Thanx 4 ur nice posting. But Rajakar shab, its not the same. There was only 8 militants in Pakis Army HQ. But in BDR HQ there was nearly 8000 mutiny with heavy arms. I understand you love pakis leadership, pakis Taleban, Pakis Military- everything. So why not go to there?

Imagine the same happens in a military head quarter in Bangladesh and Sk Hasina is in control with the help of Pranab Mukherjee. She will select the most criminal minded ones of her party to assure the terrorists that the PM is with them. Then she will have a long chat with their leaders and assure them their safe passages while the culprits keep on killing the hostages.
Paki leadership ( I am not sure if one exists) have done a good job. They have done an excellent job right after Pilkhana incident in a police compound where thugs attacked the Pakistani Police Cadets. Remember the Pakistani security forces didn't deal with the rebels they dealt with the suicide squad.

Pakistan Army Headquarter Seize Ends: What Is the Solution

 

Agencies have reported that Pakistani commandos freed dozens of hostages held by militants at the army's own headquarters Sunday, ending a bloody, 22-hour drama that embarrassed the nation's military as it plans a new offensive against al-Qaida and the Taliban. At least 19 people died in the standoff, including three captives and eight of the militants, who wore army fatigues in the audacious assault. The rescue operation began before dawn Sunday, ultimately freeing 42 hostages, the military said. One attacker, described as the militants' ringleader, was captured. Earlier Agencies reported that Militants held several security officers hostage inside an intelligence wing of the army headquarters Saturday after they and others attacked the complex in an audacious assault on Pakistan's most powerful institution.The attack, which left at least 10 people dead, was the third major militant strike in Pakistan in a week and came as the government was planning an imminent offensive against militants in their strongholds in the rugged mountains along the border with Afghanistan.It showed that the militants retain the ability to strike at the very heart of Pakistan's security apparatus despite recent military operations against their forces and the killing of Taliban leader Baitullah Mehsud in a CIA drone attack in August. The attack began shortly before noon when the gunmen, dressed in camouflage military uniforms and wielding assault rifles and grenades, drove in a white van up to the army compound and opened fire, army spokesman Maj. Gen. Athar Abbas and a witness said."There was fierce firing, and then there was a blast," said Khan Bahadur, a shuttle van driver who was standing outside the gate of the compound. "Soldiers were running here and there," he said. "The firing continued for about a half-hour. There was smoke everywhere. Then there was a break, and then firing again."Pakistani media said the Taliban claimed responsibility for the attack, and Interior Minister Rehman Malik said the ongoing assaults strengthened the government's resolve to launch the offensive.

We condemn this pointless attack. A terrorist outfit can not gain in this way .It will only enhance hatred against them and enhance their rout. No sane person will support such groups, whatever be the cause. We are worried that this outfit is doing all this in the name of Islam though all Islamic movements and leaders have rejected this madness.

UN Anti-Caste Charter: Annihilation of Caste

The United Nations Human Rights Council (UNHRC) held in Geneva (September 2009) deliberated on the recognition of caste as race. It proposed to ensure that descent and work based discriminations need to be fought against at global level. Nearly 200 million people all over the World are victims of such discriminations, which are associated with notion of purity, pollution and practices of untouchability. These are deeply rooted in our society and have also assumed cultural forms. India so far has been taking the stand that caste issues should not be internationalized as caste is not race and it is our internal matter. On this issue, earlier Nepal, a Hindu Kingdom, also was toeing similar line. With overthrow of Hindu Kingdom and coming in of democracy, Nepal has come to take the stand that caste based discriminations are akin to race based one's and so international efforts need to be thought of to supplement the national efforts. India still is trying
to hide its underbelly, which is quite unfortunate.

There are two types of pressures on India currently. The Human Rights activists are urging that India should take leadership in ensuring that UN norms are brought up, caste recognized as race and the caste discrimination should invite censures from UN as well. On the other hand BJP spokesperson Ravi Shanker Prasad stated that India should oppose such a move as that will involve UN sanctions if such violations take place in India. He went to say this internationalizing the issue of caste is a failure of India's foreign policy. At the same time we read that dalits were beaten up (15th Oct 2009) while trying to enter temple in Nagapattinam, Tamil Nadu. This is a matter of great shame. This temple entry was part of several such programs planned to ensure that dalits are not discriminated against in temples. We recall that nearly eight decades earlier Dr. Ambedkar also met a similar fate when he organized Kalaram Temple agitation on the issue of Dalits
entry into temples. How little things have changed after such a lapse of time!

