RE: [mukto-mona] Re: A case against me

I refer to Mr Jahed Ahmed's message where he most unfairly critiqued my posting on Shah Abdul Hannan's alleged assertion that: "There was no liberation war in 1971 but it was only a civil war" (paraphrased). My only point was that since I had already seen the Ekushey TV's that particular interview of Mr Hannan, where he had simply assewrted that there had been a civil war as well as a Liberation Stuggle in 1971, so the allegation that he deniedour liberation struggle does not hold any water.

I have never met Mr Hannan and am not aware of his role in 1971. If Mr Jahed Ahmed like many other Bangladeshis are so sure   that Mr Hannan is a "war criminal", it is their problem, not mine. I know this much as a former law student that even a petty theft cannot be established without sufficient proofs. You either need a few eye witnesses  to testify that they saw the particular suspect stealing or you need finger prints, DNA test or recovery of stolen goods from one's possession to prove one guilty. War Crime is such a grave crime that one's mere collaboration, association or working with War Criminals do not make one into a war criminal. Had it been that simple then millions of Germans who worked as Hitler's soldiers, civil servants and active members of his NAZI Party, would have been tried and punoshed at Nuremburg or elsewhere. Only those who killed or ordered to kill, rape or destroy properties of non-combatant civilians and a court is fully convinced beyond any reasonable doubts, they can be considered War Criminals and punished. You need eye witnesses, finger prints, written or audio-visual records to implicate someone as a war criminal. I don't know if Mr Jahed Ahmed or anybody has got that to try and punish Mr Hannan. If you have the right evidence, then good luck, go ahead and try Mr Hannan or anybody else. I have NO problem with that.
Whether I have lost anybody -- my near and dear ones in 1971-- is not a relevant point at all. Even if I have not lost anybody, I would demand and support the trial of war criminals, especially those who killed or helped the killing of civilans, Bengali, non-Bengali, Hindu, Muslim, Christian Buddhist, pr atheists.

By the way, Mr Ahmed, I lost several very close friends in 1971-- two freedom fighters and others unfortunate victims. Three of them were my class friends. I would love to see their killers tried and punished. But I don't have any evidence to prove who actually killed them.

Warm wishes to all,
Taj Hashmi

"I think, since we have so many other pressing problems in Bangladesh,
exploitation of the poor and powerless people being the Number One
Problem, we should rather concentrate on ways to liberate the people,
bringing the actual freedom for the masses, which has NOT taken place
yet."

-A very artful and often-used excuse to overlook the trials of '71 war
criminals. May I ask Mr Taj Hashmi: if the war criminals of WW II could
be put on trial even to date, why not '71 war criminals? Those who
sacrificed lives for this country and/or their children, family members
love this country no less than Mr. Taj Hashmi and others who insist on
forgetting the criminals & collaborators of '71. I wonder, did Mr
Hashmi lose any of his immediate family members in the hand of Pak army
or their local collaborators? If he did, most likely he wouldn't have
said what he has.

Regards,
J.A.
