You're absolutely right about the Mughals and their rejection/disregard of
shariah and most orthodoxy that has plagued the Muslim world since shariah
was cast in concrete by Shafii and the rest. Muslims would do well to revisit
that period of their history which shows conclusively that peaceful
coexistence is not only possible but fairly easy if one discards the yoke of shariah.
Akbar, by far the most enlightened Muslim ruler in history, knew something
today's zealots do not. In fact he was ahead of his time by a couple of
centuries compared to Europe with his concept of "universal peace" ( sulh-i kull) and
"love for all men." It wasn't until the 18th century that enlightened
rulers in Europe started to do what Akbar did, i.e. abolish established but
undesirable practices in the name of a higher morality even when they had religious
sanction. He proceeded to do away with all religious discrimination against
non-Muslims including the jizya. What he did was nothing short of rejecting
outright taqlid and sharia as the only way to God and replacing them with an
Islam that was humane and open to fellowship with all faiths. And, surprise,
surprise, he had both Muslims and Hindus eating out of his hand. And it wasn't
just that one exceptional individual, that philosophy of tolerance that
exceeded anything the Ottomans did with millet and kanun, started with Babur and
continued under Jehangir and Shah Jahan. People who claim that there was
never a period of tolerant Islam and that reforming Islam is impossible do not
know history. Unfortunately, this includes most Muslims today..