In consequence, Nepal has been the first country in South Asia, where untouchability has been traditionally practiced, to articulate its opposition to those abysmal practices in a very strong manner at International level as well. UNHRC document is proposing a regional and international mechanism, UN and its organs are to complement national efforts to combat caste discrimination. It proposes to equate all discrimination on the basis of caste occupation and descent as violation of Human rights. India's opposition to this is shocking despite an earlier (2006) statement by Prime Minister Manmohan Singh, which compared untouchability to apartheid. It seems that the state machinery has elements that are deliberately tilting the policies in this retrograde direction. BJP's opposition to the UN Human rights efforts is quite understandable, as BJP politics is based around the goal of Hindu Rashtra. In all the concepts of religious nationalism, based on any
religion for that matter, there is a neat division between rights and duties. Rights are for elite dominant sections and duties are for the downtrodden! So as per that human rights for dalits and women are unthinkable. But how come Manmohan Singh who equated untouchabilty with apartheid is keeping quiet on this?

Despite the provisions enshrined in our constitution and various prevalent laws the practice of untouchability, caste based discriminations do persist. There are also political tendencies, which want to undo the affirmative action directed to uplift those discriminated due to caste. In India today various theories are doing rounds as to the origin of the caste. Many of these are mere propaganda of vested political interests in the guise of theories.

It is being propagated that caste system came into being due to the invasion of Muslim Kings, who were out to convert the local people by sword. According to this those Hindus who were very proud of their religion escaped to forests, resulting in their social down slide and so the caste system came into being. The other such Hindus who opposed their conversion were forced to clean the toilets of Muslim kings and elite. Due to this, caste system came in and untouchability became a norm! These 'theories' of caste system are merely a figment of 'politically necessary' imaginations, not based on any historical scholarship or deeper social understanding of those times.

Some of the more serious theories revolve around Aryan-Dravid race theories, some around Marxist class theory of division of labor. About the Aryan-Dravid theory of caste, recently Genome studies have ruled out any water tight Aryan-Dravid divide, as there is unrecognizable mixture. Aryans took some as Dasas, but later intermixing was very extensive to be able to maintain race boundaries. As far as class theories, division of labor, Ambedkars's comments are very apt, caste is not a division of labor, it is a division of laborers.

The origin of caste is much more complex. Ambedkar in his various contributions presents highly nuanced theory of caste origin. Two of his books, 'Who were the Shudras?' and 'Untouchables' deal with it. His 'Revolution and Counter Revolution in Ancient India' also throws light on the topic. Ambedkar rejects the race theory to a great extent. As per him caste is a social division of people, created by ideological and religious factors. The concept of caste can traced to first Millennium BC. Let's remember here that Muslim kings' influence in India began around eleventh century only.

Multiple factors operated in converting the locally organized tribes into castes. The process was not sudden and went on getting rigid over a period of time. The factors converting these local tribes into caste entities were, coming of Aryans and Brahminical ideology. The Aryans who came here were divided loosely into three groups, warriors; priests and trader-farmers. The Dasas were added up here in India. Over a period of time this loose arrangement became birth based and tribes in local areas got transformed into fixed endogamous groups, belonging to a particular caste, performing a fixed economic function. This in turn created a social hierarchy between castes. By second century AD its contours are very marked.

The Vedic period is a one of Varna. Purush Sukta of Rig Veda tells us that Lord Brahma created four varnas from the body of Virat Purush. With coming of Buddhism, Brahmanical values of Varna got challenged and were not adhered to. This resulted in the betterment of condition of Shudra and women. This period is followed by the period of Manu Smriti (2nd Century AD) where Varna gets converted in to caste, with consequent downgrading of shudras and women.

The Muslim Kings who ruled areas of the country did not disturb the local social arrangements. As a matter of fact they had many associates and advisors, who were Hindus and they were also part of top echelons of administration and army during this period. Two other phenomena took place during this period. One, Indian caste system affected Muslim community as well, because of which there came into being castes amongst Muslim community, Ashraf; Azlaf and Arzal, quiet akin to the caste hierarchy in Hindu society. Two, some low caste Hindus tried to escape the Brahminical tyranny by embracing Islam under the influence of Sufi saints. Bhakti tradition also talked against caste system. Most of the Bhakti saints themselves were from low caste.

The period of freedom movement, in contrast, is a period of the beginning of processes demanding the equality of caste and gender. Movement for Indian nationalism was accompanied by these values while the politics based on Muslim Nationalism and Hindu nationalism, had not much to do with these social processes. Low caste Muslims and Hindus both kept aloof from Religious nationalism and followed the concept of composite Indian nationalism. We see the contrast that the protagonists of equality for Shudras burn Manusmriti, the codification of caste and gender hierarchy, while the one's based on religious nationalism called for ancient glories when Manu Smriti was ruling the roost. Some of them (Deen Dayal Upadhyay) went on to state that different varnas are like different limbs of the body politic of the society, needed for proper equilibrium in society.

