[mukto-mona] BHRC calls for execution of Muhammad Kamaruzzaman to be stayed immediately pending independent review



 

The Bar Human Rights Committee (BHRC) calls on the Government of Bangladesh to take all possible measures to bring about a stay of the imminent execution of Muhammad Kamaruzzaman following the Supreme Court's rejection of his death penalty review petition on 6 April 2015.


BHRC has raised serious concerns repeatedly about the fairness of trials before the International Crimes Tribunal (ICT) in Bangladesh, and in particular in respect of the trial of Muhammad Kamaruzzaman in a statement of 11 November 2014. There is evidence that the trial of Kamaruzzaman was flawed on a number of counts, including arbitrary limitation of witness evidence, limited ability to cross examine key witnesses and concerns relating to the impartiality of judges which resulted in an application to recuse two judges of bias being summarily dismissed.

Kamaruzzaman’s death sentence was upheld on appeal in November 2014. His legal team filed an application for an independent review of his sentence to the Supreme Court on 5 March, 2015. Regrettably the Supreme Court failed to hear the substantive application and instead, rejected the petition whilst upholding the death penalty.

BHRC draws particular attention to its previous statements on Bangladesh in which the flaws in the trial processes led to it calling for the ICT to be halted pending a full and impartial investigation into serious allegations of malpractice and unjust procedure. Those concerns have not been allayed or addressed at all. While the BHRC is opposed to the death penalty in all circumstances, it urges the Bangladeshi authorities now to take immediate steps to prevent an execution that arises out of a flawed trial. An independent review of this case and all other cases currently before the ICT must be conducted if victims are to gain genuine accountability for the atrocities committed in 1971.

Kirsty Brimelow QC, Chair of the Bar Human Rights Committee said, "The shortcomings of this trial, and others before the ICT, have raised serious doubts as to the capacity of the ICT to function independently, transparently and in accordance with basic fair trial norms. The imposition of capital sentences in such circumstances is contrary to international law. A stay of this execution is a minimum requirement to demonstrate the start of commitment to due process

প্রায় ৩ মাস পরে উনি বাড়ি ফিরলেন। বড় খবর হলো সেটা। নানাভাবে ভিন্ন ভিন্ন মনোভাব নিয়ে বিভিন্ন সংবাদ মাধ্যম প্রচার করল সেটা। কেউ ভাবছে তার পরাজয় হলো। কেউ বলল মানুষ স্বস্তির নিঃশ্বাস ফেলে বাঁচল। কেউ আবার বলল বিএনপি নতুন কৌশলের সন্ধানে। যে যেভাবেই দেখুক আর যে যেভাবেই বলুক তার বাড়ি ফেরা একটা বড় খবর। নির্বাচন বন্ধ করবার জন্য ২০১৩-১৪ সালে তিনি যে আন্দোলন করেছিলেন তখন মারা গিয়েছিল ৫০০ মানুষ। এবারের সরকার পতনের ৩ মাসের আন্দোলনে মারা গেছে ১৫০ জনের মতো মানুষ। এই ৬৫০ জনের মতো মানুষ যাদের তিনি না ফেরার দেশে পাঠিয়েছেন তারা আর বাড়ি ফিরবে না। তারা কারা? কে তাদের খবর রাখে? তারা 'শিন থ্রæ' রঙিন কাপড় পরে না। তাদের চোখে বড় রঙিন চশমা নেই। না ফেরার দেশে যাওয়ার সময় তারা বিশাল গাড়ি চড়ে সেখানে যায়নি। তাদের বিশাল গাড়ি ধরে দৌড়ে কেউ গর্ববোধ করেনি। এই অনার্য অধ্যুষিত দেশে তাদের গায়ের রঙ হয়ত ফর্সা ছিল না। কাজেই কে তাদের খবর রাখে?

