সমগ্র ইতিহাসের স্রষ্টা

বঙ্গবন্ধুর সমসাময়িক কোনো কোনো রাজনৈতিক নেতা এখনও বেঁচে আছেন। যেমন কিউবার ফিদেল কাস্ত্রো। বঙ্গবন্ধুকে দেশি-বিদেশি ঘাতকচক্র বাঁচতে দেয়নি। কবিগুরুর ভাষায় বলা যায়, 'নয়ন সমুখে তুমি নাই, নয়নের মাঝখানে নিয়েছো যে ঠাঁই। যতদিন বাংলাদেশ থাকবে ততদিন শেখ মুজিব অমর, অব্যয়, অক্ষয় হয়ে থাকবেন। কিন্তু আর যদি বঙ্গবন্ধু বিশটা বছরও বাঁচতে পারতেন তাহলে বাংলাদেশ আজ মালয়েশিয়া, সিঙ্গাপুরের থেকে ভালো অবস্থায় থাকত। 
বঙ্গবন্ধুকে নিয়ে দেশে ও দেশের বাইরে অসংখ্য কবি-সাহিত্যিক কবিতার পঙ্ক্তিমালা লিখেছেন। কবি মহাদেব সাহা তার কবিতায় লিখেছেন এভাবে, তাকে বার্লিনের এক ভায়োলিন বাদক জিজ্ঞেস করেছিলেন, তোমার পরিচয় কী? কবি তৎক্ষণাৎ পকেট থেকে একটা দশ টাকার নোট বের করে বঙ্গবন্ধুর ছবিটা দেখিয়ে বলেছিলেন, এই আমার পরিচয়, এর চেয়ে বেশি কিছু আমি জানি না। ভারতের জাতির পিতা মাহাত্মা গান্ধীকে নিয়ে যত গবেষণা হয়েছে তার কিয়দংশও বঙ্গবন্ধুকে নিয়ে হয়নি। এর প্রধান কারণ ভারতের কংগ্রেস তার জন্মের পর অধিকাংশ সময় রাষ্ট্রক্ষমতায় ছিল। আর বাংলাদেশে আওয়ামী লীগ জন্মের পর ছয় ভাগের এক ভাগ সময় ক্ষমতার। তা ছাড়া ভারতের রাজনৈতিক সংস্কৃতি যেভাবে বিকশিত হয়েছে সেভাবে বাংলাদেশে হতে পারেনি। 
বঙ্গবন্ধুর মৃত্যুর পর ২১ বছর লেগেছে সত্য প্রকাশের পরিবেশ তৈরি করতে। শেখ হাসিনাকে দেশে আসতে কত রকম বাধার সৃষ্টি করা হয়েছিল। এমনকি জিয়াউর রহমান সাহেবের প্রত্যক্ষ ও পরোক্ষ পৃষ্ঠপোষকতায় সৃষ্টি করা হয়েছিল 'শেখ হাসিনার আগমন প্রতিরোধ কমিটি'। যে কোনো পাঠক ১৯৮১ সালের মে মাসের দ্বিতীয় ও তৃতীয় সপ্তাহের দৈনিক পত্রিকার পাতা ওল্টালেই এ কথার সত্যতা মিলবে। এমনকি ধানমণ্ডির ৩২ নম্বরের বাড়িটি নিয়ে কত রকম মিথ্যা সংবাদ প্রচার করা হয়েছিল। শেখ হাসিনাকে ৩২ নম্বরের বাড়িতে মিলাদ পর্যন্ত পড়তে দেওয়া হয়নি। যারা দেননি তারাই এখন কত রকম বিশুদ্ধ গণতন্ত্রের কথা বলে যাচ্ছেন। তাই বঙ্গবন্ধুকে নিয়ে এ দেশে গবেষণার সবিশেষ প্রয়োজন রয়েছে। 
