[mukto-mona] RE: [khabor.com] SIR HANNAN & SHARIA DYNAMICS.


Salam. My letter was not personal but starting a series on evaluating your work– it is an important element of our socio-religious evolution for future generations. As a leader you must be ready to be praised, discussed, criticized and asked Qs – please clarify.

 

Big thanks for helping saving a home under attack of instant divorce. Here is on few important points of your post:-

 

1.       Only passing opinions is not enough in these dark days - your stand against (declaring also?) killing apostates will really be meaningful and effective if you openly scold mullas who do it. In your Taslima-article you said you are against taking law in hand. Then please sclod the village Fatqabaaj mullas also. God put you in a position to stop these anti-Islamic acts in Islam's name – if you don't then it will increase. BTW, I added your first stand in my book ISLAM O SHARIA published last year.

2.       Thanks for your opposition to instant-divorce – I included it in the upcoming 2nd edition of my book. (Your BidhiBoddho Islami Ain Vol 1 Dhara 351 support  Instant Divorce – but let's ignore it as of now).

3.       You said: - "there was Ijma on many aspects of Salat and ritual issues but almost none or few in the issues of Muamilat".  Exactly! This is what we claim too, there had been never an univocal agreement on worldly issues among common Muslims and Jurists - thanks!   (please see "TAQDIMA" - The Development of Early Sunnite Hadith Criticism by Ibn Abi Hatim Al Razi (854 AD – 938 AD). Books like this prove the Hadis-conspiracy of patriarchy and political power. So we have to be extremelycareful about Hadises.  

4.       You said – "I can say those who know me will testify that I have done more for creating public opinion for women rights than anybody else in Bangladesh. This has been possible because of sticking to the fundamentals of Sharia, this would not have been possible by criticizing Shariah in general".  Agreed the first claim, thanks again. But "Criticizing Shariah in general" - who does it? Please refer to my book's chapter –"Is Sharia obsolete today?"  I clearly said – NO, Sharia can nver be obsolete and explained why. But we must oppose some particular Sharia laws and their anti-Islamic spirit - that is what I do. Internet-posts don't allow me detailed explanation.

As you know a Muslim-home in England was almost destroyed due to the Sharia law of Instant Divorce. I don't know them, - they somehow got my address and contacted me. I contacted several people in BD and elsewhere by email and phone and forwarded them all related documents and support. I don't know if they had support from other sources but they informed me yesterday that their marriage was saved. Big thanks to all and specially to Sir Hannan who helped saving a marriage that was almost destroyed by Sharia Law - other homes are not as lucky.
 
Here I take the opportunity to discuss something very important. First, although I have terrible differences with Sir Hannan about Sharia law of family-matters and non-Muslims (my research shows those are evils in disguise of Islam but he respects them as Allah's Law) and he abused me several times I had no problem in joining hands with him to save a home.
[Dear brother , It is I who joined you on your request when I felt that your request is indeed important.I never abused you, if idid use harsh words in some letters in response to some issues,I am sorry .Indeed I believe the laws based on clear stipulations of Quran and Sahih Sunnah as Islamic law, the details you know from my various writings ]
 Second, he represents the slow but positive evolution of Muslim-intelligentsia about Sharia laws. He used to believe in killing apostates and now he doesn't.
[ I never publicly commented that apostates shuld be killed.In this respect I agree generally with the views of Hasan Turabi, Muzammil Siddiqi, Jamal Badawi, Hashim Kamali etc ] 
He voiced against the Sharia law of wife-beating. He changed his views about instant divorce as well
 
[ i did not change my view in this regard.I never said in my personal writing,  that instant talaq will be effective.My personal view was always that three talaqs at a time amounts to one talaq though I did not write on this before].
 
Hopefully one day he will realize that the spirit of Sharia laws and some of its contents are anti-Islamic products of power-game and cruel patriarchy. Fourth, instead of responding to the reality of women's suffering due to Sharia laws he still submits to the judgment of past jurists of different social conditions who had no idea of ou problems.
 [ I do not submit to the opinion of past jurists unless I find their opinion in conformity with the Quran and Sunnah ] 
Fifth, on one hand he says we must follow if there is univocal (?) decision of past jurists on any issue and we can choose if there are differences, on the other hand he overcomes some of the past univocal (?) decisions, as killing apostates.
 
[ There was no agreement on punisment of apostates in the past, you can read the book La Ikraha Fiddeen by Shaikh Taha Jabir Al-Alwani, he starts his first chapter with the heading No Ijma On Ridda
 
Also, he disregards the fact that there was/is never any univocal decision on important matters among past and present Muslim jurists. 
 [ I think there was Ijma on many aspects of Salat and ritual issues but almost none or few  in the issues of Muamilat]
Sixth, he over-emphasizes symbolism (such as women's veil) but does not propose real tool of establishing Islamic morals in people. Seventh and most important, in Internet he correctly vioces against women-oppression by some Sharia laws but stops there. He never gives an open call to our nation against these laws (such as instant divorce) - he never takes up an action plan with his team to save suffering helpless women. In last weeks and months several Muslim women were destroyed by these laws - he could have saved them - but he didn't. But if we are accounable for our actions, we are accountable for our inaction against evils as well. His, not ours, active voice today can save destruction of more women tomorrow and day after.

Note that he has been a strong inspiration to our cruel Shariabaaj mullas. But his updated views about some Sharia Laws is bound to bring him rejection, harassment, beating and even death by the same mullas. Muslim-history is full of this constant fact. Probably this is why he does not take an open work-plan against the sharia laws he now doesn't believe in. I have seen the same thing in India as well.  
[ Islamists, by and large, carefully listen my views, take pro-women position, of course not all of them, it is a very big country, I do not expect everybody would listen to me ]
 
Muslim-world is moving towards a positive direction about Sharia laws, albeit slowly. Our leaders need to be challenged positively so that they can lead us better.[ My final submission is please, dear brother do not write such public letters ]
