As mainland India observed the 59th Republic Day  with fanfare, the trouble torn Northeast celebrated the day with utmost conviction. 
 
SAN-Feature Service : As mainland India observed the 59th Republic Day  with fanfare, the trouble torn Northeast celebrated the day with utmost conviction.  The region has been witnessing a regular ban on the celebration of both the  Independence Day and Republic Day of India by the outlawed secessionist militant outfits for decades. But amazingly, the public support and participation increased in the last few years, where the citizens have made it a habit to defy the diktat of the insurgents and celebrate the days with great fervour.
 
The Republic Day, this year, too witnessed the participation of citizens, students and journalists, who had joined both the government and public celebrations on January 26. The local people, in considerable numbers, thronged the official R Day functions in the capital cities of the region. The celebration was peaceful at large in the region, where the banned outfits called for boycotting the day. The underground groups also called for 17 hours' general strike to prevent the celebration, but it had little impact in the region except in Manipur, where the R Day was observed under tight security.
 
While the President of India, Pratibha Devi Singh Patil unfurled the national flag and took salute of the armed forces at the Rajpath in New Delhi, thousands arrived at the venue with fanfare. The television channels beamed visuals of the celebration, where the French President, Nicolas Sarkozy was present as the chief guest of this year's Republic Day. The Prime Minister Manmohan Singh, Vice President Hamid Ansari, along with many other dignitaries attended the programme, where the defence forces showcased their striking arsenal during the R Day parade.
 
Incredible spirit and strength were shown by the residents of the Northeast, the land that nurtures nearly 30 militant outfits, who are fighting New Delhi for demands ranging from self-rule to sovereignty. Defying the diktat of militants, the people had come forward to participate in the Republic Day programmes. From Itanagar to Aizwal and Gangtok to Shillong and Kohima, the indigenous population added tremendous enthusiasm to the R Day celebration. For Imphal, Agartalla and Guwahati, the observations were held under the shadow of militants' threat.
 
The citizens of Guwahati, the prime city in the Northeast, not only joined the government programme but a group of senior citizens and journalists also assembled in Guwahati Press Club to observe the Republic Day. After hoisting the national flag at the press club premises, the participants in the programme took out a procession that paraded the main streets of the city chanting patriotic slogans like Vande Mataram (the national song), Bharat Mata Ki Jai (Long live Mother India) and Jai Ai Asom.
 
Hoisting the Tricolour, veteran journalist DN Chakrabarty called upon the people to remember the 5,000 martyrs and their sacrifices in the 1757 battle of Plassey, the 10,000 martyrs of 1857 Sepoy mutiny and the martyrs of the 1942-46 movement against British colonialism.
 
"We should also remember the 150 martyrs, who had to go to the gallows for the sake of India's Independence. Of them, seven including Piyali Phukan, Piyali Barua, Maniram Dewan and Kushal Konwar belonged to Assam," added Chakrabarty. He also criticised the militants for taking the path of violence. Chakrabarty claimed that independent Assam was an absurd idea.
 
This year, the insurgent groups of Northeast namely the United Liberation Front of Asom (ULFA), Kamtapur Liberation Organisation (KLO), Manipur People's Liberation Front (MPLF) and Tripura People's Democratic Front (TPDF) issued a joint call to boycott Republic Day. In a statement signed by the ULFA chief, Arabinda Rajkhowa, the banned armed groups also called for a general strike beginning from the midnight of January 25 till 6 pm next day and made plea to the revolutionary people of the region to prevent celebration of the day.
 
"The imposed Indian Constitution has undermined the basic unity of the region by fragmenting it on ethnic lines as part of India's colonial policy of divide and rule," the statement claimed. "We have reiterated time and again that the destiny of the region lies only in interdependent unity and coexistence with sovereign independence among the fraternal people of the region," it added.
 
But the boycott call was hit back by a group of writers and working journalists, who had appealed to the people of the region to defy the diktat and hoist the national flag atop their houses and in their localities on the occasion of the 59th Republic Day. "The Republic Day of the country should be celebrated by the citizens in recognition to the sacrifices made by the martyrs, who accepted martyrdom to wrest liberty for their compatriots. Many of their colleagues also underwent tremendous hardships to free the country from the colonial yoke," quoted a press statement issued by the groups of writer-journalists.
 
