Subject: Case of Sri Sri Shitala and Kali Temple, Lakhpur Bus Stand area, Thana- Fakirhat, District- Bagherhat, Bangladesh

Our Speech

We need UNITY to all of our minority people and organizations to protest that type of militant activities.

With the reference to the case of "Sri Sri Shitola And Sri Sri kali Temple Occupy and Threat to Religious Sentiment" (Please see the attached documents). We are very much shocked and embarrassed for untold and inhumane torture of the minority people at stated place in Lakhpur Bus Stand Area, Thana- Fakirhat, District- Bagherhat.

The responsible communal people and the godfathers involved in the destructive violence must be brought under rules and order and given proper punishment but what are we getting?

We (minority community) are the citizen of a democratic country like Bangladesh; under democratic government from where we can expect justice and harmony.

We would like to get proper action from the government, civil society, well-wishers, media and concern bodies; we are urging the government and other concerned bodies to take necessary steps against the evil deeds.

We are requesting to take necessary steps and actions against violent behavior.

A special message

THE FBI RAID AND SHOOTING
DEATH OF IMAM LUQMAN

IMAM LUQMAN
Lexington, KY (10/29/09) - It is with deep sadness and concern that we announce the shooting death of Imam Luqman A. Abdullah, of Masjid Al-Haqq (Detroit, MI).  Imam Luqman was a representative of the Detroit Muslim community to the "National Ummah" and the general assembly (Shura) of the Muslim Alliance in North America (MANA).

The Federal Bureau of Investigation (FBI) announced that their agents shot and killed the Imam during a raid related to a criminal complaint alleging that members of the mosque were engaged in criminal, but "not terrorist activity."   This tragic shooting raises deep concerns regarding the use of lethal force by law enforcement agents.

Since the investigation was "solely criminal" based upon "smuggling and fraud," we urge law enforcement and the media not to take undo advantage of this tragedy in order to demonize American Muslims generally, and those who are African American Muslims in particular.

The National Community or "Ummah" was established by Imam Jamil Al-Amin (formerly known as H. Rap Brown).  It is an association of mosques in several cities in the
U.S. that coordinates religious and social services primarily in the Black American community. Reference to the "Ummah" as a "nation-wide radical fundamentalist Sunni group consisting primarily of African-Americans" is an offensive mis-characterizatio n.

To those who have worked with Imam Luqman A. Abdullah, allegations of illegal activity, resisting arrest, and "offensive jihad against the American government" are shocking and inconsistent.  In his ministry he consistently advocated for the downtrodden and always spoke about the importance of connecting with the needs of the poor.

It is our hope and prayer that a thorough investigation will be carried out with the greatest integrity. We urge the Muslim community and all Americans committed to justice to actively monitor both the investigation and trial of the accused. Also, we urge law enforcement authorities to release Imam Luqman's remains expeditiously so that they may be buried according to Islamic practice.

MANA is committed to the establishment of viable, healthy and dynamic Muslim communities, neighborhoods and institutions that meet the religious, social, economic and political needs of the Muslims in this land. For more information about MANA's programs including SHARE centers, Healthy Marriage Initiative, Community Re-entry Program; as well as the National Campaign for Healing & Reconciliation, visit our website at www.mana-net. org.

[ALOCHONA] The maritime boundary issue

The situation has now come to a point where some of our diplomats earlier involved in negotiations on the issue with other countries feel that not only we may be denied our right to the sea to the south but we may even be reduced to a sea-locked state. Moreover, experts on oil exploration of the deep sea are of the opinion that the claims by both India and Myanmar of the sea fall within the limits of our boundary, writes Professor M Maniruzzaman Miah

The minister for foreign affairs, Dipu Mani, revealed in a press conference the government's decision to go for arbitration to settle our dispute with both India and Myanmar in regard to the delimitation of our maritime boundary. It would be interesting for the general readers to know as to how international law in this regard has evolved and why and how this problem has arisen. In the course of the discussion naturally the issue involved will be brought to the fore.