এই সাড়ে ৬শ ছাই হয়ে যাওয়া মানুষের মধ্যে ছিল শিশু। অবুঝ শিশু। ওরা কিছুই বুঝত না। রাজনীতি তো বুঝতই না। ক্ষমতার রাজনীতি তো একেবারেই বুঝত না। তবু ওরা ক্ষমতার রাজনীতির শিকার হলো। সৃষ্টিকর্তা ওদের এই পৃথিবীতে পাঠিয়েছিলেন কি অকালে ছাই হয়ে যাওয়ার জন্য। মৃত্যু তো অনেক রকমের হতে পারে। শরীরের কোনো অংশ যাদের পুড়েছে কোনোভাবে, তারাই জানে দগ্ধ হওয়ার কী ব্যথা, কী যন্ত্রণা। এই অবুঝ শিশুগুলো কী অপরাধ করেছিল যে তাদের এমন যন্ত্রণাদায়ক মৃত্যুবরণ করতে হলো! মৃত্যুবরণ করেছে অনেক নারী যাদের রাজনীতিতে কোনো ভূমিকাই ছিল না। অনেকে মৃত্যুবরণ করেছে যাদের পরিশ্রমে সংসার চলত। এই পরিবারগুলোর কী হবে? এদের তো কোনো জাদুকরী বিদ্যা নেই। কোনো উপার্জন ছাড়াই এদের স্ত্রীরা কয়েক লাখ টাকা ভাড়া দিয়ে বিশাল বাড়িতে থাকতে পারবে না। এদের সন্তানরা বিনা উপার্জনে লাখ লাখ টাকা খরচ করে সপরিবারে বিদেশে বাস করতে পারবে না। এদের সন্তানরা এমন ভাগ্যবান নয় যে দলের ধনাঢ্য ব্যক্তিরা তাদের জন্য প্রতিদিন অজস্র টাকা খরচ করবে। দলের ধনী ব্যক্তিরা গরিব ব্যক্তিদের নিয়ে আগ্রহী নয়। জোসেফ স্টালিনের সংজ্ঞা অনুযায়ী এরা পরিসংখ্যান মাত্র। কারণ এরা বিপুল সংখ্যায় মরেছে। এরা মাত্র কয়েকজন যদি মৃত্যু বরণ করত তবে এদের আমরা শহীদ বলতাম।

অন্য আরো অনেক ক্ষতি রয়েছে প্রাণহানির পাশাপাশি। উৎপাদনের বিশাল ক্ষতি হয়েছে। যানবাহনের অভাবের জন্য উৎপাদিত পণ্য নষ্ট হয়েছে। পড়াশুনার ক্ষতি হয়েছে। যারা পরীক্ষার জন্য তৈরি হয়েছে কষ্ট করে আর তারপর পরীক্ষা নিয়ে অনিশ্চয়তায় ভুগেছে তাদের কষ্ট যারা পরীক্ষা দেয়নি তারা বুঝতে পারবে না। বাংলাদেশের সব সরকারি কাজ তো রাজধানীতেই কেন্দ্রীভূত। কাজের জন্য ঢাকায় এসে তারপর হরতালের জন্য কাজ না করেই ফিরে যাওয়া কি যন্ত্রণার তা ভুক্তভোগীরাই শুধু জানেন। ২০১৩-১৪ সালের আন্দোলনে দেশ ও জাতি ক্ষতিগ্রস্ত হয়েছে। লাভ কারো হয়নি। সে অভিজ্ঞতার বিশ্লেষণ না করে উনি আবার 'একশন রিপ্লের' ডাক দিলেন। ফলাফল একই রকমের হলো।

উনি বললেন 'অবরোধ' করা হবে। কোথায় অবরোধ? অবরোধ করতে গেলে অবরোধকারীর প্রয়োজন হয়। সে রকম কাউকে দেখা গেল না। দলের কর্মীদের দেখা গেল না কোথাও। নেতাদের কথাতো ছেড়েই দিলাম। জনগণ তো ধারেকাছেই এল না। তবু একে বলা হলো অবরোধ। কেউ কেউ আবার 'টানা অবরোধ' জাতীয় কথাও বললেন। অবরোধের যখন এমনি হাল তখন আবার উনি হরতালের ডাক দিলেন। ঠিক বলা হলো কিনা নিশ্চিত নই। অজ্ঞাত স্থান থেকে ছাপান কাগজে অন্য একজন হরতালের ডাক দিতে থাকলেন। জনগণের কোনো সাড়া পাওয়া গেল না। জনগণের অংশগ্রহণ নেই। জনসমর্থন নেই তবু হরতাল। যেটা চলতে থাকল সেটা হচ্ছে বোমাবাজি। পেট্রলবোমা নিক্ষেপ। অগ্নিকাণ্ড। হত্যা। ধ্বংসযজ্ঞ।

নিরপেক্ষ সেজে তথা কথিত সুশীলরা গলাবাজি করতে থাকলেন। এদের কণ্ঠে হত্যার কোনো নিন্দা শোনা গেল না। ধ্বংসের বিরুদ্ধে কোনো প্রতিবাদ ধ্বনিত হলো না। এই স্বঘোষিত বুদ্ধিমানদের বুদ্ধির প্রতি কোনো আগ্রহ দেখাল না জনগণ।