The statement, which was signed by Nirupama Bargohain, DN Chakrabarty, Rupam Baruah, Hiten Mahanta, Ajit Patowary, Ranen Kumar Goswmai, Bhupen Bargohain, Nava Thakuria, Pramod Kalita, Sabita Lahkar, Mukul Kalita, Manish Goswami, Kumud Das and Girin Karji, also added, "The people of the region should remember those martyrs and freedom fighters on occasions like Independence Day and the Republic Day by hoisting the Tricolour in a befitting manner."
 
Kumarpara and Athgaon, localities of Guwahati also witnessed the hoisting of national flag, distinguished personalities like the former Guwahati High Court judge Jitendranath Sharma, eminent educationist KM Pathak attended the programme.
 
Similarly, in Dhemaji of eastern Assam, where the ULFA engineered explosions during the 2004 Independence Day celebration that had killed 13 people including ten children, the Republic Day observation was a major show. Leaving aside all fears, the general people including the school students had joined the celebration, where they paid floral tributes to those killed in the 2004 I Day blast and later the children performed various cultural programmes.—SAN-Feature Service

I started wondering how this business makes money without a care even in New York while a customer was claiming at the cash counter that he didn't suppose to pay dinner price as he started his diner before 6 p.m. when the restaurant authority usually changed their dinner menu with high price. The customer was right as because when he started his dining there was different menu with low price. Such changes shouldn't be imposed or applied to those who come before by any means.
 
Such allegations shouldn't be applied against anyone for any pre-emergency incidents by any means. No doubt that the landmark judgment of the day against the former Prime Minister and chairman of the Awami Leauge Sheikh Hasina on Wednesday, February 6, 2007 by the High Court (HC) of Bangladesh was purely according to the Constitution of Bangladesh and the Constitution doesn't allow cases to be tried the Emergency Power Rules (EPR) for such incidents that have taken place after the imposition of the state of emergency.
 
An HC division bench comprising Justice Shah Abu Nayeem Mominur Rahman and Justice Shahidul Islam quashed the extortion case against Sheikh Hasina, who is detained in a special sub jail since July 16, 2007. Hasina was shown arrested in the extortion case filed by Azam J Chowdhury, managing director of private Eastcoast Trading Limited, on June 13, 2007. The plaintiff accused Hasina and her cousin former minister Sheikh Fazlul Karim Selim of extorting taka about Taka 3 crore ($428571) during her Awami League rule between 1996 and 2001. Earlier on January 24, 2008, Azam said in a press briefing that he had not filed any case against Sheikh Hasina.
 
The HC court in its observations said trial of an offence committed before the promulgation of the Emergency Power Ordinance 2007 cannot be held under the ambit of the EPR and the Constitution and existing laws do not permit holding trial of an offence under a law taking retrospective effect. According to the provisions in articles 31-35 of the constitution, none of the rights of a citizen, including the right for bail, can be curtailed by promulgating any act during the state of emergency. The EPR revokes the provision of seeking bail is ''ultra vires'' of the Constitution.
 
Regarding the government sanction for inclusion of an offence for trial under the EPR, the court observed that an offence cannot be considered having public importance based on the offender's personal standing and social status rather considering the gravity of the offence. Although the state of emergency has suspended enforcement of certain fundamental rights under the Constitution, but the selfsame rights guaranteed under the Constitution are not suspended and the people have the right to invoke justice in the court of law.
 
Hasina, along with her arch political rival Khaleda Zia, the chairperson of Bangladesh Nationalist Party and subsequently Prime Minister, led the anti-autocratic movement in the 1980s, which helped in the restoration of democracy in the early 1990s.
 
Meanwhile, according to her counsel, Khaleda Zia was detained in solitary sub-jail for the last four months and was never brought in person to the court. The counsel filed a petition to produce her in the court and argued that long detention without trial is a violation of the law and she may be inflicted by serious mental and physical disease because of solitary detention.
 
In an immediate reaction with BBC about the verdict, Additional Attorney General Salahuddin Ahmed told that such judgement was not expected to them while HC quashed the entire trial proceedings against Hasina whereas she did not seek the quashing of the case. However, the government filed a petition with Chamber Court of the Appellate Division of the Supreme Court seeking stay on the High Court rulings not only for the HC verdict in favor of Sheikh Hasina but also a considerable number of cases brought under the EPR have been stayed by HC.
 