First, the evolution of the law of the sea. Several conferences on the law of the sea were held to formulate and define the rights and obligations of each littoral state. The first conference was held in Geneva in 1958 with the participation of 86 member states. This conference adopted four conventions in regard to the territorial sea, the high seas, the continental shelf and fishing and conservation of living resources. The second conference met in 1960 but ended up in disagreements on some vital issues. This was followed by three other conferences successively held in 1967, 1968 and in 1970. Having held very important deliberations the one in 1970 agreed to declare the sea-bed and ocean floor and the sub-soil thereof as the common heritage of mankind beyond the national jurisdiction of any one country. It was also decided to hold another conference to formulate laws governing the peaceful uses of the seas.

The next conference met in ten long sessions between 1973 and 1981 either in Geneva or in New York. On the conclusion of the last session, the text of the draft convention (UNCLOS III) was issued though the final decision-making session was held in 1982. On December 10, 1982 the draft was opened for signature at Montego Bay, Jamaica. Bangladesh was among the 119 countries that became a signatory on the same day.

As is evident from the above, the UNCLOS III document is the product of work of specialists spread over a long time. This is so for the simple reason that the shape and location of each country in relation to the adjacent one is different. Therefore the peculiarity of each had necessarily to be taken into consideration. Summarily speaking the document sets out the principles for delimitation of maritime boundary of all countries each one of which may have a coastline with its own peculiarity. In any case, UNCLOS-III defines the maritime zones in the following manner. From a well-defined line called the baseline each country may claim an area stretching up to 12 nautical miles known as the territorial sea. Adjacent to the territorial sea and up to a limit of 24 nautical miles is a country's contiguous zone, beyond which is the EEZ stretching up to 200 nautical miles.

The continental shelf of a coastal state comprising the seabed and the subsoil thereof may under certain circumstances stretch up to 350 nautical miles. The UNCLOS document has precisely explained as to how these boundaries have to be fixed and the rights and obligations of each coastal state within each zone so defined.

How have we acted in this respect so far and why has the conflict arisen with the neighbouring country in this regard? As early as in 1974, the baseline from where the boundaries of each maritime zone have to be drawn was defined by an act of parliament in terms of geographical co-ordinates. However, India has not agreed to the western reference point of the baseline and Myanmar has also disputed the eastern one. From 1974 to 1982 several meetings were held between India and Bangladesh but without any positive result. With India, we have yet another unsettled maritime issue, namely, the one in respect of the Talpatti island (also known as Purbasha or New Moore island).

At one point of time during the negotiations, the two countries agreed to a joint survey to determine the mid-channel of the Hariabhanga river to finally settle as to which country the sand bar should belong. This has never taken place, reportedly due to the dilly-dally tactics of our big neighbour. While we have not been able to put our claim to the vast maritime area on our south, now we seem to be within the jaws of a vice. Let us explain. India has settled its maritime boundary with each one of its neighbouring countries sharing the sea, not only surrounding the Bay of Bengal but beyond, with Indonesia in 1974 and 1977, with Myanmar in 1987 the tri-junction of India, Thailand and Indonesia in 1978 and Sri Lanka, with some concession in 1974 and 1976.

The situation has now come to a point where some of our diplomats earlier involved in negotiations on the issue with other countries feel that not only may we be denied our right to the sea to the south but we may even be reduced to a sea-locked state. Moreover, experts on oil exploration of the deep sea are of the opinion that the claims by both India and Myanmar of the sea fall within the limits of our boundary. Meanwhile we came to know, much to our horror, at a very sensitive time in our national life just days before the last parliamentary elections, of military manoeuvres in our Bay by both India and Myanmar. Do all these mean pre-figuration of more similar things to come?

What course is open to us now? It was rightly envisaged by those who drafted the UNCLOS documents that there would be disputes between states in regard to the interpretation and application of the law. More so, in our case. Because the Bangladesh coastline is an indented one and that both the Indian and Myanmar coastlines are perpendicular to ours. Naturally, delimitation by applying the normal principle of equidistance is out of the question. In any case, settlement of disputes constitutes an important part of UNCLOS. While we have wasted too much time in realising the importance of the issue we may not procrastinate any further. At the same time, however, one should understand that the matter is a complex one, albeit, the part on settlement of disputes in UNCLOS is quite comprehensive and an elaborate one leaving no room for misinterpretation. More so, because, the panel of arbitrators from where a state party will choose its arbitrators consists of people selected by various organs of the UN like the FAO, UNEP, IOC and the IMO.