কবি আল মাহমুদ যেমন করে বঙ্গবন্ধুকে উপস্থাপন করেছেন সেটা খুবই যথার্থ। তার নিশিডাক কবিতার অংশবিশেষ এখানে উৎকলন করা যেতে পারে। "সে যখন বলল, 'ভাইসব'। অমনি অরণ্যের এলোমেলো গাছেরাও সারি বেঁধে দাঁড়িয়ে গেল।" অথচ এই মাটিতে অর্বাচীনরা শেখ মুজিবের স্বাধীনতার ডাক নিয়ে বিতর্ক করেই যাচ্ছে। কেননা টিক্কা খানের সঙ্গে বসে থেকে ( ১৯৭১ সালের ২৫ মার্চ দিবাগত রাতে ওয়্যারলেসের মাধ্যমে ব্রিগেডিয়ার সালেকও শুনতে পেরেছিল বঙ্গবন্ধুর স্বাধীনতার ঘোষণা। শুনতে পায়নি এ দেশের কিছু জ্ঞানপাপী। কবি আল মাহমুদের কবিতার চরণগুলো এদের হৃদয়ে রেখাপাত করে না। জানি না টিক্কা খানের জনসংযোগ কর্মকর্তা সিদ্দিক সালেকের স্বীকারোক্তিকে এরা কীভাবে ব্যাখ্যা করবেন।
(ডযবহ ঃযব ভরৎংঃ ংযড়ঃ যধফ নববহ ভরৎবফ, ঃযব াড়রপব ড়ভ ঝযবরশয গঁলরনঁৎ জধযসধহ পধসব ভধরহঃষু ঃযৎড়ঁময ড়হ ধ ধিাবষবহমঃয পষড়ংব ঃড় ঃযধঃ ড়ভ ঃযব ড়ভভরপরধষ চধশরংঃধহ জধফরড়. ওহ যিধঃ সঁংঃ যধাব নববহ, ধহফ ংড়ঁহফবফ ষরশব, ধ ঢ়ৎব-ৎবপড়ৎফবফ সবংংধমব, ঃযব ঝযবরশয চৎড়পষধরসবফ ঊধংঃ চধশরংঃধহ ঃড় নব ঃযব চবড়ঢ়ষবং জবঢ়ঁনষরপ ড়ভ ইধহমষধফবংয). 
অনেক কবি বঙ্গবন্ধুকে নিয়ে কবিতা লিখলেও আল মাহমুদ মাত্র একটি কবিতা লিখেছেন। বোধকরি একটা কবিতাই হাজার কবিতার সমান। কবি শেখ মুজিবকে অসাধারণভাবে উপস্থাপন করেছেন। 
"সে যখন ডাকলো 'ভাইয়েরা আমার।' 
ভেঙ্গে যাওয়া পাখির ঝাঁক ভীড় করে নেমে এল পৃথিবীর ডাঙ্গায় 
কবিরা কলম ও বন্দুকের পার্থক্য ভুলে হাঁটতে লাগলো খোলা ময়দানে।"
বঙ্গবন্ধুর ৭ মার্চের ভাষণকে অনেকে আব্রাহাম লিংকনের গেটিসবার্গ স্পিস বা মার্টিন লুথার কিং ( জুনিয়র)-এর 'আই হ্যাভ এ ড্রিম'-এর সঙ্গে তুলনা করে থাকেন। 'ধূমকেতু'তে কবি নজরুল সাম্প্রদায়িক গোষ্ঠী সম্পর্কে লিখেছিলেন, 'এদেশের নাড়ীতে, অস্থিমজ্জায় যে পচন ধরেছে, তাতে এর একেবারে ধ্বংস না হলে নতুন জাত গড়ে উঠবে না।'
আবারও বাঙালি মনীষী এস ওয়াজেদ আলীর লেখা থেকে দুটি লাইন এখানে সংকলিত করা সমীচীন হবে। 
"বাঙালি জাতির স্বপ্নকে বাস্তবে পরিণত করতে হ'লে, এ চিন্তাকে রূপায়িত করতে হলে, এ সাধনাকে সার্থক করতে হলে তিনটি জিনিসের প্রয়োজন। যথা_ (১) হিন্দু-মুসলমানের ঐক্য; (২) বাংলার রাষ্ট্রীয় জীবনের স্বাতন্ত্র্য; আর (৩) শুভবুদ্ধি ও জ্ঞানের উদ্বোধন এবং সম্প্রসারণ।" বঙ্গবন্ধুর মৃত্যুর পর দেখা গেল এস ওয়াজেদ আলীর উলি্লখিত তিনটি জিনিস বিস্মৃতির অতল তলে তলিয়ে গেছে। 
