[mukto-mona] RE: Fw: article on inheritance in islam and women by Kaniz Fatima p

I apologize if I sounded harsh - I didn't want to offend anyone. I only felt frustrated when I saw simple and immensely important points are missed. That takes
us to an unreal world and we pay heavily for that.

If we put on table all the Quranic inheritance-injunctions and their corollaries we see that it perfectly guards women from all sides. But the moment one go to
apply the set-up today, even theoretically, we see a sinking Titanic. And there is a real reason for that.

The Quranic inheritance-injunctions and their corollaries were created on the context of a particular tribal socio-economic set-up. Today we differ form it on
two counts - Tribal vs Modern family structure and length of time passed that changed everything except values. There are many elements that worked then
but fail now. That is normal. Tribes use to protect its members from all sides for its existence and strength. Today's family-structure cannot afford that.
Today the failing factors are amount of Mehr, protection of women by relatives, numerous husbands failing to support family without financial support from
wives - the breakdown of joint-family, more and more engagement of women in education and profession  - the list is long.

Supporters of Sharia law claim that contextual elements of the Quran cannot be applied today (like "Jizyia", "Slavery" or "Kill them in pairs"... etc). Strange that
whenever it comes to women-rights they stick to contextual verses.  Our rising Islamic scholars must take this point in their study to do better - because
no amount of sweet words can save a failing math.

Lastly, there is no middleman between us and God. Also, our women are no less Muslim than anyone, - no mater who he is. It is not men but Muslim
women themselves who and only who have the right to decide their right in Islam. There must be a national referendum on it. Muslim men played god on women
in the name of Islam for too long and the result is disastrous. Like in India our women must create a Women Islamic Board to save their rights from the claws of
unjust laws hiding behind sweet words.

      Salam to all.

      Hasan Mahmud.

I am sorry if this is "very exhaustive and thoughtful article on  financial position of women in Islam" then we have a long way to go.

I wonder in which unreal world the writer lives in. This is a folk-story at best, void of touch with present reality. The math shown perfectly fits a tribal society of far past, not the reality around today. What the Quran addresses and describes as prevalent socio-economic-familial condition is taken as eternal socio-familial structure. What can be more self-defeating than this? Is it how one "defends Islam" at the cost of our women?

There are many misleading info too, about Mehr and maintenance and more  - sad that the article is in pdf - so I can't copy-paste to refute them.
