Indians occupy vast Bangladesh land in Sylhet border
 
Sylhet, Dec 29 (UNB) - Indians have allegedly occupied 32 kilometers of Bangladesh land in border areas of Bianibazar and Zakiganj upazilas of Sylhet district.
 
Local administration and land settlement officials of the two upazilas and local people said the occupied land has been omitted from the survey list at India's instigation in order to keep those out of the land settlement survey which is being jointly conducted by Bangladesh and India in the border.
 
Besides the 32 kilometers of land, they said, another 712 acres of Bangladesh land at Noagaon Mouja of Muria union in Bianibazar upazila was also occupied by the Indians and being used by them for long.These lands were not included in the ongoing land settlement survey and also left out of the two countries' boundary talks and previous surveys under pressure from India, it was alleged.
 
Bangladesh may lose these vast tracts of lands unless steps are not taken immediately to include those in the current land settlement survey, the local administration cautioned.
 
According to upazila land settlement officials, Boundary Commission chief Sir Cyril Radcliff, in collusion with Indian Congress leaders, submitted a report in British parliament on August 17 in 1947, illegally including three frontier thanas - Patharkandi, Ratabari and Badarpur - in Assam. The three thanas originally belonged to erstwhile East Pakistan on the basis of plebiscite held on the eve of partition of the sub-continent.
 
Similarly, the 32 kilometers of land from the mouth of Barak river at Haritikar to Gajukata near midstream of Kushiara river was originally given to erstwhile East Pakistan and later occupied by India in 1947. No initiative has been taken so far even after the independence of Bangladesh to recover the occupied lands, nor any measures taken to include the matter in the two countries` agenda of negotiations or in the survey records.
 
As a sequel to Indian conspiracy, Bangladesh also lost its sovereignty over 712 acres of land in the border between Sylhet`s Bianibazar and Karimganj thana of Assam.
 
Banking on the Radcliff report, the Indian authorities forcibly occupied the land during the Pakistan period but later agreed to return it to Bangladesh following the independence of the country.
 
But, on August 19 in 1999, more than 50 Indian nationals, backed by Indian Border Security Force (BSF) intruded into Bangladesh territory and occupied the land, driving away the Bangladeshis who had been living there for centuries.The land remained under Indian occupation since then and no step was taken by the Bangladesh government for the recovery of the land.

Indian Border Security Force (BSF) has not yet responded to a proposal made by Border Guards Bangladesh (BGB) during a director-general level meeting in March to shut scores of phensidyl factories across border in India.Officials of Department of Narcotics Control and other sources told UNB that phensidyl smuggling into Bangladesh from India alarmingly increased in the last 1 and half years because of lax border vigilance.
 
They said smuggling of phensidyl and other contraband drugs have shot up following change of government in both Bangladesh and India couple of years ago and last year's February 25-26 carnage at BDR headquarters in Dhaka.They said that lack of effective border control because of shortage of border guards following BDR mutiny, smugglers stepped up operations across the India-Bangladesh frontier.
 
Quoting a BGB source Narcotics Control officials said not only India, contraband items are being smuggled into Bangladesh from Myanmar too.About 32 types of narcotics and contraband items were pouring in through 512 points along the 4,400-kilometer long frontier with India and Myanmar, they informed.Alluding to a statistics made recently in this regard by Family Health International, they said different types of banned drugs worth over Tk 347 crore are being smuggled into Bangladesh from India every year.
 
A UN survey recently revealed that about 65 lakh (6.5 million) people, including 9 lakh women regularly use different types of contraband drugs in Bangladesh while another 1 lakh peddle with banned drugs.But Narcotics Control Department put number of drug addicts in the country at 46 lakh (4.6m).
 
Talking to UNB, Wadudul Bari Chowdhury, Director Operation, Narcotics Control, admitted that the department is outmoded and understaffed to cope with growing number of narcotics related criminal activities and smugglings on borders.
 
Among other causes, lack in coordination with other law-enforcement agencies and acute shortage of logistics supply are impeding their efforts to check use of narcotics and curb smuggling, he added.Proposals have been made to the government to update the department, he told UNB.
 
Admitting this, DG Khandaker Mohammad Alim said besides putting proposal to government for developing the department, joint meetings with India are being arranged to discuss trans-border narcotics smuggling and curbing those effectively. Officials of both countries' narcotics sat across the table recently in India to discuss the problem.
 
BGB sources said they requested BSF to shut 132 Phensidyl factories located at Indian villages bordering Bangladesh during DG-level meeting of the two countries' border guards held in Indian capital at end of March but the Indians paid no heed to their request. Besides, they mentioned that there are 52 Phensidyl factories in India's West Bengal state near Jessore border and 70 other factories along the 72km border with India near six bordering districts.
 