বঙ্গবন্ধু শুধু এই জাতিকে দিয়েই গেছেন। যেমনভাবে দিয়ে গেছেন ভারতের মাহাত্মা গান্ধী। জীবনে একটা মুহূর্তের জন্য কারও সঙ্গেই আপস করেননি। অধ্যাপক সিরাজুল ইসলাম চৌধুরী যথার্থই লিখেছেন, 'শেখ মুজিব একটি মহাকাব্যের নায়ক ছিলেন। এই মহাকাব্য জাতীয়তাবাদের। আরও নির্দিষ্ট অর্থে এ হচ্ছে পাকিস্তানি রাষ্ট্র কাঠামোর অধীনে বাঙালি জাতীয়তাবাদের অভ্যুত্থান ও পরিণতিতে নতুন রাষ্ট্র প্রতিষ্ঠার। এমনকি পঞ্চাশ দশকেই বাঙালির ভবিষ্যৎ পথরেখার কথা বলেছেন অবলীলাক্রমে। ১৯৫৫ সালের ২৫ আগস্ট গণপরিষদে দেওয়া তার ভাষণেও তা লক্ষ্য করি। তিনি বলেছিলেন , "ঝরৎ ুড়ঁ রিষষ ংবব ঃযধঃ ঃযবু ধিহঃ ঃড় ঢ়ষধপব ঃযব ড়িৎফ 'ঊধংঃ চধশরংঃধহ' 'রহংঃবধফ ড়ভ ঊধংঃ ইবহমধষ'... ঞযব ড়িৎফ 'ইবহমধষ' যধং ধ যরংঃড়ৎু, যধং ধ ঃৎধফরঃরড়হ ড়ভ রঃং ড়হি." 
স্বাধীনতার এত বছর পরও বিদ্যুতের কারণে আমাদের সব উন্নয়নের কাঙ্ক্ষিত প্রবৃদ্ধি হয় না। কিন্তু বঙ্গবন্ধু বিদ্যুৎ নিয়ে ভেবেছেন ষাটের দশকে। ১৯৭০-এর নির্বাচনের আগে তার নির্বাচনী ইশতেহারে বিস্তারিত বর্ণনা দিয়েছিলেন। তিনি উল্লেখ করেছিলেন এভাবে_ 'সর্বাধিক পরিমাণ বৈদ্যুতিক শক্তি উৎপাদনের উদ্দেশ্যে বৈদ্যুতিক শক্তি উৎপাদনের প্রত্যেকটি উৎসের সদ্ব্যবহার করা হবে। পূর্ব পাকিস্তানকে আগামী পাঁচ বছরের মধ্যে নূ্যনপক্ষে ২৫০০ মেগাওয়াট বিদ্যুৎশক্তি উৎপাদন ক্ষমতা অর্জন করতে হবে।... রূপপুর আণবিক শক্তি প্রকল্প ও জামালগঞ্জ কয়লা খনি প্রকল্প অবিলম্বে বাস্তবায়ন করা হবে।' বঙ্গবন্ধু চার দশকের বেশি সময় আগে জাতির জন্য করণীয় ঠিক করেছিলেন, আজকের দিনে তা অনেকে ভাবতে পারেন। এই জন্য তো তিনি জাতির পিতা। ১৯৭১ সালে 'বঙ্গবন্ধু ও রক্তাক্ত বাংলা' শীর্ষক এক নিবন্ধে পঞ্চিমবঙ্গের খ্যাতনামা লেখক নিরঞ্জন মজুমদার লিখেছিলেন, 'দেশে দেশে নেতা অনেকেই জন্মান। কেউ ইতিহাসের একটি পঙ্ক্তি, কেউ একটি পাতা, কেউবা একটি অধ্যায়। কিন্তু কেউ আবার সমগ্র ইতিহাস। শেখ মুজিব এই সমগ্র ইতিহাস।' বাংলাদেশে বহু মত থাকবে, বহু নেতা থাকবে_ এটাই গণতান্ত্রিক রাজনীতির মূল কথা। কিন্তু বঙ্গবন্ধুকে নিয়ে বিতর্ক থাকবে_ এটা কোনো শুভবুদ্ধিসম্পন্ন মানুষ আশা করে না। একমাত্র অর্বাচীনরাই শেখ মুজিবকে অস্বীকার করতে পারে।

