The Ongoing Torture of Syed Fahad Hashmi

Today in New York City, the U.S. is torturing a Muslim detainee with no prior criminal record who has not even gone to trial. 

For the last almost three years, Syed Fahad Hashmi has been kept in total pre-trial isolation inside in a small cell under 24 hour video and audio surveillance.  He is forced to use the bathroom and shower in full view of the video.  He has not seen the sun in years.  He takes his meals alone in his cell. He cannot see any other detainees and he is not allowed to communicate in any way with any prisoners.  He cannot write letters to friends and he cannot make calls to anyone but his lawyer.  He is prohibited from participating in group prayer.  He gets newspapers that are 30 days old with sections cut out by the government.  One hour a day he is taken into another confined room where he is also kept in total isolation.   

Children are taught that the U.S. Constitution protects people accused of crimes.  No one is to be punished unless their guilt or innocence has been decided in a fair trial.  Until trial, people are entitled to the presumption of innocence.  They are entitled to be defended by an attorney of their choice.  And the Eighth Amendment to the U.S. Constitution prohibits cruel and unusual punishment.

The punishment of Mr. Hashmi has been going on for years while he has been waiting for trial.  In addition to the punitive isolation he is subjected to today, he was denied the attorney of his choice. He was allowed only counsel investigated and pre-approved by the government.  He is not allowed to look at any translated documents unless the translator is pre-approved by the government. He is not allowed any contact with the media at all.  One member of his family can visit through the heavy screen for one hour every other week unless the government takes away those visits to further punish him.  The government took away his family visits for 90 days when he was observed shadow boxing in his cell and talked back to the guard who asked what he was doing.

If the Constitution prohibits cruel and unusual punishment, what is the impact of forced isolation?  Medical testimony presented in his case in federal court concluded that after 60 days in solitary people's mental state begins to break down.  That means a person will start to experience panic, anxiety, confusion, headaches, heart palpitations, sleep problems, withdrawal, anger, depression, despair, and over-sensitivity.  Over time this can lead to severe psychiatric trauma and harms like psychosis, distortion of reality, hallucinations, mass anxiety and acute confusion.  Essentially, the mind disintegrates.

That is why, under international standards for human rights, extended isolation is considered a form of torture and is banned. The conditions and practices of isolation are in violation of the Universal Declaration of Human Rights, the U.N. Convention against Torture, and the U.N. Convention on the Elimination of All Forms of Racial Discrimination.

In 1995, the U.N. Human Rights Committee stated that isolation conditions in certain U.S. maximum security prisons were incompatible with international standards. In 1996, the U.N. special rapporteur on torture reported on cruel, inhuman, and degrading treatment in U.S. supermax prisons.  In 2000, the U.N. Committee on Torture roundly condemned the United States for its treatment of prisoners, citing supermax prisons. In May 2006, the same committee concluded that the United States should "review the regimen imposed on detainees in supermax prisons, in particular, the practice of prolonged isolation."

John McCain said his two years in solitary confinement were torture. "It crushes your spirit and weakens your resistance effectively than any other form of mistreatment."  The reaction of McCain and many other victims of isolation torture were described in a 2009 New Yorker article on isolation by Atul Gawande.  Gawande concluded that prolonged isolation is objectively horrifying, intrinsically cruel, and more widespread in the U.S. than any country in the world.

Who is this man?  Syed Fahad Hashmi grew up in Queens and attended Brooklyn College. He became an outspoken Muslim activist.  He moved to London and received a master's degree in international relations there.

Yet the federal judge hearing his case continues to approve of the forced isolation and the rest of the restrictions on this presumably innocent man.

The reason that this is allowed to continue is that Hashmi is accused of being involved with al Qaeda.

Mr. Hashmi is accused of helping al Qaeda by allowing rain gear (raincoats, ponchos and socks) that were going to Afghanistan to be stored in his Queens apartment, he allowed his cell phone to be used to contact al Qaeda supporters and he made post-arrest threatening statements.

Supporters of Fahad have demonstrated outside his jail, set up a website – www.freefahad.com and have worked for years to alert the public to his torture.  Articles by Amy Goodman, Chris Hedges and Jeanne Theoharris have been written over the past several years documenting and protesting these human rights violations.