Continuing journey against corruption, uprooting Islamic militancy from the country, bringing chain-in-command and deleting partisan in the administration are all of positive signs of a good government. Bangladesh welcomed the crackdown against more than 160 high profiled corrupted politicians, bureaucrats and criminals being detained and expelled in the anti-graft drive by the present military backed interim government.
 
According to the emergency law, the executive authority has wide authorities related to restricting the freedoms of individuals and their constitutional rights, like restricting the right of individuals to peaceful assembly, transportation, residence, arresting suspects according to the likes and dislikes of the security forces, detention and inspecting persons and places without reference from the law or the Penal Code rules.
 
Such government is the result of necessity, of the sheer imperative of survival. The greatest wrong with such a form of government, and its related institutions and laws, is that it can remain with wrong direction not to follow the country's ordinary law and order. But because of the past bitter experience, people want this non-political government to punish every corrupted people in Bangladesh so that, they cannot take control of the government again. They do not want the repetition of previous corrupt practices.
 
Legal experts observed the HC judgment could prove to be a severe blow to other corruption cases being placed under the EPR for trial rather using ordinary laws of the land. The government's law enforcement agencies or legal advisers should be able to comprehend so that the cases against real corrupted people can't be untenable.

The cat is finally out of the bag. In numerous bomb blasts that have taken
place in the country, the investigating agencies as well as the media swoop
on certain Muslim organisations and brand them as terrorists, who
perpetrated the ghastly crime.

Irrespective of whether the crime has taken place in a Masjid or Mandir or
Market, the same stereotype stories are flashed everywhere. However the
Tamilnadu Police have turned the tables and their investigations have turned
the tide towards the real perpetrators of such crimes. It has arrested 3
Sangh Parivar activists for triggering blasts in the RSS office at Tenkasi
in Tamilnadu.

Tenkasi is a busy town in Tirunelveli District of Tamilnadu. Since its location is close to the famous Courtallam waterfalls it attracts a large number of tourists. Hindus belonging to various castes as well as Muslims and Christians have been living in harmony in this town from time immemorial. Tenkasi means Kasi of South. This town has a famous temple called
Kasi Viswanathar Temple. Though the local Sangh Parivar outfit called Hindu Munnani has been long objecting to the renovation of the Bazaar Masjid situated very near to the temple, perfect communal harmony has prevailed in this town. Muslims living in this town are basically involved in various kinds of trade.
The Sangh parivar elements have been trying to communally polarise this town for a long period of time. However their attempts in the past have become futile. But the killing of Kumara Pandian, an activist of Hindu Munnani in December 2006 disturbed the peaceful atmosphere in Tenkasi. Kumara Pandian was murdered by group of Muslim gangsters out of personal animosity. However the Sangh Parivar elements targeted leading Muslim businessmen as well as Tamilnadu Muslim Munnetra Kazhagam (TMMK) and alleged they were behind the murder. On
March 2, 2007, Mohideen Sait Khan the then District President of TMMK and resident of Tenkasi was brutally attacked by Hindu Munnani activists. He suffered grievous injuries in several parts of his body. However he survived the attack. The police arrested a handful of Hindu Munnani activists in this case.