Today sixty years after Independence and coming into being of Indian Constitution, the prevalence of untouchability and caste practices are a matter of shame for us. It is time we intensify our own efforts to eradicate it and join the global efforts to end this carry over from our past.

Timothy F. Geithner, who is now secretary of treasury under Obama administration, had to pay more than $43,200 in back taxes and interest for underpayments from 2001 to 2004 to get clearance from the Senate Finance Committee to occupy the then President-elect Barack Obama's choice for treasury secretary.
 
To meet the transparency of US administration, Clinton's foundation had to disclose the name of 205,000 donors worldwide before Hillary R Clinton was confirmed by the Senate Foreign Committee as secretary of state. But people of Bangladesh never receive any such information or examples from the country's legislatures, executives, leaders, or politicians that could inspire others.
 
Thanks to an English daily newspaper for bringing up such report that says 42 out of 345 lawmakers in the parliament both from treasury and opposition bench, including three state ministers, have never paid any income tax, claiming they do not have taxable income while according to National Board of Revenue (NBR), each of these lawmakers spent Tk 15 to 20 lakh in the parliamentary election and the limit of tax-free income in the country is 165,000 per year.
 
In addition, according to both Election Commission and NBR, most of these parliamentarians have Tax Identification Numbers (TINs) but very few of them show up in the tax book while some parliamentarians even never feel obligation to have TINs, keeping their huge income secret.
 
Since its independence in 1971, Bangladesh never saw any example from those who were in the driving seat of different government and non-governmental organizations that could motivate others. As democracy is defined as a system of government where the people are in control of how the government operates, what laws it passes, and how things get done, they have every right to know how their elected legislature is running the country. To be respectful to the law in a democratic country everyone, from top level executive to bottom level worker, is bound to show his or her earnings and savings. It is meaningless to expect the general people to be fair when top people are not.
 
According to John Quincy Adams (July 11, 1767 – February 23, 1848), the 6th President of the United States, "If your actions inspire others to dream more, learn more, do more and become more, you are a leader." The term being a good leader means that he/she inspires others to follow his/her example. They are leading people to success and also they are responsible for the actions that are taken to do this. In addition, a good leader needs to inspire confidence and represent a strong example of what needs to be aimed for.
 
As we assume legislatures or top people are good leaders, they should have good characters, beliefs and values by which they easily can motivate others, but the negative characteristics of a leader or noted person only convey the wrong message to the people.
 
Calling it as a charter for change, the present ruling government promised that powerful people must have to submit wealth statement annually including general citizen who are bound to do so in its five priority issues in the last election manifesto. Though it is politically motivated according to Awami League (AL), but its party chief, Prime Minister Sheikh Hasina was detained on corruption charges and asked to submit her wealth statement voluntarily during the last caretaker government.
 
Her arch-rival, Begum Khaleda Zia, former premier of Bangladesh and the chairperson of Bangladesh Nationalist Party, forgot to mention her wealth accrued in 1980, 1981, 1982, 1986, 1987 and 1991, while she had enjoyed the support of a huge office set-up during her tenure.
 
Taking bribe, hiding wealth report, saving in or buying a house in a foreign country, are very common activities among Bangladeshi leaders only because there is no legal obligation to give their financial status.
 
The White House published on April 15, 2009 the taxable income of the President and Mrs. Michelle Obama for the tax year 2008 as $855,323 in federal taxes and $78,000 in state taxes. The Obamas had $2.35 million in taxable income after taking deductions, which included his salary as a public servant to the US government and the royalties from his two published books, "Dreams from My Father," and "The Audacity of Hope." A further transparent look at President Barack Obama's 2008 tax returns shows that $172,050 was donated to charities like CARE and United Negro College Fund.
 
Government in Bangladesh has extended the time for submitting income- tax return from September 30 to October 30 aiming to collect more tax. Presently, country has 2.2 million TIN holders but only 0.67 of them pay income-tax, says NBR. About 80 percent companies do not pay income tax. The World Bank says Bangladesh's tax-GDP (gross domestic product) ratio is among the lowest in South Asia, even lower than that of Nepal.
 
The income- tax-collection target has been fixed at US$2.40 billion (BDT 165.60 billion) for the current fiscal year, 27 percent higher than last year's target. In fiscal 2008-09, around 0.67 million taxpayers' submitted tax returns involving $144.78 million (BDT 7.92 billion) out of 2.2 million TIN holders.
 