Moreover, list of 10 heroin-making and processing factories were placed before BSF DG for taking immediate action against those but no step was taken although nine months have passed, they said.
 
A BGB official said among 32 drugs, Phensidyl, heroin, hemp, yaba tablets, wine, beer, Lupegesic injection, pathedin, morphine, Viagra tablet, icepill, rectifying spirit, etc are mostly smuggled into the country from India. Many other drugs, including yaba, pour in through the southern-most border with Myanmar.Though discussions were held between narcotics officials of India and Bangladesh no talks were held with Myanmar as yet, Narcotics and BGB officials said.

King Birendra was a great nationalist who strongly believed that Nepal's history and tradition have bound her people and Monarchy in an enduring and intimate relationship, injecting in the Institution an inherent feature of honoring and being guided by popular will and aspiration of the people. King Birendra was born in 14 Poush (29 December) 28 Dec.1945, in the time of 2nd Great war. King Birendra followed the path of the great nationalist- King Mahendra and he supported the decision to continue Hindu Kingdom in the constitution. Hindu Kingdom and the King Birendra's proposal to declare Nepal a zone of peace are the norms of the Nepal's prestige and security opinion. From the time of accession to the throne, King Birendra supported the democratic norms and rules. He made the people's direct participation in the nation's development and went on nation-wide tour encouraging all sectors. He bore the expenditure and arranged for medical treatment in US for the democratic leader of Nepali Congress BP Koirala, King Mahendra and his opposition. King Birendra held referendum on state's political system reflecting the democratic image of Nepal's monarchies. He played a big role in development based on geography in mountains, hills and Tarai plains.

King Binendra was a development- oriented people's king. The welfare of the people was always uppermost in his mind. He always endeavored to live up to their expectations and ensure a balanced all-round development. During his coronation in 1975, he declared free primary education throughout the country and also proposed that Nepal be declared a Zone of Peace. Including USA, 116 nations support the declaration of Zone of Peace but India denied it. Nepal has had ties with India since the Muslim rule there, but Nepal always faced a threat from India. In the name of democracy (Indocracy), India always plays the Drama with Nepalese agents-the traitors.

In 1988 India initiated economic blockade on Nepal causing much suffering to the people. In the meantime, India reached out power hungry and demoralized political leaders to initiate uprising in Nepal. Indians had tried to threaten the then King Birendra through the India sponsored uprising and bring him under the Indian grip. India wants to take over the Nepal's defence and foreign policy by rendering it into such ranks as of a failed nation. After the palace macassare-2001, His Royal Highness Prince Gyanendra, according to the constitution, was proclaimed king of the Kingdom of Nepal.

When the new king Gyanendra was maintaining the system, then, since 2005, India had laden the Maoist rebellion along with Nepali Congress, UML and others with the 12-point agreement for so-called Loktantra. That movement that ensued after the 12-point agreement was not for a republic state. The movement had stopped only with an agreement between the king and the political parties with the internal consent of the Maoists. In the agreement, it was agreed that the sovereignty of the country would be handed over to the people with the king as the constitutional monarch. After the movement stopped the country failed to take the agreed path with the parties involved in the movement in the name of people's movement breached the agreement and overstepped the constitution. The South Bloc and the notorious- Indian intelligence agency-RAW used the Maoists, congress and UML to breach the agreement and to eliminate monarchy. This was a great betrayal to the country.

Let it be. History can decide the fact. It was a matter of grief that the Nepalese people had to bear the sudden loss of their beloved 'Monarch' in a dreadful and unanticipated incident that occurred in the Narayanhity Royal Palace on 1st June 2001. That was open-secret that Prince Dipendra and Devyani (daughter of Pashupati Rana whose father in law's house is Gwoliar-India) were used by RAW in the Royal massacre. reality is that on the massacre night (7-9 PM), Devyani was in Dugad Niwas near by the Indian-Embassy at Lajimpat, and was asking the activities of Prince Dipendra to his ADC, Raju Karki, now he is in America. After the massacre, she left that place and first of all, PM Girija Prasad sent the message to Indian PM from the Army Hospital by telephone where the death bodies were there. But, just after the massacre, the next day, Devyani departed to Delhi when Girija was the powerful Prime minister. Mr. Bijayamani Dixit has commented-'The unsolved murder mystery of Indian PM Lal Bahadur Shastri (PM of India who was poisoned in Masco) and mystery of Royal Palace massacre may be hatched by RAW.' History says and everybody knows the monarchy is a symbol of Nepalese unity and nationality. In between the two big neighbors- China and India, the monarchy has been playing a balanced role. So, Nepalese monarchy is the most convincing identity of Nepal's independence and democracy. King Gyanendra is also a nationalist like king Mahendra who can stand with cause and effect on national scenarios. The 1 June 2001 incident shocked the nation, when their Majesties King Birendra and Queen Aishwarya, Their Royal Highnesses Prince Nirajan and Princess Sruti Rana along with five other Royal Family members and relatives lost their lives after being fatally wounded during a family gathering at the Narayanhity Royal Palace.

