মুক্তির দাবিতে গাবতলী এলাকায় শত শত ব্যানার নিয়ে অবস্থান নেয় জামায়াত-শিবিরের নেতাকর্মীরা। গাবতলীর এসএ খালেক বাস কাউন্টার মাঠ, মিরপুর বাঙলা কলেজ, টেকনিক্যাল মোড়, গাবতলী বাসস্ট্যান্ড এলাকায় অবস্থান নিয়েছিল তারা। পথসভা শেষে খালেদা জিয়া গাবতলী থেকে কারওয়ান বাজারের উদ্দেশে রওয়ানা হলে তার গাড়ির চারপাশে শিবিরের নেতাকর্মীরা অবস্থান নিয়ে 'সাঈদীর কিছু হলে জ্বলবে আগুন ঘরে ঘরে' 'ঘেরাও ঘেরাও ঘেরাও হবে ট্রাইব্যুানাল ঘেরাও হবে' স্লোগানে ওই এলাকা উত্তপ্ত করে তোলে। এভাবে শুধু সাঈদী নয়, যুদ্ধাপরাধের অভিযোগে আটক জামায়াতের সব নেতার মুক্তির দাবিতে সেøাগান তোলে তারা। খালেদা জিয়ার গাড়ি ধীরগতিতে টেকনিক্যাল মোড়ের দিকে এগোতে থাকলে মিছিলকারীরাও গাড়ির পেছনে এগোতে থাকে। মিছিলকারীদের হাতে থাকে প্ল্যাকার্ডে আটক জামায়াত নেতাদের ছবিও ছিল।
একই চিত্র দেখা গেছে কারওয়ান বাজার, যাত্রাবাড়ী, খিলগাঁও বালুর মাঠ, ভাটারা এলাকায়। কারওয়ান বাজারে খালেদা জিয়ার মঞ্চের সামনেই যুদ্ধাপরাধীদের মুক্তি দাবি সংবলিত ব্যানার দেখা যায়। প্রগতি টাওয়ারের সামনে অনুষ্ঠিত এ সভার সামনের দিক ছিল জামায়াত ও শিবিরের দখলে। এখানে অনুষ্ঠিত পথসভায় জামায়াতের কেন্দ্রীয় শূরা সদস্য আব্দুল্লাহ মোহাম্মদ তাহের বলেন, ১৯৭৫ সালে বাকশাল কায়েম করে আওয়ামী লীগকে চরম মূল্য দিতে হয়েছিল। এবারও তথাকথিত ও ষড়যন্ত্রমূলক ট্রাইব্যুনালের নামে জাতীয় নেতৃবৃন্দের বিচার করলে চরম মূল্য দিতে হবে। কাজেই এখনও সময় আছে ট্রাইব্যুনাল বাতিল করুন।
খিলগাঁও বালুর মাঠ এলাকাও রীতিমতো শিবিরের দখলে ছিল। এ মাঠের প্রায় দুই-তৃতীয়াংশ এলাকায় জামায়াত-শিবিরের নেতাকর্মীরা অবস্থান নেয়। ভাটারার পথসভায় যুদ্ধাপরাধের অভিযোগ দায়েরকৃত মামলা প্রত্যাহার, আটককৃতদের মুক্তির দাবি, ট্রাইব্যুনাল বাতিলের দাবিতে নেতাকর্মীরা ছিল সোচ্চার। ব্যানার, ফেস্টুন, পোস্টার, মঞ্চের বক্তব্যে ছিল একই দাবি। দিনব্যাপী রাজধানীজুড়ে খালেদার গণসংযোগকালে শিবিরের নেতাকর্মীরা তাদের দাবির বিষয়টি এ কর্মসূচীর প্রধান দাবি হিসেবে তুলে ধরে। শিবিরের একদল নেতাকর্মী গণসংযোগকালে পুরো সময়ই খালেদা জিয়ার গাড়িবহরের চারপাশে তাদের দাবির স্লোগান দেয়। খিলগাঁও বালুর মাঠের মঞ্চে বক্তব্য দেয়ার সময় ঢাকা মহানগর জামায়াতের সহকারী সেক্রেটারি ও শিবিরের সাবেক কেন্দ্রীয় সভাপতি শফিকুল ইসলাম মাসুদ অবিলম্বে