liar' by SC judge

An Appellate Division judge on Tuesday termed former army chief KM Shafiullah 'coward' and 'liar' for his role on August 15, 1975 when the country's first president Sheikh Mujibur Rahman and all but two of his family were killed.
   Justice Md Abdul Aziz, one judge of the five-member Appellate Division bench, uttered the words when Abdur Razzaque Khan, the counsel for Death Row convict Sultan Shahriar Rashid Khan, was questioning the validity of Shafiullah's deposition in the case.
   Razzaque said that Sheikh Mujibur Rahman first contacted the then army chief and sought his help, and said, 'Shafiullah, your army has encircled my house and Sheikh Kamal may be killed, so please send a force.'
   Shafiullah replied, 'Sir, can you get out of the house? Let me see what I can do for you.'
   When Razzaque told the court that Shafiullah's reply as an army chief could not acceptable to anybody, Justice Aziz replied, 'He may be a liar or a coward…But what is your benefit from Shafiullah's negligence of duty?'
   The presiding judge, Justice Tafazzul Islam, pointed out that two army officers were convicted for negligence of duty after the mutiny on 30 May, 1981 when former president Ziaur Rahman was killed
   Razzaque said that those army officers who were involved in the carnage on 15 August are now behind the scenes but Shahriar had to be put on trial for his appearance in the radio station and Bangabhaban.
   He told the court that all the Awami League leaders, except Shah Mozzamem Hossain and KM Obaidur Rahman, were members of President Khandakar Mushtaque Ahmed's cabinet, but they were not made accused in the case.
   He also said that it was not right to convict Shahriar of killing Sheikh Mujibur Rahman just because of his presence in the radio station and Bangabhaban.
   Referring to the High Court's observations on Shahriar, Razzaque again pointed out that he was convicted because of his appearance at the radio station and Bangabhaban on 15 August, 1975. The High Court also said that Shahriar was a beneficiary of the killings as he was rewarded by a job in a foreign mission on 3 November, 1975.
   'Shahriar was convicted without enough discussion of the High Court's observations,' Razzaque added. 'We can't consider the verdict to be complete as the court's findings on Shahriar were not strong enough to sentence him for murder.'
   Razzaque also argued that the presence of the accused at the scene of the crime is necessary for justifying a death sentence but the High Court had not taken that into account.
   The hearing will resume today when Razzaque is expected to complete his argument.


BTV still govt's propaganda

A Jatiya Sangsad panel has observed the state-run Bangladesh Television still remains the government's propaganda machine and it must improve its news standard to compete with private channels.
   'News presentation of state-owned television looks more like advertisement of government activities. Such a public perception is not good for democracy,' the chairman of the parliamentary standing committee on information ministry, Obaidul Kader, said after a meeting of the committee.
   The members of the panel resented the "below-standard" news presentation by the public broadcasting authority asking its management to improve its quality in the interest of viewers and democracy.
   The BTV has still been doing what it had done during the tenures of the past governments.
   Presided over by the committee chairman, the meeting observed that a number of new television channels would be coming to the fray and the state-run TV would require to compete with them to survive.
   'The authorities must understand that news is a commodity and it has to be sold,' the chairman said, adding that the committee had earlier asked BTV management to improve the quality of both programmes and news presentation.
   The meeting however observed that the quality of programme has slightly improved while that of news presentation remained worse.
   The meeting, also attended by information minister Abul Kalam Azad, and other members of the committee formed two sub-committees to look into alleged irregularities in Bangladesh Film Development Corporation and irregularities related to appointment of employees in the state-run news agency, Bangladesh Sangbad Sangstha.
   The subcommittees were asked to report back by November 30.
   The meeting also asked the ministry to take measures for bringing an end to legal battle related to the office building of the BSS.

[ALOCHONA] Re: Confrontation ruled politics at that time

When data is presented like this it is most effective. This is a damning indictement of the previous Government's approach. I pray our current Governmnet gets a grip on extra judicial killings, the general law and order situation and on the police force.

The current situation is in the absence of BNP and Jamaat on our streets.

In the second half of 2010 BNP and Jamaat will return to the streets - unless they made a deal with the CTG to keep offf the streets for longer.

We don't want any more violent clashes and loss of innocent life.

NIKAH NAMA
(Sanad-e-Nikah)