ঢাকা: বঙ্গবন্ধু শেখ মুজিবুর রহমানকে বাংলাদেশ নামক মহাকাব্যের স্রষ্টা হিসেবে অভিহিত করেছেন বিশ্ববিদ্যালয় মঞ্জুরি কমিশনের চেয়ারম্যান (ইউজিসি) অধ্যাপক ড. একে আজাদ চৌধুরী।

শনিবার সন্ধ্যায় জাতীয় প্রেস ক্লাবের কনফারেন্স হলে যুক্তরাষ্ট্র প্রবাসী কবি ইসমাইল হোসেনের কবিতার বই 'মুজিব এক মহাকাব্যের নাম' এর প্রকাশনা অনুষ্ঠানে প্রধান অতিথির বক্তব্যে তিনি একথা বলেন।

তিনি বলেন, "মুজিব শুধু মহাকাব্যের নাম নয়। পুরো বাংলাদেশই একটি মহাকাব্য। আর এর স্রষ্টা বঙ্গবন্ধু শেখ মুজিবুর রহমান।"

অনুষ্ঠানে সভাপতির বক্তব্যে ঢাকা বিশ্ববিদ্যালয়ের উপাচার্য অধ্যাপক ড. আ আ মস আরেফিন সিদ্দিক বলেন, "বঙ্গবন্ধুর নাম প্রতিদিনই স্বীকার করা আমাদের দায়িত্ব।"

তিনি বলেন, "বাংলাদেশ আজ সীমান্তবিহীন। যতদূর বাংলা আছে, আমাদের ভাষা ও সংস্কৃতি পৃথিবীর কারও চেয়ে ক্ষুদ্র নয়। বরং অনেক ক্ষেত্রে অনেক বেশি উজ্জ্বল ও অগ্রগামী।"

নজরুল একাডেমীর নির্বাহী পরিচালক রশীদ হায়দারসহ অন্যরা বক্তব্য রাখেন।

বইটিতে বঙ্গবন্ধু ও বাংলাদেশের স্বাধীনতা নিয়ে ২২টি বাংলা এবং ইংরেজি কবিতা রয়েছে। প্রকাশ করেছে চয়ন প্রকাশনী।