But, once accused of connections with terrorism or al Qaeda, apparently, the U.S. constitution and international human rights apparently do not apply.  Torture by the U.S. is allowed.  Pre-trial punishment is allowed.  The presumption of innocence goes out the window.  Counsel of choice is not allowed. Communication with news media not allowed.

The trial of Syed Fahad Hashmi is set for April 28, 2010 in New York.  Till then he will continue to be tortured by the U.S. government whose star spangled banner proclaims it to be the land of the free and the home of the brave.

Dhaka, April 04 (bdnews24.com)--Prime minister Sheikh Hasina urged Khaleda Zia to sue Fakhruddin Ahmed and Moeen U Ahmed for their alleged misdeeds committed during the tenure of the military-controlled interim government. Hasina made appeal to the opposition leader during her unscheduled speech in parliament on Sunday after the BNP had staged a walkout led by Khaleda.

Khaleda had alleged that the ruling party was not initiating legal action against the two Ahmeds since the Awami League had made a secret deal with the interim government for going to power.

Addressing BNP chairperson Khaleda Zia, the prime minister said that she was efficient in filing cases and carrying out attacks. "It is better that you sue Fakhruddin-Moinuddin." Sheikh Hasina made the statements following BNP's walkout from parliament protesting against a bill endorsing pay hike of a number of top office bearers of the republic and the government including the president, prime minister, chief justice, speaker, ministers and MPs. "You have filed 10 cases against me," said Hasina.

The prime minister said that the judiciary was absolutely free and asked Khaleda to go ahead and sue the two Ahmeds. "We will not interfere at all."

Hasina continued, saying that it was the BNP that had made Moeen U Ahmed the army chief hoping that he would help her [Khaleda Zia] to rig the elections. "She made Gen Moeen army chief superseding 10 officers"

"And who made Fakhruddin Ahmed, the government of Bangladesh Bank?" asked the prime minister. "They are all her people," she said.

We are a country at the brink of meltdown â€" literally. The power crisis has now reached levels were fertilizer plants have closed, businesses are collapsing, farmers are losing crops and life in Bangladesh is becoming unbearable. We are now reading that thousands of people went out on demonstrations and attacked the upazila office of the West Zone Power Distribution Company at Bhanga on Saturday afternoon and Palli Bidyut Samiti office at Alfadanga on Friday night demanding power supply. SM Kobad Hossen, 50, a resident of Alfadanga, said they had received power hardly for two hours a day for a few days! Is this right Prime Minister! This is the start of more demonstrations to come!

Prime Minister Sheikh Hasina on Saturday promised to ensure electricity for all within 2020. Referring to the election manifesto of Awami League she said the government is working with a target of increasing power generation by 7000 MWs by the year 2013 and by 20,000 MWs by 2021. Under this programme, agreements have been signed for producing electricity from rental power stations at private initiatives at the first phase and for generating 1,000 MWs power at public sector. "Construction of these power stations is going on at a faster pace," she added.

Can we afford to wait for 2020! No. Sure the Government is hiring power stations to meet power demand, but whatever happened to the building of power stations under a public / private development initiative â€" the reality is that no private enterprise is going to invest significant sums in building power stations when there is no certainty as to as power will be generated!

What is also missing from the political rhetoric is the means of feeding these rental power stations â€" we are running short of gas and the current country coal production is nothing short of an embarrassment to a Government that has been in power for well over a year. For a year now we have heard nothing but political words!

Prime Minister Sheikh Hasina said measures were taken to import Liquefied Natural Gas (LNG) from Qatar to resolve this crisis. She said further "We are also considering with importance diversification of energy." That the present government is actively considering installing nuclear power plants to meet the increasing demand of power. In this regard, a team will be visiting Russia soon.

Does the Prime Minster realise the time frames for getting a nuclear power plant up and running and the costs involved! Does the Prime Minster understand that businesses and farmers cannot afford to install solar heating power systems! Does the Prime Minster realise that other countries are suffering from power shortages and so expecting to rely on the importation of overseas produced power is not a solution.