PREFACE

All over the world marriage is regarded as the sacred social obligation. But Islam has not confined it to social values only but has explained its religious importance also.
Nikah is not only a tool to increase generation but it also helps in character-building, protection from acts forbidden by Quran and formation of a family. The problem is that on the occasion of marriage people talk of religion, but the fact is that society has upper hand in every aspect. And when any issue takes a bad turn, then religion is always blamed for it.
In the Holy Qoran importance and virtues of Nikah have been described in many occasions in very clear terms. In the Hadith (hadees) of Rasool-ul-lah and in the sermons of Imams importance and virtues of Nikah have repeatedly been told.
Both Qoran and Sunnat have ordained better and kind behavior with wife and children.
The Qoran has very explicitly explained the rights of husband and wife. In case of differences, the Qoran has also suggested ways and means to solve the problem. When all the efforts of unity and reconciliation are exhausted, the Qoran has advised talaq but still has condemned it.
The society has made marriage so difficult that today father of every daughter is perturbed.
Frivolous customs and rituals, manjha, mehndi and chauthi are nothing but wastage of lot of money. Demand of big sums of money as Mehr and huge dowry have devastated families. It is necessary that we should seek remedy of our problems in the light of Qoran and Hadith. Emphasizing on the importance and need of the Nikah Qoran says :-
(And this is one of the signs of his command that he created women for you of your own creed so that you live with them happily and developed love and compassion between you.)
(Sura-e-Rome At. 21)
At another place the Qoran says :-
(Perform Nikah of women who have no husband and your obedient slaves (male and female). If they would be hauper, the God by his mercy would made them rich. And the God is very knowledgeable and accommodating).
(Sura-e-Noor At. 32)
Rasool-e-Islam has said :
(Nikah is my sunnat and anybody who goes against it is not from me.)
Islam has given rights to husband against wife and to wife against husband and has declared them life partners, compliment to each other, source of prestige, secrecy and pride.
So in another Ayat the Quran says :
Hun Libas Lakum Wa Antum Libas Lahan.
(Sura Baqar, Ayat 187)
(Aurtein Goya Tumhari Choli Hain aur Tum Goya Unka Daman Ho).
(Man is incomplete without woman and woman is incomplete without man).
Prophet Mohammad has said that it is obligatory on wife to obey her husband. Never disobey him, keep watch on his house and not to give even 'Sadqa' from husband's money without his permission. Likewise Hadith also ordains that it is imperative on husband to provide good food and clothes to wife and to forgive her if she commits any mistake unknowingly.
On another occasion the Prophet has strongly admonished those who ignore the rights of their wives and children.
(Discarded is the person who ignores the rights of his children).
(Wives should be kept with dignity, so the Prophet said).
(Wasail al Shia)

As far as religion is concerned, it has ordered to keep women with dignity, provide them with basic necessities of life and protection of their rights.
Another evil of the society is that to show their superiority people fix big amounts as Mahr which in the eyes of religion is unpleasant. The Prophet said:
(The best women in my 'Ummat' are those who are beautiful and their Mahr is very less).
(Wasail-ul-Shia)
The quran says:
(Behave properly with your wives.)
(Sura-e-Nisa, Verse 19)
Where on one hand against the teachings of Islam, huge amounts are fixed as Mahr on the other not to pay Mahr through the life, is an unpleasant act in the eyes of religion. So Imam Jaffer Sadiq A.S. says :-
There are three types of thieves, those who don't pay zakat, those who don't pay Maher of his wife and those to take debt with the intentin not to repay it.
(Behar-ul-Anwar)
In this connection the biggest social evil is that people demand big amounts and huge dowry from bride's family. One cannot expect more un-Islamic, uncultured and inhuman thing than this evil. Though this ailment has nothing to do with the religion, this is an economic malody. But the sale of bridegroom for dowry is an inhuman act which has no parallel. It is the duty of every member of Muslim society to raise voice against this evil practice.
Since Islam is a practical religion, it has principles to solve issues even in difficult times. If all efforts of reconciliation have failed and there is no possibility of agreement and the mutual trust has finished, the divorce is the last resort. Talaq in Islam is valid but it has been condemned and has been permitted only as a last resort. Imam Jaffer Sadiq says, "Solemnize marriage but don't give divorce because Arsh-e-Khuda shakes when a talaq takes place."
On another occasion it is said God loves that house where marriage takes place and dislikes that house where divorce is given. In the presence of these specific instructions it is the duty of every pious Muslim to make utmost effort to cleanse the society from the scrouge of divorce.

