Quarters at home, abroad trying to block war crimes trial: Ashraf

The ruling Awami League general secretary, Syed Ashraful Islam, on Wednesday conceded that the government was facing obstacles – both from forces at home and abroad – to its initiatives to put the war criminals on trial but stopped short of naming the quarters.
   ‘We are aware that some quarters at home and abroad are trying to block trial of the war criminals but I do not want to disclose their names at the moment…We are trying to overcome the barrier,’ he said at a discussion at the National Press Club.
   Sampradaikata, Jangibad Birodhi Mancha organised the discussion on ‘Militancy and present Bangladesh: our responsibility’, presided over by professor Ajay Roy.
   Ashraf, also the LGRD and cooperatives minister, said the government would be able to overcome the obstacle when there was a consensus among the countrymen over the issue. Ashraf urged the pro-liberation political parties, young generation, different organisations and professional bodies, media, civil society and people from all walks of life to mobilise public opinion for trial of the war criminals.
   Reiterating the government’s stand on the issue, the AL leader said trial of war criminals was the party’s election pledge and the government had allocated Tk 10 crore for the process in the budget.
   Ashraf said the government had no alternative to holding war crimes trial and that the first session of the ninth parliament had passed a resolution paving the way for trial of those who had been involved in various war crimes during the war of independence in 1971. ‘The people also gave their mandate for trial of the war criminals in the December 29 parliamentary polls,’ he said.
   ‘The government is trying to mobilise opinion both at home and abroad in favour of holding war crimes trial but only the government’s initiatives are not enough in this regard and all will have to come forward in support of the initiatives,’ he said.
   ‘Trial of the war criminals is not the government’s own demand, it is the demand of every man of conscience…’
   Ashraf said the Sector Commanders’ Forum, an organisation of the sector commanders of the 1971 war of independence, had mounted a campaign over the issue before the elections but now they were silent. He urged the forum to resume their activities.
   He also called on Sampradaikata o Jangibad Birodhi Mancha to organise discussions in every district to mobilize public opinion in this regard.
   The discussion was also addressed by Dhaka city AL general secretary Mofazzal Hossain Chowdhury Maya, AL’s health and population affairs secretary Badiuzzaman Bhuiyan, Gana Forum leader Pankaj Bhattachariya, Workers Party leader Bimal Biswas, Bangladesh Economics Association general secretary Abul Barakat, Dhaka University professor Syed Anwar Hossain, Swechchhasebak League leader Pankaj Devnath, rights activist Rokeya Kabir, retired major general Amin Ahmed Chowdhury and Dhaka Reporters Unity general secretary Pathik Shah.

India, hub of human trafficking in South Asia: report
 
 Nearly 150,000 women and girls, mostly from Nepal and Bangladesh, are trafficked every year to India or to a third country through India, as sex slaves, reported the Indo-Asian News Service Wednesday, quoting an international children protection non-government organization.
 
    India is the main destination of "alarming flows" of cross-border trafficking in South Asia, said a study by the global child rights group End Child Prostitution, Child Pornography and Trafficking of Children for Sexual Purposes (ECPAT) International, according to the report.
 
    "In India, the majority of trafficking in underage girls for sexual exploitation happens within the country," the report quoted ECPAT as saying.
    Children are mainly trafficked to Indian states such as Andhra Pradesh, Bihar, Karnataka, Uttar Pradesh, Maharashtra, Madhya Pradesh, Rajasthan and West Bengal from Nepal and Bangladesh, said the report.
 
    Titled "Their Protection is in Our Hands: The State of Global Child Trafficking for Sexual Purposes", the ECPAT report was published in New Delhi Wednesday, while being published in many other countries haunted with the scourge of human trafficking.
 
    "Between 5,000 and 7,000 Nepalese girls are trafficked into India for sexual exploitation every year," it said. "Children from Bangladesh and Nepal are also trafficked into and through India to Pakistan and the Middle East."

[ALOCHONA] Tipaimukh dam: Trust, but verify




AFTER holding talks with Indian authorities about the pros and cons of the construction of Tipaimukh dam vis-à-vis Bangladesh, the Parliament's water resources committee chairman Abdur Razzak told New Age that his team members were convinced that India would do nothing harmful for Bangladesh. "We have to trust our neighbour, as the Indian prime minister and two other ministers have assured that they wouldn't take up any scheme that would harm Bangladesh," he stressed.

