The High court on Monday summarily rejected the petition filed by Awami League’s president and former prime minister, Sheikh Hasina, seeking bail in the Tk 5 crore extortion case filed by businessman Noor Ali.
   The High Court vacation bench of Justice Sheikh Rezwan Ali and Justice M Rais Uddin pronounced the 90-minute verdict, putting in limbo the release of Hasina on bail.
   Hasina’s counsel Rafique-ul Huq told reporters that he would appeal against the High Court’s verdict to the Appellate Division of the Supreme Court. The process of appeal, however, will not begin until the Supreme Court’s vacation ends on October 12, and the procedure of appeal disposal is usually a time-consuming matter.
   Hasina, one of the top politicians was arrested last year amid a crackdown on the politicians after the proclamation of the state of emergency on January 11, 2007. Another former premier, Khaleda Zia, also the BNP chairperson and Hasina’s bitterest rival, has been set free on bail in all the graft cases filed against her during the purge.
   In the ruling, the High Court observed that there was no urgency in granting bail to Hasina as the bail was sought on medical grounds and she was freed by an executive order for medical treatment abroad.
   As she has already been allowed to go to the United States for treatment, there is no need of immediate bail for her, the court observed.
   ‘Sheikh Hasina’s appearance in the court is imperative for seeking bail on medical grounds,’ said the court, observing that she could not get bail in absentia.
   Although bail was sought on medical grounds, Hasina’s counsel also argued that she should be granted bail in order to ensure participation of all political parties in the upcoming national elections, scheduled for December 18. The government should ensure a level playing field for all by giving her bail, he asserted.
   Dismissing the argument, the court said that ‘a political view’ could not be considered for granting bail to any accused person.
   Apparently disappointed, Fazle Noor Tapas told reporters that they would move to the chamber judge of the Supreme Court for provisional petition, seeking permission to appeal against the High Court’s ruling.
   During the current annual vacation of the Supreme Court that will last until October 12, the chamber court will sit for only one day on October 6. As such, the appeal process and disposal may take a long time.
   The Unique Group’s managing director, Noor Ali, lodged a case with the Tejgaon police station on June 13, 2007, accusing Hasina, her cousin Sheikh Helal and his wife Rupa Chowdhury of extorting Tk 5 crore from him.
   The three were accused of taking Tk 5 crore for helping Ali’s firm to win a contract from the Power Development Board in 1997.
   The army-led joint forces arrested Hasina at Sudha Sadan, her residence, on July 16, 2007, and sent her to jail the same day, showing her arrested in a Tk 2.99 crore ‘extortion’ case filed by businessman Azam J Chowdhury with the Gulshan police station on June 13, 2007.
   She was later shown arrested in the extortion case filed by Noor Ali.
   The High Court vacation bench of Justice Mirza Hussain Haider and Justice Mamnoon Rahman on September 16 granted bail to Hasina in the Azam case, now under trial at a Special Judge’s Court set up in the Jatiya Sangsad complex. The court also stayed, till October 19, the proceedings of the case.
   Hasina’s two other bail petitions for the Niko and barge-mounted power-plant graft cases were filed on Monday with a High Court bench of Justice M Anwarul Haque and Zubayer Rahman Chowdhury.
   The petitions may come up on the list of the cases to be heard by the bench today.
   On September 23 another High Court bench of Justice AKM Fazlur Rahman and Justice Sheikh Abdul Awal accepted the petitions for hearing, but returned them as the bench has no jurisdiction to hear them.

