RE: [mukto-mona] The Appellate Division has put the last nail in human rights coffin

I appreciate Gopal Sengupta's efforts of keeping us aprised of the farcical goings on in the Bangladeshi judiciary. The present Chief Justice is indeed a joke! Remember him attending an International Seminar on Islamic Law under the chairmaship of Jamati honcho, Shah Abdul Hannnan?

Last Sunday's New Age (April 20, 2008) had an inportant Op-Ed piece by N. M. Harun in this context. It began:

In the high drama of politics is usually lost the crucial role the court plays – through action, ambivalence, inertia or inaction – in the life of a modern democratic state. Alexis de Tocqueville, the most authentic and prescient chronicler of the American democratic experience, in his classic book Democracy in America, wrote about 170 years ago: 'The President, who exercises a limited power, may err without causing great mischief in the state. Congress may decide amiss without destroying the Union, because the electoral body in which the Congress originates may cause it to retract its decision by changing its members. But if the Supreme Court is ever composed of imprudent or bad men, the Union may be plunged into anarchy or civil war.' As if to prove de Tocqueville's predilections correct in the present-day context, the court in America helped George W Bush in his robbery of the presidency in the year 2000. As a result, in this age of Pax Americana, this malfeasance of the American court produced a double disaster: domestically, America has almost turned into a police state and a bankrupt country during the eight years of the Bush administration; and globally, the world has been plunged into an un-ending imperialist war for oil in the name of fighting terror and the harmony of the human society has been jeopardised in the name of the clash of civilisations.