CONDITIONS BY THE BRIDE

1. Within the bounds of the Shariah, the bridegroom will not impose unwarranted restrictions upon me.
2. Without any proper reason, he will not refuse me to meet my parents, my siblings and my near relatives.
3. He will not force me to do anything in violation of the Shariah or which may cause me embarrassment in the society.
4. Without authentic evidence he will never make any allegation against me.
5. In case of domestic dispute, I too will have full freedom to present my cause.
6. To fulfill domestic obligations, within the bounds of the Shariah and to improve the economic situation if I wish to work anywhere, he shall not stop me.
7. In matters of upbringing of children and in domestic affairs my opinion shall carry weight too.
8. After the marriage, the groom shall never demand from my parents or me or members of my family any more gifts or cash.
9. The groom shall provide me all essential and lively needs.
10. The groom shall be responsible for the maintenance of the children.
11. If the groom disappears for two consecutive years and does not provide essentials to me, I shall have the right to refer to Hakim-e-Shar'a for divorce the groom should delegate power to divorce to me in this regard.
12. (a) If the groom constantly disappears and does not inquire about me for months together and does not provide for the essential needs and if this state continues for four consecutive years.
(b) Or, if the husband uses physical force and if his action causes danger to my life or limbs, or if he forces me to have sexual relations with other men, under these circumstances the husband will delegate to me the right to divorce him so as to be relieved of physical and mental torture.
13. After consummation takes place, in case of divorce, I shall retain full rights over my mahr. Besides, it being obligatory upon him to return to me all my belongings.
14. If any of the groom's relatives excessively troubles me, I shall have the right to ask my husband for a separate living arrangement. If this demand is not fulfilled, I shall have the right to refer to the Hakim-e-Sahr'a and his decision shall be binding upon both of us.
15. The groom shall have no right to ask for anything in cash or kind. He will also make no demands as far as reception of barat is concerned.
16. These days the demand for bridal gifts exceeds those given to the daughter of The Prophet SAWW, hence, the mahr should also be more than that of Hazrat Fatima AS and there shall be no insistence upon limiting the amount of mahr equivalent to the mahr of Hazrat Fatima AS.
17. If the groom divorces me at his own will and at that time if I have no other means of maintaining myself and to provide for my necessities, till the time the means of livelihood are acquired by me, the groom shall, as an unrelated helper, provide for my essential needs. Let it be made clear that with this condition I do not intend to interfere with the provisions of the Shariah, rather, this condition is based on humanitarian grounds that a helpless woman instead of having to beg from strangers, why she should not impose this condition binding the person to whom for a long time she had served as spouse.
18. If the groom has any complaints against me, he shall first present them before the arbitrators mentioned in this Nikahnama and shall not directly approach the court.
19. If he agrees to the conditions mentioned above, I consent to marry him.

I hereby declare that I shall not act upon conditions 11 and 12 until I procure five witnesses and have consulted a religious scholar to whose erudite opinion I shall give due weight age.

CONDITIONS BY THE GROOM


1. The bride shall support me in all matters according to Shariah and social norms.
2. After fulfilling the lawful needs of the bride if I expend my money on my parents or relatives, the bride shall have no right to object.
3. The bride shall not by wasteful expenditure which is beyond my means, land me in debt.
4. The bride shall not have the right to do any thing that would cause a disgrace to me or my relatives in the society.
5. The bride shall not have the right to make any allegations against me without investigation and authentic evidence.
6. If my financial position deteriorates and the bride's financial condition improves then until such time my economic situation improves, she shall by way of qarz-e-hasana (soft loan) support me, which shall include the maintenance of children also.
7. If the bride has any complaint against me, she will first refer the matter to the arbitrators mentioned in this Nikahnama and shall not directly approach the court.
If the bride accepts the above conditions, I consent to marry her.

It is not mandatory for both parties to accept the conditions laid down for the bride and the groom in this Nikahnama. However, any condition(s) can be deleted, cancelled or narrowed and on a separate sheet of paper, shall be described in detail and signatures of all concerned affixed.
Similarly, if any conditions are to be added, for example, if the bride works to support her aging parents and minor siblings and she wishes to continue working even after the marriage so that they are not remained unsupported, or the groom immediately wishes to take his bride outside the country or the city or any other conditions can also be included, provided two religious scholars scrutinize them and approve that the conditions do not go against the shariah.

ARBITRATION

Proceedings:

Resolving conflicts through mutual negotiations and to determine through arbitration is a desirable deed in Al-Islam (Surat-u-Nisaa, verse 35). Marital disputes that arise after marriage assume grave proportions because there are no wise counselors involved.
At the time of marriage, five witnesses from the bride's side will be named. From the groom's side, five witnesses will be named and the representatives of both parties, usually religious scholars, will also be named. In this way, when an arbitration committee is formed, it can attempt to resolve any dispute that may arise.
If during the dispute, some of the named persons are no longer alive, each party can nominate their own persons and if among the representatives one or both no longer remain alive, each party shall nominate its own religious scholar.
If the bride or the groom have complaints, the arbitrators shall assemble and according to the conditions laid down in the Nikahnama, they shall try for reconciliation between husband and wife.
If the arbitrators of one party do not attend two consecutive times after being called, then at the third time the arbitrators from the other party shall deliberate and determine the issue which shall be binding upon both parties. If despite efforts made by the arbitrators, the case ends in divorce, representatives of both parties or only the woman's representative or the area's religious scholar shall go with the woman to the religious scholar who has been appointed representative by Hakim-e-Shar'a and that scholar shall in his presence get the divorce affected.
After the divorce, it shall be upon the arbitrators to get the return of the bridal belongings and remittance of mahr from the groom. If the arbitrators fail in their efforts, the representatives of Hakim-e-Shar'a shall use his influence to get the bride's belongings.
When all efforts of the arbitrators fail, the matter shall be referred to the court.
Note :
(1) It is preferable that the pronouncement of divorce is affected after the return of belongings and if any item has been deliberately damaged then its cost shall be paid.
(2) The gifts given to the bride and the groom at the time of marriage shall not be returned in case of divorce.
(3) If only one religious scholar represented both parties at the time of the marriage, then in case of dispute, the arbitrators shall nominate another religious scholar so that the proceedings may take place in the presence of two religious scholars.

