Extortion case-Azam mentions Hasina as accused, says IO : 7 lawyers appointed amicus curiae for disposal of writ

Only three days after the statement of Azam J Chowdhury that he did not lodge any extortion case against Sheikh Hasina, the investigation officer of concerned thana made the Ejahar public that showed Hasina mentioned as an accused along with Sheikh Selim.

The latest development has questioned the authenticity of the statement of Azam J Chowdhury.

BSS adds: The High Court on Monday appointed seven senior lawyers of the Supreme Court as amicus curiae for their legal opinion to dispose of a writ petition filed by Awami League President and former Prime Minister Sheikh Hasina.

The petition was filed challenging the inclusion of an extortion case under the Emergency Power Rules. The case was lodged against Hasina and two others by businessman Azam J Chowdhury.

A two-member bench comprising Justice Shah Abu Nayeem Mominur Rahman and Justice Shahidul Islam appointed the amicus curiae on the third day of the hearing on the matter.

Former attorney general Mahamudul Islam, former judge T H Khan, Mahabub-e-Alam, Abdur Rab Chodhury, Monsurul Haque Chowdhury, Mahbubur Rahman and Barrister Abdur Rafiq Miah were appointed as the amicus curiae.

The court set the next date for hearing the writ Petition on December 30. The amicus curiae will submit their legal opinion before the court on the government''s authority to give approval to include any case under the Emergency Power Rules, Hasina''s counsel Barrister Shafiq Ahmed told newsmen.

They will also give their opinion on whether the trial of a case could be held under the Emergency Power Rules, lodged before its proclamation and whether holding trial under the Emergency Power Rules is violation of fundamental rights of a citizen guaranteed in the Constitution, he added.

Azam J Chowdhury lodged the case with Gulshan thana on June 13 accusing Hasina and Sheikh Selim for extorting about Taka three crore from him. Later, Hasina''s younger sister, Rehana, was made a co-accused in the case.

Hasina was arrested on July 16 from her residence. The Ministry of Home issued a letter of approval on the same day to include the case under the Emergency Power Rules.