In a fresh move to make its services friendlier to taxpayers, the NBR and the British donor-Department for International Development (DFID)-will pick an international consultancy early next year to come up with a string of innovative solutions that can greatly change the way the NBR functions now. But it is always remain an uphill task to NBR to function independently and properly as it regularly faces government interventions. Very often, it is used as political weapon.
 
It will be difficult to say how much the NBR worked neutrally during the last caretaker government, but no doubt it was the vital weapon to send the politicians, bureaucrats, legislatures, or business persons behind bars. While the present high profiled tax defaulters including ministers are out of legal proceedings, the former AL secretary Abdul Jalil was issued an arrest warrant in a case filed by NBR for dodging income tax to the tune of $5,910. Clearly, the filing of the case and issuance of the arrest warrant against Jalil is an outcome of his recent derogatory statements about the party and ninth parliamentary elections.
 
No doubt, paying tax is a national obligation and a step ahead to make the country financially secured.  But the policymakers, particularly those among the politicians, bureaucrat and businessmen, have so far responded very little to bring about positive changes in this issue, as many of them are widely perceived to be involved in the process thereof.
 
Setting a good example is not a "put-on." It's simply something that can positively motivate others. In exercise of its positive motivation, the present government should exercise transparency regarding tax paying and make it a legal obligation for everyone to give his/her wealth status to the government.

Errant leaders of the Awami League and relatives of its lawmakers continue flexing their muscles for grabbing public and private property, tender manipulation and extortion in defiance of the party chief Sheikh Hasina's instructions to stop such crimes.(The Newage)

'Deputy commissioners reported from different districts that a section of ruling party leaders and relatives of some party lawmakers were still engaged in crimes, including grabbing of lands, patronising tender manipulation and extortion and destruction of forests,' a senior official at the cabinet division told New Age Wednesday quoting reports sent from the field administration by October 14. 'The MPs and their followers continue seeking undue favours from the government offices.'

When asked whether the situation improved after the prime minister, Sheikh Hasina, had asked the party lawmakers to refrain from patronising offences in their constituencies, the official said, 'There is hardly any difference between the reports sent by field administrations before and after the prime minister issued the warning in the middle of last month.'

At a meeting of the Awami League's parliamentary party on September 17, the prime minister warned party lawmakers that stern action would be taken if they encouraged tender manipulation and extortion and tried to put pressure on civil administration, which, she said was tainting the image of the nine-month-old government.

Awami League lawmaker ABM Abul Kashem Master's son SM Al Mamun on October 7 allegedly grabbed land of four ship-breaking yards along the coast of Sitakunda in Chittagong. Hired goons of Mamun also assaulted journalists, who went there to cover the incident.

When contacted, Abul Kashem told New Age Thursday that the allegation of grabbing shipyard against him and his son was 'false'. 'We have been in shipyard business for quite a long time. My son has bought some land to expand the yard and the sellers had erected fences in preparation for handing over the land,' he said.

Henchmen of former Awami League lawmaker Shamim Osman and his brother Nasim Osman of Jatiya Party were engaged in activities like tender manipulation, extortion and lording over the local administration, according to a source in the Narayanganj district police.

Narayanganj municipality mayor Selina Hayat Ivy, also a local Awami League leader, on Wednesday told reporters that people of the area were afraid of speaking against the henchmen of the two brothers. 'I will continue to be vocal against criminals even if he is my brother,' she told New Age Thursday.

A section of AL lawmakers made themselves controversial by assaulting government officials, interfering in upazila elections, torturing opposition and rival activists and patronising their henchmen who seemed hell-bent on grabbing whatever they could in respective constituencies.

Awami League lawmaker Abdur Rahman Bodi made himself controversial in less than a month of his election for Cox's Bazar-4 (Ukhia-Teknaf) constituency.

Aggrieved by his atrocities in the area, many locals have started calling him another 'Joynal Hazari'.

At an election rally on January 18, Bodi threatened to 'trigger an earthquake' in Teknaf if the chairman and vice-chairman candidates backed by him were not elected in the January 22 election, said witnesses and a few candidates for the posts.

Gias Uddin, assistant presiding officer of Sufia Community School centre at Phoolerdail village, filed a case with Teknaf police station on January 22 accusing Bodi of beating election officials.

Some local Awami League and Jubo League men were allegedly involved in felling 30,000 Jhau (tamarisk) trees on about 250 acres of land in August to sell land in the form of plots for hotel, motel and business firms on the Teknaf beach in Cox's Bazar.

Denying the charges, Bodi said an anti-Awami League quarter had engineered the filing of the case against him in a bid to taint the government's image.