We are now a country that is on the verge of civil war with a Government that is unable or unwilling to act. Bangladesh is sitting on masses of coal reserves â€" enough to meet the countries power needs for many decades, by which time the energy world will be a different place (and Bangladesh will be a different place). Asia Energy is ready to mine Phulbari and has completed all preparation work. Yes, there will be local inconvenience, but even the people of Phulbari would accept that we must all work for the greater good of our nation. It is now a matter of working with the people of Phulbari to relocate people fairly and humanely.

The Finance Minister's realistic conclusion to go for open-pit coal mining published last week was seen by many to be a break through of common sense! We breathed a sigh of relief that our plight for energy was over. Asia Energy's proposal can no longer be ignored and must be put to the top of the political agenda.

Please Prime Minister Sheikh Hasina, come live in the real Bangladesh world were business are fighting for survival, farmers are losing crops and your Bangladeshi people are melting in the heat of the day. Is this a country that can encourage international business investment? Bangladesh is not a country welcoming foreign investors.

The time has now come for the Government to move forward on the mining of coal at Phulbari in the most efficient manner or accept defeat as a political party that can lead the country, and let others with more ambition for Bangladesh and its people govern the country.

Prime Minister, the Bangladeshi people are speaking. They want power and they want power now. Finalise the coal policy and start mining Phulbari. This is the key solution to our countries power crisis and the means for you to restore faith in your Government.

[ALOCHONA] River Water : Daming India Damning Nepal

INTRODUCTION:
 
Nepal is the second richest in water resources in the world which covers 45% total quantity of water of the river Ganges and 70 % of the total quantity of static water of India. Nepal has the capacity of producing 85,000 MW of electricity as an alternative source to fossil energy. But due to the sabotage acts of India through agreements, treaties and MOU’s when the weak government prevails, has compelled Nepal to long for water & electricity both for her inhabitants & the soil to remain arid. India has ventured the scheme of its chicaneries fulfilled through the politicians of Nepal on whom the ‘RAW� has done major investment.

What ever the projects or the dams / bunds have been built by India are due to the consent of the parliamentarians of Nepal because India does not want Nepal to utilize its water resources on its own or with the financial and technical support of other countries. India plays a major role in sabotaging some major hydro-projects initiated by Nepal. However Nepal is in a position to harness merely 1% of its total water quantity. In short ‘RAW’ and Indian bureaucrats are planning to grasp Nepal’s water resources at any cost and the Nepalese political godfathers are dancing on the disastrous melody of “His Master’s Voice’.

WATER POLITICS

It has been long time since India has shown great love for Nepal’s water resources in order to meet its own demand for potable water, irrigation and electricity because of the electricity generated from coal and uranium can not last India for more than half a century. India has made political investments to the bosses of the political parties and hence has succeeded in utilizing the water resources of Nepal in the best interest of India.

The rosy dreams painted by India are viewed by the intellectuals of Nepal, like generating millions of dollars of revenue to Nepal through the export of hydro electricity, irrigation and potable water to India has been an innovative idea which could never come in to force because of India’s dirty water politics in the region to which each neighbouring country is suffering. It has adversely affected Nepal’s politics and economics making it to be the inherent cause of problems for the country associated with continuous interference by India. Nepal’s hydro-power has given the boost to India’s development project. India is also interested in small and medium projects and would like to obtain Karnali, Upper Tamakosi and Upper Karnali the earliest for its usage in India. India contends that Nepal does not require much water for irrigation and that it is only India which needs water for consumption purposes. This argument is linked to the Bhutan model and India’s river-linking project. India has strategic plans to ensure its access to river water in order to meet the needs of the vast, yet not irrigated, agricultural lands in the Northern and Southern provinces. India has never fulfilled its commitments or obligations both at the national or international forums.

India is never ready to discuss matters relating to climate, environment and natural disasters. Indian experts have repeatedly argued that India can not meet its energy needs from other sources; however, the country has no other option but to harness Nepal’s water sources. Nepal is aware of this menace but wishes to retain on a rational basis its ownership over water resources and subsequent revenues. Contrary to this India wishes to obtain ownership through coercive measures, hence the conflict arises because that surely jeopardizes the independence and sovereignty of Nepal.