Former prime minister Khaleda Zia and her former cabinet colleagues M Shamsul Islam, MK Anwar, Abdul Mannan Bhuiyan and Matiur Rahman Nizami were on Monday ordered to appear in a Dhaka court to face the charges in the Barapukuria coalmine corruption case.
   Dhaka metropolitan sessions judge Mohammad Azizul Haque also issued warrants for the arrest of former ministers M Saifur Rahman, Aminul Haque, AKM Mosharraf Hossain and Ali Ahsan Mohammad Mojahid, former acting secretary to the energy and mineral resources ministry Nazrul Islam, former Petrobangla chairman SR Osmani, former Petrobangla director Mainul Ahsan, former Barapukuria Coal Mine Company Ltd managing director Sirajul Islam and Hosaf Group chairman Moazzem Hossain.
   The court also ordered the jail authorities to produce the detained former ministers Khandaker Mosharraf Hossain and Altaf Hossain Choudhury in court on October 12.
   The court passed the orders accepting the charge sheet submitted by the Anti-Corruption Commission on Sunday which pressed charges against the 16 for embezzlement of Tk 158.71 crore by abusing power in awarding the Chinese CMC Consortium the contract for the Barapukuria mining in 2005.
   This is the third case in which Khaleda, also the Bangladesh Nationalist Party chairperson, faces charges pressed so far by the commission and the first after her release on bail on September 11.
   The immediate-past prime minister now faces charges pressed earlier by the commission in the GATCO and Niko corruption cases.
   The trials in the GATCO and Niko corruption cases, however, remain stalled as the High Court has stayed the proceedings in the cases and granted Khaleda bail.
   She is also facing another case filed by the commission on July 13 accusing her of misappropriating Tk 2.1 crore of the Zia Orphanage Trust fund. The High Court on August 26 granted her interim bail for four months in the case, which is now under investigation.
   Khaleda was granted interim bail for four months in the case by the High Court on September 10 while Mannan Bhuiyan, Shamsul Islam and MK Anwar obtained interim bail in the case from the same court on August 25 till submission of the charge sheet.
   Mannan, also the expelled BNP secretary general, MK Anwar, Shamsul Islam, and Nizami, also the Jamaat-e-Islami amir, will appear in court on October 12 and file fresh petitions seeking bail in the case, their counsels told New Age on Monday.
   The nine people, against whom the court issued warrants for their arrest, were shown fugitives.
   The charges against Khaleda and the 15 in the Barapukuria coalmine case were pressed under Section 409 of the Penal Code for criminal breach of trust, Section 5(2) of the Prevention of Corruption Act 1947 for criminal misconduct in awarding the Chinese company the contract for mining and under Section 109 of the Penal Code for helping each others in committing the offences.
   The charges are punishable with imprisonment for life or 10 years for criminal breach of trust and for seven years for criminal misconduct. In addition, fine may also be imposed on them for both the offences.
   The commission’s assistant director Shamsul Alam filed the case with the Shahbagh police on February 26, accusing the 16 persons of embezzling Tk 158.71 crore by awarding the highest bidder the production, operation and maintenance contracts for the coalmine.
   According to sources in the commission, the first investigation officer of the case, Md Manirul Haque, also a deputy director of the commission, submitted his report to the commission in May, observing that the investigation did not find sufficient evidence to press charges against Khaleda and other former ministers.
   As the ministers had been busy with other business, they did not get enough time to scrutinise the documents of the contract and they signed the documents placed before them by the officers concerned, said the investigation report.
   The commission was, however, not satisfied with the first investigation report and in June assigned another deputy director, Abul Kashem Fakir, for further investigation of the case.
   In the latest turn of events, the commission on Sunday submitted the charge sheet in the case against all the 16 accused accepting the report submitted by the second investigation officer which recommended pressing charges against the 16 for embezzling Tk 158.71 crore by abusing power.
   A Tk 335.08 crore agreement signed with the lowest bidder, Sangdon Ludi Consortium, was scrapped following the company’s demand for an upward revision of the project cost, the charge sheet said.
   Although the difference between the lowest and highest bids was Tk 158.71 crore, Khaleda helped in the embezzlement by approving the recommendations of the purchase committee without accepting Petrobangla’s proposal for re-tender, the charge sheet said.

Media, Muslims and Mujahideen

Now that the Delhi Police has "cracked" the bomb blasts, I can make my own confessions. Suspicion is not a fundamental right enshrined in Indian Constitution but it is an unalienable right in a flourishing democracy. Suspicion is the fundamental premise on which the edifice of our intelligentsia stands. Therefore, intelligence agencies cannot be denied the right to suspect. The same right to suspect cannot be denied to ordinary Indians. Equality is the hallmark of a true democracy.

The journalist in me has a problem when an official declaration, a chronological monologue, is treated as the gospel. It is not the job of a journalist to arrive at conclusions. The job of a journalist is to stand outside the circle and communicate nuances and niceties taking place inside the circle. When a journalist jumps into the circle, he becomes part of the story. Proximity breeds bias. Bias breeds bigotry. A true journalist can be anything but he can never be a bigot.

