The obvious answer to the question: The present un-elected, quasi-constitutioanal Caretaker (interim) Govt. does not have the authority.
What is increasingly loud and clear is its preference for all things Jamaati.
A Chief Justice who allows himself to be openly coddled by Jamaat, a political party that was founded by an indicted crimminal who was duly tried and convicted for his crimes in a court of law and given a death sentence in 1954, is not an acceptable appointment at the Supreme Court. Moreover, Jamaat is an illegal political party according to 1972 Constitution of Bangladesh.
A justice, any justice, who attends International Islamic Law Seminar (as Ruhul Amin did on 11th January, 2008, at BIAM Foundation auditorium in Dhaka) is not fit to preside over a court of a country that follows secular legal system.
By expressing his opinion that "terrorism can be curbed by Islamic legal framework" in public, Ruhul Amin has violated the principle of neutrality, a prerequisite attribution of a Justice. Farida Majid