STRATEGIC AND DEFENSE WATER LINING

India is trying its best to churn the wheel of water and course to strengthen her strategic position to cement her defense corridors linking to the neighbouring countries apart from using the water for drinking or agricultural lands. The Indian ‘Interlinking project’ mainly concerns the irrigation, portable and power production purposes as advocates India but surely it is done keeping in view the strategic and defense requirements. The project which is estimated to cost over US $ 118 billion is primarily expected to provide internal water security to the Indian’s and water-induced disasters.

Indian authorities envisage to bring around 35 to 37 million of hectares of farm- land under irrigation to generate 34 billion KW of electricity, control floods in flood-prone state and also enhance the country’s navigational efficiency. Some elements argue that the inter-linking of rivers is purely a scheme made to benefit various bureaucrats, Army Generals and the politicians having lands in the vicinity. The scheme tempering with the natural river systems can pose a threat to the region but India will never listen to this alarming situation causing damage to the rest. Ever since the beginning of the feasibility studies, India has been in confrontation with the environmentalists who oppose the construction of large dams and embankments.

The neighbouring countries only complain asking India to display ethics and act upon rule of law but being the vagabond of South Asia she turns deaf ears to the requests made by Bangladesh, Nepal, China, Bhutan and Pakistan. Strategic and Defense orientation by India while taming rivers to change courses, creating embankments and huge bunds to inundate the soil of the neighbouring countries is a filthy game of using water as a weapon against these countries.

WATER RESRVES & CHICANERIES OF INDIA

1. HARASSMENTS

India has been constructing the embankments and dams throughout its northern border without any consultation with Nepal. The water is used for irrigation in Indian farmlands. The embankments and the dams thus built form lakes inside Nepal. This will inundate the low land in Nepal. House and farm lands will also be submerged. Fisheries will be destroyed. It will be difficult to make to and from across the rivers. The construction causes floods in Nepal since the flood water over flows the canal and get in to the farm land and villages of Nepal, ultimately submerging them. This has in turn triggered land slides and cause losses of top soil, productivity and property worth million of rupees. Every year the nation becomes forced to cope with problems of floods, famine and epidemic. And also India often keeps its barrage gates closed during the rainy season when the chances of floods are very high. Due to such very reasons, the Nepalese in the border areas are forced to live a life full of hardships and difficulties. The government faces embarrassment before the nation each year due to all these chicaneries caused by India while creating harassment in the country.

2. WATER LOGGINGS & DEFORESTATION

Tarai region of Nepal lies at higher altitude as compared to the Indian Territory. Had there been no embankment the river water could have spread over the land in a uniform fashion, and Nepal would not have faced the problem of inundation or water logging. Besides destruction of forests, mainly the dense forest known as CHARKOSHI JHADI, has intensified the problem of floods and land slides. As the dams on the KOSHI, GANDAKI and MAHAKALI rivers built in keeping with the bilateral agreements mainly dominated by Indian interests were built else where instead of being constructed at the meeting point of Tarai and hills, or at Brahachhetra of Koshi, Devghat of Gandaki and Brahmadevmandi of Mahakali. India has criminally assaulted the interests of Nepal while leaving Nepal in troubles but this episode is the joint venture of India’s hegemonic design surely supported by the politicians of Nepal. The Chure forests more or less have been destroyed by India. The landslide in the Chure hills is intensifying.

3. CHECK DAMS BY INDIA

India has ensured the protection of life and property of her people by building subject dams close to the border areas, but it seems oblivious of the fact that the same number of people on the Nepal side have had to suffer the loss of life and the property. India pays no heed to the losses on the Nepal side as that has no meaning to her. Having no respect for the international laws, India has constructed the dams to the extent of hurting national integrity of Nepal.

THE MAJOR DAMS

1. RAUTAHAT (BAGMATI) DAM

The Bagmati is a medium river originating from the Mahabharat range. This very dam built by India across the Bagmati River causes water logging in Nepal. The Check Dam in Bagmati alone has affected 30 VDC s including Bagmati and Bakaiya. The inundation has turned settlements and rolling land in to waste land. The people in the surroundings are compelled to leave their villages and live as refugees. The height of the dam constructed across the border near Bairganiya ranges from 10 to 21 ft. It looks like a hill. Vehicles can run on the top of it. The dam is 10 Km long. It checks all the rivers flowing down to India. Yet another dam with the same height and length has been built in the East along the border of Sarlahi district. The dam runs parallel to the border.

