Fatemolla or Mahmud Hasan of Canada has written a Bangla book on Sharia Law, and he is very proud of it. He thinks that he is now the champion of Muslim women's liberation from the oppression of mullahs.
What is it that Fatemolla wants? I am tired of him speaking from both sides of his mouth. What is the point of his excercise in Sharia Law? In the Medieval times the Sharia was an excellent system where the learned Ulema put their heads together and make judgements based on the human condition of a particular case and the guidance provided in the Qur'an and sunnah.
But today our legal system has abrogated the good principles of the Sharia system. That is how it should be. It is the spirit of the guidelines set in the Qur'an that matters. Literality of the Qur'anic statements can be misleading, manipulative and ultimately misogynic and inhuman.
Bangladesh is ahead of India and Pakistan in terms of drafting a comprehensive Women's Development Policy guidelines. The 1997 draft of Uniform Family Code was hailed by many as the most advanced in South Asia. Not implementing it is the failure of the government of the time. The next govt., the Khaleda/Nizami administration tried to squash the whole thing by throwing out Uniform Family Code and the Property Inheritance clauses from it in 2004. This version took out Women's equal citizen's rights and made them dependant upon the mercy of menfolks. This 2008 version is not good enough -- it is a watered down version of the 1997 'neetimala'. I would like to see the full implementation of Uniform Family Code that gives protection to women of all religions in matters of marriage, dowry, divorce, child support, inhereritance, etc.
I would urge Fatemolla to STOP talking about Sharia-- once and for all. Yes, please STOP it!
We do not want any argument with S. A. Hannan et al and their evil designs of instituting Sharia in Bangladesh in any sneaky way.
What is the use of calling out: 'pagla-re, shanko naRas-ne' when we have to cross the chasm using that very 'shanko' bridge that these maniacs are hovering over?

New Marriage law for Muslim women in India/ Bangladesh-Pakistan wake up!
The All India Muslim Women Personal Law Board did not drop from sky in a day - it is the result of constant and miserable failures of the All India Muslim Personal Law Board to protect the right and dignity of Muslim women. What is clear from Shah Banu to Shahrana cases is that Sharia laws in India as well as in many Muslim-majority countries are evolving, although very slowly, towards a positive direction.
It is noteworthy that some people such as Sir Hannan are struggling hard to bridge the gap between
historic Sharia laws and contemporary women rights. We have no problem if that can be done, I wish them good luck but find it impossible for many complex reasons. Pathetically, as Sir Hannan said, - "they are trying constantly to look into problematic issues pertaining to Shariah law application" (the problem is not in application, it is the laws themselves - Hasan), the laws are being applied formally and informally. This is against logic, we paid heavily for this suicidal act of our leaders. This must be stopped until the laws are publicly discussed and decided. Problem is - the Sharia-supporters deny our proposals of discussion in int'l and national arena.
For centuries men played god in women's lives only to destroy them and bring bad name to Islam. But it is the very Muslim women who reserves the right of deciding their legal position in Islam. They are no less Muslims than the leaders of the India Muslim Personal Law Board.