Journalistic bigotry is dangerous for it plays a vital role in shaping public opinion. Each such story leaves an imprint on public consciousness. In each blast, media, the fourth estate, behaves like fourth mistake. The needle of suspicion automatically swings towards Muslims whether it is Mecca Masjid blast or Malegaon blasts in which devout Muslims were specifically targeted inside their mosques. Every time there is a blast, Muslims find themselves in the no man's land. They are caught in the crossfire between intelligence agencies and terrorists. Neither of them will trust Muslims. The day-today Muslim problem is bread and butter rather than the bomb.

Each blast is viewed from the green lens of Islam although saffron lens is equally making India red. One of the reasons for these blasts is to put the entire Muslim community in the defensive mode by systematically manipulating Islam. The trick is like a psychological warfare before the beginning of actual war.

It is true that a minuscule minority among Muslims has become radical. It is equally true that a minuscule minority among Hindus has gone on the extreme. SIMI, RSS and Bajrang Dal, are competing identities, each one claiming to represent their respective community. It is competitive extremism at work which can be summed up in one-line: My version of extremism is better than yours! Media plays safe when RSS and Bajrang Dal are involved in bomb blasts while it indulges in triumphant journalism when SIMI comes under the scanner. The reason for this differential approach is commercial: No businessman would want to antagonize the majority Hindu readers. Media, therefore, claims to be nationalistic but it only practices majoritarian nationalism.

From a journalistic point of view, I have a problem when Police changes the names of 'alleged' (it is one adjective which we in the media have abused and used at will) masterminds overnight. First it was Abdus Subhan Qureishi (alias Tauqeer), now it is Atif, the "terrorist" who has been gunned down.

The journalist in me finds it hard to digest that Mufti Abul Bashar, the alleged mastermind of Ahmedabad blasts, is linked to Delhi blasts. If Bashar is really connected to Delhi blasts, the bomb blasts should never have taken place since he was in police custody when the blasts took place. How can Bashar, a poor madrasa-educated person mastermind Ahmedabad blast with such precision? When did Indian Madrasas start producing tech-savvy Muslims? Indian government would love that to happen! There won't be any need for Central madrasa board for modernization then!

Police says that the educated Muslims are involved in the blasts yet they arrest who will not be termed 'educated' by worldly standards. Mufti Bashar is just one example. A section of the mainstream media is extremely behaving like the nautch girl of Indian intelligent agencies. Instead of investigating the police claims, media is promoting self-contradictory journalism.

The journalist in me has a problem when a TV correspondent spits out the intelligence feed that there was a meeting of SIMI in 2001 where 200 youth were recruited to wreak havoc across India. What was our intelligence agency doing for the last 8 years?

Muslim accused are being branded as terrorists before the proper investigation and filing of the chargesheet. The actual trial by a court of law is yet to begin but the trial by media has already passed its judgement. Sample this:

"Mohammed Saif, the terrorist (emphasis added) who was arrested after Friday's encounter, even possessed a fake voter card." (TOI, September 21, page 1, Delhi edition)

Isn't it a perfect example of Judgemental journalism?

Meanwhile Muslims live under siege and fear. State, said Mahatma Gandhi, is nothing but organized violence. Friday's encounter of Jamia Nagar in Delhi raises some disturbing questions. Local Muslims have termed it as "dubious." They have reasons to believe so. As a Delhi friend put it, "No one saw cross firing yesterday. Only the police claim it happened. Did you read in any report that anyone actually saw cross-firing?" She added, "How come the two so-called terrorists managed to flee? There was only one exit." She asked, "If they knew they were going for a possible encounter, why wasn't the building or the area properly covered by the police?"

Her conclusion was chilling and disturbed me:

"But the point is that they can kill anyone anywhere. Tomorrow my brother might be the target and on flimsiest of grounds with no chance of proving the innocence. You are guilty just because they say so."

"It makes me bloody angry."

Indian Muslims live with fear, security, discrimination and terror tag. A bunch of the so-called 'Muslims' have hijacked their Faith. I detest when somebody says those who planted the bombs were Muslims. Indian Mujahideen, a faceless body, has launched a faceless jihad for the sake of Indian Muslims. A true jihad can never be faceless. If one peers through Islamic history, he will come to know that a jihad is a battle which is fought under the banner of recognition and not anonymity.

I see a problem when a country of more than one billion people can't arrest a loose bunch of murderers who want to convert India into a slaughterhouse.