Tenkasi blast accused
Tenkasi was now boiling with communal fervour. On 14th August (just a day before the Independence Day Celebrations) 6 persons (3 Hindus and 3 Muslims) were hacked to death in a fight between two groups. These two groups comprised persons who were charged for the Murder of Kumara Pandian and assault on Mohideen Sait Khan and were out on bail. Police clamped down on both sides and arrested a number of persons from both communities.
In the aftermath of these incidents, when Tenkasi was limping back to normalcy just two days before the Republic day, on 24th February, there were bomb blasts in the RSS office in Tenkasi and in the Bus Stand around 9 pm. The media carried big stories about the blasts. The Sangh Parivar organised demonstrations in various parts of the state, demanding the arrest of Muslim 'terrorist', who according to them have committed the crime. However the Tamilnadu Police did not budge like their counterparts in other states. A special team led by Mr. Kannappan, DIG, Tirunelveli range made a thorough investigation and have arrested so far 3 persons S Ravi Pandian (42), a cable TV operator, S Kumar (28), an auto driver, both from Tenkasi, and V Narayana Sharma (26) of Sencottai, all Sangh Parivar activists. The last name accused had assembled 14 pipe bombs in the office of Ravi Pandian.
Explosive experts were deployed to probe the blasts at the RSS office and the bus-stand. Earlier it was thought that unidentified persons had hurled crude bombs at these places. But now it has been found that low-intensity 'pipe' bombs had been placed in these areas, a police official told PTI. The power to the area was disconnected before the incident.
According to Sanjeev Kumar, IG, South Zone, the bomb blast inside the new bus stand was planned to divert the police investigation. DIG of Police Kannappan said the trio tested the capacity of the bombs at Papanasam before executing the plan. Since the bombs contained substances like ammonium nitrate, electric detonators, batteries and timer devices, the explosion was possible within 30 to 40 seconds, said Kannappan.
The Investigation is still going on. The Police said 14 pipe bombs were assembled and the operations began from July last year. The arrested persons have confessed that the trio executed the plan to create a divide between the rival communities and thereby pave way for a backlash and generate sympathy for the family of the four deceased. They have also confessed that in the past they could not generate support from the Hindu community in Tenkasi and thought this blast would give the right impact.
With the Lok Sabha elections approaching, it is reliably learnt that Sangh Parivar outfits want to repeat
Coimbatore in Tenkasi to get sympathy votes. The BJP which contested the last Assembly elections alone drew a blank. It is desperate to mobilise the Hindu votes and enacted the pranks in Tenkasi. Kudos to Tamilnadu Police who have exposed their nefarious intentions.
The Tirunelveli Police have also indicated that the explosives used in Tenkasi are similar those used in the Makkah Masjid blast at
Hyderabad. They have also indicated that these blasts would not have been triggered without the knowledge of the top brass of Sangh Parivar outfits in Tamilnadu.
In the light of the revelations of the Tamilnadu Police, the CBI should reinvestigate the Makkah Masjid Blasts and other Blasts which took place in different parts of the country. In all these blasts, there is a general feeling that mechanically the investigating agencies have blamed certain outfits and booked innocent persons instead of the real accused. Will the CBI and Home Ministry wake up?

In Bangladesh everything is topsy-turvy today. Even the rule of law and its
enforcement varies. All the three crumbling pillars of the State – the
Legislature, the Executive and the Judiciary – seem to be more concerned about the
petty politics of law rather than the loftier shrine of the jurisprudence of
law.
A great lawyer-statesman and philosopher of a former age – I mean Francis
Bacon – said that truth came out of error much more rapidly than it came out of
confusion. There is a wonderful truth in that saying. Next to being right in
this world, the best of all things is to be clearly and definitely wrong
because you will come out somewhere. If you go buzzing about between right and
wrong, vibrating and fluctuating, you come out nowhere; but if you are
absolutely and thoroughly and persistently wrong, you must some of these days, have
the extreme good fortune of knocking your head against a FACT, and that sets
you all straight again.
Truly to a clear eye the smallest fact is a window through which the
infinite may be seen. Louis D Brandis, one of the father figures in the evolution of
American law, observed : 'State the facts and let the characterizations
suggest themselves'. He said this as a great judge of America. Thomas Jefferson,
a founder-statesman of the American Republican State, spoke these words as a
top politician of America : 'A patient pursuit of facts, and cautious
combination and comparison of them, is the drudgery to which man is subjected by his
Maker, if he wishes to attain sure knowledge'.
While all this is absolutely true for all time and place, yet it should be
borne in mind that the main part of intellectual education is not the sterile
and mechanical appreciation of facts but learning how to make facts live.
Those who won our independence under the inspiring leadership of Bangabondhu
Sheikh Mujibur Rahman by non-violent and afterwards frontline war revolution
were not cowards. They did not fear political change. They did not exalt
order at the cost of liberty – general or individual. To courageous,
self-reliant men, with confidence in the power of free and fearless reasoning applied
through the processes of popular government, no danger flowing from speech can
be deemed clear and present, unless the incidence of the evil apprehended is
so imminent that it may befall before there is opportunity for full
discussion. If there be time to expose through discussions the falsehood and
fallacies, to avert the evil by the processes of education, the remedy to be applied
is more speech, not State-coerced silence. Only an emergency can justify
repression. Such must be the rule if authority is to be reconciled with freedom.
Such, in my opinion, is the command of the Bangladesh constitution.
These thoughts came to my mind in the context of the blatantly uneven-handed
nature of attitude displayed by the present Caretaker administration towards
the politicians like Hasina.
The due Constitutional exercise of freedom of speech in Bangladesh today is
getting punished through the State denial of freedom after speech .The
question of questions is : 'Do we have a handful of such sturdy, well meaning
common men with an optimum combination of common sense, courage, judgement, vision
and integrity in our midst today?'

