[mukto-mona] STATEMENT BY CONCERNED CITIZENS OF GUJARAT RE. DELHI BLAST ACCUSED REMAND TO CUSTODY OF AHMEDABAD CRIME BRANCH IN ABSENCE OF THEIR LAWYERS

Delhi Blast Accused remanded to the custody of the Ahmedabad Crime Branch, in the absence of their lawyers

 


The 5 accused who were arrested for their alleged role in the Delhi serial blast matter of 13th September 2008, were by way of transit remand, handed over to the Ahmedabad crime branch, who are also investigating the offences registered for the serial blasts in Ahmedabad on the 26th of July 2008. 

 

The role of these accused persons has been allegedly disclosed during their custodial interrogation by the Delhi police. The Ahmedabad Crime Branch, having obtained the said transit remand, produced the accused in the metropolitan court of Ahmedabad, on the 28th  October 2008, wherein the in-charge metropolitan magistrate was pleased to accept their prayer for police remand. It may be noted that this remand was granted, in spite of the fact that none of the accused were represented by their lawyers.
 
It is important to note that as per information available, none of the accused hail from Ahmedabad, and therefore, it is a clear denial of their basic Constitutional right, to have access to the lawyers of their choice, from the time they were arrested by the Ahmedabad Crime Branch. This, therefore, in our opinion, is a severe violation of the civil and political rights of the accused, and hence deserves unequivocal condemnation from civil society.
 
It is no one's case that the real culprits of the ghastly incidents be not brought to the book but then presumption of innocence is a principle that has withstood the test of time and cannot be diluted, merely to serve a preconceived notion, and in this context, it is urged that the oversight mechanism as prescribed by the Constitution in the form of an independent judiciary, must be vigilant against all such encroachment into the rights of the accused.
 
It is only after this, that we could have effectively fought against terror. It is crucial to remember in this context, the immortal words of Gandhi that "means are as important as the ends".