যুদ্ধাপরাধীদের বিচার বন্ধ না করলে মানবতাবিরোধী আন্তর্জাতিক অপরাধ ট্রাইব্যুনাল ঘেরাও করার হুমকি দেন। এ সময় তিনি ট্রাইব্যুালকে 'অবৈধ' বলেও দাবি করেন। এর আগে গাবতলীতে পথসভায় ১৮ দলীয় জোটের শরিক জাতীয় গণতান্ত্রিক পার্টির সভাপতি শফিউল আলম প্রধান প্রধানমন্ত্রী শেখ হাসিনাকে ভারতের দালাল আখ্যায়িত করে শেখ হাসিনাকে জেলে পাঠিয়ে জামায়াত নেতা নিজামী, সাঈদীকে মুক্ত করে আনার ঘোষণা দেন। 
গণসংযোগ কর্মসূচী চলাকালে জামায়াত-শিবিরের নেতাকর্মীরা লিফলেট বিতরণ করে। এই লিফলেটে যুদ্ধাপরাধের অভিযোগে আটক জামায়াতের নায়েবে আমির দেলাওয়ার হোসাইন সাঈদীর খোলা চিঠি রয়েছে। সেই চিঠিতে সাঈদী বলেছেন, গণতন্ত্রের লেবাসধারী এই সরকার রাজনৈতিক প্রতিহিংসাবশত যুদ্ধাপরাধের দায় চাপানোর মিশন নিয়ে হেলাল উদ্দিনকে (সাঈদীর মামলার তদন্ত কর্মকর্তা) আমার বিরুদ্ধে লেলিয়ে দিয়েছে। মিথ্যাচার প্রতিষ্ঠায় স্বনামখ্যাত হেলাল উদ্দিন আমার বিরুদ্ধে ২০টি জঘন্য মিথ্যা অভিযোগ এনে, সরকারী ও দলীয় আদেশ অক্ষরে অক্ষরে পালন করতে গিয়ে আমাকে হেয়প্রতিপন্ন করার জন্য আমার নাম বিকৃত করেছে। আমার পারিবারিক পরিচয়, শিক্ষাগত যোগ্যতা, ছাত্রজীবন থেকে শুরু করে লুটেরা, খুনী, ধর্ষক, নারী সরবরাহকারী, অগ্নিসংযোগকারী, পাক বাহিনীর দোসর, দুর্ধর্ষ রাজাকার, এক কথায় এই তদন্ত কর্মকর্তা মনের মাধুরী মিশিয়ে চার হাজার পৃষ্ঠার নাটক রচনা করেছেন আমার বিরুদ্ধে। খোলা চিঠিতে সাঈদী বলেন, কোন মুসলমানের কলিজায় সর্বশক্তিমান আল্লাহর ওপর বিন্দুমাত্র বিশ্বাস থাকলে, মৃত্যুর ভয় থাকলে, পরকালে আল্লাহর কাছে জবাবদিহিতার ভয় থাকলে, জাহান্নামের কঠিন শাস্তির ভয় থাকলে অন্য কোন মুসলমানের বিরুদ্ধে শুধু আদর্শিক ও রাজনৈতিক শত্রুতার কারণে এত জঘন্য মিথ্যাচার করা সম্ভব হতো না। স্বয়ং খালেদা জিয়াও যুদ্ধাপরাধের বিচারের সমালোচনা করেছেন পথসভাগুলোতে। খালেদা দাবি করেছেন, সরকার সত্যিকার অর্থে যুদ্ধাপরাধীদের বিচার করতে পারছে না। এর আগে আওয়ামী লীগ ক্ষমতায় থাকতে যুদ্ধাপরাধের বিচারের উদ্যোগ কেন নেয়নি সে প্রশ্ন তুলেছেন বিএনপি চেয়ারপার্সন। তিনি সরকারের উদ্দেশে বলেছেন, আপনারা যুদ্ধাপরাধের সুবিচার ও স্বচ্ছ বিচার করুন। প্রধানমন্ত্রীর আত্মীয়-স্বজন ও ক্ষমতাসীন দলের ভেতরে যাঁরা আছেন তাঁদেরও বিচারের আওতায় নিয়ে আসুন। তাহলে মানুষ বুঝবে যুদ্ধাপরাধের স্বচ্ছ বিচার হচ্ছে।

১৯৭৩ প্রণয়নের পটভূমি