On April 12, a group of AL activists went to the office of the upazila nirbahi officer, Nuruzzaman, at Kumarkhali in Kushtia and assaulted him. They also ransacked the office and allegedly threatened to kill him. The incident took place after the UNO, also the chairman of Kumarkhali Degree College, set a date for appointing a principal for the college without consulting local lawmaker Sultana Tarun.

When contacted, Sultana Tarun said the problem had been settled after the prime minister's instruction. 'Nobody indulged in excesses in Kumarkhali,' she told New Age Thursday.

Cronies of AL lawmaker Golam Moula Roni filed four 'false' cases last month against two local journalists at Galachipa in Patuakhali in a bid to avenge their reports on land grabbing on a riverbank and setting up of a market with Roni's backing.

They vandalised and burnt arches and the stage erected for a public meeting at Galachipa to welcome state minister for water resources, Mahbubur Rahman less than a week after the prime minister had addressed the AL parliamentary party meeting.

Golam Moula Roni, however, claimed that he had not asked anybody to file cases against journalists or vandalise the arches and the stage erected for the minister's visit.

Shamsul Haq Tuku, state minister for home, said the administration had been asked to take action against the persons involved in crimes no matter which party the offenders belonged to.

[ALOCHONA] 42 MPs never paid income tax



 
Forty-two out of 345 lawmakers, including three state ministers, have never paid any income tax, claiming they do not have taxable income.

Sources at the Election Commission and the National Board of Revenue said most of these lawmakers have Tax Identification Numbers (TINs) but they do not pay any tax. A few do not even have their TINs.

The 42 in question are from both the treasury and the opposition benches.

An NBR official said each of these 42 MPs spent Tk 15 to 20 lakh in the parliamentary election and the limit for tax-free income is Tk 1,65,000 per year; so, it is hard to believe that they do not have taxable income.

After scrutinising their wealth statements, the EC sent the list of the 42 lawmakers to the NBR.

An adviser to the last caretaker government and a former high official of the central bank said the NBR should enquire whether they have taxable income and if necessary, action should be taken against them.

NBR sources said they would hold discussion at the highest level of the government in this regard. They will also talk to the parliament speaker and whips on how they could be brought under the tax net.

Another NBR official said many lawmakers pay tax but not as per their real income. The NBR is preparing to file cases against some lawmaker, both from the ruling party and the opposition, the official said.

A high-ranking NBR official, however, told The Daily Star that the subject is very sensitive and action would be taken after discussion with the government.

Former finance adviser to the last caretaker government Mirza Azizul Islam told The Daily Star, "The limit of tax free income is Tk 1,65,000. If anybody's income is below this amount, he naturally would not pay income tax. However, the NBR should enquire whether those people have taxable income."

Replying to a question, Mirza Aziz said it is not believable that the MPs do not have annual income of Tk 1,65,000. However, none can be held responsible based on assumptions. The NBR has the scope to examine this and it should do that.

Former deputy governor of Bangladesh Bank and now Chairman of Krishi Bank Khondker Ibrahim Khaled said it is an abnormal phenomenon that these lawmakers do not show taxable income. The NBR should investigate the matter. They spent at least Tk 20 lakh during the election and are now saying they do not have taxable income; this is unbelievable.

Ibrahim Khaled said if the NBR investigation finds the lawmakers' income taxable, the political parties should decide on their party membership.

The number of taxpayers in the country is only 7 lakh. To increase the number, the NBR has taken a programme to conduct survey down to upazila level.

Ibrahim Khaled said before conducting the survey at upazila level, investigation should be carried out to reveal whether the MPs have taxable income.

Delimiting sea boundary by applying equitable principles

Delimitation of sea boundary is a perennial problem between Bangladesh and her neighbours like India and Myanmar. The abundance of sea resources and growing importance of sea economy has become the apple of discord between these countries. As of now, it seems that Bangladesh has laid too much emphasis on the sea dispute resolution with her neighbours rather than halting it years after years.
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
 
Given the circumstances, in layman's understanding it is said that India wants to settle the boundary dispute by applying 'equidistance method' while Bangladesh is leaning towards 'equitable solution' as she would have to surrender a great area of sea regime, if equidistance method is applied. The demarcation of conventional sea areas i.e., territorial sea, contiguous zone, exclusive economic zone and the continental shelf depends upon the baseline from which the breadth of sea is measured.
 