The Death Of Rice In India : No Basmati, No Katarni

 

Someone said, "Monsanto invented the pig.' Very soon we will learn, right here in India and Asia, that US and European seeds multinational corporations "invented" rice. And soon we shall be paying up front royalty to these companies for eating rice. Hold your breath; that situation is upon us.

I pose this question to you before you read further: What would you do to a company that claims it "invented rice" and wants its pound of flesh because you, Sirs and Madams, eat rice?

 

India is a rice country. Rice has been our staple for thousands of years. A French scientist had once said India has 200,000 varieties of rice. Other environmentalists say 100,000. Does it matter? In the traditional rice producing regions I found that the taste and shape of rice often differed from village to village. Not any more. Post green revolution, the varieties available in the market for commercial sowing has dropped to about fifty what must surely be called the greatest destruction of genetic diversity in any food crop anywhere in the world.

 

Forty years ago when my mother cooked basmati rice, a gentle aroma would pervade the entire home. Not any more. Under Green revolution rice slowly hybridized into a commodity and now produced in large mechanized farms with heavy doses of fertilizers and pesticides. Bayer CropScience, a German company, genetically modified rice seeds. This gene revolution genie is now out of the bottle and no one knows how many rice varieties are contaminated. No one really knows how much of this engineered poison has already entered our food chain. And that has happened without proper biosafety studies.

 

Rice belongs to the Oryza specie. Lay persons like me were told that rice is self pollinating with little or no chance of pollen drift and contamination of neighbour's rice field. However, RiceTech, a US-based hybrid seeds company, has documented that "wind assisted rice pollens can move over 600 feet." [APHIS Workshop, September 13-15, 2004; Abstract] If genetically engineered rice is planted amidst non-genetically modified rice, there is every chance that non-genetically modified rice will be contaminated and this is what happened in the United States of America.

 

US Rice Gets Contaminated

Bayer CropScience (the German multinational seeds company) conducted field trials of LL601 (better known as Liberty Link 601) from 1999 to 2001 in Louisiana. It then dropped the project and did not seek US Government permission to market it. In 2006, widespread contamination of US long-grain rice with LL601 trait was reported.

 

Covering the event, Rick Weiss, the Washington Post staff writer, reported, "The U.S. Department of Agriculture is investigating how the variety escaped from test plots into farmers' fields, where it was quietly amplified for years until its discovery. The seeds and plants of LL601 look virtually identical to those of the popular conventional variety with which they had become mixed, said Steve Linscombe, director of Louisiana State University's rice research station in Crowley.. The day the contamination was announced in August, Bayer asked the government to approve the variety."

 

On 5th October 2007, the United States Department of Agriculture (USDA) concluded its genetically engineered rice investigation. Investigators had hoped to identify how each GE rice line entered the commercial rice supply, but the exact mechanism for introduction could not be determined in either instance. Speculation was rife: some said mislabeling, others said human error, yet others said containers got mixed up.

 

Approval By Contamination

On 24th November, 2006 the USDA granted marketing approval of genetically-engineered Liberty Link 601 of Bayer CropScience. (GE) rice variety following its illegal contamination of the food supply and rice exports, first announced three months ago. The controversial decision was taken despite the insistence of Bayer CropScience that it had dropped plans to commercialize the variety five years ago. "With this decision, USDA is telling agricultural biotechnology companies that it doesn't matter if you're negligent, if you break the rules, if you contaminate the food supply with untested genetically engineered crops, we'll bail you out," said Joseph Mendelson, Legal Director of the Center for Food Safety. "In effect, USDA is sanctioning an 'approval-by-contamination' policy that can only increase the likelihood of untested genetically engineered crops entering the food supply in the future, and further erode trust in the wholesomeness of U.S. food overseas," he added.

Naturally, Bayer CropScience welcomed the decision of USDA. "The deregulation confirms the preliminary decision of USDA, published on September 8, 2006, that LLRICE601 does not pose any environmental concerns and should no longer be regulated."

Oh yes, it does, Mr. Bayer. That is why US rice consignments were returned or destroyed at Rotterdam port.and another, and another.and another.

Is India Vulnerable?

You bet it is. In January I received a set of documents from an Agriculture University in West Bengal that illegal genetically modified Bhindi (Okra) has been planted. In March I was told in Jhansi that poor farmers were offered lucrative deals to plant "special seed" of all sorts of vegetables including green chilly.

Who knows at how many places illegal genetically engineered rice have been planted?

Only when contamination will be discovered at the port of landing of Indian rice exporters that India will wake up to the destruction of its 10,000 years of heritage: THE RICE.

Following on from the US example, it is not too far fetched to say that our favourite staple rice will be owned by one of the five or six seeds multinationals.because they "invented" it! Who will be the first to contaminate our rice is at best a guess.

But IT WILL BE CONTAMINATED. THEY ARE TOO DETERMINED TO OWN OUR FOOD.

The army arrested two innocent villagers in a raid last night in Manikchari under Khagrachari district.

 
Sources said a group of army personnel from Manikchari camp raided the village of Mahamuni Para around 10pm on Saturday and picked up Kongyo Marma (40) s/o late Aungjairi Marma and Kyopru Marma (35) s/o late Nira Aung Marma.

 
Kongyo Marma was eating his dinner when the army came and began beating him.
 
Both of them were taken to the camp and tortured severely.
 
At one stage the army tried to photograph them after putting guns in their hands, but when they resisted the army put some Indian wine bottles in front of them and then photographed them.

 
Later, they were handed over to the police, and have been kept in their custody till the writing of this report at 10am.
 
A human rights activist, after making inquiry about the arrested Jummas, told chtnews.com that both of them are completely innocent.

 
"There could be only one possible reason for their arrest, and it is that they are relatives of Apruchi Marma, General Secretary of PCP Khagrachari District Unit, who played a very important role in organising protests against the recent land grabbing in the area." he said.

 
Kongyo Marma is his elder brother while Kyopru Marma his sister's husband, he said.
 
The Hill Students' Council president Ricoh Chakma condemned the arrest and demanded their immediate and unconditional release.

 
He said PCP will not tolerate such actions of the army any more and warned of vigorous programmes if it does not stop human rights violations in the CHT.

India appoints new envoy to Dhaka
 
New Delhi, Oct 27 (bdnews24.com)—India is replacing its high commissioner to Bangladesh Pinak Ranjan Chakravarty.

The Indian government's ministry of external affairs announced on Tuesday that Chakravarty would be replaced by Rajeet Mitter currently India's ambassador to Philippines.

The move comes ahead of prime minister Sheikh Hasina's upcoming visit to New Delhi, expected to take place at the end of the year.
 
Chakravarty has been transferred to Bangkok as India's ambassador to Thailand. A ministry of external affairs spokesman said that both Mitter and Chakravarty would take up their new assignments shortly.

Chakravarty, who was appointed as Indian high commissioner to Bangladesh in January 2007, will succeed Vijaya Latha Reddy as India's ambassador to Thailand. Chakravarty's security in Dhaka had been enhanced recently after he reportedly received a threatening e-mail.

The main opposition BNP had demanded that the Indian Government should recall Chakravarty after he had reportedly made several "undiplomatic" remarks defending India's plan to construct the controversial Tipaimukh Dam.

[ALOCHONA] SC terms Shafiullah coward for failing to protect the President




The Supreme Court relegated ex-army chief KM Shafiullah to a "coward general" for his failure to command his force into action for saving life of the then commander-in-chief, President Sheikh Mujibur Rahman. "Shafiullah is a liar and coward general. None of the learned judges of the High Court division bench relied on his evidence.(UNB, Dhaka)

So it is redundant to point out for discussion here," the five-judge Appellate Division bench made the scathing remarks during the Bangabandhu murder case appeal hearings on Tuesday.

The highest court spat out the swinging words when his evidence as a prosecution witness came up for discussion during the hearings.

The court came down heavily on Shafiullah when Abdur Razzaque Khan, the defense counsel for condemned prisoner Lt Col (retd) Sultan Shahriar Rashid Khan, pointed out the evidence made by the then army chief.

Adding fuel to the flames, Razzaque quipped: "Were Shafiullah not a coward general, he would have resigned from the army as in other countries."

But he had served all the post-75 beneficiary governments of Ziaur Rahman and HM Ershad for over one and a half decades as diplomat abroad. Terming a cruel joke Shafiullah's telephonic advice to Bangabandhu, the defense counsel, however, did not hesitate to inform the court that Shafiullah, one of the sector commanders of the 1971 Bangladesh Liberation War, "is believed to be the father of Bangladesh Army".

Referring to the crucial telephonic conversations between Bangabandhu and Shafiullah before the bloodletting carnage, the defense counsel told the court that Bangabandhu, after informing him about the attack on his Dhanmondi official residence, ordered the army chief to send in troops. But, instead, general Shafiullah asked Bangabandhu: "Can you get out of house?"

"It's a fun," the lawyer said, adding that it was very significant and the matter still remained unexplained.

"Unfortunately, none turned up to rescue the President, the supreme commander of the defense services," he told the court, trying to get the benefit of the doubt for his condemned client because of the muddled-up situation of the time surrounding the August 15, 1975 Dhanmondi tragedy.

Earlier, at the outset of his argument, Razzaque said as the prosecution witnesses made contradictory evidences about the presence of Shahriar in the night parade before the 'Operation First Light' marches towards the residence of Bangabandhu, the death sentence might be reduced to other forms on grounds of the benefit of the doubt.

About Shariar's presence in the radio station and Bangabahaban on August 15, 1975, the defense counsel admitted the fact but argued that his client's presence was on authority as he was reemployed in army on the day with retrospective effect. Shahriar's presence in radio station and Bangabhaban on the day of occurrence does not justify the act of participating in the killing of Bangabandhu, along with his family members, like the others in the military cabal, he argued.