বাঙালী জাতির স্বাধিকার সংগ্রামের ইতিহাসে ১৯৭০-৭১-এর সাধারণ নির্বাচন একটি মাইলফলক। উক্ত নির্বাচনে এদেশের জনগণ তৎকালীন পূর্ব-পাকিস্তানের প্রায় সকল আসনে এবং পাকিস্তান জাতীয় পরিষদে একক সংখ্যাগরিষ্ঠ দল হিসেবে আওয়ামী লীগের প্রার্থিগণকে নির্বাচিত করে সংবিধান প্রণয়নসহ জনগণের রাজনৈতিক, সামাজিক ও অর্থনৈতিক অধিকার নিশ্চিত করার পে সুস্পষ্ট ম্যান্ডেট দিয়েছিল। কিন্তু তদানীন্তন পাকিস্তানী সামরিক জান্তা জনগণের এই ম্যান্ডেটের প্রতি শ্রদ্ধাশীল হওয়ার পরিবর্তে উহাকে ব্যর্থ করার ষড়যন্ত্রে লিপ্ত হয়।
১৯৭১ সালের ২৫ মার্চ দিবাগত রাতে পাকিস্তানী সামরিক বাহিনী অতর্কিত হামলা চালিয়ে নির্বিচারে গণহত্যা, ধর্ষণ, অগ্নিসংযোগসহ শান্তি ও মানবতাবিরোধী অন্যান্য অপরাধ সংঘটন করতে থাকে। এ প্রোপটে বাঙালী জাতির অবিসংবাদিত নেতা জাতির পিতা বঙ্গবন্ধু শেখ মুজিবুর রহমান ১৯৭১ সালের ২৬ মার্চ প্রথম প্রহরে ঢাকায় বাংলাদেশের স্বাধীনতা ঘোষণা করেনÑযা তদানীন্তন ইপিআরের ট্রান্সমিটার, টেলিগ্রাম ও টেলিপ্রিন্টারের মাধ্যমে বাংলাদেশের সর্বত্র প্রচারিত হয়। পাকিস্তানী দখলদার বাহিনীর এদেশীয় দোসর রাজাকার, আলবদর, আলশামস বাহিনী পাকিস্তানী হানাদারদের সহযোগিতায় স্বাধীন বাংলাদেশের মাটিতে নির্বিচারে মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা ইত্যাদি শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধ সংঘটন করে এবং দীর্ঘ ৯ মাসের রক্তয়ী যুদ্ধে ৩০ লাখ মানুষকে হত্যা করে, ২ লাধিক মা বোনের ইজ্জত লুণ্ঠন করে, প্রায় ১ কোটি মানুষ বা¯'হারা হয়ে পাশ্বর্বর্তী দেশ ভারতে আশ্রয় গ্রহণ করতে বাধ্য হয় এবং ৩ কোটি মানুষকে গৃহহারা করে। এই কুখ্যাত রাজাকার, আলবদর, আলশামস বাহিনী পরিকল্পিতভাবে অত্যন্ত ঠা-া মাথায় স্বাধীন বাংলাদেশকে মেধাশূন্য করার ল্েয বিজয়ের মাত্র কয়েক দিন পূর্বে হাজার হাজার বুদ্ধিজীবীকে নিষ্ঠুরভাবে হত্যা করে। মহান মুক্তিযুদ্ধ চলাকালে স্বাধীন বাংলাদেশে সংঘটিত মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা ইত্যাদি শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধের জন্য কোন সশস্ত্র বাহিনী বা প্রতিরা বাহিনী বা সহায়ক বাহিনীর সদস্য বা অন্য কোন ব্যক্তি বা ব্যক্তিসমষ্টির বিচার ও দ- প্রদানের জন্য বাংলাদেশ কলাবরেটরস (¯েপশাল ট্রাইব্যুনালস) অর্ডার, ১৯৭২ জারি করা হয় এবং আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩ প্রণয়ন করা হয়।