Martin Luther King Jr., and Ronald Reagan in one life time, and also can
boast ridiculously that his first ten years of life in Indonesia makes him
an expert on foreign affairs. Hidden political lobbies has made a hero out
of Senator Obama.

This is evident from the support of John Kerry and Ted Kennedy and other
celebrities before super Tuesday. Ted Kennedy could have done better by
following the alternative way of repaying his debt to the Clintons for their
support of him in senatorial election against Mitt Romney.

Ransack house of principal, set fire to house of a teacher; college closed indefinitely

Rangpur Carmichael College was closed indefinitely yesterday as Islami Chhatra Shibir activists rampaged through the campus, torched the house of a teacher and a power substation, ransacked the college principal's house and vandalised several motor vehicles.

The Shibir workers roamed around the campus for nearly five hours since 10:00 in the morning and set fire to the house of Dr Hafizur Rahman, a professor of Mathematics and secretary of academic council of the college. They also ransacked the house of Dip Chandra Roy, the principal of the college, and vandalised his car.

The mob vandalised at least ten automobiles and set a power substation on fire. They also ransacked the academic building, damaged the furniture in it and destroyed official records of the college.

At around 3:00 pm in an emergency meeting presided over by Principal Dip Chandra Roy, the academic council of the college decided to suspend all classes of the college sine die and vacate all dormitories.

At the meeting, a number of teachers complained that a few teachers of the college have been aiding and abetting Shibir violence on the campus, said sources.

Principal Roy told The Daily Star, "Such violence on the campus is unprecedented and incidents of this sort did not take place here even during the Liberation War."

Male residents of the dormitories have been asked to leave the campus by 6:00pm yesterday while females by 8:00pm the same day, he added.

According to eyewitnesses, several hundred rioting Shibir activists led by Emdad, Abdullah Al Mamun, Rezaul Karim Rana and Mohammad Tareque brought out a procession on the campus, demanding that Rangpur Carmichael College be upgraded to university.

Police intercepted the procession at Lalbagh as it came out of the campus and headed towards the office of the deputy commissioner. The activists at this point locked in a clash with the police, injuring six police personnel including Additional Superintendent of Police Asaduzzaman and SI Saidul Islam, and four pedestrians.

Police lobbed ten rounds of tear shells near Modern point to disperse the agitators.

The police later raided the dormitories of the college and arrested at least 60 students -- most of whom were activists of Islami Chhatra Shibir.

Five cases were filed against the agitators under Emergency Power Rules.

Expressing his resentment over the violence on the campus, Dr Rezaul Hoque, former principal of Rangpur Carmichael College, said, "The people of Rangpur want an autonomous and full-fledged university. They don't want Carmichael College to be upgraded to university."
 
