Former army chief Mustafizur Rahman was arrested at Apollo Hospitals in Dhaka on Sunday in the MiG-29 graft case. He was detained in the hospital and was being treated.
The Badda police arrested Mostafiz in the afternoon on a warrant for his arrest, issued by Dhaka divisional special judge Golam Murtoza Majumder on May 20.
He was not taken to the police station or produced in court immediately after his arrest, the police said, adding Mustafiz was undergoing treatment in police custody in the hospital.
The judge also deferred till May 28 the hearing in the framing of charges against the detained former prime minister Sheikh Hasina, also the Awami League president, and six others, including Mustafiz, in the case.
In its order, passed in the makeshift courtroom on the Jatiya Sangsad complex, the court observed the former army chief’s absence in the court was wilful as he had been discharged from hospital and living in his house.
The court earlier had to defer the hearing on March 20, April 27 and May 4, when Mustafiz was admitted to Apollo Hospitals and his counsel sought time for the hearing on medical grounds.
On May 11 when Mustafiz was at home, his counsel filed a similar petition and the court fixed May 19 for order. On May 20, a similar time petition was filed although Mostafiz was at home.
Five others accused in the case — former air chief Jamaluddin Ahmed, former defence secretary Syed Yousuf Hossain, former air force officer Mirza Akhter Maruf, former joint secretary of the defence ministry Mohammad Hossain Serniabat and businessman Noor Ali — are remanded on bail.
Abdullah Al Zahid, deputy director of the now-defunct Bureau of Anti-Corruption, filed the case with the Tejgaon police on December 11, 2001 accusing Hasina and the six for doing corruption in the purchase of eight MiG-29 fighter planes from Russia in 1999, which caused to the state treasury a loss of Tk 720 crore.