[ALOCHONA] A looming crisis



In this age of enlightenment proliferation of ignorance is a significant problem. Millions of people who still find peace and solace with their religious beliefs this issue of ignorance are related to them. An immovable contradiction between reason and religion is playing havoc with our cherished desire to have a world based on logic and realism. Historically the provision of traditional religion is reserved for a fearful mind who will always keep the thoughts of reason at bay. This phenomenon is based on a prehistoric layer of fear which is very difficult to overcome. A staggering number of people still feels helpless to ignore this attraction to fear and this fear led some people to revolt against any attempt to minimize the influence of faith to help usher reasonable enlightenment. The scourge Islamic extremism which is challenging democracy to create a tolerant society based on equal justice is a matter of great concern for any sensible person. In the history of mankind ignorance never had a chance to reassert itself in such a profound way when humans have so much to get rid of it. In the realm of knowledge there is always a place of polemics but the reason is not to create a war but to find out the synthesis. At this juncture of time the blame goes to our failures to build a rational bridge to fill the gap in the differences of various concepts. We came up with bright ideas without a proper mechanism to implement it. The spread of Taliban type of religious extremism is raging forward not because that it can offer any better alternatives but only to deepen the crisis of understanding which can only bring a catastrophe.

It is scary that they are now invoking this in Canada. The primary victims of this attack on personal liberties has been women and youth."

Bigotry unchallenged

With an air of triumphalism, finger-waving cleric Said Rageah harkened his Toronto flock: "We have to establish Islam [in Canada]. I wanna see Islam in every single corner of the city; I would like to see niqabis, and hijabis [women wearing face masks and head covering] everywhere in the city. I want to see 'brothers' [Muslim men] in beards everywhere in the city. Because when they see more of us, they will have more respect for us. They will say, 'look they are everywhere...we cannot go against them'."

The Somali-born Saudi-trained cleric was taunting his congregation for what he said was their impotence in face of a call by the Muslim Canadian Congress to disallow any public dealings with any person wearing a facemask.

Urging his congregation to take 'action', the imam said:"Please brothers and sisters, please. Do not just sit 30 minutes listening to a khutba [sermon] and not do anything about it. Please take a stand. Take action against this." He then switched to Arabic to invoke a verse that has been used by Islamists and radical jihadis to intimidate and silence opponents.

"Aamr bi alma 'ruf wa nahi 'an almunkar" [enjoin good and forbid evil].

Like with so many other verses of the Koran, Islamists have usurped the inherent good faith of the word of God and turned it into an instrument of authoritarianism to spread fear among the faithful.

Across the pond, Ziauddin Sardar, the London-based Islamic scholar addressed the misuse of this Koranic verse in these words:

"Now, I must admit, that this is one of the most misused injunctions of the Koran. It is used as a charter by all self-appointed moral supervisors who think they know what is best for everyone else. In its worse forms, we have the state-sponsored moral police harassing the citizens for alleged moral shortcomings in Saudi Arabia and Iran. But the injunction has nothing to do with moral policing."


The Toronto imam made no secret about what 'action' he wanted his congregation to take. His sermon ended with a rallying cry: 

"Oh Allah protect us from the evil agenda of these people; Allah destroy them from within themselves, and do not allow them to raise their heads in destroying Islam."


Who were "these people"? Who did Imam Said Rageah wish to destroy? The answer lay in what the cleric had sneaked into his sermon in the Arabic language, which might have slipped unnoticed had I not noticed it when I heard it on a YouTube.

"Oh Allah, give victory to Muslims and Islam...Oh Allah, give defeat to the Kufaar and Mushriqeen," he prayed.

Every Friday, at almost every mosque in Canada, the clerics make this prayer at the end of their sermon and no one bothers to protest. My mistake was that I did.

Since the disclosure, there has been orchestrated campaign by the mosque establishment to deny that the word "Kufaar" means "Jews and Christians".

I have received dozens of e-mails, some threatening with intimidation, angry that I chose to blow the cover for this weekly supremacist sermon of hate.

One letter writer to the Post, Ibrahim Hayani, tried to spin the prayer asking God to defeat the Kuffar by arguing: " 'Kufr' is denying and rejecting faith with ingratitude toward God and negligence toward the duties conferred by God, such as telling the truth. It has little, if anything, to do with Christians and Jews."

What he failed to mention is that sharia law and all medieval and contemporary scholars of Islam agree that the word "kufaar" includes all people who reject the Koran as the word of God and deny Prophet Muhammad as God's final messenger. This of course includes not just Christians and Jews, but also Hindus, Buddhists, Bahais, Zoroastrians and atheists.

Perhaps we should hear it from the horse's mouth.

Sheikh Muhammad Al-Shinqiti is a Mauritanian-born Imam who is a Director of the Islamic Center of South Plains, Lubbock, Texas and is a resident scholar on the IslamOnline website that issues fatwas on various issues raised by Muslims from around the world.

In 2005, Sheikh Al-Shinqti was asked by a Muslim woman, whether Muslims are "allowed to call a Christian person kafir? Who is, exactly, a kafir?"

The good Sheikh answered: 
"Christians and Jews are kuffar because they rejected the Prophethood of Muhammad (peace and blessings be upon him), but the Koran did not describe them as mushrikeen or polytheists."