The enforcement of execution decision about Moulana Abul Kalam and other trials must be stopped owing to the fact that Bangladesh cannot secure a fair trial, viewed 14 members' representative team (termed as 'Turkish Team' in Bangladesh Media) of the International Jurist Union who recently visited Bangladesh in last December to observe the proceedings of an ongoing trial at the International War-crime Tribunal.
In a report published on Tuesday the union demanded that Bangladesh must refer the case (of Azad) to the International Criminal Court. Bangladesh is a State Party to the Rome Statute.
Stretching the point that the trial cannot be in the international standards the report says, 'since the judge, the prosecutor and the investigating committee totally appointed by the Government, and the defendants are the members of two separate political parties, which are the opposition of the government, it is our point of view that it is not possible to be subjected to a trial in the international standards.'
Report raised a strong point that, if Bangladesh, as a State Party to the Rome Statute, does not refer the case to the ICC or do not secure a fair trial, the United Nations may establish an inquiry commission, and as a result of a report of such a commission the United States Security Council may decide to refer the case to the Prosecutor of the ICC according to Article 13 (b) of the Rome Statute.
The report suggested 12 steps for securing a fair trial
Those are:
1. The case must be freed from political elements and it should be handled on a legal basis.
2. The offenses that contained in the ICT should be defined clearly.
3. The judges need to be reappointed in order to secure the impartiality.
4. The judges should be appointed by an independent committee that consists of jurists.
5. All actions of the abstained judge should be cancelled and renewed.
6. The other judges and the prosecutors of the case should be replaced by the new impartial judges and prosecutors.
7. The officials who abuse their authority need to be investigated.
8. The defendants should enjoy the same rights that are granted to the other defendants in domestic law.
9. As a consequence of the principle of separation of powers, the judiciary should be immune from political pressure.
10. Those that put the judiciary under pressure need to be investigated.
11. The trial should be brought in accord with the international human rights standards.
12. The trial should be opened to the international observers.
Any human rights violations is concern of the world community 
Referring to the complaints raised objection rose just after their departure from Dhaka by Law Minister Shafique Ahmed and Foreign Minister Dipu Moni the team have violated the international norm the report emphasized, 'the sovereignty of the Bangladesh is as any other state inviolable. Yet, the contemporary conception of sovereignty limits states from abusing their power and violating their citizens` human rights. Therefore it is of concern of the world community any human rights violations wherever they would have taken place.'
Bangladesh Government questioned the intention of the visit and termed the visit as politically motivated.
Although the team along with the Turkish ambassador had meeting with Law Minister Shafique Ahmed, the Minister later in an interview with BBC questioned the intention of the visit and termed the visit as politically motivated.
But the way the group of the foreign citizens approached the tribunal has raised concerns whether the intention was to create problems, said the Foreign Minister Dipu Moni.
In a report published in vernacular daily Janakantha, known as left-wing daily, on December 25, attorney general Mahbube Alam raised concerns about the visit to the ICT by the group of these 14 lawyers from Turkey and Belgium .
Although there no party in the name of Muslim Brotherhood in Turkey , Attorney general blamed that, 'Members of Muslim Brotherhood came from Turkey to rescue the war criminal'.
An official of the home ministry said the Turkish team did not inform them about their visit. Interesting it is the immigration agency under the same home ministry who issued the 'on-arrival visas' at Shahjalal International Airport to the team.
The outlook of top leaders of the ruling party and govt. officials towards a 'foreign team' will question the sincerity of govt. in running a most sensitive trial after 41 years of independence of Bangladesh.
Any democratic government should not carry out a political vendetta against opposition leaders.
And obviously any other international body or democratic government should not let it go unchallenged.
Turkey being an Islamic democratic country is doing nothing more than that.
It's not only Turkey !
Recently the Economist along with other the global media have exposed the myth behind the so called free, fair, just, transparent, international standard & not politically motivated trial as shamelessly claimed by the government and all its political and ideological agencies, allies and cohorts.
Since the beginning of this trial government of Bangladesh is claiming that the trial is maintaining 'International' standard.
However in practise the tribunal proved to be neither international tribunals nor domestic tribunals. ICT is something ambiguous, if it is an international tribunal; it should have international judges and international prosecutors and should be conducted under international law.
This is not a domestic tribunal either because it excludes domestic rules of procedure and evidence applied in all criminal cases in Bangladesh under the Criminal Evidence Act and the Criminal Procedure Act. Those charged with crimes under the jurisdiction of the tribunal are denied the fundamental freedoms and rights guaranteed by the country's constitution to all its citizens.
United Nations, Human Rights Watch, Amnesty International, the International Bar Association and other agencies also expressed concern that such courts are in violation of international laws and not up to international legal standards.
If Bangladesh has to continue this trial honestly to heal the suffering of millions of martyrs and free-doom fighters then this trial should be strictly in accordance with the international law ratified by the UN Human Rights Council. It is a fair demand of all the conscious people of Bangladesh and also the international body.
Background of the Team
The International Jurists Union which pursues the objectives of protection of human rights and human dignity, and establishment of justice and rule of law around the globe, established by jurists of 32 countries. The Union monitors and reports human rights violations and breaches of law.
In last December the Union established a 14 member commission for observing the situation in Bangladesh with regard to trials of the members of the opposition, which take place at the International Crimes Tribunal (ICT), for a 41 years old allegation.
The Turkish team came to Dhaka on last 20th December and stayed in Dhaka for five days at Dacca, the capital city of Bangladesh, and met with the Minister of Justice, the Chief Advisor of the Prime Minister, the Chief Prosecutor, the main Opposition Party, the President of the Bar, a member of the investigation committee and the defense lawyers. Besides, members of the Commission have attended the hearings and had talks with the prosecution and the defense counsels of the crimes against humanity cases.
The team also visited International Crimes Tribunal-1 when the hearing on the petition seeking retrial of Ghulam Azam's case was being heard. They also discussed with different quarters the trial proceedings being held for crimes against humanity committed during the Liberation War.
Sources said that team consists of representatives from the International Jurist Association and human rights activists as well as lawyers sent by the Turkish government to look into the trial procedures and standards of fairness of the International War Crimes Tribunal.