The arbitrators to be nominated by parties to the dispute must be known for their experience in maritime matters, enjoying at the same time highest reputation for fairness, competence and integrity. The flipside of the whole thing is that the decision of the tribunal shall be final (art. 11, Annex II: Arbitration) unless the parties to the dispute earlier agreed otherwise. This enjoins on us extreme caution to prepare our case flawlessly. We can't really have the luxury of making any faux pas. People who have some interest in the problem know that we need to undertake surveys to put forward our claim of the continental shelf beyond the 200 we mark, measure the thickness of the sediment all over the EEZ up to the 200 we and clearly formulate our claim to the extended shelf.

The point we are trying to make is that the matter cannot be handled by a charlatan, but really needs someone with impeccable record of experience and expertise in dealing with it. The ministry of foreign affairs will do well to appoint a real expert known to have a thorough knowledge of the UNCLOS and its application, an expert who can work out the different phases of the task to be undertaken and advise the government as to what should be done to begin with and what would be the sequence of tasks to be undertaken. With whatever little knowledge we have of the problem, we are at a loss to understand as to why we have asked for 'arbitration'. Have we exhausted the very preliminary option of settling disputes by 'peaceful means'? Do we have all the data and information in hand to argue our case skilfully and exhaustively?

Let us hope the foreign ministry is well prepared to face the situation competently.

[ALOCHONA] Indira Gandhi: The authoritarian patriot

Indira Gandhi: The authoritarian patriot

Indira Gandhi
Indira Gandhi remains very popular among many Indians

Indira Gandhi was gunned down by her bodyguards on this day 25 years ago. Ramachandra Guha looks at the legacy of India's most controversial and best-known politician.
In the summer of 1965, Indira Gandhi was thinking of shifting base from Delhi to London.
She was then serving as a junior minister in the cabinet of Lal Bahadur Shastri, who had succeeded her father Jawaharlal Nehru as prime minister of India.

With her political prospects fairly bleak, she was attracted to England for personal reasons. Her sons Rajiv and Sanjay were both studying in the United Kingdom; besides, living in London would allow her to further her interest in culture and the arts.
In the end, Mrs Gandhi chose to remain in her homeland and would reap a wholly unexpected reward.

When Mr Shastri died of a heart attack in January 1966, she was asked to replace him as prime minister. The choice was made by the "Syndicate", the group of crafty old men who ran the ruling Congress party.
Hesitant start
They calculated that the elevation of Nehru's daughter would reassure a nation reeling from the deaths in quick succession of two prime ministers; besides, as a novice in politics she could be easily manipulated.
After a hesitant start in office, Mrs Gandhi grew in confidence.

In 1969 she cut herself loose from the "Syndicate" by portraying them as a bunch of reactionaries while she represented the progressive forces of history.
She nationalised banks, mines, and oil companies; abolished the titles and privileges of the former maharajas; and comprehensively won the general elections of 1971 on the stirring slogan of "Garibi Hatao" (Remove Poverty).
The elections were held in January; in the last month of the same year, Mrs Gandhi played a key role in India's military victory over Pakistan, which led to the dismemberment of that country and the formation of an independent Bangladesh.

Among a certain section of the middle class, Mrs Gandhi remains very popular.
In polls conducted by English-language magazines she is usually chosen as "India's best-ever prime minister". This endorsement is principally based on her performance during the 1971 war, invariably contrasted with her father's disastrous leadership during India's border war with China in 1962.
Lukewarm
Others admire her for her identification with the whole of India (although a northerner by birth and background she had a special affection for the south). Socialists sympathise with her pro-poor rhetoric.

Mrs Gandhi's assassination was a traumatic moment in Indian history (Photo: Ashok Vahie)

On the other hand, there remain many Indians who are lukewarm about Mrs Gandhi's legacy.
They point to her authoritarian tendencies, which came to the fore after her annus mirabilis: 1971.
At this point she asked for a "committed bureaucracy" and "committed judiciary", seeking to make these previously autonomous institutions subject to the whims and fancies of politicians in power.
In 1974, the respected Gandhian politician Jayaprakash Narayan launched a countrywide movement against corruption in government. In June 1975 the Allahabad High Court found the prime minister guilty of electoral malpractices.

Mrs Gandhi's response to this twin challenge, political and judicial, was to declare a state of emergency, censor the press, and put hundreds of opposition politicians in jail.
The emergency lasted until January 1977. In elections held in March, the Congress were routed by the Janata Party, a coalition of four previously distinct entities.

However, the new government lasted less than three years, collapsing under the weight of its contradictions. In 1980 Mrs Gandhi and the Congress were voted back to power on the plank of "stability".

Stoking trouble
The first two years of her fourth term were uneventful, but then, almost at once, Mrs Gandhi was confronted with discontent in the state of Andhra Pradesh, secessionist stirrings in the north-east, and a fully-fledged insurgency in the Punjab.

Indira Gandhi and Sonia Gandhi in March 1977
Mrs Gandhi has been accused by critics of promoting dynastic politics
It was claimed at the time that the prime minister deliberately stoked the troubles in the Punjab, so that when elections were held in 1985 she could put herself forward as the one person standing between India and anarchy.

In June 1984 she ordered the army to storm the Golden Temple, where a band of Sikh extremists were holed up. The "terrorists" were killed, but the action also led to the destruction of the second holiest building in the complex.

Five months later, two Sikh security guards gunned down Mrs Gandhi in an apparent act of revenge.
"I see that marble conceals a multitude of sins," remarked Aldous Huxley on seeing the Taj Mahal.

In the same manner, the fact that she died a martyr's death - and after contemptuously rejecting advice to purge her staff of Sikhs - has led to a posthumous evaluation of Indira Gandhi that exculpates or ignores her very many mistakes.

That she was a thoroughgoing patriot we may not doubt; nor, indeed, that she led India nobly and well during the refugee crisis of 1971 (when nine million East Pakistanis fled into India) and the war that followed.
At the same time, the historian is obliged to record her failings.
Foremost among these was the perversion of public institutions.
In Nehru's time, the bureaucracy and judiciary were insulated from political interference; recruitment, postings, and promotions were decided on the basis of diligence and competence.

Damaging tradition
Mrs Gandhi inaugurated an altogether different (and deeply damaging) tradition, whereby ministers, chief ministers and prime ministers decided the assignments of civil servants on the basis of kinship or loyalty.
Golden Temple, Punjab
Mrs Gandhi's decision to send the army into the Golden Temple alienated Sikhs
Among the institutions damaged in this fashion was the Indian National Congress.
In Nehru's time, the Congress was a genuinely decentralised and democratic party, with district and state committees chosen on the basis of inner-party elections.

A chief minister was elected by the legislators of the state. Mrs Gandhi, on the other hand, worked unceasingly to make the Congress an extension of herself. Inner-party elections were abolished. Chief ministers were chosen by her alone.
That was not all.

Since Mrs Gandhi knew she was not immortal, and since she could not bring herself to wholly trust anyone who was not related to her, she brought her sons into politics.
Family politics
From 1976 Sanjay Gandhi worked closely with her, on the understanding that he would succeed her when she retired or passed on.
When it was Sanjay who unexpectedly died in June 1980, his elder brother Rajiv was drafted into politics, on the same understanding.
(The conversion of the Congress into a family firm has been emulated by other parties. Had Mrs Gandhi not showed the way, it is impossible to conceive of the Akali Dal or the Dravidra Munnetra Kazhagam [both state-based parties in India], for example, becoming, as they have now, captives of the interests of a single family.)

These criticisms are not merely retrospective.
Sanjay Gandhi
Sanjay Gandhi was a very controversial politician
They were made at the time, as indeed were criticisms of her economic policies.
By the late 1960s, India had built industrial capacity and a technological base through promoting self-sufficient economic growth.

Leading economists such as Jagdish Bhagwati now urged a dismantling of the industrial licensing system and an encouragement of foreign trade. However, instead of freeing the economy from government control, Mrs Gandhi instead further increased the stranglehold of the state, which caused (as might have been expected) gross inefficiency and corruption.

Although the economy was finally liberalised in 1991, two decades had been lost to ideological dogma and personal expediency.
Great patriot, but deeply flawed democrat - that is how history should remember Indira Gandhi, prime minister of India from 1966 to 1977 and again from 1980 to 1984.

Dear Chief Minister Shivraj Chouhan,

We write to you to immediately release Narmada Bachao Andolan activists Alok Agarwal, Chitaroopa Palit, farmers and adivasis displaced by the dams on Narmada river. Ten thousand displaced families marched the streets of Khandwa on Oct 28th , and thousands were on dharna in front of the collectorate on 29th, demanding the implementation of Madhya Pradesh High Court orders to provide land to the displaced. Instead of providing alternate agricultural land for rehabilitation and sources of livelihood the Government of Madhya Pradesh has responded brutally on 29th and 30th October by lathi-charging and arresting the farmers, tribals and peaceful activists of the Narmada Bachao Andolan (NBA).

We demand:

1) An immediate apology for lathi charging and arresting, Narmada activists and peacefully protesting people affected from Indira Sagar, Omkareshwar, Maheshwar, Sardar Sarovar, Upper Veda and Maan dams.

2) Release of Narmada activists, farmers and adivasis immediately, and

Here is a bit of Good News from the outbreak of the H1N1 Virus. Hopefully the butcher of Gujarat has miserable few days in bed.

Narendra Modi will be kept in isolation for seven days at his residence.

Gujarat Chief Minister Narendra Modi, who returned from abroad two days back, tested positive for swine flu on Friday, a doctor attending on him said. Samples of Modi were taken for test on Thursday after he showed symptoms of cough, cold and fever, Atul Patel, one of the four doctors in the team looking after the Chief Minister, said.

The results came on Friday morning, the doctor said, adding Modi had insisted on the H1N1 test.

Modi, who returned from Russia on Wednesday, will be kept in isolation for seven days at his residence, where a team of doctors are attending on him.

All his public functions have been cancelled.

"There is no cause for any concern regarding the health of the Chief minister and he is responding to treatment," Modi's doctor said.

The Chief Minister had yesterday attended office at the State Secretariat, chaired a cabinet meeting and met officers and received visitors till late in the evening.

[mukto-mona] FW: CNN is trying to silence us

Subject: CNN is trying to silence us
From: info@presente.org

Together we can make our voices heard.

Can you upload a photo and help get the BastaDobbs message on CNN?

Dear Farida--

You and more than 75,000 others are spreading the BastaDobbs message across the country, but now CNN is trying to silence us.

Last week, BastaDobbs partners held events in 19 major cities attracting major media coverage, including El Diario (the nation's second largest Spanish language paper) and the New York Times.1,2 CNN sent cameras to several events, but they never ran the story. And when a BastaDobbs representative talked about Lou Dobbs on a CNN show, they edited out her comments.3

We have a way to make sure our message gets on CNN. Please click here to find out how:

http://bastadobbs.com/lia/?mid=1861-66735

The BastaDobbs local events, and their coverage in the media, were a powerful testament to the growing strength of our campaign. On the day of the events, campaign spokesman Roberto Lovato was even asked to appear on Lou Dobbs' show. His response: "I'll appear on one condition: that CNN president Jon Klein be there in person to hear our concerns."4

Klein refused our offer, so instead, campaign partner and human rights advocate Isabel García carried the BastaDobbs message to CNN. When García appeared on CNN's Anderson Cooper 360, she twice mentioned the danger Lou Dobbs poses to Latino and immigrant communities. But both comments were edited out of the final interview.5

Since CNN will not give us fair air time, we've found another way to get the point across. A portion of CNN's web site — called "iReport" — is dedicated to photos and videos submitted by everyday people. It is the perfect place to tell CNN exactly how you feel. [mukto-mona] YOUTUBE VIDEO: Women Demand Republican Dan Halloran Disclose His Views on Women's Health Issues

Dear friends,

Video is now available from yesterday's press conference in which NARAL, Planned Parenthood and Senator Toby Ann Stavisky, the first woman elected to the State Senate from Queens, endorse my candidacy and demand my opponent disclose his views on women's health issues.

Despite repeated requests by NARAL and Planned Parenthood, Republican Dan Halloran has still not filled out their questionnaires asking for his positions on these issues.

Yesterday's press release is below.

Women Pick a Side

In Heated City Council Race

NARAL, Planned Parenthood, Others

Endorse Kevin Kim & Demand His Opponent

Be Open About His Views on Reproductive Rights

Women's organizations NARAL Pro-Choice NY and Planned Parenthood of NYC Action Fund, along with female elected officials and voters from Northeast Queens' Council District 19, endorsed Kevin Kim in that heated race on Oct. 29.  They also challenged Kim's opponent, Dan Halloran, to disclose and be open about his positions on women's reproductive rights before Election Day.