Now, the country is standing on the verge of dismemberment in the last five years. When the relationship between the king and the people have been detached one can easily imagine, Nepal can't remain safe and unified if monarchy is actually abolished from the country. Now, the traitors are being active to blame the royal institution. There are so many evidences that they have well-planned design to defame the King Gyanendra as well as the crown prince Paras who are becoming popular among the people. The people are demanding- 'King come save the nation' without hesitation. We have a current incident on the crown prince-PARAS-13th Dec.2010. The Crown prince was celebrating the birthday ceremony of his daughter. The foreigner, citizen of Bangadesh, most culprit man, Rubel Chaudhari, the brother in law of Sujata Jost-German citizen, came to the table where Paras was sitting with his family, the nonsense Rubel Chaudhary started to threaten the royal family and denounced the Nepalese people. But, Paras tried to advise to late patience, but Rubel was blaming him at that moment. That was the mail reason about the grand design of conspiracy by Rubel at Tiger Tops resort-Chitwan.

Without cause, Paras was arrested so quickly by the government where the traitor PM-Madhab Nepal, the nonsense NC president Susil Koirala, RAW agent Krishna Sitaula were active to arrest and blaming. But the Nepalese people became aggressive and agitated against the government's decision. After the naked action on the Crown Paras, all the leaders have exposed. In such antinationalist activity, Crown prince Paras said- 'I am always been inspired and encouraged to be independent Nepali citizen. No obstacle or influence will ever diminish extreme love and respect for my nation. I have full faith and trust that all Nepalese in Nepal and other parts of the world will continue to bravely and actively work in keeping intact the integrity and sovereignty of Nepal.'(23 Dec.2010 People Review).

Being a liberal and democratic aspiration, sometimes the crown prince Paras shows the common activities. But, if anybody meets him, he will impress with him as a good personality. Pous 15, (Dec.30) is the birth day of the crown Prince-Paras. On this occasion, I extend thanks him for his good health and prosperity. I hope, Paras as well as the nationalist people will be able to reinstate the beloved monarchy. Because, the Interim Constitution that walked the unconstitutional path by stepping over constitutionalism was in itself handicapped. The declaration of republic on 28 May was unconstitutional. It was against the mandate of the Nepalese people.

In a country with such geographical and ethnic diversities Nepal will fall into a severely dangerous situation because of the tug of war for power and money. This can be avoided if there is monarchy because monarchy is always impartial politically and of the political parties. All of us are against if there are anomalies within the royal institution, but those things could be sorted out through negotiation with the monarch. But, it is our unfortunate that the politicians have learnt no lesion from their past mistakes. To make no mistakes is not in the power of man, but from their errors and mistakes that wise and good learn wisdom for the future.

Constitutionalism is the way of the nation. But the profounder of parties don't like the follow the norms of the constitution and existing laws. There is establishing the anarchism by such destructive activities. The leaders of Nepal Congress, UML, Maoists and other don't like to improve their mistakes.

It is true that there are many countries which do not have monarchy still they could remain independent and prosperous. But, some communist parties take monarchy as the root cause of Nepal's all woes. But, this is not correct. Nepalese king has ever acted or walked on the path which is against Nepal's national interest. Nepal could remain an independent and sovereign country only because of monarchy. The permanent institution- 'Monarchy' can put unites the cordial relation between Nepal & India. In between the two big neighbors-China & India, the monarchy had been playing a balanced role. Nepalese monarchial system has been supporting-'One China policy'- Tibet as an integral part of China. But, in the absence of Monarch- RAW (India's the Research and Analysis Wing) and CIA (Intelligence agency of America) approach their agendas to destroy the Nepalese identity, unity and the Chinese integration.

Nepalese around the world and Nepal's well-wishers are anxious about this conspiracy against monarchy by some deviant leaders. Former minister and elder son of the founder of Nepali Congress BP Koirala's elder son Prakash Koirala says–'After republic was declared, no one is secure. Due to the passiveness of nationalist elements, to much foreigner are playing to desintrigate the Nepalese unity in the current vacuum. The 12 points agreement was worked out of Delhi. All these destructive works were carried out from Delhi. The republic was declared by the force of Indian leaders. King did not take decisions under foreign pressure. Nepali Congress's major ideology is constitutional monarchy and multi-party democracy. Constitutional monarchy and multi-party democracy is still a need in Nepal. But, the international force- such as India, America removed the monarchy. Girija Prasad (uncle) created chaos in the country. There is no law and order and the presence of the government is nil.' The unnecessary conflict between the political parties and the king came up because of the mistakes and blunders of Nepali Congress and the CPN-UML and the authoritarian thinking of the Maoist. In this context, the former minister Padmasundar Lawoti says-The Monarchy will itself emerge eventually. Rest assured. We need not to advocate for the revival of the monarchy because the people know it better as to who were responsible for the current political instability-a mess in effect- in the country. The Constituent Assembly has already become defunct and thus there is the urgent need for its dissolution. Why the Maoists are following the agenda of expansionism and imperialism, minimizing this truth forcefully? The Maoists should understand the glorious history of Nepal's sovereignty with the monarch.