The Bangladesh International Crimes Tribunal and the Right to a Fair Trial

The International Jurists Union (hereinafter called the Union ), which pursues the objectives of protection of human rights and human dignity, and establishment of justice and rule of law around the globe, established by jurists of 32 countries. The Union monitors and reports human rights violations and breaches of law.
As a consequence of this mission, the Union established a commission for observing the situation in Bangladesh with regard to trials of the members of the opposition, which take place at the International Crimes Tribunal (hereinafter called ICT), for an 41 years old allegation. The Economist reports that: 'in 2010 Bangladesh established a tribunal to try those accused of war crimes. It is called the International Crimes Tribunal, though it is not an international court in the sense of being founded on international law. Rather it is a national court, based on a Bangladeshi statute passed in 1973 and amended in 2009 and 2012. It was very late to begin the search for justice, for the accused as well as for victims. But war crimes are subject to no statute of limitation.'[1]The Commission's task was to meet with the national authorities and to monitor possible violations of fair trial rights and breaches of human rights.
Our Commission stayed five days long at Dacca, the capital city of Bangladesh, and met with the Minister of Justice, the Chief Advisor of the Prime Minister, the Chief Prosecutor, the main Opposition Party, the President of the Bar, a member of the investigation committee and the defense lawyers. Besides, members of the Commission have attended the hearings.
It must be emphasized that the sovereignty of the Bangladesh is as any other state inviolable. Yet, the contemporary conception of sovereignty limits states from abusing their power and violating their citizens` human rights. Therefore it is of concern of the world community any human rights violations wherever they would have taken place.
In 1973, after the independence of Bangladesh , International Criminal Court Code, has been adopted by the Parliament. That law,  was changed amendment by the parliement in 2009 and it has become today. The striking aspect of that law is; " The court is independent in performance of judicial function and fair trial". But, due to issues mentioned below, we and employees whose working on that subject have a doubts about the fair trail. Indeed, the present case raises serious concerns with regard to an impartial and fair trial. First of all, the defendants being tried at the ICT are deprived of numerous rights that enshrined in the domestic law. Furthermore all the judges, prosecutors and the members of the investigation committee have appointed by the current government. The ICT tries two leaders of the opposition, who established a coalition during last elections, a former minister, and a former deputy which makes the case primarily of international concern. The impartiality of the trial is shadowed by the fact that the announcement of the possible date of execution of the defendants before the trial ends. The Committee firmly believes that there are serious violations of fair trial in regard of the cases before the ICT. This view is also supported by the news of the international press concerning a judge, who has abstained as a result of the appearance of his communication in the press.[2] Our concerns with regard to the trial are shared by the international human rights organizations as well.
As stated in the International Criminal Court Statute, it is recommended for the ICT, which is the executer of the Statute that causes serious worries with respect to international criminal justice, to delegate this authority into International Criminal Court. Since the judge, the prosecutor and the investigating committee totally appointed by the Government, and the defendants are the members of two separate political parties, which are the opposition of the government, it is our point of view that it is not possible to be subjected to a trial in the international standards.
We strongly recommend that the enforcement of execution decision about Moulana Abul Kalam and other trials must be stopped. Owing to the fact that Bangladesh cannot secure a fair trial. It must refer the case to the International Criminal Court. Bangladesh is a State Party to the Rome Statute. If Bangladesh does not refer the case to the ICC or do not secure a fair trial, the United Nations may establish an inquiry commission, and as a result of a report of such a commission the United States Security Council may decide to refer the case to the Prosecutor of the ICC according to Article 13 (b) of the Rome Statute.
Thus, there are steps that need to be taken with respect to the ICT for securing a fair and public trial, which may be listed as follows:
1. The case must be freed from political elements and it should be handled on a legal basis.
2. The offenses that contained in the ICT should be defined clearly.
3.  The judges need to be reappointed in order to secure the impartiality.
4. The judges should be appointed by an independent committee that consists of jurists.
5. All actions of the abstained judge should be cancelled and renewed.
6. The other judges and the prosecutors of the case should be replaced by the new impartial judges and prosecutors.
7. The officials who abuse their authority need to be investigated.
8. The defendants should enjoy the same rights that are granted to the other defendants in domestic law.
9. As a consequence of the principle of separation of powers, the judiciary should be immune from political pressure.
10. Those that put the judiciary under pressure need to be investigated.
11. The trial should be brought in accord with the international human rights standards.
12. The trial should be opened to the international observers.
As stated above, if the Bangladeshi government does not take action for betterment of trial conditions in terms of fair trial rights, it can refer the situation to the ICC as a State Party. Assuming that the Bangladeshi Government does not make progress in this regard, the situation may be referred by the UN Security Council to the Prosecutor of the ICC.