বাংলাদেশ কলাবরেটরস (¯েপশাল ট্রাইব্যুনালস) অর্ডার, ১৯৭২ অনুযায়ী বিচার কার্যক্রম

বাংলাদেশ কলাবরেটরস (স্পেশাল ট্রাইব্যুনালস) অর্ডার, ১৯৭২ এর অধীন প্রায় ৩৭০০০ অপরাধীকে আটক করা হয়Ñযাদের মধ্যে মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা ইত্যাদি শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধ সংঘটনকারী প্রায় ১১০০০ অপরাধীকে বিচারের জন্য সোপর্দ করা হয়। এই সকল অপরাধীদের বিচারের জন্য সারা বাংলাদেশে মোট ৭৩টি ¯েপশাল ট্রাইব্যুনাল গঠন করা হয়। বিভিন্ন ট্রাইব্যুনালে বিচারান্তে ২২ জনকে মৃত্যুদ-, ৬৮ জনকে যাবজ্জীবন কারাদ- এবং ৭৫২ জনকে বিভিন্ন মেয়াদে দ-িত করা হয়। ১৯৭৫ সালের ১৫ আগস্ট জাতির পিতা বঙ্গবন্ধু শেখ মুজিবুর রহমানকে সপরিবারে শংসভাবে হত্যা করা হয় এবং সামরিক শাসকগোষ্ঠী বাংলাদেশ কলাবরেটরস (¯েপশাল ট্রাইব্যুনালস) অর্ডার, ১৯৭২-এর অধীন পরিচালিত বিচার কার্যক্রম বন্ধ করে দেয়। এক সামরিক ফরমান বলে ৩১-১২-১৯৭৫ খ্রি. তারিখে বাংলাদেশ কলাবরেটরস (¯েপশাল ট্রাইব্যুনালস) অর্ডার, ১৯৭২ বাতিল করে উক্ত আইনের অধীন দ-িত ও আটক সকল অপরাধীকে মুক্তি দিয়ে তাদেরকে সামাজিক ও রাজনৈতিকভাবে প্রতিষ্ঠিত করা হয়। জেনারেল জিয়াউর রহমান তার শাসনামলে ৬ এপ্রিল ১৯৭৯ তারিখে সংবিধানের ৫ম সংশোধনীর মাধ্যমে সকল সামরিক ফরমানের বৈধতা প্রদান করেন।

৪০ বছর পরে কেন আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩ অনুযায়ী ট্রাইব্যুনাল গঠন

বাংলাদেশের তদানীন্তন প্রধানমন্ত্রী, জাতির পিতা বঙ্গবন্ধু শেখ মুজিবুর রহমানের নির্দেশে আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩-এর অধীন অপরাধ সংঘটনকারীদের তদন্ত ও বিচার পরিচালনার জন্য প্রসিকিউশন টিম গঠন করা হয়। কিš' ১৯৭৫ সালের ১৫ আগস্ট জাতির পিতা বঙ্গবন্ধু শেখ মুজিবুর রহমানকে সপরিবারে নৃশংসভাবে হত্যা করার পর এ বিচার কার্যক্রম বন্ধ হয়ে যায়। সামরিক শাসক জেনারেল জিয়াউর রহমান তার সামরিক শাসনামলে কিংবা সেনা ছাউনিতে থেকে গড়া তার দল বিএনপি ১৯৭৯ সালে অনুষ্ঠিত জাতীয় সংসদ নির্বাচনে বিজয়ী হয়ে ১৯৮২ সাল পর্যন্ত মতায় থাকা পর্যন্ত এ বিচার কার্যক্রম বন্ধ করে রাখে। ১৯৮২ সালে জেনারেল এরশাদ সামরিক অভ্যুত্থানের মাধ্যমে মতা গ্রহণের পর দীর্ঘ প্রায় এক দশক মতায় থাকাকালে আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩-এর অধীন