On receiving the team's report about the controversial 1,500 MW Tipaimukh dam (TD), Prime Minister Sheikh Hasina ordered the formation of an expert committee to assess the environmental, ecological, and economic (EEE) impacts on Bangladesh.

The building of the dam is of serious concern because of its potentially detrimental effects on Bangladesh's rivers. The plan is to build TD on the trans-boundary Barak river which channels water to the Bangladesh rivers Surma and Kushiyara, both of which merge into the Meghna. Thus, any potentially destabilising water flow in Meghna should be unacceptable to Bangladesh.

Razzak's imprudent assertion that India would do nothing that is harmful for Bangladesh can be dismissed as a memory-lapse statement -- one that ignores the adverse consequences of the Farakka barrage (FB) that both India and Bangladesh have been coping with ever since its construction.

One of the devastating impacts of the FB is the vanishing of a large village, Akheriganj of Bhagabangola, rendering 23,394 people homeless and raising tensions between India and Bangladesh. Besides, the barrage has turned parts of northern Bangladesh into a desert, raising salinity, affecting navigation, and adversely impacting the environment, agriculture and fisheries.

The government of India is now thinking of repairing the damage with a massive $120 billion plan to link its rivers, which originate in the Himalayas, with 30 interlinked canal systems that would deliver water to so-called Peninsular India. Razzaque is a politician, not a water expert -- even a "so-called" one. His assertion about the team being "convinced that India would do nothing harmful" may be deemed gratuitously friendly, diplomatically pandering, evidentially unsubstantiated, and openly vociferous. Despite environmentalists' concerns, Razzak dismissed BNP's remonstrations about the project as nothing but an attempt to keep themselves politically alive. All his post India trip statements seem to suggest: "In India, we trust."

"Trust, but verify" should have been the mission of the Razzak-led 10-member get-to-know delegation. The Russian proverb doveryai, no proveryai -- Trust, but verify -- had often been quoted by US President Ronald Reagan when discussing US and Soviel relationships with USSR General Secretary Mikhail Gorvachev. If the Farraka barrage had taught us anything, the Razzak led delegation should have adhered to the Russian proverb before being convinced that dam would have no adverse effects on Bangladesh.

The lessons of FB make it imperative that the proposed expert committee must consist of professionals with expertise in all three areas of EEE to produce an independent and professionally sound assessment. The TD is not a diplomatic matter or a cross-border political issue -- it's a question of Bangladesh's national security.

The recent actions and concerns expressed by members of the US Congress, the UN Security Council, and retired US military officers have awakened many nations to the consequences of climate change, including the destabilising effects of storms, droughts, and floods (SDF). Experts think that the effects of climate change could easily overwhelm disaster-response capabilities in the US. Internationally, it may cause humanitarian disasters, contribute to political unrest, and undermine weak governments -- leading to failed states.

Last week, in a national public radio talk show on climate change, I heard a retired US military officer refer to Bangladesh several times while discussing what could potentially happen to natural disaster prone countries. He argued that the effects of SDF brought about by climate change could lead to starvation, political violence and terrorism. As a consequence, climate change has increasingly been called a "security" problem, and there is conjecture that climate change may enhance the risk of violent conflict.

A recent study, National Security and the Threat of Climate Change, projected climate change as "a threat multiplier in already fragile regions, exacerbating conditions that lead to failed states -- the breeding grounds for extremism and terrorism."

The disastrous effects of the Farraka barrage must remind the politicians of Bangladesh not to blithely jump to hasty conclusions about the potential negative impacts of the controversial Tipaimukh dam. The potential adverse effects are similar to those of climate change. Therefore, the government of India must abandon the project if the dam -- even if remotely -- poses a threat to the environment, ecology, and economy of Bangladesh. A rise in terrorism as a result of dam related adverse effects could easily spill over across the border into India -- which neither Bangladesh nor India would ever like to see happening.