Recently, praying for the defeat of Christians and Jews was brought up by a senior Saudi cleric. Sheikh Salman al Awdah told Dubai-based MBC Television channel, Muslims should avoid prayers that call for the destruction of non-Muslims.

Sheikh al-Awdah, who is director of the the website Islam Today, said: 
"Praying for the ruin and the destruction of all infidels is not permitted because it goes against God's law to call upon them ... to take the righteous path."


Why then would so many Muslims in Canada be willing to whitewash the truth about the hateful sermons in almost every mosque in Canada? One would hope that by exposing one imam caught on video praying for the defeat of Christians, Jews, and other non-Muslims, would spur ordinary Muslims to protest this type of bigotry.

However, it seems not only are ordinary Muslims too scared to take on their religious establishment, even the non-Muslim groups, specifically targeted in this hateful prayer, are too frightened to say, Stop this hurtful prayer.

The silence with which Imam Said Rageh's supremacist sermon was met sends a clear message to all other Islamist clerics in Canada. You are free to pray to God for the defeat of non-Muslims and the victory of Islam in Canada. You are free to spread this segregationist message to boys as young as five and to nurse in them the seeds of hatred towards Christians and Jews, while simultaneously saying with disarming smiles, "You are people of the book."

আমি তখন চতুর্থ শ্রেণীতে পড়ি। সহশিক্ষা। আমাদের ক্লাশে আধাআধি ছেলে-মেয়েগীতা, অঞ্জলী, জাহানারা, রহিমা, ফাতেমা, সুরমা, বকুলী আরো অনেকে আমার ক্লাশ মেট। খেলার সাথী। প্রাইমারী স্কুলের সুবিধা এই যে, মাঝে মাঝে শিক্ষকদের কেহ কেহ আসেন না, তখন আমরা মাঠে গোল্লাছুট খেলি। আবার আছে লেইজার টাইম ছুটি। গোল্লাছুট খেলা আমাদের আছেই। এই খেলা ধুলার মাঝেই আমরা আমাদের খেলার জুটি বেঁচে ফেলি। গীতার সাথে খেলতে খেলতে কখন যে আমাদের পারস্পরিসমমর্মিতা হয়ে গেছে আমরা তা বুঝতে পারিনি। গীতা ফরিদগঞ্জ বাজারের বড় মূদি দোকানদারের মেয়ে। পাশের বাসা অঞ্জলীদের। সে মুদি দোকানদারের মেয়ে। আমরা এক সাথেই গোল্লাছুট খেলি। দু'জনেই আমাকে চকলেট খাওয়ায়।দু'জনের গায়ের রং ফর্সা। অঞ্জলী একটু হেংলা-পাতলা এবং লাজুক টাইফের। খেলায় আগ্রহ কম। বেশীক্ষন দৌঁড়াতে পারে না। হাফিয়ে উঠে। কিন্তু গীতা একটু মোটা-সোটা এবং মিশুক। সারাক্ষন খেলার পাগল। আমি একজন ছেলে মানুষখেলায় আমার নেশা। আর গীতার সাথে আমার সমমর্মিতা শুধুই গোল্লা ছুটের জন্য। গীতা খেলার ফাঁকে ফাঁকে আমাকে হাত ধরে টেনে স্কুল ঘরের পিছনে নিয়ে যায় এবং তার ফ্রগ পেছনের দিক দিয়ে একটু খানি উপরের দিকে তুলে ধরেআর আমাকে বলে তার হাফ পেন্টের সুতলীর ভিতরে লুকিয়ে আনা চকলেট বের করতে।সুতলীর ভেতর থেকে অনেক কসরত করে দু'টি চকলেট বের করতে পারলে দু,জনে মুখে দিয়ে আবার আমরা সকলের সাথে খেলতে শুরু করি। এভাবে লেখা-পড়া খেলা-ধুলা করে আমাদের দিন ভালোই কাটছিল।

গত দু'দিন গীতা স্কুলে আসেনি। আমার ভালো লাগছিল না। তাই আমি খেলি না। সারাদিন মনে হচ্ছিল, এই বুঝি গীতা এলো। দ্বিতীয় দিন অঞ্জলীকে জিঞ্জাসা করলাম,

-অঞ্জলী, গীতার কি অসুখ হয়েছে? ও স্কুলে আসে নাই কেন?

অঞ্জলী রহস্যময় হাসি দিয়ে বলল,

-ওর মা ওকে মেরেছে। ওর জ্বর হয়েছে।

মনটা খুবই খারাপ হয়ে গেল।

পরদিন গীতা এল। চোখ মুখ লাল। চেহারা মলিন। ক্লাশের কোনার বেঞ্চে বসেই রইল। কারো সাথে কথা বলে না। আমি তাকে ক্লাশের বাইরে এনে জিঞ্জাসা করলাম,

-গীতা তোমার কি হয়েছে, আমাকে বল?

গীতা বলল,

"তুমি হলে মুসলমান", তোমার সাথে কথা বলতে মা আমাকে নিষেধ করেছেন।

কেন?