কোন বিচার কার্যক্রম শুরু করেনি। পাকিস্তানী দখলদার বাহিনীর এদেশীয় দোসর রাজাকার, আলবদর, আলশামস বাহিনী কতর্"ক পরিচালিত মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা ইত্যাদি শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধের বিচারের দাবিতে গোটা জাতি সোচ্চার থাকা সত্ত্বেও ১৯৯১ সালের নির্বাচনে বেগম খালেদা জিয়ার দল বিএনপি অপ্রত্যাশিতভাবে মতায় যেয়ে জাতীয় দাবির প্রতি কোনরূপ সম্মান দেখাতে ব্যর্থ হয় এবং তার পূর্বসূরী জেনারেল জিয়াউর রহমান ও জেনারেল এরশাদের ন্যায় রাজাকার, আলবদর, আলশামস বাহিনীর জঘন্য অপরাধীদের বিচার করা থেকে পরিকল্পিতভাবে বিরত থাকে।
১৯৯৬ সালে জাতীয় সংসদ নির্বাচনে বিজয়ী হয়ে বাংলাদেশ আওয়ামী লীগ জাতির পিতা বঙ্গবন্ধু শেখ মুজিবুর রহমান ও তাঁর পরিবারের সদস্যদের নৃশংসভাবে হত্যাকা-ের বিচার কার্যক্রম পরিচালনার প্রধান প্রতিবন্ধকতা ওহফবসহরঃু ঙৎফরহধহপব, ১৯৭৫ বাতিল করে উক্ত বিচারকার্য স¤পন্ন করে জাতিকে কলঙ্কমুক্ত করে। একই সঙ্গে ৩ নভেম্বর ১৯৭৫ তারিখে ঢাকা কেন্দ্রীয় কারাগারে জাতীয় ৪ নেতাকে হত্যা করা সংক্রান্ত মামলার বিচার স¤পন্ন করে। কিন্তু ২০০১ সালে অনুষ্ঠিত জাতীয় সংসদ নির্বাচনে জাতীয়- আন্তর্জাতিক গভীর ষড়যন্ত্রের মাধ্যমে বিএনপি-জামায়াত জোট সরকার মতায় আসার পর বঙ্গবন্ধু হত্যা মামলার বিচার প্রক্রিয়া শেষ করে দ- কার্যকর করার ক্ষেত্রে নজিরবিহীন প্রতিবন্ধকতা সৃষ্টি করে জাতিকে নতুনভাবে কলঙ্কে ফেলে দেয়। মহান মুক্তিযুদ্ধকালে মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা, শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধের হোতা রাজাকার, আলবদর প্রধানদের মন্ত্রিত্ব দিয়ে বেগম খালেদা জিয়া নতুনভাবে বাঙালী জাতিকে কলঙ্কিত করেন এবং বহু রক্তের বিনিময়ে অর্জিত স্বাধীন বাংলাদেশের জাতীয় পতাকার চরম অবমাননা করেন। এমনকি ১/১১-এর পর মতা গ্রহণকারী তত্ত্বাবধায়ক সরকারও তাদের মেয়াদকালে এ বিচারের কোন উদ্যোগ গ্রহণ করেনি।
বাঙালী জাতির দীর্ঘদিনের যৌক্তিক দাবি ও আকাড়ার প্রতি সম্মান প্রদর্শন করে বাংলাদেশ আওয়ামী লীগের নেতৃত্বে গঠিত মহাজোট ২০০৮ সনে অনুষ্ঠিত নবম জাতীয় সংসদ নির্বাচনে তাদের নির্বাচনী ইশতেহারে মহান মুক্তিযুদ্ধকালে মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা, শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধ সংঘটনকারীদের সুষ্ঠু