Halloran, running on the Republican, Conservative and Independence Party lines, has not responded to multiple requests by NARAL and Planned Parenthood to fill out their candidate questionnaires for this election, giving female voters no indication of his positions on reproductive rights and sending them the message that women's health care rights don't matter to him.

Kim, who just had a baby girl in August, fully supports age-appropriate and medically accurate access to health information in order to prevent unwanted pregnancies and the spread of disease; the protection of health clinic patients and workers from violence; the strictest penalties for domestic violence; and a woman's right to make decisions about her body without government intervention.

"It's unfortunate that my opponent wouldn't give the women of Council District 19 the respect of responding to questionnaires from two organizations respected nationally for their unequivocal advocacy on behalf of women," Kim said.  "At the very least, this is a matter of general transparency and respect.  I'm proud to be endorsed by the local committees of NARAL and Planned Parenthood, and am happy to be an unapologetic defender of women's rights in public."

Kelli Conlin, President of NARAL Pro-Choice NY said:

"The women of New York City deserve to know where their leaders stand.  The women of New York City deserve leaders committed to protecting and enhancing their fundamental reproductive rights.  The women of New York City deserve leaders who stand proudly pro-choice and are dedicating to the issues we care about -- access to birth control and family planning regardless of economic status, comprehensive sexuality education in our schools, and the ability to make private and personal decisions without government interference.

"The women of New York City need Kevin Kim in the New York City Council.

"Kevin Kim is a 100% pro-choice leader who will be a critical and enthusiastic voice for the district he represents and the women he serves.  NARAL Pro-Choice New York is proud to endorse Kevin Kim for New York City Council."

Joan Malin, President and CEO of the Planned Parenthood of NYC Action Fund said:

"Planned Parenthood of New York City Action Fund is proud to endorse Kevin Kim for Council District 19.  Kevin will be a strong ally in our work to protect and promote reproductive health in New York City.  We want to make sure voters know exactly what they're facing when they get to the ballot box, and Kevin is the 100 percent pro-choice candidate in the 19th District."

City Council Speaker Christine Quinn said:

"It is of the utmost importance to me that all of New York's women are represented by leaders who are vocal about their beliefs on women's issues.  We all deserve elected officials who support a woman's right to choose.  Kevin Kim is that leader in the 19th District and I am proud to support him for New York City Council."

Senator Toby Ann Stavisky, Chair of the Women for Kevin Kim Committee, said:

"I'm voting for Kevin Kim because he cares about the things I care about: good schools, public safety, affordable health care.  We know where Kevin stands on the issues.  As a husband and the new father of a baby girl, Kevin is in a unique position to understand women's rights.  Voting for Kevin's opponent is like buying a pig in a poke.  You just don't know where he stands."

Borough President Helen Marshall said:

"I support women's rights, I support NARAL's position -- women have a right to know where their leaders stand -- and I support Kevin Kim for City Council."

Assemblywoman Grace Meng said:

"As a woman, a wife, a mom and a daughter, it is important to me to know that Kevin will be a strong voice for women throughout New York City.  I support Kevin because he is pro-women and pro-respect."

District Leader Martha Taylor said:

"In a democracy, we have a right to our opinions and a responsibility to share them, especially if you're a candidate for office.  Apparently Mr. Halloran doesn't want to let us know what his opinions are on women's rights, rights that are crucial to us.  How can anyone vote for him when we don't know what his opinions are?  What does Mr. Halloran have to hide?"

Former candidate for Council District 19 Debra Markell said:

"All candidates should fully disclose their positions on women's issues.  After discussions with Kevin Kim, I know he represents the true ideals of women's values and will fight to preserve quality health care for all.  He will work to protect women's rights in the City Council."

Kim is currently the Deputy Director of Community Affairs for Congressman Gary Ackerman (D-Queens/L.I.) and is running on a platform of improving education and preserving the low-density, clean and quiet residential character of Northeast Queens neighborhoods.

Council District 19 includes the Northeast Queens neighborhoods of Auburndale, Bayside, Bay Terrace, Beechhurst, College Point, Flushing North, Malba, Robinwood, Whitestone and parts of Douglaston and Little Neck.