Kashmiris have for long deluded themselves into believing that some day Pakistan or the United States would help them in realizing their long cherished dream of independence. Granted that every liberation struggle needs allies, supporters and cheerleaders but external support cannot and must not be seen as the blood of a resistance. Whenever the leaders of India and Pakistan get together for the so-called peace talks, we wrongly assume that Kashmir is the theme of deliberations between the two and it is only a matter of a few months that some breakthrough would be achieved.

Our politically infantile leadership loses no time in hailing the meetings between Indian and Pakistani leaders or diplomats, with a naïve hope that the two countries would soon start behaving and let the battered Kashmiri people have some watered down version of freedom.

A national liberation movement cannot be expected to walk on crutches. The resistance movement has to learn to walk alone when there is no forthcoming international solidarity and until the time such solidarity is earned through relentless efforts. It is high time for the younger Kashmiri generation to take full charge of the political landscape and chart new paths of non-violent and creative resistance, which are not dependent on the signposts erected by Pakistan or any other State.

Steve Coll, recently wrote a piece, "Backchannel Diplomacy", which revealed that in 2007 India and Pakistan had almost agreed on some kind of demilitarization in Kashmir, which was to be followed by 'self rule' and a soft border in the form of free trade and movement of Kashmiris across the Line of control. We have also seen news reports that majority of our so called independentist leadership had agreed to be midwives for selling the proposal to hapless Kashmiris, provided India could formally commit to the idea and guarantee its deliverance.

It is depressing to see our leadership nodding their heads in affirmative to almost every sound that emanates from the durbars of Delhi and Islamabad. We are a nation bereft of any independent agency. It is very important for us to stop breathing the air of expectancy, hope against hope that Indians and Pakistanis would soon start loving each other soon and spare us their shackles. Freedom is not a dole to be received but an ideal to be realized through an unflinching commitment to uphold human dignity, justice and liberty.

We have historically outsourced our freedom struggle to Pakistan and now we are reaping the bitter harvest. Kashmir liberation struggle remains unrecognized by the world and to the extent it is recognized, it is only seen as an inter-State conflict. Beyond a few informed or concerned journalists, academics or policy makers in England and the United States, Kashmir remains an oblivious idea. Some Europeans think that it is just the name of a particular type of a fabric, Cashmere and for the few news hungry ones on the globe it is some border conflict between India and Pakistan. If one were to randomly scan European, Latin American or African media, for news on Kashmir, it should not come as a surprise that Kashmir story does not exist and if it does exceptionally, it is about rising Indo-Pak tensions on a border region called Kashmir .We may ascribe this to our unfavourable geo-political reality or ill luck but the question that must stare us in the face is what have our leaders and intellectuals done to address the almost total lack of awareness about the Kashmiri freedom struggle across the globe? The cocooned reality of our leadership deludes it into believing that a barrage of pro freedom statements in the Kashmiri media makes the world stand up and take notice.

How many awareness campaigns have been launched by our leaders to sensitize the civil society of at least the world powers if not the globe about the grim happenings in Kashmir. Reading a few news reports in local newspapers about one or two conferences that are held in the United States or Belgium should not lull us into complacence and make us believe that the whole world is discussing Kashmir. The sad story is: It isn't.

Of all the major recognized academic works on conflicts across the world, Kashmir constitutes the subject matter of a very few. Nearly all major works on ethnic/inter State conflicts or nationality movements do not register Kashmir. Kashmir has not captured the imagination of major theorists of nationalism or ethnicity like Kedourie, Homi Bhaba, Ernest Gellner, Anthony Smith, Benedict Anderson, Donald Horowitz, Thomas Hyland Erikson, John Brueilly, Milton J Esman, Michael Billig, etc.

Even if we concede the point that the conflict in Northern Ireland –with roughly 3700 deaths as compared to around 60,000-70,000 deaths in Kashmir- enjoyed a lot of global academia and media attention as it pertained to a globally dominant continent of Europe and that Global media is awash with happenings in Palestine, owing to the geopolitical importance of the Middle East. But how does one explain the virtual absence of Kashmir in the global academic discourse, when Kurdish national movement, Tamil nationality movement in Sri Lanka, figure much more prominently in world academia than Kashmir.

Even if Kashmir does get noticed, it is seen as more as a raison d'etre of a conflict between two nuclearized States, a nuclear flashpoint and not as a national liberation movement waged by a Stateless nation of Kashmiris.