The issue is legitimate but not new. Many of these non-Bengalis were not exactly innocent angels during our liberation time. They were right at fore front of massacring Bengalis from the get go. These non-Bengalis with their Razakar friends were fully licensed to kill anybody at anytime. Their main target was mainly non-Muslims, progressives and Awami leaguers. As we all know, the final toll was nearly three millions. No single family escaped from their bloody daggers or bullets unless you were Jamatis or razakars.

I am not sure what Mr. Qutubuddin or his friend Mr. Hussaini were expecting from the Bengali public when the country was liberated with three millions dead? We should have accepted those non-Bengalis and razakars with garlands? Forget and forgive for raping our mothers and sisters? Is there any liberated country where revenge killing never took place right after the liberation?

I would not justify killing of any innocent person. However, the numbers are pretty pale compared to our three millions dead. The numbers may not even go beyond few thousands. I understand where Mr. Hussaini would like to go with this non-Bengali killings when we are trying put some of our mass murderers behind the bars. I understand his implicit sympathy for these notorious murderers.

Noted Bangladeshi social worker and Gandhian Jharna Dhara Chowdhury has been chosen for Padma Shri, one of India's highest civilian awards.
The award is recognition of Jharna's long-standing, selfless service to the people of Bangladesh, in particular those of Noakhali, Indian high commission in Dhaka said in a statement yesterday.
"It is an honour to the womenfolk and will encourage women to dedicate themselves to social work," 74-year-old Jharna, secretary of Gandhi Ashram at Sonaimuri in Noakhali, told our correspondent in the district.
On Friday night, on the eve of India's 64th Republic Day, New Delhi announced her name as one among the six foreigners who would get this year's Padma Shri awards in different fields.
Indian home secretary called her on Friday morning to inform her about his government's decision as well as to seek her consent.
"I will receive the award if it brings development to the ashram," she told the Indian official over the phone.
Padma Shri along with Padma Vibhusan and Padma Bhusan awards are given every year to recognise exceptional contribution in various disciplines and fields of activities.
Jharna is possibly the first Bangladeshi citizen to be given the Padma award, said the Indian high commission's press release.
The award-giving ceremony is held at the Rashtrapati Bhavan in New Delhi in March/April, in which awards are handed by the Indian president.
Bollywood actors Sharmila Tagore, Sridevi, late Rajesh Khanna and director Ramesh Sippy, credited with making a number of blockbusters, including "Sholay", have also been picked for this year's Padma Shri in the category of films.
BBC reports: Jharna was eight when bloody communal riots between Muslims and Hindus broke out in late 1946 in southern Bangladesh or the then East Bengal.
According to eyewitness accounts, villages were burnt to ashes and hundreds of thousands of people fled their homes.
Over a few weeks, thousands were killed and hundreds of women raped as mobs went on a rampage in the remote Noakhali region.
Media reports described how thousands of minority Hindus were forced to convert to Islam and compelled to dress up like Muslims and eat beef, acts which contravene their religious traditions.
The Noakhali massacre, as it came to be known, took place about a year before the end of British rule in the subcontinent.
'Destruction everywhere'
India and Pakistan were carved out of British India and East Bengal became part of Pakistan.
"Our house was burnt down and many of our relatives were killed. We fled to neighbouring Assam [in India] for safety," Jharna said.
"On my way, I saw death and destruction everywhere," the social worker and eminent peace activist remembered.
The brutality of the riots shocked Indian independence leader Mahatma Gandhi, who rushed to the region and went barefoot around villages for about four months preaching communal harmony and non-violence before the clashes finally came to an end.
The Noakhali Peace Mission set up by Gandhi is considered to be a key event during the Indian independence struggle.
The violence in Noakhali started months after similar massive communal riots in the eastern Indian city of Calcutta. Thousands died in the "Great Calcutta Killings".
"We came back to our village in Noakhali after life returned to normal. But the communal riot left a deep scar on my mind," Jharna affectionately known as Jharna recalls.
"I was deeply touched by Gandhiji's peace message. It influenced me to work for the community and to promote communal harmony."
Overwhelming response
Although she never met Gandhi in person, she said she was touched by his principles of non-violence, self-reliance and community work.
In line with Gandhian values, she thought basic education was vital to lift people out of poverty and to promote better understanding.
At the age of 17, Jharna and her sister started a school in her village for under-privileged children.
Although neither had proper qualifications, it was met with an overwhelming response.
"We had no money to run the school. We used to fast twice a week to save some money. With that money, we bought books and other items," she recounted.
But the school was closed after a few years because the sisters were not qualified. The decision shattered them.
Later, Jharna became a full-time social worker and lived in Dhaka, Chittagong, Comilla and in many other parts of the country. Like many Gandhian followers, she stayed single to focus fully on her work.
After spending many years working in various social organisations, Jharna finally joined the Gandhi Ashram Trust. It was established in the village of Jayag, soon after his visit to Noakhali.
"When Gandhiji left in March 1947, he told some of his disciples to stay back and that he would return. But he was killed a year later," Jharna said.
"His followers, led by Charu Chowdhury, believed that Gandhiji will one day come back in spirit, so they never left this place and continued with their community work until their deaths."
'Much better'
Hemanta Kumar Ghosh, a local landlord, donated his house and about 2,500 acres of land to the charity. The house has a symbolic significance as Gandhi stayed there for a night during his Noakhali peace mission.
When East Bengal became part of Pakistan, Gandhian followers and the charitable trust went through a turbulent period. Most of the land donated to the trust was confiscated and the Gandhians were put in jail on suspicion of spying for India.
But despite various threats from the Pakistani authorities, the disciples refused to leave.
"Four of Gandhiji's disciples were killed by Pakistani soldiers in the same house. After spending many years in jail, Charu Chowdhury was released when Bangladesh became independent in 1971," she recalled.
She says that the ashram has gradually regained its past glory since 1971.
However, after years of court battles, only 25 acres of Gandhi Ashram Trust lands were recovered. A small Gandhi museum has also been set up in the main building.
Soon after the death of Charu Chowdhury in 1990, Jharna took over the responsibility of running the trust.
Today it is working directly with 25,000 poor families, both Muslims and Hindus. It has become a centre for various activities including training programmes for rural women to boost their income, free education for poor children and poverty alleviation schemes.
Jharna also travels around villages in the Noakhali region, working to improve the lives of Dalits, who are at the bottom of the centuries-old Hindu caste system.
The ashram is still working steadfastly to maintain peace and harmony between different communities. But almost 65-years after the bloody riots, has that been achieved in the Noakhali region?
"Things are much better now. There hasn't been any major communal riot here ever since Gandhiji visited this place. His peace mission has left a lasting legacy here in Noakhali," said Jharna proudly.

Noted Bangladeshi social worker Jharna Dhara Chowdhury was selected for one of India's prestigious civilian awards 'Padma Shri' on Friday night.
Jharna was chosen for the honour in the category of foreigners for her social work on the eve of the Republic Day, reports our New Delhi correspondent Pallab Bhattacharya quoting an official announcement.
She is one of the six foreigners to get the Padma awards in different fields.
'Padma Shri' title is given for distinguished service in any field.
The Padma Shri, along with Padma Vibhusan and Padma Bhusan awards are announced every year on the occasion of Republic Day.
The awards are conferred by the president of India at a function held at Rashtrapati Bhaban sometime around March or April.