 
Islami Chhatra Shibir (ICS)
Base of Operation: Bangladesh
Founding Philosophy: Islami Chhatra Shibir (ICS) is the student wing of Jamaat-e-Islami, the largest Islamic political party in Bangladesh. Although ICS is legal, and a member of legitimate organizations such as the International Islamic Federation of Student Organisations (IIFSO), Islami Chhatra Shibir is extremely militant and has been linked to numerous acts of violence over the years. In addition, the group has also been linked to a number of larger terrorist organizations both in Bangladesh, and internationally.
Islami Chhatra Shibir was founded in 1941, along with the establishment of its parent group, the Jamaat-e-Islami. Today, the group has grown to be one of the largest Islamic student organizations in the world. Like the Jamaat-e-Islami, the ICS is an Islamic fundamentalist organization that seeks to establish an Islamic state in Bangladesh. The ICS has its main base of power in the universities of Bangladesh, most notably at Chittagong and Rajshahi. Furthermore, the group has a great deal of influence in the large madrassa (religious school) system throughout Bangladesh.
Despite claims of legitimacy from the group, the ICS is undoubtedly a militant organization. The violence perpetrated by the ICS can generally be put into two categories. The first category involves inter-fighting between ICS and other student organizations on university campuses. The ICS's main rival on campuses is the Bangladesh Chhatra League (BCL), student wing of the Awami League, a political opponent of Jamaat-e-Islami. Clashes between the BCL and ICS have caused numerous deaths over the year, most notably in July 2000 when suspected ICS members killed 6 BCL activists in a shooting attack in Chittagong. The second category of violence includes general terrorism beyond the borders of educational institutions. The ICS has been blamed for numerous terrorist attacks throughout Bangladesh, including the bombing of an Awami League rally in July 2001 that killed over 20 people. Although an ICS activist was arrested in connection with the incident, the man was later released, and ICS was never directly implicated.
ICS has also been linked to several larger terrorist organizations. Many officials and news sources allege that the group is nothing more than a recruiting ground for Bangladeshi terrorist groups such as Harakat ul-Jihad-i-Islami and Jamatul Mujahedin, while others simply view ICS as a front for Jamaat-e-Islami terrorist operations. The ICS has also been linked to international groups such as the Taliban and al-Qaeda, but concrete linkages have never been proven, and these accusations usually come from Awami League politicians. In any case, Islamic militancy in Bangladesh has exploded over the past few years, and it does not seem far-fetched that ICS might have, or soon have, affiliations with these groups.
Current Goals: ICS is an active student-militant organization with a large, but unknown amount of members. The group is currently dedicated to the establishment of an Islamic system of education in Bangladesh, and the foundation of an Islamic state in greater Bangladesh. Although the group enjoys legitimacy and support from many Bangladeshis, the ICS has shown no hesitation to use violence to further its aims.

jailed cartoonist on February 25th 2008 based on blue print mastered by corrupt

The entire nation knows young cartoonist Arifur Rahman draw a simple cartoon

He wanted to express his view that how out substandard religious trader�s uses
great religion Islam as pretext to ill influence creating a realm of religion to
control.

We have seen these religious bigots attacked religious minority in our country
anytime they can. Calling anyone Kafir even to Muslims and placing a head price
is a common observable fact in so-called religious bigots meetings that take
place in the north gate of Baitul Mukarrom mosque. This the place where its
started from a stick holding stone throwing KAT Mullah�s meeting where they
called cartoonist Arif a murtad an enemy of Islam and wanted him to be hanged.
So-called Barrister fallen Moinul Hosein one of the most corrupt Adviser the
Bangladesh ever saw fanned the situation with the help of his political wing
Jamaat-e-Islami leader then head imam of Baitul Mukarrom.

Caved in state law enforcement agencies arrested daily Prothom Alo cartoonist
Arifur Rahman accusing his cartoon "hurting religious sentiments".

Evidently, mullahs in the poorest of the poorest country have more frightening
influence over uneducated religious population and government then birthplace of
Islam Mecca of Saudi Arab.

What an outrageous malicious steering of such a simple mater by mullahs and
more contemptible action by Bangladesh government. What was there in the cartoon
in Aalpin a Prothom Alo production? Gian Papi Barrister Moinul called it
inflammatory and act of conspiratory plot to destabilize the calmness of the
country and put country on fire! Really? Is there was something of that height
of damaging nature in this cartoon? Let us examine one more time what was there
in this text-based cartoon titled Naam (name) based on conversation between an
elderly and a kid on its September of 2007 issue.

Elder person: Boy, what is your name?
Kid: My name is Babu.
Elder person: It is customary to mention Mohammed before the name.

Elder person: What is your father's name?
Kid: Mohammed Abu

Elder person: What is this in your lap?
Kid: Mohammed cat

To me it is a mere satire of our naming culture, which follows not religion in
its essence but a false perception of religion. I see no sign of disgracing
Prophet Muhammad (P.B.U.H) or Islam through this cartoon called NAAM (name).

Islam and its prophets teachings have been violated many folds more in the
hands of these mullahs in Bangladesh and elsewhere who is protesting this
cartoon. You do not have to go far but read any daily news from Bangladesh and
you will get how the sermon of these mullahs in the name of Fatwa destroyed so
many innocent families. It is not cartoon or books, which brings bad name for
Islam and its Prophet but the illiterate mullahs who defame our religion.

It is sometime ago, November of 1998 Kishor Kontho a monthly magazine of
Islami Chatra Shibir printed a very similar joke. No one of these Islamic sole
agents at that time or now demanded that author of that joke or the editor of
the magazine should be brought to justice and magazine license should be
revoked. Readers of that joke took it as mere fun with the spirit of the section
titled �Hashir Baksho�.

Islam and its prophet Muhammad (p.b.u.h.) are not so fragile that a mere
cartoon or few lines of text can damage its serenity. I rather see it was
Barrister Moinul, powerful adviser of the government who played the role of The
Pied Piper of Hamelin tuning his pipe to bring the worst out of ordinary. Moinul
and probably the entire government wanted to divert the nation eyes on some less
important matter to accomplish their hidden big agenda of the time.

Addressing Islami Oikya Jote (IOJ) Chairman Mufti Fazlul Haq Amini, IOJ Vice
President Maulana Muhammad Mahiuddin, and Secretary General Mufti Faizullah Bar
Moinul Hosein said, "There is a conspiracy to create a dangerous and unwanted
situation," Mainul said, adding, "Everyone has to remain united against the
conspiracy to destabilize the country."

Despicable Bar Moinul the Bottolar ukil, this dishonest man with hidden agenda
since his assumption of power as adviser until his rock bottom fall is made every effort to divide the nation. Getting the mighty backing of the owner of tanks and gun is making him thinking invincible, not understanding his days will be over soon.

I like to take this opportunity to condemn Prothom Alo editor and publisher
for not standing beside Arifur Rahman the young cartoonist and providing him
with a lawyer to defend him. I ask all journalists of Prothom Alo and others to
raise their voice against all injustice and attempt to divert a simple matter
into a conspiratorial one.

I demand government free Mr. Arifur Rahman immediately and take proactive role
rather then fanning the issue.

Fates of around 150 graft cases filed under emergency power rules (EPR) against many biggies of politics and business, in connection with corruption committed before the declaration of the state of emergency, may become uncertain yesterday following a High Court (HC) verdict.

The HC yesterday declared illegal the trial under EPR of an extortion case filed against Sheikh Hasina, following a writ petition filed by her challenging the trial's legality.

The watershed verdict also affects all other cases that either had already been tried or are currently being tried or awaiting trials under EPR in connection with crimes committed before the declaration of the state of emergency.

Verdicts in around 50 of such cases were already delivered by different trial courts, sentencing some former ministers, lawmakers, bureaucrats and businessmen to different terms of imprisonments, another 50 cases are currently being tried, while over 40 others are currently being investigated, following which those were also supposed to go on trial.

Since the army backed caretaker government had launched a crackdown on corruption suspects, the Anti-corruption Commission (ACC), the National Board of Revenue (NBR), and individuals filed the cases against top politicians, businessmen, and former bureaucrats accusing them of graft.

The accusations include amassing of wealth through illegal means, extortion, tax dodging, and concealing of information in wealth statements submitted to the ACC.

Following yesterday's HC verdict, all such cases have become illegal, said eminent jurists.

Before the verdict, Law Adviser Hassan Ariff who is also a former attorney general, said the judgment on the writ petition filed by Hasina in connection with the extortion case against her would determine the fate of other such cases under EPR.

The verdict throws into uncertainty the caretaker government's plan for making it impossible for 'corrupt' political bigwigs, detained or convicted under EPR, to contest in parliamentary and local government elections.

According to a provision of EPR, any person, convicted of corruption by a trial court, will be disqualified from contesting in any election until adjudication of the person's appeal against the verdict.

But, if detained and fugitive political leaders are tried under general laws instead of EPR, then even convicted persons will be able to contest in polls until the Supreme Court (SC) upholds the convictions by the trial courts, which is usually a very lengthy process.

For instance, Jatiya Party Chairman HM Ershad contested in the parliamentary election of 1996 filing an appeal against his conviction by a trial court during a BNP regime between 1991 and 1996.

Moreover, once trials begin under general laws, detained politicians will have to be allowed to seek bail, a defendants' right denied by EPR.

Yesterday's HC verdict created a setback for the ongoing prosecutions under EPR of the offences committed before the advent of EPR under Emergency Power Ordinance (EPO), both of which were promulgated in January of last year.

If the Appellate Division of SC upholds yesterday's HC verdict then trials of the cases will have to begin afresh under general laws, legal experts said.

Talking to The Daily Star yesterday Justice Ghulam Rabbani, a former judge of the Appellate Division of SC, said trials of the pending cases under EPR will have to be started afresh including fresh indictments under general laws.