As far as the campuses of international universities go, Kashmir is missing from the student debates and discussions. There are hundreds and hundreds of student solidarity groups and networks across world's famed universities, in support of many a nationality movements, especially in the cases of the Palestine, Tibet and not surprisingly Kashmir and Kashmiris are invisible there as well.

Except for a few good men, most of our intellectuals have chosen not to speak truth to power. Many yes men in our academia, journalism and NGOs, to safeguard their interests, have largely maintained silence on the repression unleashed by India in Kashmir or at worst have become the apologists of the Indian colonial enterprise. Most of our academics tend to hide behind a ridiculous veil of so called "academic neutrality" and refuse to term the Indian military control of Kashmir as military occupation.. What they articulate is actually an affirmation of an oppressive State's position on Kashmir, a garrisoned territory, with no freedom of association or dissent, controlled by half a million soldiers. Majority of our meek and self-centered academics have often discouraged their students from critical thinking and many times prevented them from expressing political dissent on college or university campuses. They have been singing paeans in the honour of the men in power. Not surprisingly some of them end up misrepresenting the mass sentiment for Azaadi as demilitarization, self rule etc. In contrast, world renowned Palestinian academics like Ibrahim Abu-Lughod, Walid Khalidi, Edward Said, Rashid Khalidi, Nur Masalha never minced words whenever they spoke about the Israeli occupation of Palestine.They have authored seminal works on the Palestinian question and convincingly demolished the warped Zionist discourse on Palestine.

Kashmir is still waiting for its own Khalidis and a Said, for organic intellectuals who can lead the people out of the current morass and steer the nation towards a complete liberation. We are yet to see the emergence of an indigenous Kashmiri narrative that could resonate across the globe. When a nation's intellectuals and leaders have lost their moral compass, it is bound to give birth to flawed forms of resistance.

The Kurdish national leader, Abdullah Ocalan once said, I have struggled to develop a new kind of a Kurdish person, a new identity among Kurds, one that is informed and capable of making a stand for Kurdish demands. This is what I have been preparing my people for. Hope our leadership and intellectuals can draw some lessons.

Thank you. I fully agree with you that these articles can be distractions, although they do not ever seem to run out of readers. Biological warfare is nothing new. It was even recorded in 1500 BC in Hittite (Turkey, Syria area) texts that the victims of plague were driven into enemy territories. Germ warfare was extensively used in modern wars. In 1972 it was outlawed by Biological Weapons Convention (BWC), signed by 100 countries. But there are reports that clandestine activities are going on.
 
Similarly, there is a Chemical Weapons Convention (CWC), which by May  2009 was signed by 188 nations. But it is believed that clandestine activities are going on. 
 
There is, above all, the danger of nuclear warfare and, as regards  development of nuclear weapons, the disarmament pacts don't seem to be working.
 
There are also lots of articles on depopulation plan and conspiracies and there are lots of scaremongering and false accusations about these. In these areas it is difficult to differentiate the truth from the untruth.   
 
In many countries intense research is going on on artificial intelligence by computers and robotics. Computer hacking is also done pretty extensively, except that it is illegal.
 
The article however concludes by saying that "This engineered pandemic is a heinous crime against humanity. I submit that this paper, combined with the others I have authored, fulfills the legal requirements of a criminal prosecution of suspected murderers. I have established motive (windfall profits), opportunity, and finally, the means and methods employed to commit this crime." So, why doesn't the author go to the court?

May I suggest that we discourage these types of Illuminati conspiracy ideas. They are a distraction, even though enjoyable entertainment, & hugely successful commercial pseudo-religious scams largely based in the USA.
 
Now think about it. If these guys were really exposing the rotten system and naming names of the satanic individuals do you imagine they would not be eliminated? Often they have made profitable career out of clever mixing of facts with fiction creating plausible tales . Please avoid exposing intellectually minded Muslims into this or else we will continue down into a black-hole of superstition and miseducation.
 
I heard a Dhaka professor whispering Illuminati garbage on a Bangla TV channel, he claimed his views were too advanced for the uneducated masses to understand the deeper conspiracies. Little did the gullible professor know that that the American conspiracy literature he had been consuming with relish was often written by the unwashed (uncultured) members of that chaotic American society never passing a chance to make a fast buck!