The depth method of delineating the baseline as adopted by Bangladesh based on its sea peculiarity is not expressly covered by Article 7 (2) of United Nations Law of the Sea Convention 1982 (UNCLOS III). India seemingly has taken the advantage of this gap in law and has insisted on equidistance method of delimitation of maritime boundary. The negotiation talks over the years being unfruitful and India's reservation for some other alternative forum's jurisdiction (like ICJ or ITLOS etc.) has paved the way for Bangladesh to pursue her neighbours to opt for an arbitral tribunal under the LOS Convention. Sometimes, the arbitral tribunal of such nature is coined as 'compulsory' which seems to be a misnomer considering the consensual nature of the procedure and the whole aspiration of international law of the sea. Even to my view, recent Bangladesh's notification to India and Myanmar to resolve maritime disputes by arbitration may be an array of rediscovering the positions of these countries as per the principle of good neighbourliness. However, from a doubted aspiration this write up focuses on some aspects of maritime delimitation with reference to examples from the international case law and sheds light into the Bangladesh-India-Myanmar situation.
 
Any scope for depth-method?
Article 7 (2) of the UNCLOS concedes an exception from a normal baseline (low water mark) where the sea coast is highly unstable because of the presence of delta and other natural conditions. The depth method (from 10 fathom depth of the sea) adopted by Bangladesh conforms to the expression, 'other natural conditions'. The adoption of a straight base-line has also been established in the famous Anglo-Norwegian Fisheries Case, 1951. International law also does not prohibit delimitation of sea area by taking into account the 'local requirements'. Bangladesh's depth method is neither 'normal' nor 'straight' but somewhat an isomer of straight baseline method not prohibited by international law, if not expressly mentioned in Article 7 (2). The geographical and topographical peculiarities of the coast of the bay can be accommodated within the ringing tune of the Article 7 and whole dispute settlement mechanism of UNCLOS III under its Chapter XV. It is to be noted that equity has been a thematic touchstone of the LOS Convention starting from its preamble to other Articles throughout the convention.
 
Equitable considerations in maritime case law
In the North Sea Continental Shelf Cases of 1969, the International Court of Justice held that the equidistance principle, codified in the 1958 Geneva Convention on the Continental Shelf to which Germany was not yet a party, did not represent customary law. The court went on to say that equitable principles, including all relevant circumstances, should be used by the parties in their settlement. Factors to be considered by the parties were: (1) configuration of coasts (e.g. Germany's concave coast) including any special features, (2) physical and geological structure and natural resources of the continental shelf, and (3) reasonable proportionality between extent of continental shelf and length of the parties' coasts (the proportionality principle), considering actual or potential effects of other continental shelf (5) delimitations between adjacent States in the same region. Subsequent to the ICJ's decision fulfilling the parties' request for the applicable principles of international law, Germany, the Netherlands, and Denmark drew an equidistant line then adjusted it taking the aforementioned equitable considerations into account, despite the ICJ's decision to exclude equidistance as an applicable principle of international law for resolution of the dispute. One thing to be observed the parties resort to equidistance method but adjusted it with equitable considerations. This can be an implication for Bangladesh-India-Myanmar. If the proposed arbitration is contested a transitional arrangement may be made by negotiation.
 
In the Anglo-French Continental Shelf Arbitration of 1977, a maritime boundary was established between the United Kingdom and France both of which were parties to the 1958 Geneva Convention on the Continental Shelf. The arbiters first drew a provisional equidistance line (as equidistance was specifically mentioned in the aforementioned applicable treaty), then took into account the equitable considerations of: (1) France's strategic defense interests as UK's Channel Islands were much closer to France than to the UK, (2) population and the political/economic importance of the Channel Islands, and (3) the proportionality principle. The result was an equidistant median line between the mainland of two nations' and a twelve nautical mile enclave around the Channel Islands. In this case, in spite of specific mention of equidistance method, equitable considerations have not been ignored at all.
 
In the 1982 Continental Shelf Case (Tunisia-Libya), the ICJ held that the delimitation was to be effected in accordance with equitable principles, considering the following relevant circumstances: (1) the parties' coastal configurations, (2) islands off the Tunisian coast, (3) the land frontier between the parties, (4) conduct of parties in granting petroleum concessions, and (5) proportionality between length of coasts and extent of continental shelves, although this criteria had little impact on the final delimitation as the parties' coasts were of relatively equal lengths. Evidently, solely equitable doctrine was applied in this case.
 
In the 1984 Gulf of Maine Case, the International Court of Justice delimited the exclusive fishery zone and Continental Shelf between the United States of America and Canada, neither of which was a party to the Convention at the time, by drawing a provisional median line then adjusting it based on the length of the parties' respective coasts along the Gulf of Maine. The ICJ acknowledged that Georges Bank, one of the world's prime fishing areas, was the "real subject of the dispute" and observed that Canada's argument for considering economic need would only be relevant if the delimitation resulted in "serious economic repercussions". Though the case was related with fishing rights, yet one significant ratio of the decision is that the resultant 'serious economic repercussions' can be a factor in resolving sea dispute. Bangladesh's population and future dependence of economy on sea resources certainly qualifies to this aspect.
 
