[mukto-mona] RE: [khabor.com] New Marriage law for Muslim women in India/ Bangladesh-Pakistan wake up!

The All India Muslim Women Personal Law Board did not drop from sky in a day - it is the result of constant and miserable failures of the All India Muslim Personal Law Board to protect the right and dignity of Muslim women. What is clear from Shah Banu to Shahrana cases is that Sharia laws in India as well as in many Muslim-majority countries are evolving, although very slowly, towards a positive direction.

It is noteworthy that some people such as Sir Hannan are struggling hard to bridge the gap between
historic Sharia laws and contemporary women rights. We have no problem if that can be done, I wish them good luck but find it impossible for many complex reasons. Pathetically, as Sir Hannan said, - "they are trying constantly to look into problematic issues pertaining to Shariah law application" (the problem is not in application, it is the laws themselves - Hasan), the laws are being applied formally and informally. This is against logic, we paid heavily for this suicidal act of our leaders. This must be stopped until the laws are publicly discussed and decided. Problem is - the Sharia-supporters deny our proposals of discussion in int'l and national arena.

For centuries men played god  in women's lives only to destroy them and bring bad name to Islam. But it is the very Muslim women who reserves the right of deciding their legal position in Islam. They are no less Muslims than the leaders of the India Muslim Personal Law Board

Dear members,

Assalamu Alaikum. With reference to correspondence below,I find Mr Jawed is right.I do not know Golam F.Akhter sb..I could not make any sense of his letter.Human rights record in most countries are bad .We have to improve it in all countries including my country Bangladesh.
However, why proposed change in  Indian Muslim Marriage Rules has been brought in here.We know that Indian Muslims have stoutly upheld Shariah in personal matters, they have rejected so-called Uniform Civil Code there, their organisations are struggling to find legal and social ways of  stopping abuse of some provisions of law of divorce, Indian government also does not do anything in this matter without consulting Muslim leadership and Ulama, Muslim Personal Law Board thereis  trying constantly to look into problematic issues pertaining to Shariah law application. These are all very good steps.

We have a lot to learn from Indian experiments and actions regarding personal law issues.

Nobody should make any adverse comment in this intricate issue without detailed knowledge, for instance we must know the whole proposed Indian legislation in this respect etc.

You represent a defeatist mentality sir. There is no power on earth which can make a nation of 160 Million people a slave. Bangla Desh has faced difficulties but is coming up.

As far as human rights are concerned , why do not you look at what America is doing to Iraqis and Afghanis. Carpet Bombings and  torture of prisoners are the orders of the day. You should be ashamed of talking about human rights.

Yes woman beating is common in our countries, but what about America. US men not only beat their women but also assault their own young children. How many women are enticed, promised a marriage and then left alone. What kind of morality is this On the other hand we respect our mothers and sisters and share a real partnership with our wives. .  I suggest you pay attention to small time job you have been bestowed with and leave our matters on us.

Dear All,

We are friends & Bangladeshi,  and almost like close relatives, we may and should be very free, frank, and true to ourselves to the most of our ability. I am seeing a day is very soon coming we shall be beaten by our own wives, sisters, daughters , & mothers, and outsiders like Indiians (combined Hindu, Muslim, Sikhs etc.) along with westerners. To know why- please read the following news 'Muslim-News. The Sharia laws and Quranic Laws which we, the men have used/still using to suppress our wives, including  " A muslim woman can seek divorce if she is forced by her husband to indulge in unnatural sex ..", these laws proposed to be passed in Indian Parliament. We have long history of being beaten- in the historical time in our memory- In the subcontinent- First we were Hidu- converted to Budhist , we can see Budha Bihar in Bogra and Comilla, then beaten and converted to Hindu again some  fled towards Japan, then Arab Conqurerors- Mohammad-bin--Quasem and Mughul rulers protected us to be converted to Islam with constant rioting with Hindus till the British partitioned and gave us Pakistan,  after lot of Hindus and Muslims were killed. Then our Muslim brothers of Pakistan killed 3 million during  liberation of  Bangladesh. Presently a civil war is hanging on us - like in Iraq, Afghanistan, Pakistan- those countries have very powerful friends so killing will be limited, but we do not have powerful friends so this time our deaths and killings will be unlimited, experts say- only India can give us shelter provided at least 10% Bangladeshi behave to be  friendly with India or worst comes worst India will have to occupy Bangladesh not for liberation this time but for occupation or colonization or back to greater mother India. In Farsi there is a saying- translated into Urdu is: "Akal-mand ki lia Isharaya Kafi Hai, Magar Ba-Akkal ki lia Achasa Danda Marna Parta Hai" English- ' A reasonable hints is sufficient to wake up intellegent people but a good beating is essential to wake up dumb people". Our Human Rights record is worsening day by day: Bangladesh- Country Report on Human Rights Practices - 2007- US State Department released after approval of the US Congress,  the summary is:  "The government's human rights record worsened, in part due to the state of emergency and postponement of elections." who is responsible for this    - clearly and evidently our two major political parties, BNP and AL. If the President would not have declared Emergency, there would have been "Blood Bath"- shame on all of us; after 1971 to 2007-  37 years, still no democracy in Bangladesh. You can read the full text by going to  www.state.gov   then go to          Country Reports on Human Rights Practices for 2007. in the annual reports  press release. We shall soon meet to discuss all the related annual reports.
So our future is blink, doom, and gloom. If we want to make it brighter and hopeful, let us follow the age-old saying- charity begins at home. Let us seek forgiveness to our sisters and wives and give them equal rights, be tolerant to Taslima Nasrin( she or any body like Danish cartoon have the freedom of press/opinion/criticism in modern civilization- we are bound to allow it, we like it or not), otherwise a good beating is hanging on us, please read the news below:
Regards.
Yours sincerely,

Subject: <<History Islam>> New Marriage law for Muslim women in India

New Marriage law for Muslim women in India New Marriage law for Muslim women in India 17 March, 2008 New Delhi: The All India Muslim Women Personal Law Board has released the "Shariat Nikahnama" that they claim would give equal rights to both Muslim men and women. If the board has its way, a Muslim woman would be entitled to seek divorce if her husband was found having illicit relationship with another woman. The board has also rejected any divorce done through SMS, e-mail, phone as video conferencing, besides rejecting divorce done on provocation. A Muslim woman can seek divorce if she is forced by her husband to indulge in unnatural sex. She can also seek divorce if her husband contracts AIDS. "We have framed the new nikahnama strictly in accordance with the tenets of Islam, which clearly prohibit any kind of harassment or oppression of a married woman by her husband," said AIMWPLB president Shaista Amber. Shaista Amber added that at the shariat also entitles a woman to take separation even when the husband refuses to grant a divorce. "Besides extra-marital relationship, these include absence of physical relationship between the husband and wife for more than a year, abandonment of the wife for more than four years, failure of the husband to look after the wife and family or any kind of ill-treatment or torture," said the model nikahnama. The new nikahnama has 17-point guidelines for marriage under the Shariat for bride and groom, while eight points on the divorce process.