FINANCIAL TIES THAT BIND

The brilliant and capable financial genius, Catherine Austin Fitts is likely the first economic "guru" to tie these two seemingly unconnected stories together. In a paper she authored on July 22, 2009, Fitts declared: "I believe one of the goals of the swine flu vaccine is depopulation. Perhaps it is the goal of a swine flu epidemic as well, whether bio-warfare or hype around a flu season."
Fitts then goes on to make her case that the GATT and similar "globalist agenda" treaties are primarily20nothing more than consolidations of global resources into the control of a select few. Implemented first during the "Poppy" Bush administration, this corrupt agenda has expanded globally every day since then.Fitts warned Bush in 1991 that such policies would ultimately result in a massive centralization of wealth and natural resources into the hands of an elite minority; as a result, the vast majority of the earth's population would of necessity need to be systematically stripped of food, water, and ultimately, of life itself. This is where the "engineered pandemic" enters the picture, according to Fitts.
Fitts explains that she developed a mathematical, (i.e logarithm) formula for this 'elitist model' ­ and it showed that the global policies adopted would only mean sustainability of all natural resources for a mere 500 million "elect' individuals. (Just as their monument of evil, the "Guidestones of Georgia" predict..) These residents of the "New Order" would enjoy a very high standard of living, and would want for nothing. ILLUMINATI TOOLS DEVELOPED AND IN USE TODAY

There is no doubt that we live in an increasingly high-tech world. We have incredible information at our fingertips through something called the internet. This is one reason, however, why many people fail to grasp the danger the world is in at the present time ­ the wealth portrayed by and through the convenience of "Cyber-Space" often creates a false sense of security ­ generating a false confidence that because of this increased wisdom born of technology, nothing could ever "go wrong". For purposes of our discussion, however, one needs to know and understand that "PROMIS" software has been modified and greatly expanded from its original 1972 prototype. We need to track and document the software's evolution which eventually allowed the MAPPING AND COMPLETE DETAILED SEQUENCING of DNA and RNA strands ­ the very CODE OF LIFE. Once this is understood, one can better understand exactly HOW scientists in top-secret U.S. Government labs were able to successfully resurrect the deadly killer virus of 1918, place it in human plasmid cells, and ultimately to a killer, time-released VACCINE.

Riconosciuto's "modifications" are so "sensitive to national security" that Riconosciuto was placed into forced detention in a high-security federal prison ­ not because any "crime" had been committed ­ but to keep him from being kidnapped by other competing "multi-national group's" interests.
According to Riconosciuto's files, the NEW GENERATON of PROMIS software, today trademarked as DAYLIGHT and ORACLE8i are unbelievably complex, and have exhibited incredible ARTIFICIAL INTELLIGENCE capabilities as portrayed so well in the movie, "Eagle Eye".
ORACLE8i not only has the ability to rapidly analyze gene clade sequencing in viruses and bacteria in mere minutes, it can build a model of a complex new viral structure just as quickly, and can calculate to the minutest detail its possible "drift" of mutations after its release. This software can not only predict the DEATH TOLL the virus would produce, but also the accurate final numbers of its genetic mutations over a given period of time. As powerful as this software system is, there are some limitations, however. You would probably use it wouldn't you?"
In the area of WORLD DEPOPULATION and EUGENICS as prescribed by Hitler's financial backers in Wall Street and London ­ such a computer program would be indispensable. Not surprisingly, since the world of the Global Elite is really quite small and inter-connected, other, seemingly unconnected world news stories find their way into this massive web of deception.
This trail leads us to a "Dr. Orly Taitz" and her husband, Yosef. Nicoloff then writes: "Yosef Taitz, the self-described "CEO" of Daylight Chemical Information Systems, Inc., a private software company located in Mission Viejo, CA, Santa Fe, NM, and Cambridge, England. DCIS, Inc. is intimately involved with Novartis Pharmaceuticals (United States, Switzerland, Germany, France, England), the patent holder of the bird/swine flu vaccination. The "DayCart" software produced by DCIS, Inc. integrates ongoing research and development by Novartis and others using proprietary Oracle 8i technologies."
What Nicoloff fails to mention, however, is the fact that Novartis' patent specifically details that the viral pathogen which the patented vaccine is designed to protect against is a "reverse engineered" designer virus that could only have been created in the labs of Ft. Detrick utilizing ORACLE 8i equipped computers. This is EXACTLY what Michael Riconosciuto testified about years earlier concerning the Biological Warfare capabilities of ORACLE 8i software.