Indian intelligence agencies have some much input yet they produce zero output.

Why are the non-Muslims 'pathologically' anti-Muslim? One has to look into
Islam to find the answer. Any half educated person can find them. Arabian
cruelty supersedes the Goths by a long extent. The religion is awash with
phallo-centric symbols, and run by an oligarchy lured by the houries and
ghelmans in the after life. They consider their way of life as the best
though their history proves otherwise. How can others live with such
ideas. There is not any place in the world where a believer in Islam is not
self-segregated.

[mukto-mona] Custom House Chittagong Automation

My Dear Friends
Let me tell you how it came in my mind.
Custom dept already spent 350 crore for automation.
We have so far given one crore to Data Soft and 87 lacs to purchase
Hardware.
Back up at 3 places because once they bought a scanner and operated
putting a cat inside to explode and make it out of order.
That can not be repeated. One at NBR, one CHC Ctg and one at a
neutral venu, CCCI, ctg.
There were 300MT old papers. They demanded Tk 40 lacs to burn them.
I wanted to recycle it and sold it to a pulp and paper industry for
tk 24 lacs. Imagine only old paper selling can earn that much! There
used to be files after files and people used to sit rather hide them
behind to take money.
So much had been done.
Imran knew little bit what I was trying to do.
Now from LC for Import to delivery, you can do it sitting at your
office. First time in Bangladesh. It was my brain chield to get all
stake holders connected in the net with WAN.

Let us pray for our poor mother land.
What NBR is going to do is not going to work.
Here 80% of the money of the country is with 2% people. Rest 20%
money is with 98% people. Instead of chasing 98%, they should look
for 2%. It is people of NBR, tax and custom who are the barrieer for
earning. We don't need to make a deficit budget.
Given the opportunity, we can make miracle and we can do it
ourselves.

his brilliant acumen, relentless persuasion to implement projects
within a deadline and crystal clear perception of a just and
visionary purpose to bring about a really historic change in the
automation of custom house of Chittagong. In today's Ittefaq, the
Datasoft management partner Mr. Mahbub Jaman gave a rather timid
recognition of the contribution of Tofayel and his brothers-in- arms
which you might really call a case of floccinaucinihilipilification!
But Tofayel and his working team of the joint force didn't work for
recognition or for name or fame or even for official recognition.

They worked and achieved this rare success for the love of our
beloved country and to bring smile to our ever so resilient people,
people who want to see our country come out of the scourge of being
named as the most corrupt country in the world and reach the pinnacle
of success. By thier hard work, the custom house brought down the
process of import documentation (and the chances of getting bribes)
from 44 to mere 5!

It'd take another endless span of time if it wasn't for Tofayel and
his forces on the job to bring this success.

Congratulations Tofayel. May Allah see what you've done for the
people of this country.

Google maps interface is being populated slowly with Bangladeshi towns
 
So far, detailed local roads of these following towns have been added to google maps:
 
Bagherhat
Chittagong
Cox's Bazar
Dhaka
Lal Monirhat
Patuakhali
Rajshahi
 
 
If you are not sure what we are talking about, go to this link:
http://maps.google.com  and zoom in to Bangladesh and its different regions. If you zoom in enough, you will find the details of local roads of the above-mentions cities and towns already existing in the site.
 
Not sure, exactly how this incremental development is progessing, but it is pretty sure that it is not result of any centralized initiative that is responsible for this. Rather it shows the result of peoples' small initiatives on their part - a step at a time.
 
One could say it is very insignificant, whats the big deal about a local map of Patuakhali being uploaded to the Google maps? If you are one of those who ask the question, you are missing a big point.
 
It is the individual people who are ultimately responsible to decide our destiny, not the authority. Thats what is showing up in these individual efforts - slowly but surely.
 
Don't be surprised if one day find all the local maps of all the district towns and upazillas and unions show up in different maps software and are accessible to the whole world. A government initiative to make the digitized information available at different government owned site under e-governance initiative would make this transition fast. Hopefully someone in the government will make sure that its branches are not run with same mentality which left us without a submarine cable connection for a long time.
 
Also, these maps needs to be complemented by further information about historical artifacts, social / festival locations and natural locations that could be very useful for our planned social tourism and eco-tourism. On the national level, the maps still don't show the locations of forests - not even the Sundarbans.
 