স্বরাষ্ট্র দফতরের খবর: গত ৭ ডিসেম্বর মুর্শিদাবাদের পুলিশ সুপার হুমায়ুন কবীর সেখানকার সীমান্ত-এলাকার পরিস্থিতি সম্পর্কে ডিজি-কে একটি রিপোর্ট দেন। তাতে বলা হয়েছে, সীমান্তে এখন বিএসএফের একাংশই মানুষ পাচারে সক্রিয় ভূমিকা নিচ্ছে, যে জন্য বিএসএফের কেউ কেউ বাংলাদেশি দুষ্কৃতীদের সঙ্গে সংশ্রব রাখতেও কসুর করছেন না। এসপি-র রিপোর্ট অনুযায়ী, বাংলাদেশের রাজশাহি জেলার সমাজবিরোধী মহম্মদ সইদুল ইসলামের সঙ্গে বিএসএফের কিছু অফিসারের যোগাযোগের প্রমাণ মিলেছে। এসপি'র বক্তব্য: বাংলাদেশের সীমান্তরক্ষী 'বর্ডার গার্ড বাংলাদেশ' (বিজিবি)-এর গোদাবাড়ি আউটপোস্ট এলাকায় সক্রিয় সইদুল চর-আসারিয়াদহ, সাহেবনগর প্রভৃতি পয়েন্ট হয়ে রাজশাহি করিডর দিয়ে ভারতীয় ভূখণ্ডে লোক ঢোকায়। বিএসএফের বেশ কিছু অফিসারের সঙ্গে ঘনিষ্ঠতার সুবাদে সইদুল এই কারবার চালিয়ে যাচ্ছে বলে দাবি করে এসপি'র রিপোর্টে অভিযোগ, এ ভাবে দু'পক্ষের যোগাযোগের মাধ্যমেই লাগাতার অনুপ্রবেশ চলছে। নিজের দাবির সমর্থনে তথ্যও পেশ করেছেন মুর্শিদাবাদের পুলিশ সুপার। কী রকম?
এসপি জানিয়েছেন, গত ১৮ নভেম্বর রানিনগর থানা-এলাকায় বেশ কয়েক জন বাংলাদেশিকে পুলিশ পাকড়াও করে। তাঁরা এ দেশে ঢুকেছিলেন বিএসএফের ১৩০ নম্বর ব্যাটালিয়নের আওতাধীন কিছু এলাকা দিয়ে, মূলত কাহাড়পাড়া আয়রন ব্রিজ ধরে। এসপি'র দাবি: জেরার মুখে ধৃতেরা বলেন, বিএসএফের ইন্সপেক্টর শিবরাম শিবাজিরাও ভোঁসলে ও মুর্শিদাবাদ এলাকার দায়িত্বপ্রাপ্ত বিএসএফের ডিআইজি-সদর তাঁদের অনুপ্রবেশের কথা জানেন। পাশাপাশি সইদুলের সঙ্গে ওই সব অফিসারের প্রত্যক্ষ যোগাযোগের কথা জানিয়ে ধৃতেরা বুঝিয়ে দিয়েছেন, 'বোঝাপড়ার' মারফতই তাঁরা এ দেশে ঢুকেছেন। এসপি জানান, পুলিশ অনুপ্রবেশকারী ওই দলটিকে গ্রেফতার করে তাঁদের থেকে আরও তথ্য পেয়েছে। পুলিশ সব খতিয়ে দেখছে। 
মুর্শিদাবাদের পুলিশ-কর্তার রিপোর্টে বলা হয়েছে, মুর্শিদাবাদের সীমান্ত এখন অনুপ্রবেশের খোলা ময়দান হয়ে গিয়েছে। বিশেষত ভগবানগোলা, যেখানে বিএসএফের ১৫১ নম্বর ব্যাটালিয়ন মোতায়েন। এসপি'র রিপোর্ট মোতাবেক, ভগবানগোলা, লালগোলা, চর-লবণগোলার ৭ থেকে ১০ নম্বর পয়েন্ট দিয়ে মানুষ-মাদক-গরু অবাধে পাচার হচ্ছে, এমনকী আইরমারিতে অনুপ্রবেশের সুযোগ করে দিতে কাঁটাতারের বেড়া খোলা রাখা হয়েছে। পুলিশের অভিযোগ: বিএসএফ সব জেনেশুনেও চুপ, কারণ তাদের একাংশই এই কাজের মদতদাতা। মুর্শিদাবাদের ১৫১ এবং ১৩০ নম্বর ব্যাটালিয়নের অধীনস্থ এলাকা দিয়েই সবচেয়ে বেশি অনুপ্রবেশ হচ্ছে বলে জেলা পুলিশ মহাকরণকে জানিয়েছে। 
৭ ডিসেম্বর এসপি'র ওই রিপোর্ট পেয়ে তা ১০ ডিসেম্বর স্বরাষ্ট্র দফতরে পাঠিয়েছেন ডিজি। স্বরাষ্ট্র-সচিবকে তিনি লিখেছেন, বিএসএফের বিরুদ্ধে ওঠা এ হেন মারাত্মক অভিযোগ নিয়ে সরকার সংশ্লিষ্ট স্তরে আলোচনা করুক, প্রয়োজনে তদন্ত হোক। ডিজি-র রিপোর্টের ভিত্তিতে স্বরাষ্ট্র দফতরও বিএসএফ-কর্তৃপক্ষের ব্যাখ্যা চেয়েছে বলে মহাকরণের খবর। বিএসএফের কী বক্তব্য?
সীমান্তরক্ষী বাহিনীর পূর্বাঞ্চলের এডিজি বংশীধর শর্মা বলেন, "মহাকরণ থেকে এ নিয়ে জানতে চাওয়া হয়েছে। এক আইজি পদমর্যাদার অফিসারকে তদন্ত করতে বলা হয়েছে। কাজ চলছে। তদন্তে দোষী প্রমাণিত হলে সংশ্লিষ্ট অফিসারদের বিরুদ্ধে ব্যবস্থা নেওয়া হবে।" তবে বাহিনীর এক মুখপাত্রের দাবি, "বহু ক্ষেত্রে দেখা গিয়েছে, বিএসএফ সীমান্তে মাদক ও গরু পাচার রুখতে কড়া মনোভা�
