Home Minister Sahara Khatun disclosed an updated list of 42 top terrorists, prepared by the elite force Raid Action Batalion (RAB), Home Ministry sources said the New Nation yesterday. The sources said, Sahara Khatun disclosed an updated list of 42 top terrorists without the names of Shahadat and Dacoit Shahid, Jeshin, Ashik, Nabi, Mosharraf, Chanchal and Shahin. In this top terror list there were names of some 'local thieves,' sources added.

Sources said Shahadat, Dacoit Shahid and Joy reportedly hiding in India but are regularly collecting money from the businessmen through young terrorists. One of the foreign intelligence agencies allegedly helped them flee the country, source added.

Interpol issued red alert against 92 top terrorists in the country. Of them 20 top terrorists were controlling the underworld from home and abroad, but were reportedly absent in the updated list

Home Secretary Abdus Sobhan Sikder told newsmen yesterday that updated list of 42 top terrorists was prepared two months ago. Many of the law enforcement agencies contributed to the top terrorists' list Home Minister disclosed "only one law enforcement agencies' report" before the parliament

Towhiduzzaman Khan and Liakat were in the list of 42 top terrorists, but they were killed nine years and one year ago respectively, sources added.

Lutfozzaman Babar, former state minister for the home affairs, prepared a list of 23 top terrorists to bring them to justice. Then AL claimed that the most wanted criminals were activists of the Jubo League and Chhatra League. Rapid Action Batalion (RAB) killed two of them in crossfire. all of them fled the country after Picshi Hannan was killed.

Most wanted criminals of the web pages of the police were Aminul Rosul Sagar Tokai Sagar, Trimoti Subrata Baine, Molla Masud, Prakash Kumar Biswas, Kala Jahangir, Khandakar Tanvir Islam Joy, Shamim Ahmed Aga Shamim, Haris Ahmed Haris, Jabbar Munna, Imam Hossain and Shahid Kamrul Hasan allies Hannan, Jafar Ahmed Manik, Nabi and Hossain, Rafiqul Islam Kajol. The law enforcement agencies could not arrest them.

Home Minister Sahara Khatun in the parliament yesterday disclosed an updated list of 42 top criminals. The list, however, did not say anything about the whereabouts of 27 of them.

It said three top criminals are staying in India and one each in Canada and US while ten were arrested from 2000 to 2005 from India, Nepal and Bangladesh.

In response to lawmakers' queries, Sahara also placed another list of 73 fugitive criminals against whom red alerts were issued. Nine convicted killers of Bangabandhu, nine accused in August 21 grenade atack case and some of the listed top terrors are among others in the list of 73 fugitive criminals. The rest of the fugitives are accused in killing cases.

The Home Ministry's list did not say anything about the whereabouts of listed top criminals Kala Jahangir, Kazi Ataur Rahman Litu, Sadikur Rahman alias Hiru, Islam alias Bihari Munna, Nur Mohammad, T Babu, Ashik alias Ashik Islam, Shahidullah alias Lebu Shahid, Suman, Towhiduzzaman Khan, Arif Hossain, Mia Delwar Hossain, Abul Kashed alias Hadi, Jasim alias Jasi, Dulal alias Motka Dulal, Golam Mostafa alias Pappu, Selim alias Saila, Munna alias Monu Mia, Mamun alias Mafizur Rahman, Rabi, Toku alias Toku Khan, Mamun, Kamrul Hasan alias Hannan, Shamim Ahmed alias Aga Shamim, Liakat, Zafar Ahmed alias Manik and Jabbar Munna.

The arrested ten top criminals are Titon, Sohel alias freedom Sohel, Harris Ahmed alias Hares, Khorshed Alam alias Rashu, Abbas alias killer Abbas, Kamal Pasha alias Pasha, Arman, Mashiur Rahman Kochi, Subrata Baine and Imamul Hossain alias Pichchi Helal.

According to the list, top criminals Tanvir Islam, Prokash Kumar Biswas and Molla Masud are hiding in India, Aminur Rasul Sagor alias Tokai Sagor in USA and Imam Hossain in Canada.

[ALOCHONA] 57 students held after BCL factions clash over control




In overnight raids at seven dormitories of Dhaka College and adjacent areas police yesterday arrested 71 students and recovered 52 bullets from one of them.The raids were conducted following Tuesday night's clash between two factions of Bangladesh Chhatra League Dhaka College unit over gaining control of the dormitories.

Of the arrestees Md Abdul Baset Galib was detained for interrogation, 57 were produced before a Dhaka court while 13 others released from New Market Police Station.The court sent the 57 students to jail.

Police said Chhatra League activist Galib was arrested with 52 bullets at North Hostel. He was carrying 50 bullets with him while Tk 32,100 and two more bullets were recovered from his dormitory room around 5:30am.Some central leaders of Chhatra League said Galib was involved in a number of clashes on the campus before. They said a top BCL leader backed him and promised him a vital position in the coming college unit committee.Galib took part in Tuesday night's clash for Titu group, they claimed.

Yesterday's raids were conducted in two phases. The first phase started around 12:15am and lasted until 5:00am. But police immediately launched another raid sensing Chhatra League activists preparing for a fresh clash, said Officer-in-Charge AM Kamrul Islam of New Market Police Station.He said police recovered machetes, iron rods and a huge number of sticks from the dormitories.

At least 10 students were injured in Tuesday's clash between the cohorts of recently dissolved college unit education and library affairs secretary Titu and assistant secretary Shihab Uddin. Around 20 gunshots were exchanged and 15 handmade bombs blasted during the clash.

Chhatra League sources said a number of BCL activists, who are not from the college, took part in the clash.In the morning, several hundred Chhatra League activists gathered at New Market Police Station and demanded release of the arrested students.While leaving the police station in a prison van Nayeb Jamil Hossain, a first-year student of zoology department, said police picked him up while he was having dinner at South Hostel.

Another arrestee Manzurul Islam said a number of students, who have no affiliation with politics or not involved in the clash, were picked up along with Chhatra League activists. However, Additional Deputy Commissioner (ADC) Syed Nurul Islam said they picked up the students who were directly involved or trying to take part in the clashes.Three platoons of police and patrol police of New Market Police Station took part in yesterday's raids.

Manufacturing 'Muslim' Extremists

The Muslim 'extremists' are identified by their reaction, to the belligerent actions of the British government towards the Muslim countries. In contrast, the silent majority are labelled as the moderates, as if they represent a single viewpoint on the same issue. So, who really speaks for the moderate Muslims in the UK? Sometime back, it was the Muslim Council of Britain (MCB). However, the MCB is gradually being marginalised and tainted as an extremist voice. One can speculate on the reason as being the failure of the British government to utilise the organisation effectively, in particular the failure to legitimise its foreign policies in the eyes of the Muslims.


Furthermore, the MCB did not compromise on certain basic aspects of Islam. Indeed, it would have been futile for the organisation to deny the obligation to have a Caliphate, the existence of the penal codes, the obligation to observe the Hijab; these are too well narrated in the Islamic textual sources. Similarly, the MCB also stood by the universal principle of the right to resist foreign occupation, which is also an integral part of Islam. They were not willing to issue one-sided condemnation for acts of resistance (or terrorism) from Muslims, whilst remaining silent on the atrocities committed on the people of Palestine and Iraq that predates 9/11 and 7/7!  
 
Thus, the MCB is gradually being replaced by an amalgamation of certain Sufi groups as representative of the silent majority. But, the problem is, many of these Sufi groups tend to be spiritual, lack experience and the resolve to get involved in political affairs. When they do, it usually backfires.  For example, recently a one-sided edict issued by Dr. Tahir Al-Qadri condemning all acts of resistance as terrorism, which made no reference to the Muslims facing Anglo-American terrorism on a mass scale, adding to the ongoing ethnic cleansing of the Palestinians by the Israelis. Such erroneous verdicts are not going to have any resonance amongst the Muslim population and it will be discarded.
 
In addition, the British government is eagerly promoting groups like the Quilliam Foundation on the back of these Sufi groups, as it manufactures a new voice of the moderate Muslims. This organisation comprises of a few individuals who flout their credential of being ex-extremists or ex-Islamists. Allegedly, they saw the light on the road to Damascus, or should I say on the road to Downing Street; it was worthwhile, they have been rewarded with cheque for 1 million pound perhaps that was the source of their vision, and thus they were born-again ex-extremists.
 
The British government is not on some benevolent mission to promote the opinion that best represents the silent majority of Muslims in the UK. After all, this can be easily established by simply asking them. Their mission is to manufacture an opinion that would suit its agenda, and enforce that on the silent majority, they would be bullied into submission by the propaganda process of the efficient ubiquitous mass media.  Perhaps, the moderates would finally concur with Tony Blair, and admit their sins for having a false sense of grievance. Thus, the illegal war, and the killings of the Muslims in numerous places is a mirage, the only thing real is 9/11, 7/7 and of course, Iraq's WMDs! In this information age, it is difficult to conceal the reality. In any case, historically, the Muslims always had an understanding of the real world. Whether they are radical or moderate, they knew the world was spherical, long before Christendom was struggling with Galileo or Copernicus! 
 
Despite catapulting few individual from the Quilliam gang onto the mainstream media, they have virtually no following amongst the Muslims. More than a year has passed, and just as I predicted, the number of 'Muslims' (maybe I should say individuals with Muslim heritage), in their organisation has shrunk, still well below double digits. To inflate their appearance as a representative group they are deploying desperate measures; for example, they would announce their allegiance to any group that issues one-side condemnation of 'terrorism' whilst remaining silent on the Anglo-US terrorism in distant lands.
 
The media often characterises extremist organisations based on their viewpoint and numbers, the Quilliam Foundation certainly qualifies based on their numbers. In terms of their views, it is also an extremist organisation as it is at odds with the views of the vast majority of Muslims in the UK and the established rules found in the clear textual evidences.  Such organisations have more in common with American-Israeli neo-conservatism then they have with Muslims.
 
Accordingly, the Quilliam Foundation support Anglo-US terrorism in distant lands, and modern day oil-piracy. They promote the fundamentalist policy of waging war for democracy and profit; and legitimise violence against the defenceless Muslims in Gaza, Palestine, Iraq and Afghanistan. No surprise, that their works are promoted by those who are openly hostile towards Islam and Muslims. 
 
Consider the following point to contrast the position of the real extremist organisations that ally with militant warmongering regimes, with the moderate Muslims comprising of the vocal and silent majority.  

  • The majority of Muslims want a world that is free from all types of terrorism emanating from individuals, groups and 'states', whereas the extremists are only calling for the cessation of the actions of non-state actors, whilst justify state-terrorism carried out through illegal invasion and disproportionate slaughtering of civilians.
  • A nuclear free world is favoured by the Muslims, whereas the extremists favour a nuclear free Iran, and only give themselves the right to possess nuclear, chemical and biological weapons. It is fact that chemical weapons were deployed in Fallujah, as a result today we see an alarming rise in the deformities of children.
  • Far from being oppressive to women, Sharia Laws provide dignity, stability and honour to women; otherwise, the Muslim women would have made apostasy en masse in the west and in the east. The number of women entering the fold of Islam is larger than men. This is something the deceptive media of the extremists continues to conceal.
  • The Muslims are in favour of fair enforcement of UN resolution to all nations chronologically. They are also in favour of the General Assembly to pass and enforce UN resolution, which would be consistent with democracy and fair.


The moderate Muslims and most non-Muslims are in favour of greater equality of the distribution of wealth, protection for the weaker members of society, whereas the extremist favour raw capitalism, which exploits the weak and the vulnerable in society.
 
The extremist media has concealed the real extremists. For example, Israel can slaughter the civilian population in Gaza, and yet the children fighting back with rocks and stones are tainted as militants and terrorists.  The militant neo-conservatism means, one can explode bombs for democracy but not for Sharia laws. Indeed, we live in a paradoxical world; the illiterate atheists proclaim complex scientific theories as the answer to everything, and concurrently accuse the believers of being blind followers.

On March 14, 2010, the Indian Border Security Force (BSF) opened fire at the Jointapur frontier in Sylhet District which left 15 Bangladeshi citizens injured. The people at the border area had bound to leave their villages due to the sudden attack by the BSF. A tense situation exists all around the border area. Odhikar expresses its deep concern over this aggressive attitude, illegal trespass and continuous firing on Bangladeshi citizens by the BSF since March 13, 2010.

BSF has been conducting inhuman activities, violating the joint agreement between the Prime Ministers of the two countries relating to the cessation of violence at the border and also the commitment made at the Director General level conference of BSF and BDR, held on March 7-11, 2010. These inhuman activities of BSF prove that the commitment made by the Indian counterpart was false and frivolous.

The Director General of BSF Raman Srivastab said in a joint statement on March 11, 2010, that they have no right to kill 'innocent' people at the border. However, the definition of 'innocent Bangladeshi' was not clarified and the BSF extra-judicially kill Bangladeshi people if they are not 'innocent'. After this statement, about 50 BSF members entered into Bangladesh territory at the Protappur border under Goainghat Upazila, made 14 bunkers and took position with heavy artillery. Despite a serious protest by the BDR, the BSF continued digging bunkers which is, indeed, a grave violation of international law and aggressive trend to grab territory from a small state.

Killing and torture by the BSF continues at the border areas. According to Odhikar documentation, a total of 843 Bangladeshi people have been killed by BSF between 01 January 2000 and 28 February 2010, of which 15 people were killed in last two months. The process of surrounding Bangladesh with fences has been added to the acts of killing, torture and abduction of Bangladeshis.

There is no scope to see this incident of aggression as an isolated matter. After this incident took place, Major General Moinul Hossain, Director General of the BDR said, "We have to keep patience." Odhikar condemns this statement made by the BDR DG. There are BSF bunkers on Bangladeshi territory now. Without taking immediate steps to protect Bangladeshi sovereignty and people, it is not acceptable to give license to kill more Bangladeshis by keeping patient. Odhikar urges the Foreign Ministry to call on the Indian High Commissioner to lodge a stern protest against these incidents and to take effective measure to stop repetition of such incidents once and for all.

This is a grave violation of human rights as well as of international law. There have been violations to an independent and sovereign state and firing at its citizens without any provocation by another state. Odhikar urges the Bangladesh Government to take effective steps to stop illegal intrusion and killing by the BSF and also to ensure the security of its citizens, who live at the border areas. Odhikar demands a proper investigation of the incidents, punishment of those guilty under international law and compensation for the victims.

Odhikar also calls upon the UN bodies to take a position and condemn such violations of international law and human rights.

It looks like Taslima Nasreen is a good pass time for the Indian Muslims. They are never tired of tormenting her with their weird way of proving their adherence to their faith. Historically most of the Indian Muslims never became dedicated to their home land. To them their faith is closer to their hearts than their ancestral belongingness to India. Although their forefathers were born in India the converted Muslims showed a deliberate negligence to their own country. This negative tendency never allowed them to integrate into the mainstream society which pushed them to take shelter in their faith. When Maulana Azad opposed the Two Nations theory he was castigated for his views but when Pakistan was created and millions of the Muslims could not migrate to Pakistan, their holy land, overnight the Indian Muslims felt themselves as second class citizens. They started struggling to rediscover their century's old connection to India but it was too late. They flocked to Maulana for guidance and ways to become Indians. The ignominious poverty of the Indian Muslims and their illiteracy and other social ills are the direct result of their love affair with their faith than their motherland. They are still suffering from this general blunder and paying heavily.

Communal violence erupted in Shimoga and Hassan, in the Malnad region of Karnataka on Monday, resulting in the death of two persons in police firing.

Riotous incidents across the two cities were sparked off by protests by the minority community against a controversial article, by Bangladeshi writer Taslima Nasreen, published in a Kannada daily in its Sunday edition. Scores of people were injured in incidents of stabbing and large scale stone-throwing.

The article, about the purported views of Nasreen on the purdah system, led to protest marches in the two cities by Muslims, prompting retaliatory demonstrations by a section of Hindus.

The counter-protests, parades and demonstrations worsened the situation and the violence went into a spiral as mobs from various parts of the towns took to the streets, burning police vehicles, smashing cars, stoning buildings and causing damage to  public property.

Curfew was imposed on Shimoga and prohibitory orders under Section 144 of the CrPC was clamped on Hassan.

The Rajiv Gandhi University of Health Sciences postponed the scheduled examinations in the Faculty of Pharmacy, Nursing and Allied Health Science throughout the State in view of the situation in the two districts. New dates would be notified later.

Sadiq (23) and Latif (25) died of bullet injuries in Shimoga when the police tried to quell the group violence. East range IGP Satyanarayan Rao issued shoot-at-sight orders and curfew was imposed on the town till the evening of March 3.

Vehicles parked along B H Road and Nehru Road were targeted by miscreants. A KSRTC bus, two four-wheelers and 20 two-wheelers were badly damaged in the incident. A mob ransacked and set fire to shops at Amir Ahmed Circle and Shivappa Nayaka Circle areas of the city.
Two multi-storied buildings were badly damaged as shops located in them were set ablaze.

Thousands of people gathered at Wakf Board premises on Sir M V Road in the morning to protest against the article. A procession taken out turned violent near B H Road as a KSRTC bus was stoned. Police resorted to mild lathi-charge to quell the mob.

At Shivappa Nayaka Circle, the mob vented its wrath on shops. Stones were thrown at the procession and a group clash ensued. Two-wheelers parked along Nehru Road and B H Road were set ablaze. Police lobbed teargas shells and then opened fire at the the mob, resulting in the death of two persons.

Violence again re-erupted in the evening and shops were looted along Kote Road, Gandhi Bazaar, Nehru Road and surrounding areas. Incidents of looting, torching and stabbing were reported from extensions in city outskirts. The office of a newspaper group which had published the article was attacked.

The district administration declared education institutions closed on Tuesday. Buses bound for the city plied on alternative routes as burning tyres blocked roads at several places.

Similarly in Hassan, as many as 14 persons including five policemen and a woman were injured when miscreants resorted to stone throwing on Monday, in protests against the article. The mob set fire to 43 petty shops, three autorickshaws and 17 two-wheelers. Two places of worships were also targeted.

Police have imposed prohibitory orders under Section 144 of CrpC on the entire city for next three days. Seven persons have been arrested.

The violence began when hundreds of people took out a procession to protest against the article. The processionists threw stones at shops and set fire to two-wheelers and other vehicles parked on roads. The police resorted to lathi-charge to disperse the mob.
People belonging to other community also resorted to strike protesting against the violence. Violence spread to other areas and the police had a tough time bring the situation under control.

When the mob torched parked vehicles, police lobbed teargas shells and resorted to a lathi-charge. Several people including policemen were injured in stone-throwing.

Cases booked against dailies
Chief Minister B S Yeddyurappa on Monday said the Bangalore police have booked cases against two dailies –– one Kannada and another Urdu –– for publishing articles which led to violent protests in Shimoga and Hassan, reports DHNS from Bangalore. The chief minister said the dailies had already expressed regret for publishing the articles.

I thought you would rebutt Munshi's theory on Pilkhana Massacre. Possibly he is an ISI agent, but come up with clues and facts to nullify his theory. He has put together a story line based on infomation floated in our print and popular media, if u like form one of yours. We would love to read! If some one like to investigate the mystery, the skeloton created by munshi, is one I see available. but since 'shadow' forces were involved the mystery will linger for ever, I believe neither BAL or BNP will have ever enough standing and guts to resolve the case. Now about your warning, to become an anti_Indian one just have to look into the dosier of Indo_bangaldesh relation, one does not need  Munshi's posting.
 
Bangladesh is very unlikely region for Jehadists activities, then one wander what caused these so many parties to crop up.Who is playing behind the scene, ISI, RAW, MOSSAD or CIA? It is for sure just one is not playing? But question is who is doing what to whom!  But MOSSAD and CIAs are expert in it and ISI and RAW are probably experimenting and learning!
About 'Jehad'  as far as I know the so called "Jehadists' in reality fighting agresssion, fighting for their freedom not so much for Islam. We all know freedom fighters are often termed as Terrorist, now a nown 'ISLAM' was added to it for propaganda purposes? I am sure you know where that started!
 
About pakistani ISI activity, it far more easier for RAW to play fast and easy because of our geogrpahy, ISI never can beat that!
 
Let me come back on pilkahana you will never get far you look into the matter either from BAL's of BNP's perspective!

Mr. MBI Munshi will NOT talk about demanding our legitimate share of undivided Pakistan when we know Pakistans wealth foundation was then East Pakistans income from export but he will ONLY talk about trade gap between Bangladesh and Pakistan but we want to bring both in the table.

 

Mr. MBI Munshi will NOT talk about many hundred thousand stranded Pakistani living in Bangladesh soil for last THIRTY EIGHT years and their repatriation but he will ONLY talk about few dozens or hundreds of Indians infiltrating into Bangladesh soil, we want to talk about both, departure of Pakistanis from our soil and curbing Indian infiltration into our soil.

 

Mr. MBI Munshi will talk about Indian hegemony but hides the Pakistan / ISI blue print to turn Bangladesh soil a proxy state of Pakistan against India , which they successfully implemented in Kashmir and Afghanistan using seditionist Jihadist in the name of Islam. Almost one hundred percent of any kind of terrorism that took place in Bangladesh has signature of state sponsored intelligence agency of Pakistan. Safe heaven of hundreds of terrorist cells in Pakistan has turned the country into inferno, which is going to reduce existence of Pakistan to nothing wants to destroy its enemy India launching its Islami brotherhood ammo from Bangladesh and Kashmir .

 

Mr. MBI Munshi does not understand people of Bangladesh will not allow anyone to run a Pakistani proxy war using Bangladesh soil. Pakistani conspiracy surely will go into vain but their endeavor will never cease to stab Bangladesh on the back.

 

Bangladesh must be alert to challenge these hooded effort sometime at the name of Islam or other time in the name of Indian hegemony.

The Government of India is implementing a mega project, National River Linking Project for Inter-basin water transfer. The project will have major impact on the livelihood of people, environment, socio-economic conditions of Bangladesh and will have adverse impact on the every sector. In simple word it will cause a disaster to Bangladesh. Halima Neyamat explains.  

'Water' should be looked upon as a social and environmental resource.  Freshwater have remained the life-blood for our nation, communities and individuals. The universal concept,  without freshwater, nature cannot sustain itself and life, cannot be imagined. In this sense, water as the universal solvent and sustenance of the very fabric of life has always remained an inevitable substance for the survival of the people as well as their socio-economic development. We have already faced serious socio-economic losses and environmental degradations due to the unilateral withdrawal of the waters of the Ganges. Bangladesh and India entered into a 30-year Ganges Water Sharing Treaty in 1996 to share the waters of the Ganges available at Farakka during dry season. In this 30-year long Treaty, India agreed to share the waters of some of the border rivers such as the Teesta, the Dharala, the Dudhkumar, the Manu, the Muhuri, the Khowai and the Gumti, the modalities of which will be determined after negotiation between the two countries.  It was expected that the contentious and complex conflicts between Bangladesh and India would be resolved. However, we dissatisfed over the allocation of water, particularly in the dry season: in the event of unexpectedly diminished flow, there is no provision to regulate it, as it had been set out in the previous agreement of 1977.

The Government of India claims that the main idea of the National River Linking Project is to transfer the waters from the areas of surplus traversed by the Himalayan rivers in the north to the areas of deficit in the peninsular south by linking 37 rivers. The main area from where the waters are to be diverted is the Ganga-Brahmaputra-Barak basin, which accounts for 60% of the surface water resources of the country and is also rich in groundwater. However, the rivers that comprise this mega-basin are international watercourses and naturally, international politics as well as international law are bound to be explicitly involved in this undertaking.

It has been roughly estimated that minimum 20% of the total land area of Bangladesh (figure may become far more than this) will be directly affected due to the river linking project.  The harmful effects will be on: environmental degradation, availability of both surface and ground water, quality of water, salinity in soil, agriculture, fisheries, industries, environment, flushing of pollutant, supply and sanitation, public health, navigation etc,. It will have adverse impact on every sector.

The transfer of waters from the Himalayans rivers through the implementation of the present River linking Project will seriously aggravate the situation of Bangladesh further more and will cause a massive disaster. We should clearly know and realize that the National River Linking Project is no more in 'proposed' stage; it is already in the implementation level. The Government of India has the Order from the Supreme Court in support of the project and they have to establish these links within the year 2016. So, we should not wait and watch. We should protest in every-level from national to international. Take actions and fight for our right to water. Bangladesh have to handed over its protest to India and strongly opposed it at the highest political level. We have to criticize, that the concept is politically unsound, technically infeasible and very wrong from the viewpoint of international water law and practice. We have to safe us and our future generation from this upcoming disaster.

[ALOCHONA] CHT Peace Treaty violation of constitution: TH Khan




 
Senior lawyer TH Khan on Tuesday told the High Court that the Chittagong Hill Tracts Peace Treaty, signed by the Awami League government in 1997 to resolve the long-standing dispute, was a clear violation of the Constitution as former chief whip of the Parliament, Abul Hasnat Abdullah, had no authority to sign the treaty.
   Article 145 (1) of the Constitution stipulates: 'All contracts and deeds made in exercise of the executive authority of the Republic shall be expressed to be made by the President, and shall be executed on behalf of the President by such person and in such manner as he may direct or authorise.'
   
Referring to the constitutional provision, TH Khan told the High Court bench of Justice Syed Refaat Ahmed and Justice Moyeenul Islam Chowdhury that the treaty was a 'one-man show' as Hasnat had signed the treaty at his own will, not on the President's direction.
   
TH Khan was making the argument as amicus curiae (friend of the court) in the two writ petitions filed by a Supreme Court lawyer and a resident of the CHT, challenging the legality of the Chittagong Hill Tracts Peace Treaty signed by the then Awami League government on 2 December, 1997.
  
 He also questioned the legality of the word 'treaty'. He pointed out that a treaty can only be signed by two governments, 'but the CHT people were not a government'.
   Quoting the High Court's verdict, which declared illegal the Fifth Amendment to the Constitution made through martial law regulations, Khan argued, 'The CHT Peace Treaty was illegal as it was not ratified by the Parliament.'
  
 'The gazette notification on the treaty was not issued,' he added.
   In reply to a query by the court, Khan said, 'The previous governments did not implement the treaty as it was contradictory to the Constitution.'
   Replying to a question by the court on why the previous government had not scrapped the treaty as it violated the Constitution, Khan said, 'No government could deal with the matter as the CHT people were controlled by an Indian intelligence agency.'
  
 Quoting from Banglapedia, Bangladesh's first encyclopaedia, and the Pakistani Gazette (CHT division), Khan argued, 'Hilly people are not indigenous people because they have settled in our country after being evicted from Arakan in Myanmar and Assam in India, so their claim of being natives is not legal.'
   
'As Article 28 [discrimination on grounds of religion] and 29 [equality of opportunity in public service] of the Constitution are not applicable for the hilly people, the CHT Peace Treaty is ultra vires of the Constitution,' he further argued.
   After the hearing, the court asked the petitioners' counsels, Moudud Ahmed and Abdur Razzaq, to reply to the government's and amicus curiae's arguments on March 23 when the hearing resumes.

Bilateral relations between Bangladesh and China

In view of China's growing importance globally, Bangladesh should attach importance to its relations with China. Bangladesh should consider seeking technical assistance from China to make Bangladesh technologically advanced. It remains to be seen how adroitly our prime minister handles these issues on her visit to China, writes Mohammad Amjad Hossain

The upcoming visit of the prime minister, Sheikh Hasina, to China is expected to provide her with an opportunity to have dialogue with the new generation of Chinese leaders and exchange views on bilateral, regional and international issues of mutual interest, but any dramatic development could hardly be expected from this visit. China would study the trend in Bangladesh in view of the recent visit of the Bangladeshi prime minister to India.

Relations between Bangladesh and China had developed following the change in the administration in 1975. Until then China did not recognise Bangladesh. Since the establishment of diplomatic relations, ties between the two countries have developed, both in depth and dimension over the last two and a half decades. Chinese assistance in the form of soft loan for establishing development projects like Sundarban Textile Mills in Khulna, Polash Urea fertiliser factory in Ghorasal, Rupganj water conservancy project, China-Bangladesh Friendship conference centre and a bridge over Buriganga is emblematic of Bangladesh-China friendship. China had extended financial and technical assistance for the establishment of a rice bran oil extraction plant at Fatullah in Dhaka. China has also been involved in constructing roads and flyovers in Dhaka. Economic assistance from China has reached an estimated total of about $715 million.

Over a period of time China has turned out to be a major supplier of arms, equipment and training to armed forces of Bangladesh, apart from the United States. Politically, relations between the two countries deepened when the Bangladesh Nationalist Party was in power. The Chinese premier Wen Jiabao visited Bangladesh two times during the five years of Khaleda Zia's administration. In 2005, both countries declared 2005 as the Bangladesh-China friendship year. These amply reflect the steady development of bilateral relations between the two countries in a wide range of fields.

A long-term trade agreement was signed between China and Bangladesh. China now turns out to be a major trading partner of Bangladesh. Bangladesh has imported from China 18 per cent of its goods in 2007-2008, which places Bangladesh in a trade deficit with China amounting to $3.8 billion. It is expected that the prime minister will raise the subject of trade relations with China and find out modalities to narrow down the huge trade deficit with China. During his visit to Bangladesh in 2005, the Chinese premier committed to ensure duty free access of Bangladeshi products to Chinese markets.

It is understood from news reports that the prime minister is carrying a big shopping list. While in China, she is likely to seek Chinese financial assistance for construction of a rail road connecting Chittagong with Teknaf to develop Cox's Bazar into an important business hub; another friendship bridge; power plants; Chittagong-Myanmar-Kunming highway and a deep sea port on Sonadia Island. There is no indication why Bangladesh is showing interest in constructing a highway linking Bangladesh with Kunming province of China over the territory of Myanmar. It is not clear whether Bangladesh government has had an agreement with Myanmar on this proposed project, although this proposal was considered by the Chinese premier when he paid a visit to Bangladesh in 2005. Kunming is located in Central Yunan and the Northern part of Dianchi Basin which is known historically as an important gateway to Silk Road that connected Tibet, Sichuan, Pakistan, Myanmar and India.

While in China the prime minister may discreetly find out the intention of China about diverting waters from the River Brahmaputra. Reportedly, India has expressed concern to China. Diversion of waters from Brahmaputra would adversely affect the lower riparian Bangladesh.

Bangladesh may consider placement of a request to China to offer academic scholarships to learn Chinese by Bangladeshi diplomats and teachers to strengthen social interaction.Although Bangladesh considers developing relations with China from political and economic point of views, but its big neighbour India sees it from a different perspective. Growing military relations between Bangladesh and China concern India. India's concerns emanate mainly from the Siliguri corridor link which connects mainland India with its landlocked north-eastern part of the country, a part of which belongs to Arunachal Pradesh of India. China has been demanding Twang district of Arunachal Pradesh, which has become a source of conflicts between China and India. Twang remains a disputed area since the British colonial rule of India. Historically, Twang area has had close relations with the people of Tibet and its culture. This area borders XiZang autonomous province (Tibet) of China.

Today China has become a giant country economically with a growth rate of nearly 11 per cent. China holds $894.8 billion US treasury securities as of December 2009. The US is now paying 60 million a day as interest to China. Technologically, too, China has been progressed tremendously. China's has also had success in space technology, sending an astronaut into the orbit at a cheaper cost than that of the United States.

Therefore, Bangladesh may consider seeking technical assistance from China to make Bangladesh technologically advanced, which is one of the important agenda of the Awami League-led alliance government. In view of China's growing importance globally, Bangladesh should attach significant importance to its relations with China. Bangladesh government should avoid causing any irritant in bilateral relations with China. It remains to be seen how successful our prime minister's visit would become in this regard.

There's no reason to be fair to Joy. He should know better about a lot of things - but he doesn't.

- He should know better than to act as the defacto representative of Bangladesh in the US.

- He should know better than to take an appointment as an official Advisor to the government

- He should know better than to try to negotiate a truce between warring factions of Chatra League without seeking the punishment of murderers and extortionists

- He should know better than to attend intra government level meetings

- He should know better than to encourage sycophancy, dynastic politics and the cult of personality

- He should know better than to remain silent on undemocratic practices within his own party

- He should know better than to take advantage of people who revere him simply because he belongs to a certain family.

Blah, blah, blah....

Joy, without doubt, welcomes the sycophancy involved in being described as 'eminent computer scientist'. Its is probable that he drafted or approved the term himself. And why not?

WHAT OTHER BASIS IS THERE FOR HIM TO GIVE THAT SPEECH IN THE FIRST PLACE?

Other than carefully introducing to him the electorate with a view of giving him the crown?

Joy's real power to help Bangladesh is palpable - for it is a power that has been conferred on him irrespective of what he wants and only because of who he is. But his real power to help Bangladesh is to fight for real change in the way we do things.

Unfortunately, he's not doing that. He's benefitting from and directly supporting the same crappy politics that have blighted us from birth.

You see - he needs the existing political infrastructure, with all its evils and failures, as much as his mother does.

There is no reason to be fair to anyone who exploits, perpetuates and benefits from the status quo of Bangladeshi politics.

Joy suffers from a common disease. He probably is a Democrat and would not tolerate extortion by the younger members of the Democratic Party. But extortion by his own AL in Bangladesh - well, thats "understandable"!

So much for a Masters degree in Public Administration!