বিচার করে দ- প্রদানের মাধ্যমে জাতিকে কলঙ্কমুক্ত করার অঙ্গীকার ব্যক্ত করে। মহাজোট সরকার মতা গ্রহণের পর জাতির পিতা বঙ্গবন্ধু শেখ মুজিবুর রহমান ও তার পরিবারের সদস্যদের নৃশংস হত্যা মামলার বিচার প্রক্রিয়া সফলভাবে স¤পন্ন করে দ- কার্যকর করার মাধ্যমে জাতিকে সুদীর্ঘকালের কলঙ্ক থেকে মুক্তি দিয়েছে। একইভাবে মহাজোট সরকার তাদের নির্বাচনী ইশতেহারে জাতিকে দেয়া প্রতিশ্রুতি বাস্তবায়নের লক্ষ্যে মহান মুক্তিযুদ্ধকালে মানবতাবিরোধী অপরাধ যেমন খুন, ধর্ষণ, অগ্নিসংযোগ, লুটতরাজ, বলপূর্বক ধর্মান্তরিত করা, শান্তির বিরুদ্ধে অপরাধ, গণহত্যা এবং যুদ্ধাপরাধসহ আন্তর্জাতিক আইনের অধীন দ-যোগ্য অন্যান্য অপরাধ সংঘটনকারীদের সুষ্ঠু বিচার করে দ- প্রদানের মাধ্যমে জাতিকে কলঙ্কমুক্ত করার জন্য নবম জাতীয় সংসদের ২৯ জানুয়ারি ২০০৯ তারিখে অনুষ্ঠিত অধিবেশনে সর্বসম্মতভাবে সিদ্ধান্ত গ্রহণ করে। সার্বভৌম জাতীয় সংসদের সর্বসম্মত সিদ্ধান্তের ভিত্তিতে আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩-এর ধারা ৬ অনুযায়ী ২৫ মার্চ ২০১০ তারিখে আন্তজাতিক অপরাধ ট্রাইব্যুনাল গঠন করা হয়।

আন্তর্জাতিক অপরাধ ট্রাইব্যুনাল গঠনের উদ্দেশ্য

আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩-এর অধীন প্রধানত যে সকল উদ্দেশ্যে আন্তর্জাতিক অপরাধ
ট্রাইব্যুনাল গঠন করা হয়েছে তা হলোÑ
(১) দেশে আইনের শাসন সুপ্রতিষ্ঠিত করা
(২) ঘৃণ্য অপরাধীদের মাফ করে দেয়ার সংস্কৃতির অবসান করা
(৩) তিগ্রস্ত ব্যক্তিদের সুবিচার পাওয়ার অধিকার নিশ্চিত করা
(৪) জাতিকে কলঙ্কমুক্ত করা

আন্তর্জাতিক অপরাধ ট্রাইব্যুনালের প্রকৃতি

আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩ গণপ্রজাতন্ত্রী বাংলাদেশের সার্বভৌম জাতীয় সংসদ কর্তৃক প্রণীত একটি দেশীয় আইন এবং এ আইনের ৬ ধারার অধীনে গঠিত ট্রাইব্যুনাল একটি দেশীয় ট্রাইব্যুনাল। আন্তর্জাতিক অপরাধ (ট্রাইব্যুনালস) আইন, ১৯৭৩-এর ধারা ৩-এর উপধারা (২) এ সংজ্ঞায়িত অপরাধসমূহ আন্তর্জাতিক আইনে সংজ্ঞায়িত অপরাধসমূহের পর্যায়ভুক্ত বিধায় আইনটির নামকরণ করা হয়েছে ঞযব ওহঃবৎহধঃরড়হধষ ঈৎরসবং (ঞৎরনঁহধষং) অপঃ ১৯৭৩ অর্থাৎ আন্তর্জাতিকভাবে সংজ্ঞায়িত অপরাধের পর্যায়ভুক্ত যেসব অপরাধ এ আইনের ধারা ৩-এর উপধারা (২) এ সংজ্ঞায়িত করা হয়েছে ঐসব অপরাধে অভিযুক্ত ব্যক্তিগণের বিচারের জন্যই দেশীয় আইনের অধীনে দেশীয় ট্রাইব্যুনাল গঠন করা হয়েছে।