Bhartiya Janata Party leader Jaswant Singh's bold reinterpretation of Mohammed Ali Jinnah--his book on the founder of Pakistan is being launched on Monday--is bound to create controversy in both India and Pakistan.

 

On the face of it, it would seem futile to reapportion the political blame for the Great Partition of 1947. Yet, the renewed controversy over Jinnah could help us rethink the future of Indo-Pak relations.

 

No amount of blood-letting and political quibbling will alter our past. But we owe it to ourselves to overcome the many bitter consequences of the Partition. It is in this context that Jinnah's frequent invocation of the 'Monroe Doctrine' is of some interest.

 

The 'Monroe Doctrine', of course, is about the US foreign policy aspirations in the 19th century, when it sought to minimize the influence of European powers in the Western hemisphere. Jinnah visualized that after Partition, India and Pakistan could declare some kind of a Monroe Doctrine that would prevent the great powers from intervening in post-colonial Subcontinent.

 

In an interview to a European newspaper in early 1948, Jinnah discussed broadly his idea of how he wanted India and Pakistan to relate to each other and the world. "Our own paramount interests demand that the Dominion of Pakistan and the Dominion of India should co-ordinate for the purpose of playing their part in international affairs. It is of vital importance to Pakistan and India as independent sovereign states to collaborate in a friendly way to jointly defend their frontiers both on land and sea against any aggression. But this depends entirely on whether Pakistan and India can resolve their own differences," Jinnah said.

 

That India and Pakistan have not been able to resolve their differences or cooperate during the last six decades does not, in any way, detract from the essence of Jinnah's logic. If India and Pakistan reflect on their relationship with each other and the world purely in terms of power, they will confront two broad political conclusions.

 

One is that--hard as it may try--India can't shake off Pakistan. Put it another way, India will rise in the international system only if it takes Pakistan along with it. The other is that Islamabad can trip up Delhi at will but it can't force India to pay up what Pakistan considers are its dues from the Partition and then some.

 

Pakistan's determination to balance India with the help of other great powers turned Jinnah's logic of a South Asian Monroe Doctrine on its head. While Pakistan's foreign policy has certainly helped other powers, it has produced few enduring strategic gains for itself.

 

One does not have to be a rocket scientist to figure out that global weight of India and Pakistan would be a lot heavier if they stopped fighting with each other. If the two countries can embark on political cooperation, Delhi and Islamabad could easily become arbiters of the regional security order in the Indian Ocean and the Southern Asia.

 

It should not be impossible for Delhi and Islamabad to see that the absolute gains they could harvest from mutual cooperation are much larger than the compromises they need to make to resolve their differences. The reaction in India and Pakistan to Jaswant Singh's book on Jinnah might tell us whether the Sub-continent is ready to redo the Partition sums with a power calculus that is not cluttered with anger and tears.

The Bharatiya Janata Party (BJP) on Wednesday expelled senior leader Jaswant Singh from the primary membership of the party two days after the release of his book praising Mohammad Ali Jinnah, the founder of Pakistan.BJP president Rajnath Singh told reporters here that the party's parliamentary board decided to expel the former external affairs minister from the primary membership of the party. "Yesterday, I issued a statement about the BJP dissociating itself from Jaswant Singh's views. The party discussed the matter at the chintan baithak (introspection session) and it was decided to expel him," Rajnath Singh said.

BJP had on Tuesday dissociated itself from the book written by Jaswant Singh praising Mohammad Ali Jinnah, saying the "painful" part of history cannot be wished away for which the Pakistan founder was responsible. "Views expressed by Jaswant Singh in his book 'Jinnah -- India, Partition, Independence' does not represent views of the party. In fact, the party completely dissociates itself from the contents of the book," party chief Rajnath Singh told reporters here.