Asked what will be the fate of the cases in which verdicts were already delivered, Rabbani said it is difficult to say now what will happen to those. "The matter will be resolved through the appeal process," Rabbani said.

Another eminent jurist, Shahdeen Malik said the interpretation of law is that crimes committed before the emergency cannot be tried under EPR.

"And it follows that others who had been tried and convicted under EPR for offences committed before the emergency shall also get the benefit of the judgment. Their convictions under EPR are also likely to be thrown out," Malik observed.

Many senior government officials including officials in the attorney general's (AG) office said the verdict is sure to give rise to a big crisis ahead of the parliamentary election, which will inevitably prompt the government to appeal the verdict at the Appellate Division.

The verdict came at a time when the caretaker government is under tremendous pressure to lift the state of emergency allowing resumption of political activities for creating an atmosphere for holding the stalled 9th parliamentary election before the year ends.

In a bid to free the body politic from the vice-grip of corrupt politicos, the army backed caretaker government launched the biggest ever crackdown in the country's history on 'corrupt politicians' on February 4 of last year, detaining a large number of big names in politics including two former prime ministers Khaleda Zia and Sheikh Hasina.

The trial of an extortion case against detained former prime minister also AL chief Sheikh Hasina was being held under EPR while a graft case filed against another detained former premier also BNP chief Khaleda Zia was also brought under the ambit of emergency rules.

Many former ministers and lawmakers were also facing trials on charges of corruption under EPR.

If they are now tried under general laws instead of EPR, they will be allowed to seek bail and will have the scope for contesting in the next parliamentary election, even if they are convicted, until the SC upholds the convictions by trial courts, the process of which is usually very lengthy.

"There will be no point in holding the election if the corrupt politicians make a comeback in the polls. We did not join our posts to hold a business as usual parliamentary election. Matters concerning arrested corruptionists needs to be resolved," Chief Election Commissioner ATM Shamsul Huda said on April 5 defending the Election Commission's (EC) 18-month timeframe for holding the stalled parliamentary polls.

CONVICTED, DETAINED HEAVIES

Former ministers of the immediate past BNP-led alliance government Nazmul Huda, Shajahan Siraj, state ministers Amanullah Aman, Ruhul Quddus Talukder Dulu, Mir Mohammad Nasiruddin, Ziaul Haque Zia, Salahuddin Ahmed, Iqbal Hasan Mahmud Tuku, former BNP lawmakers Naser Rahman, Nadeem Mostafa, Mizanur Rahman Minu, Rashiduzzaman Millat, Motiur Rahman Talukder, Nurul Islam Moni, another Salauddin Ahmed, Ali Asgar Lobi, Manjurul Ahsan Munshi, Shahidul Islam, Helaluzzaman Talukder Lalu, and former political secretary to prime minister Harris Chowdhury have already been convicted among others.

Former ministers and senior BNP leaders Khandaker Mosharaf Hossain, Moudud Ahmed, Morshed Khan, Tariqul Islam, Altaf Hossain Chowhdury, Miraza Abbas, former parliamentary affairs adviser to prime minister Salauddin Quader Chowdhury, former state ministers Lutfozzaman Babar, former lawmakers MA Hashem, Mosaddak Ali Falu, Hafiz Ibrahim, Joynal Abedin Faruk, Fazlul Haque Milon, Majibur Rahman Sarwar, Nasiruddin Ahmed Pintu, BNP Senior Joint Secretary General Tarique Rahman, and his brother Arafat Rahman among others have been detained on charges of graft, and cases have been filed against them under EPR.

Former ministers of previous AL government Mohammad Nasim, Mohiuddin Khan Alamgir, former AL lawmakers Rafiqul Anwar, Shamim Osman, Joynal Hazari, and AL leaders Pankaj Debnath among others have already been convicted on charges of graft.

AL senior leaders Abdul Jalil, Fazlul Karim Selim, Obaidul Quader, Engineer Mosharraf Hossain, Habibur Rahman Mollah, Kamal Ahmed Majumder, ABM Mohiuddin Chowdhury, Badruddin Ahmed Kamran, Salman F Rahman, and ANH Mostafa Kamal have been detained on charges of graft, while some other AL leaders are on the lam as they have also been indicted for corruption.