-অঞ্জলী মাকে বলেছে, তুমি নাকি স্কুল ঘরের পেছনে আমাকে নিয়ে গিয়ে আমার জামা উপরে তুলে কি কর। এটা সে দেখেছে। এ জন্য মা আমাকে অনেক মেরেছেন। তোমার সাথে কথা বলতে নিষধ করেছেন। তুমি আর কখনো আমার সাথে কথা বলতে এসো না। তা হলে মা আমার স্কুলে আসা বন্ধ করে দেবেন।

তুমি সত্য কথা বললে না কেন? বললে না কেন পেন্টের সুতলীর ভেতর থেকে আমাকে দিয়ে চকলেট বের করিয়েছ কেবল।

-সত্য কথা বললে তো আরো বিপদ। তা' হলে তো জানেই মেরে ফেলতো। বলতো চকলেট চুরি করায় দোকানের লক্ষী চলে গেছে। ব্যবসায় নষ্ট হয়ে গেছে।

এর পর থেকে গীতা আর আমার সাথে কথা বলেনি। বার্ষিক পরিক্ষার আগে স্কুলে আসা বন্ধ করে দেয়। চতুর্থ শ্রেণীর পরিক্ষা তার আর  দেয়া হল না। একদিন অঞ্জলী এসে জানালো গীতাদের পরিবার কোলকাতায় চলে গেছে। সংবাদ শুনে আমার মন দুঃখ ভারাক্রান্ত হয়েগিয়েছিল। তবে কি সে আমার কারনে এ দেশ ছেড়ে গেল। সে থেকে আমার মনে একধরনের দুঃখ দানা বেঁধে রইল। বিষয়টি মনে এলে আজো নিজকে অপরাধী মনে হয়। এ নিয়ে আজো আমি বেদনাক্রান্ত হয়ে পড়ি।

আমার পরিচিতি সম্পর্কে  অন্যের স্ব-আরোপিত ধারনার কারনে কতবার যে আমাকে আসামীর কাঠ গড়ায় দাঁড়াতে হয়েছে তার ইয়ত্তা নেই। গীতার মুখেই আমি প্রথম শুনেছি "আমি মুসলমান"। মুসলমান হয়েছি বলে আমার সাথে গীতার খেলা, দেখা করা ও কথা বলা নিষেধ হল। গীতার মা আমাকে কেন মুসলমান হিসেবে বর্ননা করল? আমি জানি না। অন্যে আমাকে যে ভাবে দেখে- আমি কি তাই? পরিচয় কি স্থির কিছু? পরিচয় কি শুধু ধর্ম দ্বারা নির্ধারিত? পরিচয়ের কি আর কোন মাপ-কাঠি নেই? নৃতাত্তিক বিচারে আমি কি বাঙ্গালী নই? দেশ বিচারে আমি বাংলাদেশী ছিলাম। এখন প্রতিদিন কানাডিয়ান হিসেবে বিনির্মিত হচ্ছি(Being Bangladeshi, I am becoming Canadian)। বহুস্তরিক পরিচিতির (Multiple identities) পাশাপাশি আমার বড় পরিচয় আমি একজন মানুষ। আর দশজন মানুষের মতই আমিও একজন। গীতা আমার কাছে একজন মানুষ ছিল। 'সবার উপরে মানুষ সত্য তাহার উপরে নাই'। এ কথা কি মিথ্যা। গীতার সরল মনের সরলতা আজো আমাকে আনমনা করে তোলে। আজো আমি সরল মনের ভালোবাসা পাবার জন্য গীতার মত মানুষ খুঁজি।

 

[এ গল্প-গাঁথায় আমি দুই বিপরীতমুখী চিন্তা-প্রকল্প (Binary world-view)দ্বারা কি ভাবে মানুষের মন বিষাক্রান্ত হয়, তা দেখানোর চেষ্টা করেছি। পুর্ব-আধুনিকবাদ(Pre-Modernism) ও আধুনিকতাবাদ (Modernism)দুই বিপরীতমুখী চিন্তা-প্রকল্প দ্বারা শাসিত। এ চিন্তা-প্রকল্প একে অন্যের বিপরীতে দাঁড়িয়ে একে অন্যের পরিচিতি নিশ্চিত করার রাজনৈতিক খেলায় লিপ্ত। পরিচিতির রাজনীতি (Identity Politics)এ চিন্তা-প্রকল্পের উত্পাদিত পণ্য। মাস্টার-স্লেইভ, বুর্জোয়া-প্রলেতারিয়েত, সাদা-কালো, পুরুষ-মহিলা, অয়েষ্ট- রেষ্ট(West-Rest/West is the best rest is the waste), স্বামী-স্ত্রী, উচ্চ-তুচ্চ, দিন-রাত-এ সবই দুই বিপরীতমুখী চিন্তার শব্দমালা। উত্তরাধুনিকতাবাদী (Post-Modernism) দার্শনিকগন এ দুই বিপরীতমুখী চিন্তা-প্রকল্প বলয় থেকে বের হয়ে আসার পথ খুঁজছেন]।