In the 1985 Guinea-Guinea-Bissau Arbitration, the arbiters, in order "to achieve an equitable solution, taking into account relevant circumstances," considered: (1) the need "to ensure that, as far as possible, each State controls the maritime territories opposite its coasts and in their vicinity," and (2) the need to ensure that other actual or future maritime delimitations are given due regard (e.g. Guinea's risk of being enclaved by its neighbors' maritime zones if equidistant lines used, also a truth for Bangladesh). The arbiters unequivocally stated that "[t]he boundary is not to be delimited on the basis of equidistance." The Convention was not in force between the parties at the time of arbitration, yet it entered into force between them only one year later. In our case all the three countries are signatory to the UNCLOS III, a relatively more obligatory situation.
 
In the 1993 Case Concerning Maritime Delimitation in the Area between Greenland and Jan Mayen (Denmark v. Norway), the ICJ drew a provisional median line, then adjusted it given the following equitable considerations: (1) proportionality of relevant coastlines, and (2) equitable division of the capelin fisheries. The consideration of equitable fisheries allocation builds upon the Gulf of Maine precedent concerning equitable division of natural resources.
In the 2002 Case Concerning the Land and Maritime Boundary between Cameroon and Nigeria, (Both states were parties to the Convention), the ICJ held that territorial seas had already been delimited under prior, valid, international agreements between the States and between their colonial predecessors.
 
The court went on to delimit the EEZ and Continental Shelf by applying Articles 74 and 83 of the UNCLOS III, while ensuring that neighboring third parties' rights were not adversely affected. Factors calling for the adjustment or shifting of equidistance line in order to achieve an 'equitable solution', as envisaged by Articles 74 and 83 were found to be present in this instant case.
 
It is apparent from the above case decisions that the practical approach towards delimitation of maritime boundary takes into accounts the factors like, configuration of the coast line, the presence of delta or island, the existence of continental shelf, the existence of fish-stocks, socio-economic and geo-physical impact etc. Given the geographical, geological and geomorphological characteristics of the sea, as Professor Habibur Rahman puts it, Bangladesh-India situation can not be taken to be a normal case. It falls within the ambit of 'special circumstances' to be dealt by considering the factors as discussed above. To reach an equitable solution the concavity-convexity of sea coast, geo-physical traits, socio-economic impact considerations must get preference in interpreting the relevant provisions of international law of the sea.
 
Conclusion
The preamble of the LOS Convention speaks about 'mutual understanding and co-operation' to ensure 'equitable and efficient utilization of sea resources' for the purpose of contributing towards 'justice, peace and progress of human kind' and to create an 'equitable international economic order'. Every state has an obligation to work for it. Even if Bangladesh-India-Myanmar vies with each other in the arbitration, the ultimate decision would have to be effected by the countries themselves. So has been the case with other countries. There is no alternative but to work taking the other friends into confidence.

Bangladesh Rifles authorities have identified the St Martin's Island as the probable main target of Myanmar and asked the government to immediately strengthen its defence by constructing aircraft landing zones and concrete bunkers.In a strategic proposal that came in the wake of constant military build-up and intimidation by Myanmar, the BDR has also urged the government to increase defence capability of land and sea borders to repulse any possible aggression by the neighbouring country.

Marking 148km stretch of border with Myanmar and India as unguarded, the border force has suggested setting up temporary frontier camps until a new battalion is set up in Ali Kadam area as per the BDR restructuring proposal.To safeguard the country's territorial sovereignty, the BDR has sorted out short-, mid- and long-term measures.It has requested the government to arm the paramilitary force with more manpower and modern military equipment.

The St Martin's Island, the only coral island of the country and the main attraction for local and foreign tourists for its panoramic beauty and pristine marine life, is under the jurisdiction of the Coastguards. The island, which is located in a mineral rich region in the Bay of Bengal, is just about 8km west of the northwest coast of Myanmar.

The BDR has submitted its proposal to the Ministry of Home Affairs, the Prime Minister's Office, the navy and air force headquarters and the director general of Coastguards.The proposal says Myanmar military often crosses the zero line at the Bandarban frontier and carry out operations to combat various separatist organisations. Apart from erecting barbed-wire fences and mobilising army unilaterally, the Myanmar authorities are forcing their nationals to enter Bangladesh territory.