যেটা এখন স্পষ্ট সেটা হচ্ছে যে উনাকে আর উনার সমর্থকদের জনগণ প্রত্যাখ্যান করেছে। সোজা কোথায় হেরে গেছেন তিনি। কিন্তু এখানেই আমাদের মনে একটা প্রশ্ন দেখা দিয়েছে। ২০১৩-১৪ সালের হত্যা আর ধ্বংসের পর কিছুদিনের বিরতি নিয়ে তিনি আবার একই কাজের ডাক দিয়েছিলেন। আন্দোলনের ফলে যে হত্যাকাণ্ড সংঘটিত হয়েছিল সে জন্য কি কেউ দায়ী নয়? ওই বিশাল ধ্বংসযজ্ঞের দায়বদ্ধতা তবে কার? কয়েকজন কিশোরকে বোমা নিক্ষেপের জন্য শাস্তি দিয়েই কি সব শেষ? বিশাল অপরাধের জন্য কোনো ব্যক্তিকে দায়ী করা হয়নি। এর ফল আমরা কী দেখলাম! আমরা দেখলাম 'একশন রিপ্লে'। ২০১৫ সালেও দেখলাম হত্যার আর ধ্বংসের পুনরাবৃত্তি। ২০১৩-১৪'র দায়ী ব্যক্তিরাই সেটা ঘটালেন। প্রশ্নটা হচ্ছে এই যে, আমরা নিকট ভবিষ্যতে কী দেখতে যাচ্ছি? আমরা কি আবার দেখবো ২০১৩-১৪ আর ২০১৫'র দায়ী ব্যক্তিরা কিছুটা বিশ্রাম নিয়ে আবার হত্যাযজ্ঞে নেমে যাবে? এই বিশাল হত্যাকাণ্ডের জন্য কেউ কি দোষী সাব্যস্ত হবে না? কারো কি শাস্তি হবে না এই বিশাল অপরাধের জন্য? তবে কি নিরপরাধ মানুষগুলো জীবন দিতেই থাকবে? এই হত্যা আর ধ্বংস প্রতিরোধের কোনো ব্যবস্থাই কি নেয়া হবে না?

1. Das is lying. I have never said that a Hindu is a devil and a Muslim is an angel. The lie he has uttered simply reflects his communal mindset. 
2. Das is upset that Bal Thackeray tolerated Fida's paintings. Bal Thackeray himself was an artist. His art appreciation definitely far exceeds that of Das. Moreover, even if Das can appreciate art at all, the problem is that his capability is polluted by his communal bias.

He painted those pics probably in 1970s, long before he became rich and famous. He might have done it out of inherent hatred towards Hindus. Not even Bal Thakeray and his Shiv Sena was terribly offended by them. That is besides the point, the point is that every Hindu is a devil and every Muslim an angel in the view of Chakrabarty. Seven centuries of Muslim rule in India has created such inferiority complex even among Brahmins apparently.

Please read my post again before you apply your broad brush stroke. I said only the obvious. An artist is also a salesman. He was a creative artist but needed to sell his products. Historically many artists were/are provocative for that very good reasons. I think most of the Indians tolerate him more than you think.

My guess is that he wanted to be a controversial person at the very late stage of his life and sell more of his paintings. I am sure prices went up few notches after Hindus started to protest. It was a calculated risk for an old man.

As a supporter of free expression, I do not see any problem with his products. A Muslim is far more freer in an infidel country than in any Islamic country. The proof is in the pudding!

The Persian equivalent of Saraswati is Sura Aredvi Anahita. She was usually portrayed stark naked mounted on a lion. She transformed into Durga and Kali of Hinduism later. No religion is free from sex symbol. To put an emphasis on it is risky enough to invite the wrath of it's followers.

I do not care who the painter/cartoonist is; I do not see any good purpose in painting/drawing distasteful physical appearances of religious icons. Criticizing their rubbish and hateful messages has the purpose of removing nonsense and hatred from human societies; painting/drawing them nude, for example, could cause only provocations with no positive outcome.

Let me make a correction. The holy mythological figure is Sita, not Saraswati. That was a typo. FMH painted Sita riding Rama devotee hanuman. Many hindutvabadis saw this as an insult to Hindus many of whom want their women to follow the ideals of Sita and Sabitri. 

Unfortunately many so called muktomonas maintain double standard on the point of allowing freedom of expression.

5. How much one will tolerate is subjective. The cartoon of the prophet of Islam by a Christian cartoonist will not be tolerated by some and will be approved by others. The same argument applies to the paintings of Hindu goddess Saraswati and holy mythological figure Saraswati by a Muslim painter. 

6. I am not bringing up issues like gay rights and abortion as these are not related to freedom of expression. But I can bet even the Muktomonas will be divided on these issues. We see them as legal, moral and ethical issues. Moral and ethical judgments are subjective.

Actually, it is a much bigger and more intractable problem than intolerance. The problem is lack of education, lack of development of human minds. When I say education, I mean ability of reasoning, not academic degrees. In fact, when the mind is a zombie that follows instructions from religious books, the human common sense and intelligence are gone, the ability to think is nowhere to be found; and nothing can be on the way of following the imaginary God's words. Barbaric intolerance is only a corollary to that bondage of human minds.
 
I do not think it is appropriate for anyone to think that they tolerated humanists like Dr. Avijit Roy. Rational thoughts are for learning from, for developing human minds. We tolerate faults that are not very harmful; and humanism is not a fault by any means. It is for all kinds of humans, including the Muslims, to live in a just and peaceful world.
 
In fact, intolerance, when done right, is needed. For example I am fine with any force that would be totally intolerant of the bribe culture in places like Bangladesh.