2. DAM AT KUNAULI

The Indians have built a dam in the no-man’s land at Kunauli of Saptari. About two Kilometer of the no-man’s land from Rampura Malhaniya to Tilathi VDC has been inundated. The dam forcibly constructed by India, protects Kunauli area, but it inundates some 15-20 villages of Saptari district. The inundation has caused losses to the tune of thousands of millions of rupees to Nepal unilaterally. The dams built across the Koshi & Mahuli Rivers have directed the flow of water towards west instead of South or towards Nepal. Many people there have been turned homeless.

3. MARCHBAR (KHURDLOTAN) DAM

Marchbar lies in the central â€" southern part Rupandehi district. The Tinau River originating from the Mahabharat range of Nepal flows downward to this region. India built the Khurdlotan dam in fiscal year 2001-2002. The dam caused inundation of 18 VDCs including the Lumbini area enlisted in the world heritage.

4. LAXMANPUR DAM

The Rapti river forms through the merger of various rivers originating from the mid-hills. This is an important river jutting out of the Mahabharat range. The Laxmanpur Barrage has been built across this river in Baharaich district near the Nepal border. The high dam across the river has formed a reservoir. The dam has submerged 2,412 bighas of the most fertile land yielding three cropping a year in Banki district. More over 16,000 people of the 2600 house holds in 33 villages of five VDCs have been forced to leave their houses and the farmland and are to living as refugees.

5. MAHALISAGAR BUNDH

This bundh is located in the Bundhganga River bordering Kapilbastu district. This dam was constructed during British regime which did not harm any part of Nepal. But to these days India heightened the dam. Over 500 hectares of land, in two VDCs Rampur and Parsaiya of Nepal is under water. Nepali land is being as the reservoir to irrigate Indian farmland.

6. BAJAH SAGAR

At a short distance from Mahalisagar, India has now converted a British regime causeway in to a dam which stores water in Nepal over hundreds of hectares of land of Pipra & Baluwa VDCs which can irrigate 1000 hectares of Indian soil by the Jamuwar rivulet flowing from Nepal.

7. SIWA SAGAR

Siwa Sagar dam is the third side in Kapilbastu district which drowns whole of Hathiwah VDC. Even Nepali farmers bribe the Indian dam operator to lower the check gates of the dam for the sake of protecting their standing crops for a short period. It is a mere display of muscles by a strong vagabond of South Asia i.e. India to a weaker nation like Nepal who being so rich in water resources is on her knees due to her corrupt politicians.

8. INUNDATION OF DODHARA

The water released from the Lohiya power house of India empties in to the Jogbudha River in Kanchanpur district of Nepal. The release of water could be controlled by the human hands but it is done intentionally. This results in the destruction of crops so the farmers go hungry. Their farmland turns in to wasteland due to cutting of the River.

CONCLUSION

The neighbouring countries which include Bangladesh, Nepal, China, Bhutan & Pakistan think that India alone can not take decision on natural resources of other countries but unless they unite to make a forum to stand against the water terrorism caused by India nothing will stop her to continue a silver aggression.

The actions of India are totally against the international laws, against the accepted behavior and against morality and thus amounting to naked interference in sovereign, independent state of Nepal. On IST April 1990, that at that point of time when Indian Foreign Secretary put a draft proposed to the late King Birendra to have a similar power like the King of Bhutan. King Birendra strongly rejected the proposal saying that IT IS PREFERABLE TO BE A POWERLESS KING THAN A POWERFUL KING UNDER INDIAN DOMINATION.

Now, we Bangladeshis are fighting a psychological war against the bestial HINDUs of HINDU STAAAN. But it is taking time since there are lot more quislings( GADDARES) than the Pakis had during 1971. Apology Day for Pakistanis


SOME people hate me a lot in Pakistan. They hate me because I said sorry to Bengalis two years ago in Islamabad Press Club for the atrocities committed by Pakistan Army in 1971.They hate me because I also demanded an official apology from the government of Pakistan to the people of Bangladesh for the genocide of March 1971.They say I don't know anything. They say I am not a good Pakistani.

They say I was very young in 1971 and I am not aware about the truth. When I say yes I was only a young schoolgoing boy in 1971 but I heard and read a lot about the genocide. How can I deny my late father, Professor Waris Mir, who visited Dhaka in October 1971 with a delegation of Punjab University students? My father was a teacher of journalism in Punjab University, Lahore. He was asked by the University administration to organise a visit of the student's union office bearers to Turkey, but he took the boys to Dhaka with their consent. They wanted to know what was actually going on in Dhaka.

I still remember that when my father came back from Dhaka he wept for many days. He told us stories of bloodshed. These stories were similar to the story of my mother. My mother lost her whole family during migration from Jammu to Pakistan in 1947.Her brothers were killed by the Hindus and Sikhs in front of her eyes. Her mother was kidnapped. She saved her life by hiding under the dead bodies of her own relatives. I remember that my mother cried a lot when my father told her that Pakistan army officers raped many Bengali women. My mother said: "We made sacrifices for the safety of our honour but why we are dishonouring each other today?"

My father always said that Bengalis made Pakistan and we Punjabis broke Pakistan. Once he said that March 23rd was Pakistan Day, March 26th should be the apology day and December 16th should be the accountability day. I started understanding the thoughts of my late father when I became a journalist in 1987.

When I first read the Hamoodur Rehman Commission Report I felt ashamed. This report of a Pakistani commission admitted murder and rape but, despite this documentary evidence, many people still live in a state of denial. They say Sheikh Mujib was a traitor who created Mukti Bahini with the help of India and killed many innocent Punjabis and Beharis. I say that Sheikh Mujib was a worker of the Pakistan movement, he was a supporter of Fatima Jinnah (sister of Muhammad Ali Jinnah) till 1966.He only demanded provincial autonomy but military rulers declared him a traitor. In fact, these military rulers were traitors because their troops raped their own mothers and sisters. They say I am a liar and an enemy of Pakistan. How could I be an enemy of Pakistan? My mother sacrificed her whole family for Pakistan. My problem is that I cannot deny truth.

A senior colleague of mine, Afzal Khan, is still alive. He is 73 years old. He worked with Associated Press of Pakistan (APP), and was secretary general of the Pakistan Federal Union of Journalists (PFUJ) from 1980 to 1985. He was sent to Dhaka on March 28, 1971 for the coverage of the army operation. He told me many times that yes Mukti Bahini killed a lot of innocent people but what the Pakistan army did was not the job of a national army. Once he was staying in Ispahani House in Khulna. An army major once offered him a girl to spend a night with. When Afzal Khan asked who the girl was, the major said that she was the daughter of a local police officer and she could come to Ispahani House at gun-point. After this incident Afzal Khan came back to Lahore in May 1971. He says that all those who were responsible for the rape and genocide of Bengalis never enjoyed any respect in Pakistan.

The name of General Yahya Khan is still like an abuse in Pakistan. His son Ali Yahya always tries to hide from people. General Tikka Khan is still remembered as the "butcher of Bengal." General A.A.K. Niazi wanted to become "tiger of Bengal" but is remembered as "jackal of Bengal." The majority of Pakistanis hate all those who were responsible for the genocide of their Bengali brothers. That is the reason the family members of these army officers don't even mention publicly that who their fathers were.

But still there are some people who are not ready to admit their blunders. These people are a minority but they are powerful. I consider them enemies of the Pakistan for which my mother sacrificed her family. Why should we defend these enemies? Why doesn't our democratic government officially apologise to Bengalis? This apology will not weaken Pakistan. It will strengthen Pakistan.

I am sure that Pakistan is changing fast. A day will come very soon when the government of Pakistan will officially say sorry to Bengalis and March 26th will become an apology day for patriotic Pakistanis. I want this apology because Bengalis created Pakistan. I want this apology because Bengalis supported the sister of Jinnah against General Ayub Khan. I wants this apology because I want to make a new relationship with the people of Bangladesh. I don't want to live with my dirty past. I want to live in a neat and clean future. I want a bright future not only for Pakistan but also for Bangladesh. I want this apology because I love Pakistan and I love Bangladesh. Happy Independence Day to my Bangladeshi brothers and sisters.

Dhaka, Apr 5 (bdnews24.com) – The government backed a petition in the High Court to declare Ershad's military regime "illegal" on Monday. UPDATE

An additional Attorney General also told the High Court that the seventh amendment to the constitution legalising the takeover of power by the former military ruler HM Ershad was not lawful. He was speaking in support of a petition filed by Siddique Ahmed, a resident of Chittagong, who was convicted of murder during Ershad's martial law period.

Ershad's Jatiya Party is an ally of the current AL-led government.

The High Court, following the legal argument, issued a rule on the government asking it to explain why the seventh amendment to the constitution should not be declared illegal. The amendment legalised the takeover of power by the former military ruler HM Ershad along with the martial law instructions made between 1982 and 1986. The home secretary, law secretary, inspector general of prisons and Chittagong deputy commissioner are required to respond to the rule in four weeks.

The bench of justices Md Momtazuddin Ahmed Naima Haider also granted Ahmed a six-month bail.

Additional attorney general MK Rahman, who stood for the government, said the imposition of martial law by Ershad, his taking over of power, his enforcing of martial rule and all activities under it are illegal. The constitution does not allow the imposition of martial law, he said.

So Ershad's taking over of power disobeying the constitution was illegal, Rahman added. Barrister Hassan S Azim, the lawyer for the petitioner, had earlier told the court that the imposition by Ershad of martial law was against the basic foundations of the constitution.

All martial law instructions imposed between 1982 and 1986 are illegal along with the seventh amendment which legalised the martial law itself, the lawyer argued. It was illegal to establish a martial law court and the life imprisonment given to Siddiqur Rahman by that court was therefore also illegal, he said.

In 2005, the High Court declared illegal the fifth amendment that provided constitutional legitimacy to the governments in power — both military and civilian — following the 1975 assassination of the nation's founding father Sheikh Mujibur Rahman. This decision was upheld by the Supreme Court in January 2010.

The petitioner was convicted in 1986 of the murder in Nov 1984 of Abu Taher, a spice trader in Chittagong. A case was filed at Kotwali Police Staion by sub-inspector Ataur Rahman on Dec 24 of the same year. The 3rd martial court of Chittagong sentenced Siddique Ahmed, Noor Mohammad and Nurul Anwar to life imprisonment on Mar 20, 1986 in connection with the case.

The chief martial law administrator upheld the verdict on July 19 that year. Siddique Ahmed, who remained a fugitive for 20 years, was arrested on Aug 2, 2006. He is currently behind bars in a Chittagong jail.

Explain legality of 7th amendment endorsing Ershad's takeover: HC

The High Court on Monday issued a rule upon the government to explain within four weeks why the seventh amendment to the Constitution endorsing takeover by HM Ershad and all the actions taken under the martial law should not be declared illegal.

The Constitution (7th amendment) Act 1986 covered proclamation of the martial law issued on March 24, 1986 and all other proclamations, proclamation orders, chief martial law administrator's orders, martial law regulations, martial law orders and martial law instructions.These proclamation orders and instructions were made during the period between 1982 and November 10, 1986, the date of commencement of the seventh amendment to the Constitution.

The HC issued the rule upon a writ petition filed by one Siddique Ahmed of Chittagong challenging the legality of ratification of imposition of the martial law taking over the state power by HM Ershad.Siddique Ahmed filed the petition since he was convicted by a special court formed during the period.The court convicted and sentenced him to life term imprisonment in a murder case in 1986.

KOLKATA India and Bangladesh will launch a forum for cooperation in the conservation of the Sunderbans, a region that is "ecologically vulnerable and sensitive to climate change," Union Minister of State for Environment and Forests Jairam Ramesh said here on Sunday.

"The India-Bangladesh Sunderbans Ecosystem Forum will be launched in September this year," Mr. Ramesh said. The decision was taken at a meeting with his Bangladeshi counterpart Hasan Mahmud.

Emphasising the need for international cooperation on environment issues, Mr. Ramesh said Climate Change is the theme for the South Asian Association for Regional Cooperation (SAARC) summit to be held at Thimphu later this month."We are working on a convention for environmental cooperation among the SAARC countries. This initiative could be a part of the overall process."

The forum, which will include non-governmental organisations and civil society of both the countries, will coordinate efforts in afforestation, management of mangroves and conservation of the tiger. A joint tiger enumeration exercise may also be undertaken, he added.

"We have to recognise that the entire Sunderbans region is one ecosystem — 40 per cent of which is in India and the remaining 60 per cent in Bangladesh, and we must share our experiences and working plans for conservation," Mr. Ramesh said.He also announced that the Union Cabinet had approved the Rs.1,156 crore Integrated Coastal Zone Management project. Of this, Rs.300 crore will be spent in West Bengal, most of it on the Sunderbans.

The project, to be funded by the World Bank, will be executed over five years and includes prevention of erosion of the islands, building of storm shelters, promotion of eco-tourism, improving the livelihood of the inhabitants of the region and electrification of Sagar Island.The Minister also said that the 13th Finance Commission had sanctioned a grant of Rs.450 crore for strengthening embankments at critical areas in the Sunderbans.

He is one of the more fantastic examples of the effects of Deshi politics. There is no one at the helm of his entire party who could discuss Islam and modernity for more than 5 minutes but they won't hesitate to generalise about Islamic organisations.

They are outraged if an American Islamic organisation condemns human rights violations in Bangladesh today - because these activists turn a blind eye to any such violations when their own party is in power. It is the same for both AL and BNP.

You know there are rumours of Chinese, Jews and Indians trying to take over America... not far behind are a bunch of AL extremists who think Americans should follow the life and teachings of Sheikh Mujib. Obaid Chowdhury is probably hallucinating and Zia veneration probably should be rejected.

But by the same token many a man hallucinates about Sheikh Mujib and engages in unseemly Mujib veneration.

Thats why so many see a seemless transition from Mujib to Hasina to Rehana to Joy.

The truth is the cult of personality should be rejected outright on all sides.

It is no good for anyone.

The student leaders and a section of Awami League had since been pressurizing Mujib to make the UDI. Mujib refused to do any such thing, not even on March 7, despite generation of much public hype on that day. He finished his 17- minute speech with Joy Bangla and Joy Pakistan, because he still believed in an united Pakistan and wanted to form the next government in Islamabad .

Yet on the same day, Mujib retorted at the inquisitive journalists that he was making progress in ‘talks’ and he had a meeting scheduled with Yahya soon (Please see Ittefaq, Observer, Dawn and many other newspapers of March 26, 27, 1971). Meanwhile, the rumor of Operation Searchlight spread outside the Dhaka cantonment and people started fleeing the city or preparing for resistance. Top political and student leaders were on the run knowing that they would be the immediate targets of the military. Many of them requested Sheikh Mujib to move to a safe location but Mujib did not care. According to a source, a few student leaders led by A S M Abdur Rob went to Mujib around 10 pm with a written declaration of
> independence. Sheikh Mujib was coerced to sign it. Rob can explain if it was a fact and what happened to that declaration, if any.

> There were reports that Mujib talked with the US ambassador Joseph Farland in Islamabad that night. Shortly after midnight on March 25, Sheikh Mujib was taken into custody from his residence and flown to West Pakistan . His family was allowed to stay at his residence under Pakistan military protection and with a fat allowance. Young Sheikh Hasina seemed to have been enjoying the life pretty well then; she conceived Joy during that period.

Perhaps, it was ‘an unpardonable offence’ in the eyes of the Awami League and its sycophants, thus Zia should be punished for his ‘audacity’. Ironically, the Supreme Court had to come to the rescue of the Awami League on this controversial issue!

> It was President Ziaur Rahman who allowed Sheikh Hasina to return to Bangladesh in 1980 from her self-exile. Well tutored by her mentors during asylum in India, the first thing she worked on was to get rid of Zia, because Zia always reminded her of her father’s failures and he was too assertive to the liking of India (Please see “Amar Phansi Chai” by Matiur Rahman Rentu, onetime Hasina’s aide). Indeed the fall of Zia came soon; he was killed on May 30, 1981. According to reports, Hasina was caught near Kasba while trying to flee to India at that time. In death, Zia became much larger than life; people understood what the man he was and what a leader Bangladeshis lost!