Some people lacking information about Nepal's geo-political stand point along with the cultural history as the king remained symbol of unity in diversity take as an obsolete and ancient institution, but not all countries with monarchy are deprived and destitute. In the context of Nepal, the political parties can always get along with monarchy. History is evidence that the parliamentary parties, mainly the Nepali Congress and the UML, who came to power after 1990 completely failed to steer the country and they handed over power to the King in 2001. Later when they failed to get position and power they climbed on the shoulder of the Maoists to launch an anarchic struggle by the hints of the notorious Indian intelligence-RAW. The Nepalese monarchy has no role in bringing this sorry state of this country. So, Nepalese people shall not remain quiet if these political parties try to destroy the identity of this country, monarchy, Hindu-kingdom and the tradition and the basic foundation of Nepal.

We Nepalese people no longer want the unconstitutional rule of the so called visionless larger party leaders including Maoists. The Nepalese only believe in parliamentary democracy and always follow the constitutional path. Now, the only way would be the acceptance and restoration of benevolent and people-oriented monarchy. There is, thus, no way other than to form a national government of all sides, reinstating the 1990 constitution including the king, through a broad conference and find a way out to solve the country's problem. So, on the occasion of birth memory of King Birendra, we should never forget his great patriot actions. Long Live the Nepalese Monarchy.

The High Court on Wednesday released the full text of its judgement declaring illegal constitutional amendment that had legitimised the military rule by Hussain Muhammad Ershad.
 
The bench of Justice AHM Shamsuddin Chowdhury Manik and Justice Sheikh Md Zakir Hossain that delivered the watershed judgment earlier on August 26 made the full text available at around 3:00pm, reports our staff correspondent.
 
Attorney General (AG) Mahbubey Alam later briefed the press about the judgement."Proclaiming martial law ravaging the constitution accounts to treason. It can't be pardoned," the AG said quoting from the judgement.Pointing out that different countries in the world have duly punished the autocrats. This should be the case in Bangladesh too. The parliament and the government can decide on his fate, the AG said while reading out from the verdict.
 
Parliament can make law to stop further extra-constitutional usurpation of state power and bids to grab state power.
 
Ravaging the constitution, Khandker Mushtaque Ahmed proclaimed martial law, the AG said, adding that the HC verdict also denounces Ziaur Rahman for introducing military rule in the country. Ershad had usurped power following the path shown by Zia, the verdict says.
 
Ziaur Rahman made a bigger blow to the nation by wiping out the fundamental state principles --secularism and Bengali nationalism -- that were the main spirit of the Liberation War, the AG said quoting from the verdict.
 
Zia had released the anti-Liberation War forces that committed crimes like murder, rape, and arson during the Liberation War in 1971 by repealing the Dalal Ain, the verdict says, adding that he had rehabilitated the local collaborators of Pakistan's auxiliary forces.
 
"In the follow-up to these injustices, Ershad dared to usurp power and ravage the constitution. He later brought the seventh amendment (on November 10, 1986) to legitimise all his actions under martial law, regulations and orders," the AG said while reading out from the judgement.
 
The court observed that the seventh amendment to the constitution came following the fifth amendment, said the AG.The then chief of army staff Lt General HM Ershad proclaimed martial law on March 24, 1982, suspending the constitution and dissolving parliament. He also ousted elected president Justice Abdus Sattar and his council of ministers from office.
 
Ershad declared himself the chief martial law administrator (CMLA), seizing powers of the chief executive and head of the government.Ershad had snatched state power from the then president Justice Abdus Sattar by illegal means as Khandker Mushtaque Ahmed, Abu Sadaat Mohammad Sayem and Maj Gen Ziaur Rahman had done the same earlier.
 
As their takeovers and regimes were illegal and unconstitutional as per the Supreme Court judgement on the constitution's fifth amendment, Ershad's takeover was also illegal and unconstitutional, the court said while delivering the verdict on August 26.
 
The August 26 verdict came in response to a writ petition filed by one Siddique Ahmed of Chittagong in January. He challenged the legality of the seventh amendment that had ratified the proclamation of martial law and other regulations, orders and instructions by Ershad between March 24, 1982, and November 10, 1986.