The BDR has suggested designating responsibilities and areas of jurisdiction of the Coastguards and BDR and making intelligence activities of various agencies faster and stronger.A senior home ministry official yesterday said the Prime Minister's Office is dealing with the "very sensitive and serious matter".

As short-term plans the BDR has suggested increasing and strengthening overall border patrol to prevent Myanmar nationals or groups from entering Bangladesh territory. It has also recommended identifying the routes of refugees and deploying additional patrol teams.For quick evaluation of the situation and making decisions, the BDR has suggested incorporating army officers in the existing border outposts along the border with Myanmar.

The other suggestions include reinforcement of police personnel in the bordering Ukhiya and Teknaf upazilas and additional police patrol on the Cox's Bazar-Teknaf Highway, and involving locals including lawmakers, elites, upazila chairmen and members to build awareness against push-in of Rohingya refugees."Stern actions should be taken against locals who help refugees come and stay in Bangladesh," says the proposal.

The BDR has suggested erecting barbed-wire fences along the border as a mid-term measure.The proposed long-term measures include signing an agreement with Myanmar on border security like the 1975 agreement with India, accelerating diplomatic efforts to put pressure on the Myanmar government to resolve the Rohingya crisis and construction of ring roads between border outposts and camps.

To tackle the current tension on the border with Myanmar, the BDR authorities have urged the government to allocate necessary budget for immediate implementation of the short-term plans.

Prof Imtiaz Ahmed of international relations department of Dhaka University said Myanmar is an "isolated state that has minimum links with the international community and has been ruled by military for 20 years"."Such a country can do anything anytime and Bangladesh should have all kinds of preparations," he said."Little diplomatic and political attention has been paid to Myanmar so far. After the BDR proposals, it seems that serious attention is now being paid to Myanmar," said Imtiaz.

Fierce fighting has broken out as Pakistan's army launched an air and ground offensive against Taliban militants in the South Waziristan area.

Officials said 30,000 troops, backed by artillery, had moved into the region where Pakistan Taliban leader Hakimullah Mehsud is based.
Militants were reported to be offering stiff resistance as troops advanced from the north, east, and west.
A curfew was imposed in the region before the offensive began.
There have been several co-ordinated Taliban attacks in recent days, killing more than 150 people in cities across Pakistan.

The fighting in South Waziristan is fierce and it is intense. Local administration officials say the Taliban are resisting fiercely as troops try to push into their territory.
Dozens of casualties have taken place, they say, and both sides are using heavy weapons.
Meanwhile locals from South Waziristan are facing great difficulty in leaving the area. All roads have been blocked by the military which is using them to transport ammunition and arms into the heart of the battle.
The transport and communication network has been effectively crippled. The casualties are now expected to rise as the terrain gets difficult for ground troops to operate in against the battle-hardened Taliban.
Pakistan's top army spokesman Maj Gen Athar Abbas confirmed that a fully-fledged assault had begun and said that an offensive could last up to two months.
"The objective is to clear this terrorist organisation from the area, who has taken over the area, turned these state institutions, organisations out and has taken the entire population hostage," he told the BBC.
He added that intense fighting was expected during the course of the operation.
Dozens of casualties have already been reported by local officials as both sides used heavy weapons.
The bodies of three Pakistan soldiers were taken to the northern town of Razmak. There have also been unconfirmed reports of militant deaths.
Nearly all communications in the region were down after the Taliban destroyed a telecommunications tower at Tiarza, local officials said.

Reports from the area are sketchy as it is difficult and dangerous for foreign or Pakistani journalists to operate inside South Waziristan.
Aerial bombardments in the the Makeen area, a stronghold of the Mehsud tribe and a key army target, were also reported by local officials and witnesses.
One resident of Makeen town described the onset of fighting.
"We heard the sounds of planes and helicopters early Saturday. Then we heard blasts. We are also hearing gunshots and it seems the army is exchanging fire with Taliban," Ajmal Khan told the Associated Press news agency by telephone.

The ground operation comes after weeks of air and artillery strikes against militant targets in the region, which lies close to the Afghan border.
Thousands of civilians have fled South Waziristan in anticipation of the offensive.
Aid agencies say that many more are expected to flee but the tough terrain and the Taliban's grip on the area will present difficulties.
Transport has been difficult as roads have been blocked by the military.

There is a huge army presence on the road between Tank and Dera Ismail Khan, says the BBC's Islamabad correspondent Shoaib Hasan, near South Waziristan.
On his way to South Waziristan, he passed several army convoys on the road.
The mobilisation came a day after Pakistan Prime Minister Yusuf Raza Gilani held a meeting of the country's senior political and military leadership.