Isn't it surprising that our tourism top-heads are campaigning among populace to vote for Sundarbans as one of the greatest natural wonders of the world, but we are not willing to share the very basic information (such as location of this natural wonder) with the world?
 
Also, there is another thing that is awaiting to happen.
 
We are yet to produce a locally hosted Bangla interface mapping portal to be used by the local people. We would hope somebody from our IT entreprenuers will soon rollout such a portal. If you want to consider to develop such a site - don't think its just a free labour. A proper business plan could make you earn a lot of money if you can develop a informative mapping interface of Dhaka or Chittogong with Bangla interface. Your exit strategy could be to develop the business groud up or you could be a target acquisiton of global players who are constantly looking for niche plays in emerging markets.
 
If you thought some of the ideas are worth of your reading time, please forward it to others. If you have an ear to the columnists in regular traditional media, please forward it to them. If you have an ear to the journalists and news editors of the electronic media, discuss it with them. Hope they would look at the suggestions and give due diligence.

I like the sense of Mr.Subimal
Chakraborty's presentation. To control certain group of peoples the successful
available methodology and tools are religions. The opiate of the masses has
little to do with God. The ingredient in the packaged system of beliefs has been
well marketed for centuries, because it has fear of death and fear of creator.
Religious dogma is always used by faith groups to control the composition of
the government of a country. In USA individuals are asked by church
leaders to vote for G.W.Bush because of the Abortion Issue. Naturally it comes
in my mind why Tabligh should not use their platform for political purposes?

In my knowledge Veda was taught orally for
thousands of years. Finally it had been compiled on the shores of the lake Manasa_Sarovara, beyond the Himalayas in a district
of Tibet. Though Veda has four number: moreover, the Veda itself being commonly
divided into two great portions, "Section of Works" and "Section of  Wisdom". Manu in his work on law speaks of
the three Vedas, connected with the Vedas is a large body of other works of various
kinds, liturgical, ritualistic, exegetical, and mystical.

The journey of Taligh was begun in
the late 1920 by Maulana Muhammad Ilyas Kandhalawi in India. Tablighi Jammat does not see as
Deobandi; however, Ilyas was a prominent member of Deobandi movement. The
Tablighis are apolitical that they have passed largely unnoticed by the West. The
mostly-silent majority of Muslims are not secularists, but neither do they make
a totalitarian conflation of religion and politics. To me Tabligh does not, look
like the kind of Islamic movement oriented or Jaamati Islami type. Don't forget
that the Sunni and Shi'a are at each other's throats already.

Death toll now 49 in northeast India ethnic riots

GAUHATI, India (AP) — Clashes between ethnic groups in India's remote northeast has left at least 49 people dead in four days including 19 killed on Monday, officials said.

The fighting in Assam state began Friday when a group of young ethnic Bodo men were attacked after patrolling their villages. Bodo leaders blamed relatively recent settlers, most of whom are Muslims, for sparking the clashes, said Assam Home Commissioner Subhash Das.


But authorities said the National Democratic Front of Bodoland, a Bodo separatist group with a history of violence, were targeting Muslim settlers.


Ethnic Bodos and Muslim settlers in Assam have a history of conflict and have fought recently with bows and arrows, spears and machetes, and have burned each other's homes and property, officials said over the weekend.


More than 150 people have been injured in the violence and more than 100,000 have fled their homes in some 30 villages, Das said.


"This is a clear case of ethnic cleansing by the NDFB," said Assam government spokesman Himanta Biswa Sarma. He said Bodo militants were coordinating attacks with violent mobs who were burning Muslims' homes.


In an e-mail sent to journalists Sunday night, the Bodo group's spokesman, S. Sanjarang, denied any role in the fighting.


The 49 people killed since Friday include 15 people who were fatally shot when police opened fire on violent mobs in at least four different incidents, said Sarma. Police have been authorized to shoot at anyone fighting in the streets.


An indefinite curfew imposed Friday in the northern Assam districts of Udalguri and Darrang continued Monday with small breaks to allow people to buy essential supplies.

Animosity between the Bodos and Muslim migrants stems from long-standing land disputes. The groups clashed sporadically throughout the 1990s, leaving at least 250 dead and an estimated 300,000 displaced.


Nearly 100,000 people are still living in makeshift relief camps.