In his book, Jaswant Singh has held Jawaharlal Nehru responsible for the partition of India and Jinnah has been "demonised" in India. Rajnath Singh underlined that Jinnah had played an important role in "division of India which led to a lot of dislocation and destabilisation of millions of people". "It is too well known we cannot wish away this painful part of our history," he said.

He also took objection to ridiculing of Sardar Vallabhai Patel by Jaswant Singh, saying the first Home Minister played a historic role in unification and consolidation of India amidst serious threats to its unity and integrity. "The entire country remains indebted and proud of all the profound vision, courage and leadership of Patel," he said.

Lord Avebury stresses need for strategic framework so none can reverse the process

The government should have a strategic framework to implement the CHT Peace Accord and should implement it in such a way that ensures justice for all so that none can reverse the process, said Lord Eric Avebury.
Avebury, co-chair of the International Chittagong Hill Tracts Commission, said this while talking to The Daily Star after a press conference at the Jatiya Press Club on the CHT Commission's recent six-day visit to the three hill districts.
"The government [Awami League-led] in their earlier tenure signed the Peace Accord, and now initiated its implementation. So it should have a timeframe, say four years, for its completion so that the next government, even with different ideology cannot reverse it," he said when asked about BNP's opposition of the CHT Peace Accord implementation.
Different political parties have different ideologies and a democratic government will do what it thinks best, he said.
"Therefore, the present government should have a strategic framework, and set appropriate rules to settle the land disputes based on justice," Avebury said.
CHT Commission co-chairs Ida Nicolaisen and Sultana Kamal. The Sami Parliament President Lars Ander Baer of Sweden, Hideaki Uemura of Japan, Shapan Adnan and Sara Hossain are also included in the commission's tour.
Members of the commission, which was formed in Copenhagen in the 90's to create pressure on the then Bangladesh government to stop human rights violations in CHT, also met the prime minister, foreign minister, finance minister, cultural affairs minister and the CHT affairs minister.
The commission members at the press conference said during their visit they talked to army personnel, police, local authorities and the people, both Bangalees and indigenous people who saw no security risks in the army pull out.
They praised setting up of the National Committee for Implementation of the CHT Accord, re-establishment of the Land Commission, the Taskforce for CHT Refugee Rehabilitation Affairs, cancellation of leased out land for plantation and the withdrawal of temporary military camps.
"This has generated a sense of momentum," said Lord Avebury.
He, however, said the commission was disappointed with the pace of progress towards activation of the Land Commission, its lack of progress in solving disputes over land claims, its apparent decision to depend on the cadastral survey to resolve land disputes and the absence of proposals for electing the Hill District Councils.
Settling the land disputes will be a major issue, Avebury said, adding that because of the complexity of overlapping titles, granted in different circumstances, a definite set of rules should be developed by the Land Commission to rank priority of different kinds of land titles.
For those whose claims on land are disallowed, the government should draft rehabilitation measures for discussion with community leaders, he said.
The commission suggested that the Land Commission establishes a database of all disputes over land and provides claimants with forms on which they can supply the information required for this purpose.
Asked if the CHT Commission wants the Bangalees who have settled in that region in the 80s to move out, commission member Shapan Adnan said more important question than that is who originally owns the land, Bangalee settlers or the indigenous people.
"Under the traditional land systems, the indigenous people do not have any records, other than some for paying taxes. But in the 1979-80s, several lakh Bangalees with the state instigation settled on the land of the hill people. Bangalees were also provided with documents," he said..
Adnan said this way the hill people were made refugees.
"We have to make a policy decision on the traditional land systems of the hill people," he said, adding that if precedence is given to original owners in settling land issues then the settlers will be dispossessed of the land.
Stating that the settlement of the Bangalees was an "artificial problem", the commission member said those who are losing land must be rehabilitated by the state.
"We want each and every part of the dispute resolved in a transparent way where no family is deprived of justice," said Ida Nicolaisen.
Asked how the government can rehabilitate several lakhs of people, Lord Avebury said the finance minister during their meeting gave assurance of financial assistance in implementing the CHT Peace Accord.
"Of course, the international community has to come forward in this regard because they want peace in the region. Bangladesh has to approach the international community for it," he said.
The major challenge in implementing the accord will be logistics. "The government has to calculate what it requires and go forward accordingly," Avebury told The Daily Star.
